Mike Shore Receives National Appointment
W. Michael Shore, President of Sharp Ford, 3931 U.S. 31 South, Indianapolis,
Indiana, has been appointed Chairman of the Industry Relations Committee for the
National Automobile Dealers Association, a Washington D.C. area group
representing 93% of all United States new car and truck dealers. Mr. Shore has
been active in city and state associations for over 20 years and is the current
Indiana NADA Director. As Chairman, Mr. Shore will work with all automotive
manufacturers and provide input to give America’s dealer body a voice in the
planning and implementation of long term automotive strategies.

The TIME Magazine Quality Dealer Award is the automobile industry’s most prestigious and highly coveted award for car dealers. TMQDA
recipients are among the nation’s most successful auto dealers. However they must also demonstrate a long-standing commitment to effective
community service. Heuring and Skillman are two of only 65 automobile dealers, from more than 19,500 nationwide, nominated for the 36th
annual award. The award is sponsored by TIME Magazine in association with Goodyear, and in cooperation with NADA. Mr. Heuring was
nominated by the Auto Dealers Association of Indiana and Mr. Skillman was nominated by the Indianapolis Auto Trade Association.

David Paul “Big D” Heuring, President/Owner/Dealer, of Paul
Heuring Motors, Inc., Hobart, received the 2005 TIME Magazine
Quality Dealer Award (TMQDA) on January 29, 2005.
Heuring was born into the automobile business. His father
started the family business in 1944. “At the age of 12, I was
always hanging around the dealership,” Heuring recalled. “Unlike
my friends, I liked cars, trucks and the automobile business more
than baseball.”
Heuring is also an avid drag racer. He has built and
maintained his own drag race car and racing team, Big “D”
Racing.
In addition to his business successes, Heuring and his
dealership have also supported a wide range of organizations and
causes. He has been an active member of the Hobart Chamber of
Commerce, Fraternal Order of Police, and the American Legion
Post #54. He helped establish the Hobart Police Department’s K-9
Core Unit and donated the first K-9 police vehicle to the city. He
is also an active supporter of the Muscular Dystrophy Association,
Cerebral Palsy of Northwest Indiana, 4-H and many community
sports teams, as well as many other causes and charities.
Heuring lives in Hobart with his wife of 41 years, Susan. The
couple has four children and seven grandchildren.

Ray Skillman, President, Ray Skillman Olds & GMC Trucks,
Indianapolis, received the 2005 TIME Magazine Quality Dealer
Award (TMQDA) on January 29, 2005.
A native of Owensboro, Kentucky, Skillman is a 25-year
automotive industry veteran. He began by wholesaling
vehicles with his partner, Chuck Stuart, the son of a long-time
Oldsmobile dealer. Skillman wholesaled vehicles to Stuart
before obtaining a new vehicle franchise. Skillman has
performed all facets of dealership operations, including
detailing, reconditioning, body shop repairs and vehicle sales.
Skillman and his dealership have also supported a wide range
of organizations and causes in the Indianapolis area. The Ray
Skillman Feed and Clothe a Child Program has provided clothing,
gifts and food to families in need during the holiday season for the
past 13 years and now provides for over 300 families. He has also
provided major funding to Johnson County Independence Park, a
facility designed specifically for disabled children. Skillman
describes “seeing children enjoy this park who would not
otherwise have had the opportunity to do so” as his most
meaningful community achievement.
Ray Skillman lives in Greenwood. He has five children and 13
grandchildren.

Before I was elected to the Board of Directors of ADAI, I automatically paid my
association dues for all my dealerships every year. But now that I’m on the
Board, I learned firsthand what I have been buying all those years.
Legislative Representation. These are two big words but their meaning is
simple. Our Association hires people to work full time protecting our interests in
Indiana’s Legislature and myriad state government agencies like the Bureau of
Motor Vehicles, Department of Revenue, Department of Financial Institutions,
Department of Insurance, Attorney General’s Consumer Protection Division, etc.,
etc., etc. Just think what a mess our businesses would be if we didn’t have this
legislative representation. Can you say “No Inventory Tax Repeal”? By the way
… Thanks to ADAI’s hard work, this is our last February Tax Sale!
Legal Defense Fund. ADAI’s Legal Defense Fund has greatly benefited every
one of us regardless or what make vehicle you represent. Again, it’s real simple.
Individual dealers do not have the money to mount a legal battle against
manufacturers, state government, or any other entity that threatens our franchise
system. As long as each of us continue to support our legal defense fund, we can
be sure the money will be available to continue fighting the battles.
Political Action Committee. Here’s another real simple idea. Every dealer in
the state contribute a small amount of money each year to the Indiana Dealer
Election Action for Survival (IDEAS) … that allows ADAI access to the people
elected to enact laws which can greatly affect the way we do business. None of
us, regardless of our size, could come close to ADAI’s ability to access policy
makers.
Speaking with one voice and keeping a collective eye on the ball. That’s what
our association does day-in and day-out. ADAI speaks on behalf of all 615
franchised new vehicle dealers in Indiana. ADAI also watches out for every
franchised dealer every day. Again, this only happens because guys like you and
me pony up a small amount of money to OUR ADAI.
It’s unlikely, unless you’re elected to serve on the Board of Directors of our
Association, you will see these activities first hand. That’s how I was before I
joined the Board. But take my word for it. The best money you spend will be
honoring your annual Association dues, Legal Defense Fund request and
contributing to IDEAS and the Dealer Election Action Committee (DEAC).
By the way, read Nelson Becker’s comments on page 7 to see how your annual
dues investment is working for you right now.

Jack Kain Takes the Wheel of NADA for 2005
NADA’s new chairman, Jack Kain, will concentrate on improving the image of dealers and battling negative vehicles
finance media coverage and legislation. “Our response must be open and straightforward and based on a greater
transparency in the car-buying process.” The Kentucky Ford/Lincoln Mercury dealer told his convention audience that
“Dealers are always ranked near the bottom of the list of whom the public trusts most.” “We dealers do too much for
our customers, communities, and for our nation not be held in higher esteem. I will not be satisfied until all of us are
near the top of that list.”

SALES TAX FROM OUT-OF-STATE
RESIDENTS

Q.
Should I collect Indiana sales tax from out-of-state residents who are exempt in their state or
that state has a lower tax rate than Indiana?
A.
YES – unless you deliver the vehicle outside the state of Indiana.
Background
The change in the Indiana sales tax law effective July 1, 2004 requires you to collect Indiana sales tax from all
purchasers, regardless of what state they reside in, unless they qualify for a bona fide Indiana sales tax
exemption as described on the back of the current Indiana Sales Tax Exemption Form ST-108E.
Indiana Department of Revenue’s (IDOR) Commissioner’s Directive #25 states the transaction is exempt from
Indiana sales tax if the vehicle is delivered out of state. The purchase would then fall under the Interstate
Commerce laws and is exempt from sales tax.
Therefore, if your customer qualifies for an out-of-state sales tax exemption but does not satisfy an Indiana sales
tax exemption – or – his state of residence has a lower tax rate, no sales tax, or does not give credit for sales tax
paid out of state, your only alternative would be to deliver the vehicle to an agreed upon location outside of
Indiana.
IDOR states you must indicate the out of state delivery on the purchase order and provide substantial evidence of
the vehicle delivery out of state. Acceptable forms of proof of delivery would be a copy of a ‘bill of lading’
from
a common carrier hired by the dealership or the dealership can draft their own similar form if delivering the
vehicle themselves. The form must be signed and dated by the person accepting delivery of the vehicle out of
state.
A word of caution: If you deliver vehicles to a particular state frequently and do not hire a common carrier, you
run the risk of being deemed by that state as a merchant of that state and could be required to collect their sales
tax.
NOTE: Once you have collected sales tax from an out-of-state resident, the “deed is done.” – There are no
refunds by either state!

The Indiana General Assembly has been working continuously for two months, and by the time you read this
they will have reached the half-way point. Bills which passed the first House are now being considered by the
second House.
Three of the four bills introduced at the request of the Automobile Dealers Association of Indiana, are moving
nicely through the system. Senate Bill 264, authored by Senator Ron Alting, removes airbags and other items
from the repair cost calculation to determine whether or not a salvage title is necessary. It has passed the Senate
and is awaiting action by the House of Representatives. Senate Bill 264 is being sponsored in the House of
Representatives by Representative Cleo Duncan and Representative Scott Reske. It is anticipated this bill will
be heard by the Roads & Transportation Committee during the second or third week of March.
Senate Bill 509, authored by Senator Murray Clark, passed out of committee on February 22nd and is now
eligible for passage by the full Senate. This bill that establishes an expedited remedy under the Indiana
Deceptive Consumer Sales Act. This legislation will be beneficial to dealers who find themselves being
confronted by a customer who is claiming the dealer is guilty of deceptive practices. It provides for the dealer to
make an Offer to Cure and provide an additional amount of 10% of the value of the cure, not to be less than
$500 or more than $4,000. If the offer is not accepted and the matter goes to court, the consumer would not be
entitled to attorney’s fees as provided for in the act if the court award is less than the amount of the Offer to
Cure. This gives both sides an incentive to settle the matter out of court.
House Bill 1186 started out as a bill to reduce the cost paid to the Bureau of Motor Vehicles to obtain a title
inquiry via the Internet, from $4 to $1. This bill passed out of committee on February 21st, however it was
amended in the Roads & Transportation Committee to provide for the Bureau of Motor Vehicles to determine
what the actual cost would be for obtaining a title inquire electronically through the Internet. Under the terms of
the bill, the fee cannot exceed the present $4 being charged by the Bureau. Amending the bill in this manner
allows the Bureau to determine what the real cost is for an electronic inquiry of a title. This bill is now eligible
to be considered by the full House of Representatives.
The only bill that is not moving is Senate Bill 271 which ran into difficulty from the insurance industry. This
bill would have prohibited insurance companies from owning body shops and repair facilities. The insurance
industry had a lot of problems with the bill and rather, than try to move it forward, we’ve agreed to sit down and
discuss where we can find agreements and bring the bill back next year.
The House has now passed a budget it believes to be balanced and will be considered by the Senate starting the
second or third week of March. The Senate does not anticipate any tax increases to provide funding for this biannual budget.

POA ‘COPY’ POLICY
– NEW FORM REQUIRED!
The Bureau of Motor Vehicles Title Division has again revised its policy regarding acceptance of copies of
power of attorney forms. The new policy simplifies the confusion over copies and reverses its previous
policy stated in the ADAI Dealer Title Manual in Section 3.13(D) and was effective February 22, 2005.
Basically, the BMV will now accept POA copies if they are accompanied by the new Power of Attorney
Affidavit, period. …. This means copies of individual POAs and general POAs - vehicle specific and nonvehicle specific – will be accepted if you attach a completed POA Affidavit.
Copies of the new POA Affidavit will be made available via the BMV website and the Dealer Supply Order
Form once the form has been printed with its State Form number. The BMV has approved the current format
without the State Form number for use by ADAI members until the BMV forms are available. We have
placed it on our website ( www.adai-inc.org ) in the “Forms Online” section. [Note: We will update our
website with the final version as soon as possible.]

DEALER DIVISION DIRECTOR
Bureau of Motor Vehicles’ Commissioner Joel Silverman has recently appointed two new additions to his
staff. These positions are those of Driver and Vehicle Services Deputy Commissioner and Dealer/Special
Sales Division Director. Both of these positions deal with issues related to the motor vehicle sales industry.
Stephen Leak, a newcomer to BMV, has been appointed as the Deputy Commissioner of Driver & Vehicle
Services. Mr. Leak will directly report to Commissioner Silverman and will oversee all of the driver’s
license/safety responsibility operations as well as the Registration/Excise Tax, Title and Dealer/Special Sales
Divisions.
Brad Hoffman, an existing BMV manager, has been appointed as the Dealer/Special Sales Division Director.
Mr. Hoffman will report to Deputy Commissioner Leak and will oversee the Vehicle & Watercraft Dealer
Department as well as the Special Titles and Abandoned Vehicle Departments.

these actions would be bad public policy. But another significant reason is because our Association
continually works with State policy makers to educate them about our business.

It’s the third month of 2005 and DEAC is in full swing. As I stated earlier in the year, we finished 2004
with contributions of $35,200 or 102.63% of our goal. Again, thank you to everyone who contributed.
NADA has kept our fundraising goal the same as last year at $34,122. With the 2004 presidential
election behind us, it is now time to start rebuilding our war chest.
Last year we finished with 5 President Club members, 1 Gold Eagle donor, 8 Silver Eagle donors, 25
Bronze Eagle donors and 32 contributing members for a total of 71 new vehicle dealers giving to DEAC
out of our 615 new vehicle dealers in the State of Indiana.
I am asking for your help. I would like to increase our contributors by 20% or a minimum of 85 dealers
giving to DEAC for 2005. I would like to see our President’s Club and Gold Eagle Donors increase if
possible. If you have never donated, PLEASE CONSIDER DOING SO.
DEAC must have a signed permission form on file to accept contributions and you must be a member of
NADA to contribute to DEAC. A DEAC Permission form is on the facing page … remember, this
MUST BE A PERSONAL CHECK, and DEAC does accept personal credit card payments.
There are some Indiana new vehicle dealers that are not members of NADA. Your membership fee is
based on the number of new vehicles sold the previous year. Fees are minimal for the service received
(see Mike Shore’s NADA column this month on page 4). For more information on joining NADA,

Over the last several years employers have seen a number of employer-friendly court
decisions concerning interpretation of the Americans With Disabilities Act. In fact, the court
decisions have ticked off some of the handicap activist groups to the point where they are now
asking Congress for additional amendments to the Act to attempt to void certain pro-employer
decisions.
One area that still remains a problem is a split of decisions by the courts on employees
who have a mental condition that adversely affects their ability to interact positively with fellow
employees. For example, is a particularly abrasive, hard-to-get-along-with employee really
suffering from some sort of mental condition which would bring this employee under the
protection of the ADA? One court has held that interacting with employees can be a major life
activity; thus any mental or physical impairment that affects this "major life activity" could be
protected under the ADA. In a reported case, an employee who had bouts of depression for a
number of years had such a problem interacting with other employees that the company changed
her work responsibilities to a home job. She did not like that and the company ultimately
terminated her employment. A court allowed the case to go to a jury and the employee was
awarded $190,000 in damages. On appeal, the court remanded the case to the trial court for
further actions, deciding that an appropriate standard would be that if an impairment severely
limited an individual's ability to initiate contact with or respond to other people, there would be
an impairment which would rise to coverage under the ADA. For example, this could be caused
by severe depression, autism, etc. The court stated that the employee would not be protected if
he/she simply could not get along and communicate with others inappropriately and
ineffectually, etc.
In short, look to the condition, if any, that causes the employee's behavior. If there is an
underlying significant physical or mental deficiency, seek legal assistance in determining what to
do. If it is simply a personality matter, feel free to take appropriate disciplinary action. For

Your business has been seriously damaged from a recent storm, and repairs will take several weeks. Business
operations are totally or partly suspended due to the covered loss. Who will pay for extra expenses over and
above normal operating expenses to get back into business? What about the net income loss and continuing
expenses during the period it takes to restore your business operations?

Build Your Own Safety Net
Most agree that safety training for new employees make good sense. For one thing, statistically speaking, new employees are among those
most likely to be injured, and a bit of training just might enable the new person to work more safely. Also, a well-done series of safety
training sessions sends a powerful message that your dealership takes safety seriously. There is only one chance to make a first impression,
and this would sure be a good one. Finally, there are those pesky OSHA regulations that require this training.
Just what training is required? Well, the list may be longer than you think. And while requirements can vary somewhat by state, here is a
brief summary of several of the more important ones:
N
Emergency Response Training: The purpose is to provide dealership staff with guidelines for responding to a fire or explosion, a
spill or release of a hazardous material, and certain natural disasters.
N
Personal Protective Equipment Training: Employers are required to survey their work areas in order to determine what PPE is
required, and where. This training is supposed to inform an employee of the PPE he should wear (ex: eye protection) as well as how
and when it should be worn.
N
Hazard Communication Program Training: This mandatory training informs applicable employees of the chemical hazards present
in the workplace and how one can protect against these hazards. The training also addresses product labels and Material Safety Data
Sheets.
N
DOT HazMat Handler Training: This training applies to those who ship or receive hazardous materials; typically members of the
Parts Department staff. While some dealerships may have to obtain off-site training, in many instances, this is not necessary. As a
general statement, HazMat training supplements the above noted Hazard Communication training.
N
Forklift Safety: This training is only required for those employees at the dealership that operate a forklift. It includes classroom type
training, as well as operational qualification.
N
Respiratory Protection Training: This training is normally required for respirator wearers in the paint shop. It includes training on
respirator selection, use and maintenance. Respirator fit testing is also required.
As you have no doubt already figured out, the dealership is responsible for providing this new employee training. But how? One way
would be to put together your own training syllabus. Another could be to get help from your workers’ comp carrier. For clients of Kip
Prahl Associates, our endorsed environmental and safety consultant, the answer seems a little easier. In addition to scheduled on-site
training, KPA offers clients a series of internet-based training sessions, training videos, and sample training packages. These materials
make it relatively hassle-free for a dealership to put together safety training programs tailored to the requirements of the individual new

A final point: the reality is that, across the country most dealerships do little new employee safety training. Moreover, there does not
appear to be any vigorous or sustained enforcement activity in this area. But with soaring workers’ compensation premiums, regulatory
compliance may be secondary to reducing accidents.
