TENDER NOTICE
Subject: Hiring of Services of skilled Junior Hindi Translators from registered Service
Providers / Firms / Agencies on engagement basis for use of Department of Commerce.
Sealed tenders are invited from reputed and well established Service provider
Companies / Firms / Agencies to provide 03 (Three) skilled Junior Hindi Translators to the
Department of Commerce initially for a period of Six Months, which may be further
extended as per the requirement.
2.
The Service provider Company / Firm / Agency should send all the documents in
support of eligibility criteria, for consideration by Department. The tenderers are advised in
their own interest to submit the desired papers/documents with their bids failing which
their bids may be rejected as non-responsive.
3.
The Earnest Money Deposit (EM D) of Rs. 50,000/- (Rupees Fifty Thousand only) in
favour of Under Secretary (Cash). Department of Commerce, must be sent with the Tender
and original in a sealed envelope super scribed with the works" Hiring of Services of skilled
Junior Hindi Translators from registered Service providers for use <if Department of
Commerce "and has to be dropped in the Tender Box installed in Room 27C, Udyog Bhawan,
New Delhi latest by 3.00PM on 09.04.2015 No tender shall be entertained after this
deadline under any circumstances whatsoever .

The tender shall be opened at 04.00 PM on 09.04.2015 in the Room No. 2SA. Date
and time for opening of Financial Bids of the eligible firms would be intimated later on.
5.
This Department reserves the right to amend / withdraw any of the terms and
conditions contained in the Tender Document or to reject any or all tenders without giving
any notice or assigning any reason . The decision of the Department in this regard would be
final.
The Technical bid and Financial Bid details are plac-ed at Annexure A & B
respectively.

The Department of Commerce requires the services of reputed and well established
Service Provider Company / Firm / Agency to provide Junior Hindi Translators for the work
related to Hindi Section of this Department.
9.
The bidder who has been in existence for over three years and supplied services of
Junior Hindi Translators to the office of Central/State Government will be considered. In
this regard a copy work orders to be enclosed with technical bid. The bidder should not have
been disqualified by any Government/Semi Government Or.ganisation for similar work and
must give a self declaration (Annexure C).

The successful tenderer will have to deposit a Performance Security Deposit (Ten
percent of total billed amount) as determined by the department in terms of General
Financial Rules, 2005 in the form of Fixed Deposit Receipt (FDR)/Bank Guarantee in favour of
Under Secretary (Cash), Department of Commerce, New Delhi which shall remain valid up to
a period of 60 days beyond the completion of all engagement obligations. In case, the
engagement is further extended beyond the initial period, the FDR/BG will have to be
accordingly renewed by the successful tenderer.
11.
The conditional bids shall not be considered and will be out rightly rejected in very
first instance. All entries in the tender form should be legible and filled clearly. If the space
for furnishing information is insufficient, a separate sheet duly signed by the authorized
signatory may be attached. No overwriting or cutting is permitted in the Bid Form. In such
cases, the tender shall be summarily rejected.
12.
The
service
providers'
Personnel
shall
not
claim
any
benefit/compensation/regularization or services from this Office under the provision of
Industrial Dispute Act, 1947 or Contract Labour (Regulation & Abolition) Act, 1970.
Undertaking from the person to this effect shall be required to be submitted by the
service provider to this office.
13.
The tender is subject to the provision of Rule 160(ii) of General Financial Rules, 2005
which enables a bidder to question the bidding conditions, bidding process and/or rejection
of its bid. Accordingly, enquiries in this regard by a bidder will be responded if the request is
received in writing, in time in GA Section of this Department.
14.
The Agencies should have at least previous three financial years i.e. 2011-12, 2012
13 & 2013-14 of experience in providing such services as mentioned above, to Government
Ministries/ Departments/ PSUs/ other reputed national level institutions. A complete list of
clients serviced during the last three years (year-wise) shall he provided along with the value
of contracts/engagement executed.

The bidder having annual turnover of more than Rs. 25 (Twenty Five Lakhs only) per
annum during the last three Financial Years 2011-12, 2012-13, 2013-14 will be considered .
In this regard Charted Accountant's Certificate certifying the bidder's turnover to be
enclosed in technical bid.

16.
Preference shall be given to the Micro and Small Enterprises registered with District
Industries Centres or Khadi and Village Industries Commission or Khadi and Village
Industries Board or Coir Board or National Small Industries Corporation or Director of
Handicrafts and Handloom or any other body specified by Ministry of Micro, Small and
Medium Enterprises. The Micro and Small Enterprises quoting price within price band of
L1+ 15% shall also be allowed to supply a portion of requirement by bringing down their
price to L1 price in a situation where L1 price is from someone other than a Micro and Small
Enterprises.
17.
The Junior Hindi Translators provided by the Service Provider shall be required to
work from Monday to Friday 9.00 AM to 5.30 PM with a lunch break of 30 minutes from
1.00PM to 1.30 PM. The Junior Hindi Translators may also be called upon to perform duties
on Saturday and Sundays and other Gazetted Holidays, if required.
18.
The tender is not transferable.
19.
The EMD will be refunded without any interest within 30 days of award of purchase
order.

(A)REQUIREMENTS FOR THE SERVICE PROVIDfR COMPANY / fiRM / AGENCY:
The tendering manpower Company / Firm / Agency should fulfil the following conditions:
(i)The Registered Office or one of the Branch Office's of the Service Provider
Company / Firm / Agency should be located either in Delhi / New Delhi or in any of
the Satellite Towns of Delhi;
(ii)The Service Provider Company / Firm / Agency have at least three years
experience in providing services to Public Sector Companies / Banks and
Government Departments etc;
(iii)The Service Provider Company / Firm / Agency should have its own Bank Account;
(iv)The Service Provider Company / Firm / Agency should be registered with Income
Tax and Service Tax departments;
(v)The Service Provider Company / Firm / Agency should be registered with
appropriate authorities under Employees Provident Fund and Employees State
Insurance Acts.
(vi}The engagement shall be for an initial period of Six Months unless it is curtailed or
terminated by this Department owing to deficiency of service, sub-standard quality
of Junior Hindi Translators deployed, breach of contract/engagement etc.
(vii) The engagement shall automatically expire on completion of Six Months unless
extended further by the mutual consent of engaging agency and this Department.
(viii}The engagement may be extended, on the same terms and conditions or with
some addition / deletion / modification, for a further specific period mutually agreed
upon by the successful Service providing Company / Firm / Agency and the
Department.
(ix}The payment shall be made on conclusion of the calendar month only on the
basis of number of working days for which duty has been performed by each Junior
Hindi Testator.
(x}The Department of Commerce reserves right to terminate the engagement during
initial period or also after giving a week's notice to the engaging agency.
(xi) The Service Provider Company / Firm / Agency will be responsible for compliance
of all statutory provisions relating to Minimum Wages, Provident Fund, and
Employees State Insurance etc. in respect of the persons deployed by it in this

(xii) The Service Provider Company / Firm / Agency shall also be liable for depositing
all taxes, levies, Cess etc. on account of service rendered by it to the Department of
Commerce to concerned tax collection authorities from time to time as per extant
rules and regulations on the matter.
(xiii) The Service Provider Company / Firm / Agency shall maintain all statutory
registers under the Law. The agency shall produce the same, on demand, to the
concerned authority of this Department or any other authority under Law.
(xiv)The Tax Deduction at Source (T.D.S.) shall be deducted as per the provisions of
Income Tax Department, as amended from time to time and a certificate to this
effect shall be provided to the agency by this Department.
(xv)ln case, The Service Provider Company / Firm / Agency fails to comply with any
statutory / taxation liability under appropriate law, and as a result thereof the
Department is put to any loss / obligation, monitory or otherwise, the Department
will be entitled to get itself reimbursed out of the outstanding bills or the
Performance Security Deposit of the Service Provider Company / firm / Agency, to
the extent of the loss or obligation in monitory terms.
(xvi)In case of breach of any terms and conditions attached to this
contract/engagement, the Performance Security Deposit of the Service Provider
Company / Firm / Agency will be liable to be forfeited by this Department besides
annulment of the contract/engagement.
(xvii)The payments shall be made on conclusion of the calendar month only on the
basis of number of working days for which duty has been performed by individual
Junior Hindi Translator. The Service Provider Company / Firm / Agency shall raise the
bill, in triplicate, along with the attendance sheet/satisfactory performance
certificate [duly verified by Hind Section) in respect of the persons deployed and
submit the same to Under Secretary (General Administration) in the first week of the
succeeding month.
(xviii)The claims in bills regarding Employees State Insurance, Provident Fund, and
Service Tax etc. should necessarily be accompanied with documentary proof that the
amount deducted has been credited to appropriate account pertaining to the
concerned bill month. A requisite portion of the bill / whole of the bill amount at the
discretion of this Department shall be held up till such proof is furnished.

(B)TECHNICAL REQUIREMENTS FOR JUNIOR HINDI TRANSLATORS TO BE DEPLOYED BY THE
SUCCESSFUL SERVICE PROVIDER COMPANY / FIRM / AGENCY IN THE DEPARTMENT OF
COMMERCE:
The Service Provider Company / Firm / Agency shall ensure that the individual Junior Hindi
Translator deployed in the Department of Commerce conform to the following technical
specifications of age, educational and skill qualifications:
(i)The Junior Hindi Translators should have master's degree of a recognized university in
Hindi with English as a subject at degree level;
OR, Master's degree of a recognized University in English with Hindi as a subject at
degree level;
OR, Master's degree of a recognized University in any subject with Hindi as a medium of
instruction and examination with English as a subject at degree level;
OR, Master' s degrees of a recognized University in any subject other than Hindi/English
with Hindi/Engli sh medium and English/Hindi as compulsory/ elective subject;
OR, Bachelor' s degree of a recognized University with Hindi and English as main/elective
subjects or either of the two as medium of examination and the other as a main
/elective subject.
(c) The Junior Hindi Translators should have recognized diploma /Certificate course in
translation from Hindi to English and vice-versa OR two years experience of translation
work from Hindi to English and vice-versa in any Central/State Govt'/ U.T.
Administration Offices including Government of India Institutions.
(d)The knowledge of Computer Operation in both Hindi and Engli sh is desirable.
(e)The Junior Hindi Translators should give current Character certificates from two
Gazetted Officers of the Central Government / State Government;
(f) Attested copy of certificate containing date of birth;
(g) Character certificate from two gazetted officers of the Central/State Government;
(i)Certificate of verification of character & antecedents of persons by local police
authority
Olin case, the person employed by the successful Company / Firm / Agency commits any
act of omission / Commission that amounts to misconduct / indiscipline / incompetence,
the Service Provider Company / Firm / Agency will be liable to take appropriate
disciplinary action against such persons, including their removal from site of work, if
required by the Department

(k) The Service Provider Company / Firm / Agency shall replace immediately, upon
receiving written notice from this Department, any of its personnel who was found
unacceptable to this Department because of security risks, incompetence, conflict of
interest, improper conduct etc.
(I)The person deployed shall be required to report for work at 9.00 AM to Assistant
Director, Hindi Section, Department of Commerce, and would leave at 17.30 PM . In
case, person deployed comes late / leaves early on a particular day, three occasions in
a month, one day's wage shall be deducted.
(m)The Service Provider Company / Firm / Agency shall depute a coordinator who would
be responsible for immediate interaction with the Department so that optimal services
of the persons deployed by the agency could be availed without any disruption.
(n)The selected Service Provider Company / Firm / Agency shall immediately provide a
substitute in the event of any person leaving the job due to his / her personal reasons.
The delay in providing a substitute beyond three working days would attract a penalty
@ Rs.SOO/- (Rupees Five Hundred only) per day on the service providing agency.
(q) The Service Provider Company / Firm / Agency shall be solely responsible for the
redressal of grievances / resolution of disputes relating to person deployed. This
Department shall, in no way, be responsible for settlement of such issues whatsoever.
(r)This Department shall not be responsible for any financial or other injury to any
person deployed by service providing agency in the course of their performing the
functions/duties, or for payment towards any compensation.
(s)The persons deployed by the service providing agency shall not claim nor shall be
entitled to pay, perks and other facilities as admissible to regular / confirmed employees
of this Department during the currency or after expiry of the engagement.
(t)ln case of termination of this engagement on its expiry or otherwise, the persons
deployed by the service providing agency shall not be entitled to any claim for any
absorption in the regular / otherwise capadty in this Department.
