Policies, Rules and Regulations
Purpose
Central Elgin Council has had a policy for Port Stanley’s Main Beach, based on an outstanding Port
Stanley by-law, indicating that temporary vendors were not permitted. In 2014 this policy came under
review and discussion. It was decided to pilot a new policy that would encourage more recreational
activity and business opportunity during the tourist season. Central Elgin Council values the Blue Flag
status of Port Stanley’s Main Beach, and will not allow any activity that would jeopardize that status.
Additionally, it was decided, that the pilot project will also include the West Harbour Walkway, and an
area at Little Beach. Central Elgin Council will select vendors on the basis of optimising the types of
activities most desirable for Port Stanley. In 2015, Council was satisfied with the results of the pilot
program based on the input received from vendors and the public and the program was made
permanent.
Vendor Policies and Procedures
Location
Port Stanley beaches are located on the shores of Lake Erie. Vendors will be assigned their specific
locations, whether in the Main Beach, Little Beach, or West Harbour Walkway area. There is ample
parking for both vendors and beach goers in each location.
Hours of Operation and Season Duration
The official hours that vendors may operate between are 10:00 a.m. until sunset from Victoria Day
weekend to Labour Day weekend.
Set-up
Set-up time may begin at 9:30 a.m., if required.
All vendors must have removed their goods from the beach areas by sunset, unless otherwise approved
by the Municipality.
Vendors must park their vehicles in municipally signed lots (seasonal parking passes are available).
Allocation of Vendor Location
The Municipality will allocate locations for vendors as follows:


All vendors must apply each season to have a space designated to them
Renewing vendors with full season payment may request same location as they occupied at the
end of the previous season. The payment must be received by a publicized date, to be
determined by the Municipality

Renewing vendors who wish to change to a new, unreserved location will be given next
consideration in the process of assigning available location. The location must be reserved by a
publicized date, to be determined by the Municipality
New, vendors have third choice of remaining locations
The Municipality has designated the following areas for vending:





6 spots, approximately 10 meters long, on the West Harbour Walk Way
6 spots, approximately 10 metres long, along the Board Walk
6 spots, approximately 10 meters long, on the south side of the dunes on Main Beach
1 spot, approximately 10 meters by 10 meters, on the beach on the piece of land close to the
pier
6 spots, approximately, on the southern beach embankment of Little Beach
Vendors set up in areas on Main Beach, Little Beach, and beside the Pier will not encroach on
sunbathing areas. Vendors set up along the Board Walk and West Harbour Walkway will not interfere
with the clear passage of pedestrians.
Food vendors will be located at least fifty (50) metres from a permanent restaurant or other permanent
eating establishment by measuring the distance by the “most direct route” or “the straightest route”.
Other vendors should be located at least fifty (50) metres from a permanent retail establishment by
measuring the distance by the “most direct route” or “the straightest route”.
In all instances, locally produced products and services are encouraged.
The final location will be at the discretion of the Municipality

Vendor and Location Appearance
Vendors are to post their name/name of their business and address prominently at their location if
stationary or on their cart if mobile.
Municipal license must be prominently displayed by Vendor.
Vendors shall maintain their assigned location in a neat, clean and orderly fashion.
All vendors are expected to dress in a neat and appropriate manner.
Garbage and Storage
Vendors must place their own refuse in a suitable container. All refuse must be cleared at the end of
each day, and ensure their area is restored to its original state (free of garbage).
There will be no storage of tables, benches, signs, coolers, etc. by the Municipality for vendors.
Insurance
Vendors must obtain Comprehensive General Liability Insurance satisfactory to the Municipality,
including the following:
Proof of insurance must be provided to the Municipality at the time of application for a license;



The Corporation of the Municipality of Central Elgin be named as an additional insured
The policy shall contain a provision for cross liability in respect of the named insured
Owner’s protective coverage
Product/Service
All vendors shall comply with the requirements of the local Health Unit. Enquiries regarding health
regulations are the responsibility of each vendor and may be obtained from the Elgin St. Thomas Health
Unit at (519) 631- 9900.
All service providers must provide proof of certification. Proof of certification must be provided with
application.
All Other Vendors
All other vendors, not listed above, may be permitted at the discretion of the Municipality on a specific
case by case basis.
Enforcement of Policies, Rules and Regulations
The Municipality will enforce vendor policy, rules and regulations.

The Municipality shall decide on to the admissibility of any item for sale or rent. A vendor may ask for a
specific ruling by the Municipality for future reference.
Vendor policies, rules and regulations will be made available to all vendors at the beginning of each
season, and with each new vendor application.
Compliance
All Vendors agree to comply with the rules and regulations of the Municipality of Central Elgin as set out
in this document.
All policies and procedures set out in the document are expressly an agreement set out between the
vendor and the Municipality. No vendor may sublet their assigned site.
Understanding and compliance of these policies, rules and regulations is acknowledged by the vendor by
means of their signature on the bottom of this document, as well as the Outdoor Seasonal Vendor
application. All vendors shall complete an application package, each season.
Compliance with both provincial and federal sale tax regulations is the responsibility of the individual
vendor.
Vendors shall comply with all federal, provincial and municipal regulations regarding the sale of their
merchandise. The Municipality shall not be held responsible for any non-compliance.
The Municipality will undertake vendor compliance site visits. Vendors who violate any of the rules and
regulations may have their vendor status revoked.
Any items not specifically covered by these rules and regulations shall be dealt with by the Municipality.
