REPORT TO THE LEADER TO BE HELD ON 1 MAY 2015 Corporate Priority: Key Decision No Cabinet Portfolio Holder Cllr T Fox Date of Decision/ Referral to O&S 1 May 2015 Inclusive and Vibrant Deadline for call-in 5.00pm Implementation Date (if no call-in) 7 May 2015 8 May 2015 REPORT OF: DIRECTOR OF DEMOCRATIC AND LEGAL SERVICES – 15/125 WARDS AFFECTED: Derwent Valley, Esk Valley and Mulgrave SUBJECT: PARISH ORDER – TEMPORARY APPOINTMENT OF COUNCILLORS RECOMMENDATION (S): The Leader is recommended to approve the appointment of the individuals set out in paragraph 5.1 of this report to act as Parish Councillors for the listed Parish Councils, until the new Councillors take office after 22 June 2015. REASON FOR RECOMMENDATION (S): Failure to approve these temporary appointments will result in the Parish Councils listed in paragraph 3.1 being inquorate and therefore unable to operate. HIGHLIGHTED RISK: See reason for the recommendation. 1. INTRODUCTION 1.1 In the event that Parish Councils receive insufficient nominations for a forthcoming election to be quorate, the Borough Council has powers under the provisions of Section 91 of the Local Government Act 1972 to enact temporary appointments to these Parish Councils until such a time as further elections can take place and a quorum re-established. 2. CORPORATE AIMS/PRIORITIES AND THE COMMUNITY PLAN 2.1 This report contributes to Corporate Aim 3 (Inclusive and Vibrant) and its top priority: community cohesion and participation. 3. BACKGROUND AND ISSUES 3.1 The following number of nominations was received for the following Parish Councils after the nominations period for the scheduled ordinary elections taking place on 7 May 2015: Goathland Newholm-cum-Dunsley Snainton Sneaton Ugthorpe Group 3.2 0 1 2 0 0 The total number of seats on these councils and their quorums are as follows: Goathland Newholm-cum-Dunsley Snainton Sneaton Ugthorpe Group Seats 7 7 5 5 6 Quorum 3 3 3 3 3 3.3 Therefore the number of nominations received in the above mentioned Parishes leaves them all being inquorate from 11 May 2015. 4. CONSULTATION 4.1 The Borough Council has invited nominations for temporary appointments from the Parish Councils concerned to ensure they remain quorate after the elections on 7 May 2015. 5. ASSESSMENT 5.1 Below is the list of nominations received to occupy these temporary positions on the Parish Councils concerned: Helen Beeforth Goathland Martin Holland Jason Wood Anne Hodgson Newholm-cum-Dunsley Martin Milburn Snainton David Mathewson Mike Shardlow Sneaton Rose Stainthorpe Gordon Stock Stuart Brown Ugthorpe Group Colin Hodgson John White 5.2 Another election has been scheduled for 18 June 2015 to fill the remaining vacancies on the Parish Councils. 6. IMPLICATIONS Policy 6.1 There are no policy implications as a result of this report. Legal 6.2 See paragraph 1.1 above. The Borough Council is required to make an Order to enact the temporary appointments. Financial 6.3 There are no financial implications arising for the Borough Council from the recommendations in this report.
