BILL NO. 6449.1 ORDINANCE NO. 6048 Sponsored by: Mayor Hennessy AN ORDINANCE CALLING FOR A BOND ELECTION IN THE CITY OF O'FALLON, MISSOURI, AT THE GENERAL MUNICIPAL ELECTION ON TUESDAY, APRIL 7, 2015, FOR THE PURPOSE OF ACQUIRING, CONSTRUCTING, FURNISHING AND EQUIPPING A NEW POLICE STATION THAT WILL BE MORE CENTRALLY LOCATED WITHIN THE CITY OF O'FALLON, MISSOURI, AND PROVIDE HOLDING CELLS, TRAINING AND SUPPORT FACILITIES WITH A SECURE MUNICIPAL COURTROOM. WHEREAS, the City Council finds it necessary and hereby declares its intent to borrow $28,680,000 for the purpose of acquiring, constructing, furnishing and equipping a new police station that will be more centrally located with the City of O'Fallon, Missouri and provide holding cells, training and support facilities with a secure Municipal Courtroom, and to evidence such borrowing by the issuance of general obligation bonds of the City in the amount of $28,680,000; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF O'FALLON, MISSOURI, AS FOLLOWS: Section 1. An election is hereby ordered to be held in the City on April 7, 2015, on the following propositions: PROPOSITION 1 FOR THE PURPOSE OF ACQUIRING, CONSTRUCTING, FURNISHING AND EQUIPPING A NEW POLICE STATION THAT WILL BE MORE CENTRALLY LOCATED WITHIN THE CITY OF O'FALLON, MISSOURI AND PROVIDE HOLDING CELLS, TRAINING AND SUPPORT FACILITIES WITH A SECURE MUNICIPAL COURTROOM, SHALL THE CITY OF O'FALLON, MISSOURI, ISSUE ITS GENERAL OBLIGATION BONDS IN THE AMOUNT UP TO TWENTY-EIGHT MILLION SIX HUNDRED EIGHTY THOUSAND {$28,680,000)? The authorization of the bonds (the "Bonds") will authorize the levy and collection of an annual tax in addition to the other taxes provided for by law on all taxable Page 1of4 tangible property in the City sufficient to pay the interest and principal of the Bonds as they fall due and to retire the same within twenty years from the date thereof. Section 2. The form of the Notice of Bond Election for said election, a copy of which is attached hereto as Exhibit A and made a part hereof, is hereby approved. Section 3. The City Clerk is hereby authorized and directed to notify the Director of Elections of St. Charles County, Missouri, of the adoption of this Ordinance no later than 5:00 p.m. on January 27, 2014, and to include in said notification all of the terms and provisions required by Chapter 115 of the Revised Statutes of Missouri, as amended. Section 4. The City expects to make expenditures on and after the date of adoption of this Ordinance in connection with the Police Station and Municipal Courthouse, and the City intends to reimburse itself for such expenditures with the proceeds of the Bonds. The maximum principal amount of Bonds expected to be issued for the Police Station and Municipal Courtroom is $28,680,000. Section S. This Ordinance shall take effect and be in full force and effect immediately after its adoption by the City Council and approval by the Mayor.
