Page 1 of 4 CONTEST RULES Loved in Your ‘Hood: Best Local Burger The Loved in Your ‘Hood: Best Local Burger (the “Contest”) is presented and administrated by Vicinity, a business unit within Rogers Communications Inc. (herein referred as "Vicinity" or “Contest Sponsor”). No purchase necessary. 1. ELIGIBILITY - The Contest is open to residents of Canada who are over the age of majority in their province or territory of residence excluding residents of Quebec, (individually “entrant” and altogether “entrants”). Employees of Contest Sponsor, its parent and affiliated companies, representatives, dealers and agents, contest suppliers and judges, and those with whom they are domiciled are not eligible to enter. Entrants under the age of majority must, prior to participating in the Contest, obtain the consent of their parent(s) or legal guardian, who will be considered the Contest entrant. 2. CONTEST PERIOD – The Contest is being held from March 18, 2015 12:00 am until 11:59 pm on April 26, 2015. All times are Eastern Daylight Saving. 3. HOW TO ENTER The Contest Webpage and collection of entries is managed through the Rafflecopter application. i) Visit the Vicinity Rewards Facebook page (Facebook.com/VicinityRewards) and click on the “Best Burger Contest” tab. Log in using your Facebook credentials or email address Once you have logged in, nominate your favourite local burger place with a short essay on why you you love it. This submission will enter the entrant into the judged portion of the Contest (Grand Prize) and will count as one (1) entry in the random draw (Secondary Prize). ii) To obtain additional entries into the random draw (Secondary Prize) a. Obtain two (2) entries in the Secondary Prize draw by visiting Vicinity Rewards on Facebook via Rafflecopter. b. Obtain two (2) entries in the Secondary Prize draw by following @VicinityRewards on Twitter via Rafflecopter. c. Obtain one (1) additional entry in the Secondary Prize draw by tweeting about the contest including the hashtags #LoveYourHood and #BestLocalBurger via Twitter. iii) Any use of robotic, automatic, programmed or any entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries. All entries that are incomplete, illegible, damaged, contain erroneous contact or entry information or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsor. iv) Although this Contest may be communicated, promoted, or administered by means of any third party social media or social networking service or site (each, a “Third Party Service”), entrants acknowledge that: (i) this Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; (ii) if entry into this Contest is by means of a Third Party Service, entrants must have a valid account with the applicable Third Party Service (and may be required to have a public (i.e. non-private) account in order to participate) and must comply with the applicable Third Party Service’s terms and policies; and (iii) any questions, comments or complaints regarding this Page 2 of 4 Contest should be directed to the Contest Sponsors and not to any Third Party Service. By participating in this Contest, you completely release any Third Party Service of all liability in relation to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from your participation. 4. PRIZES Three (3) prizes are available to be won as follows: a) GRAND PRIZE (judging of essays) - One (1) $500 Visa gift card to be awarded to entrant associated with the entry having obtained the highest score in the judging portion of the Contest (see Section 5 below). - $500 worth in marketing support to be awarded to the restaurant nominated (herein referred to the “merchant”) by the Grand Prize winner b) SECONDARY PRIZE (random draw): One (1) $50 Visa gift card, 5. JUDGING OF ESSAYS Judging will be carried out by a panel of judges comprising representatives of the Contest Sponsor on or about April 27, 2015 at the office of Contest Sponsor or the independent agency at Media Profile (Vicinity PR supplier). Eligible entries will be judged on the following criteria, weighted equally: quality of the food, quality of customer service and community involvement of nominated restaurant. Decisions by the judging panel in awarding points to eligible entries are final and without appeal. The entrant associated with the entry having obtained the highest score will be the eligible Contest prize winner of the Grand Prize. In the event of a tie between entrants, a random draw will be made by a representative of the Contest Sponsor to break the tie and to determine the eligible Contest prize winner. Selected entrant will be contacted by email or by phone. 6. DRAW - A random draw for the Secondary Prize by a representative of the Contest Sponsor or the independent agency from all entries received will be made on or about April 27, 2015 at the office of Contest Sponsor or the independent agency at Media Profile (Vicinity PR supplier). Selected entrant will be contacted by email or by phone. 7. CONFIRMATION OF WINNERS - An eligible winner (entrant/ merchant associated to winning restaurant) will be contacted by email/phone at the email address / phone number indicated on the eligible winner’s applicable entry. An eligible winner will be disqualified and required to forfeit any claim to the Contest prize if he or she cannot be reached within five (5) business days following the first attempt of contact or if the terms set forth in these Contest rules are not adhered to. To be declared a winner, a selected entrant / merchant may need to first correctly answer, unaided, a time-limited, mathematical skill-testing question administrated by email or posed by phone at a mutually convenient time; and may also need to return a signed Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. 8. ACCEPTANCE OF PRIZE- Each must be accepted as awarded and is not transferable, redeemable, refundable or exchangeable for cash and not replaceable if lost/stolen. Contest Page 3 of 4 Sponsor reserves the right to substitute a prize, in whole or in part, with a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize. 9. RULINGS - Rulings by Contest Sponsor are final and without appeal in all matters related to the promotion, the administration of the Contest and the awarding of the prizes. 10. ODDS OF WINNING - Odds of winning depend on the number of eligible entries. Contest Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Contest Sponsor. 11. CONSENT TO PUBLICITY - By entering this Contest and/or accepting a prize, entrants consent to the use of their entry, name, city of residence and/or voice, statements, any photographs or other likenesses for publicity, advertising or informational purposes carried out by the Contest Sponsor and/or its advertising agencies in any medium or format without further notice or compensation. 12. LEGISLATION - The Contest is subject to all applicable federal, provincial and municipal laws and regulations. 13. COMMUNICATIONS - No communications will be entered into except with selected entrants. To receive a copy of the list of the winners, send an email to [email protected] on or before the Contest Closing Date. 14. PRIVACY - Vicinity is collecting personal data about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide Vicinity with explicit permission to do so. RELEASE OF LIABILITY - By entering this Contest, entrants release and hold harmless the Contest Sponsor, its advertising and promotional agencies and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, if declared a winner, the prize. 16. LIMITATION OF LIABILITY - Releasees do not assume any responsibility and each entrant releases Releasees from any and all claims, actions, damages, loss, injury, costs, demands and liabilities of whatever nature or kind arising in connection with the Contest and/or prizes including, without limitation, the administration of the Contest, the selection and confirmation of Winner, and the awarding and use of the prize. Contest Sponsor assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Contest Sponsor reserves the right to cancel or suspend this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion may be a violation of criminal and civil laws. Should such an attempt be made, Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 17. This Contest will be run in accordance with these rules, subject to amendment by Contest Sponsor. Entrants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest.
