Banks hearing challenges sentence
after serving 30 years in prison

After 30 years on death row, a man
who killed a Texarkana teen is back in
Bowie County.
Delma Banks, now 52, was just 21
when he fired two shots into Richard
Whitehead’s brain in a Nash, Texas
park in April 1980. Whitehead and
Banks were acquainted because they’d
worked together. Banks killed Whitehead for his car after the two drank beer
together.
In October 1980 Banks was found
guilty and sentenced to die by a jury of
Bowie County residents. But the case
didn’t end there.
For three decades judges, lawyers
and appellate court justices have argued
about the conviction and sentence. The
main sticking point being the testimony
of a key state witness who was a paid
police informant. The witnesses paid informant status wasn’t known to the defense at the time of Banks’ trial and was
never mentioned to the jury.
Appellate courts at the state and federal levels have ruled Banks’ conviction sound amid “substantial and overwhelming evidence,” said 102nd District
Judge John Miller at a hearing Sept. 27
in Bowie County.
Banks’ conviction was affirmed by
the U.S. Supreme Court in January.
But several years ago a federal judge
ruled that the sentence needed a redo
because of the jury’s lack of information
about the paid informant.
The case is now back in the hands
of a Bowie County District Court for a
trial on sentencing alone. A new jury
will hear the evidence and be asked to
decide if Banks should receive the ultimate punishment or if he should be allowed to die of natural causes in prison.

recused himself at the hearing Sept. 27
because of his previous role as a prosecutor involved in the proceedings.

Folsom scheduled a hearing on the
matter. When a federal agent went to
Allen’s home in Dallas to serve her with
a subpoena and notice of the hearing,
Underwood was there.
Not only was he in violation of
Folsom’s no contact order, Underwood
was supposed to be living and working
in Oklahoma.
Folsom told Underwood he’d granted
probation against his better judgment
and gave him six months in prison.
Once he’s served that time Underwood
will be supervised for three more years
by federal probation.

A Bowie County man who shot
a Bowie Cass Electric Cooperative
lineman who was trying to restore
power after a storm outage in Hooks,
Texas, pleaded guilty to deadly conduct
in October and was sentenced to ten
years probation.
Jeffrey Bryan Duke, 40, unloaded
three rounds from his shotgun, hitting
the lineman in the chest, chin and lip.
The electrician, who still carries some
of the buckshot in his body, did not want

will lead to the arrest and conviction, for the person(s) responsible for the crime.
The family has also said that they will pay $1,000.00 for information that leads
to locating David Todd Coulter, if there is no foul play.

The lineman was reportedly in Duke’s
yard shining a light on power cables
when he was shot. The Bowie-Cass

A 45-year-old Texarkana man, who
wasn’t going to let his girlfriend get
away without a fight has been indicted
by a Bowie County Grand Jury.
Ronnie Donnill Hartfield wasn’t
at odds with another suitor. He
brandished a knife and told
the woman who’d broken
up with him a few days before, “So, you think you’re
going to leave me?”
Hartfield and his alleged victim had been dating for about six months
when things ended Sept.
11. That day, Hartfield reportedly blackened his love
interest’s eyes, according to
an arrest affidavit filed by officer Daphne Stiles.
On Sept. 14, Hartfield allegedly paid
the woman a harassing visit at her Tyson
Foods job. The next
day, Sept. 15, the

woman was sleeping
when a noise roused her at about 6 a.m.
When she went to the door, the alleged victim saw Hartfield tromping
through her place with a butcher knife,
the affidavit said. He’d broken the back
door and was in a violent rage.
The woman told investigators Hartfield came at her with the knife while
mocking her choice to end their romance. In an attempt to quell his anger
the woman said things like, “she loved
him and was not going to leave him,”
the affidavit said.
Hartfield approached the front
door, “turned around and started
cutting her,” according to the
affidavit.
The terrified woman told
officers Hartfield was inconsolable as he swung
at her head and held the
knife against the flesh of
her neck.
Hartfield “...just kept
cutting her and she ducked
down behind the couch with
her arms trying to cover her
head,” the affidavit said.
The woman’s screams
for help continued
through the attack
and Hartfield fled.
Hartfield is presently being held in
the Bi-State Justice
Hartfield
Center in downtown Texarkana.
He was indicted Oct. 14 by a grand
jury in Bowie County. If convicted he
could spend five to 99 years or life in Institutional Division of the Texas Department of Criminal Justice.

A Nevada man making a delivery to
Red River Army Depot in Bowie County
is in federal custody for allegedly
possessing sexually explicit images of
children.
Will Frank Campbell, 27, aroused
suspicion at the depot and a search of
his truck revealed he was in possession
of illegal child pornography, alleged
federal court documents.

Bryant ruled that Campbell would

Campbell’s mental state is such that
he doesn’t comprehend his situation

If found guilty of possessing material
involving the sexual exploitation of
minors, Campbell could be sentenced
to up to 10 years in a federal prison and/
or assessed a fine of up to $250,000.
Federal law requires offenders convicted
of the offense to be supervised for
at least five years and as much as
life following completion of a prison
sentence.
Until the court receives a
report from mental health
experts about Campbell’s
psychological state, the
case will not proceed.

Protect Your Identity And Money This Holiday Season
The holidays can be a wonderful
time for shoppers who enjoy bargain
hunting or admiring festive window displays. But it can also be prime hunting
season for identity thieves.
According to a recent report from
Javelin, the number of identity fraud
victims in the United States jumped in
2009 by 12 percent from the previous
year to 11.1 million adults - the highest
increase since the survey was first conducted in 2003.
“Whether shopping online or in
stores, all consumers need to be vigilant,” says Shelley Solheim, Director
of Financial Education at Capital One.
“By taking a few simple steps, shoppers
can help protect themselves both online
and at the mall, and safeguard their per-
sonal information from identify thieves.”
To protect consumers during the
holiday shopping season, the experts
at Capital One are offering these simple
tips.
At the Mall
No matter where you shop, be careful during the hectic holiday season.
* Streamline your wallet: Before
shopping, clean out your wallet and
take only credit cards, checks and/or
cash that you need. Never carry your
social security card in your wallet.
* Be aware of your surroundings: Be
conscious of other shoppers standing
nearby when you are making purchases. Identity thieves have been known
to copy credit card information or take
pictures of cards on their cell phones.
* Don’t leave valuables in your car:
Your car’s glove compartment isn’t a
secret hiding place. Wallets left in glove
compartments account for thousands of
credit card thefts every year.
Shopping Online
Be vigilant in cyberspace, especially
when shopping on a Web site that’s
new to you.
* Only use secure sites: When you’re
asked to provide payment information,
the beginning of a Web site’s URL address should change from http to shttp
or https, indicating that the purchase is
encrypted or secured.
* Consider how you’ll pay: Credit
cards generally are a safe option because they allow buyers to receive
credit from the issuer if the product isn’t
delivered. Don’t ever send cash or use
a money-wiring service because you’ll
have no recourse if something goes
wrong.
* Use caution with social media: Re-
tailers increasingly use social media to
promote deals and disseminate coupons. But scammers also use these
sites, often masquerading as a friend to
deliver malicious links that allow hackers to steal personal information. Be
suspicious of any message or promotion you did not sign up to receive, and
instead of following links, go directly to
a store’s Web site.
* Keep your password private: When
selecting a password for an e-commerce site, do not use commonly known
information, such as family names,
birthdates, or numbers from your driver’s license or Social Security number.
If you are a victim of identity theft,
make sure to report it immediately to
one of the three credit reporting agencies -- TransUnion, Experian or Equifax
-- and file a police report.

Misdemeanor trouble leads to felony indictment

A man who knew he was going to jail
for violating a misdemeanor marijuana
probation made a felonious decision in
August.
Demetrick Lashon Williams, 34, reported to his probation officer August 18
knowing he would be arrested on a motion to revoke probation. While booking
Williams into the Bi-State Justice Building in downtown Texarkana, guards discovered a stash of contraband hidden
in his shoes.

were two bags of Bugler tobacco, a
lighter, rolling papers and a clear bag
with what appeared to be marijuana,
according to court filings.
“Offender Williams knew that when
he reported to his probation officer, he
would be going to jail,” court documents
state. “Offender Williams knowingly and
intentionally carried these items into the
correctional facility.”
If convicted of bringing prohibited
substances into a correctional facility, a
third degree felony, Williams could receive two to ten years in prison. A Bowie
County grand jury indicted Williams Oct.
14.
The misdemeanor charge of marijuana possession for which he was serving
probation is punishable by up to a year
in the county jail.

Texarkana dad confesses while in
mental hospital to sex with daughters

A Texarkana father who got one
daughter pregnant and had sex with another was given 40 years in prison Oct.
11 by a Texas judge.
The mother of Glyn Edward Wilson’s
daughters, one younger than 17 and
another younger than 13, called police
after finding out her oldest was pregnant and that her father was the father,
court documents state.
When Wilson, 42, learned of the
pregnancy he became suicidal and
eventually ended up in a Little Rock,
Ark. mental hospital where he con-
saulted her in January.
The victim told police her
dad pulled her clothes down

told her father ‘no’ but
he continued,” the report
said. “She advised that
her father put his penis in
her mouth and told her to
suck it. She advised that he
told her boys like girls to
do this.”

security video that “clearly” showed a
man identified by witnesses as Jolly
pulling a handgun and “racking the
slide.”
Under Texas law aggravated assault
with bodily injury involving the use of
a deadly weapon is a second degree
felony punishable by two to 20 years
in prison. A deadly conduct conviction
could net Jolly another two to ten years.

A smoothly flowing pattern formed
by alternating crests (ridges) and
troughs (valleys) on the palmar aspect of hand is called a palmprint.
Formation of a palmprint depends on
the initial conditions of the embryonic
mesoderm from which they develop.
The pattern on pulp of each terminal
phalanx is considered as an individual
pattern and is commonly referred to as
a fingerprint. A fingerprint is believed
to be unique to each person (and each
finger). Fingerprints of even identical
twins are different.
Fingerprints are one of the most
mature biometric technologies and
are considered legitimate proofs of
evidence in courts of law all over the
world. Fingerprints are, therefore,
used in forensic divisions worldwide
for criminal investigations. More recently, an increasing number of civilian and commercial applications are
either using or actively considering
to use fingerprint-based identification
because of a better understanding of
fingerprints as well as demonstrated
matching performance than any other
existing biometric technology.
