Sunday, May 3, 2015 Drugs? To Hell With It...Just Make Them Legal By Mitchell Skolnick I have a suggestion to those who wish to attain the so called "level playing field." Let's legitimize the use of all performance enhancing drugs. I don't hear anyone making a ruckus about performance enhancing feed. You know the feeds that "deliver optimal nutrition to maximize performance." Or performance enhancing equipment like aerodynamically designed race bikes. I haven't heard much objection to shock wave therapy nor equine laser systems. DMSO improves joint mobility. Lasix keeps horses from bleeding in their lungs. Red Cell says it's the "industry standard" blood builder for fueling champion horses. So what makes performance enhancing drugs different? I especially like the legitimate use of performance enhancing drugs from the bettor's standpoint. A wise horseman once said to me that bettors don't have an issue with drivers and trainers trying to win races - it's the guy who tries to lose that's the issue. So let the trainers have the drugs if it helps them win races. Hell. W e should make it mandatory that trainers declare, before they race a horse, exactly what performance enhancing drugs they used. We can even list them on the program. This will certainly level the playing field. W e can use our existing drug testing system to ensure that the trainers are telling the truth. Think how much easier the labs will have it - Mike says he administered Clenbuterol to his horse one lab technician says to another. "Yep, there it is on testing" the other responds - "anything else on his declared list of drugs?" "Yea - Aranesp, Cobalt, phenylbutazone/flurosemide, naproxen, and sodium bicarbonate." "Yea - all there." Poor Bobby, poor Rene, poor Lou. W hat did they do? They're only trying to win races. Can't blame a guy for that? I hear the animal lovers out there starting to rattle their sabers and shouting "performance enhancing drugs are dangerous - the safety of the horse demands we have a strong and effective drug policy." I say, ‘Shut up already!’ We have no concern for the horse's welfare, If we did - those horses that test positive for banned substances would be removed from competition because the unusual blood levels and the foreign chemicals (not normally found in horses) puts the health and perhaps the life of the horse in jeopardy. Owners are always claiming their support of ways to level the "playing field." I believe that owners - for sometime now - have secretly harbored a fear that one day someone will actually suspend a horse from racing that tests positive. Imagine what will happen then. The owner will be suing the trainer for lost purse earnings, professing shock that drugging is taking place right under his/her nose, claim they knew nothing of the matter and ask why they should be penalized for the actions of others. Owners would be holding trainers accountable. God - it would be a mess. But think. Once we make the use of performance enhancing drugs transparent, the owners need not be concerned about this anymore. And, as an added benefit, owners will no longer have to make the exhaustive effort to move their horses to the guy who presently has the best "juice." Everyone will have it. Well, there is my suggestion. W hich now that I think about it, doesn't say much for me. Maybe I should revisit the idea of suspending horses that test positive. Let me think about it some more. I'll get back to you. Wiggle It Jiggleit Returns a Winner By Bill Finley Still perfect in his young career, Wiggle It Jiggleit was as sharp as could be in last night's $47,124 Simpson Memorial at the Meadowlands after a seven-week layoff. Never pressed or tested, he cruised around the track on the front end on his way to a 3 1/4-length win in 1:50. He is 7 for 7 in his career. "W ith a seven-week layoff you hope they are prepared enough Wiggle It Jiggleit returned a because the other horses winner in last night’s Simpson have been racing," at the Meadowlands winning owner George Teague Jr. said. "I thought he would still be a safe bet. He qualified awesome and he's been training good. He looked as good as he always has. It still doesn't pay to go in over confident." As impressive as W iggle It has been he still must prove himself against the best of his division, which will likely happen in the Pepsi North America Cup at Mohawk. Teague is confident his horse will be up to the challenge. "All we want to do is let him win and feel confident," he said. "Ideally, he's more advanced right now than the others. First, the NFL Draft started Thursday and runs right through Sunday. Second, the Kentucky Derby goes to post at sometime around 6:30 ET on Saturday. Later that evening the ultra-hyped fight between Mayweather and Pacquiao takes place at the MGM Grand in Vegas. It's a crazy sports weekend. For the NFL Draft, the internal and external reporting of the event is flat-out monstrous. The first round of the draft has higher TV ratings than a Major League Baseball playoff game and the networks which cover it do so with added verve. For about two months now the NFL Network has had wall to wall coverage and ESPN has devoted many hours to mock drafts and the like. It's just huge. The welterweight championship bout is another event which has captured fight fans, and casual observers alike. And the media - both earned and paid - is devoting hundreds of hours of coverage. It feels as electric as the Rumble in the Jungle, forty some years ago. As for the Derby, it's not quite the same. In fact, it's not even close. On the main ESPN Network you'd need a microscope to find any real Derby coverage so far this week. The jokes about that on social media are relentless. "No Derby coverage on ESPN this week, but you can watch the Pepsi IRL for $79.99 on their pay per view," tweeted Al. "At least ESPN found something to show about horses this week," tweeted another, while attaching an ESPN plays of the day screen shot of a jockey who lost his pants in a race in Europe. Everyone can be perplexed about the mainstream network coverage so far this week, but they should not be surprised. The Derby, despite huge TV ratings, is not on par with the goliath sports like the NFL, or a once in the lifetime type event. The media follows the money. They have an edge for their big events that other sports can only, at times, dream about, because people are now consuming media in many different ways. This week, from the comfort of my recliner, I watched Dortmund gallop, American Pharoah's 58 and change work, (continued on next page) HarnessRacingUpdate.com • 5/3/15 PAGE 6 of 15 and just about everything else, including them getting bathed afterwards (bath shots and the Derby are an interesting exacta). I've seen handmade interviews from fans with jockeys, bettors and others you'd want to hear from. I've listened to podcasts, read blog posts, and consumed other free media. W here did I see and watch all this? On twitter. Point and click, on demand. This is not by accident. W hile major networks can struggle with media rights, racing's are (for the most part) wide open. If you have a smartphone and catch a Derby horse galloping, you can upload it and tweet it out without worrying about getting fined or yelled at. It's the same with pictures. If you want to know about any Derby horse, search for the horse's name on twitter, you will find everything you need to know or see. This is no small thing and it is not seen in other sports. Want to see Floyd Mayweather work out, or get inside the New England Patriots draft war room? Fat chance. Those camps only show you what they want you to see, and to even get that paltry access you likely have to be with an ESPN or Fox. The fans then get their news through that lens. In Thoroughbred racing we are shown what your average every day fan sees, and at times it's magical. "It's the one race [the Derby] that crosses over into mainstream consciousness, and it's a lot of fun to see casual fans and dedicated horseplayers sharing the excitement on social media," said Jessica Chapel, a Digital Media Consultant. "Horse racing is so accessible, even at the top level. It's possible to get close to the contenders and to feel close to the spectacle -- social media turns fans from observers into participants," she added. Dana Byerly, co-founder of Helloracefans.com notes the breadth of items shared on social media. "W hat strikes me as potentially unique to racing is the wide variety of content being shared at all levels, from official channels to individuals," she typed via email. "You've got everything from foal pictures and baths to workout splits and speed figures. The statistical, handicapping stuff is probably a one-to-one to types of things you'd see around big sporting events, but are there pictures of football players as babies during Superbowl week?" As much as we may snicker about foal pictures - and getting people looking at them interested in betting is a whole other discussion - it does show how big a tent this form of media is. For a Derby week, where buzz and eyeballs are paramount metrics, everything means something to someone. This edge helps Thoroughbred racing promote itself to the grassroots sports fan and stand out in a cluttered sports landscape. If a newbie wants to get exposed to horse racing, he or she can head to social media and get what they're looking for. These potential fans will speak directly with high level bettors, or industry insiders, or other fans and get answers. W hen they do go to an event and tweet out a picture or video they will be retweeted by these same insiders. It's infectious. Horse racing's resonance when it comes to old time TV networks might seem weak and deficient, and being a niche sport maybe it is. But I believe that it's far too overblown. This weekend, horses will trend on twitter, as will a trainer or jockey. Millions of average sports fans might see "Materiality" on their trends, some will click the link and discover what everyone is talking about. They can then share their thoughts, all in real time. A 90 second spot on Sportscenter is supposed to be that much more vitally important for the sport? Search analysis for "Little Brown Jug" (blue) and "harness racing" (red) show degradation. As for harness racing, the sport has lagged behind in this endeavor. Back in 2009 and 2010, Thoroughbred racing began their journey into social media and tracks hungry for more buzz entered the space rather quickly. And of course, (continued on next page) HarnessRacingUpdate.com • 5/3/15 PAGE 7 of 15 harness racing has an even bigger struggle in trying to get old, legacy media to notice it. However, that of late has been changing. Rob Key and the team at Converseon have been doing some good work in this regard and you are starting to see some buzz surrounding the sport. Tracks like the Big M have a solid presence and most recently Hoosier Park has become more active. I understand funding and some of the concerns, but this is something that needed to, and needs to be done. To get noticed like Thoroughbred racing has is no small task. But like Thoroughbred racing, harness has an edge on a lot of other sports and allocating resources into spaces that can work increases return on ad spend. To accomplish this task, harness racing needs to rely on itself, and its passionate fan base. It will take time, but with all hands on deck and a little bit of patience, I think it will get done. Marketing writer Seth Godin in his seminal web marketing work "Purple Cow" said that for something to succeed in today's world it needs to stand out and have an energized base that markets for you. Thoroughbred racing has an edge with social media that beats almost any other sport and, especially for their big events it has been working. Hopefully harness racing can follow. Invariably the game takes place the day before the Kentucky Derby. W ithout fail, at some point in the evening, someone will ask "W ho do you like in the Derby?" At that point I have to explain that I don't know follow the thoroughbreds, and try to explain (usually unsuccessfully) that trotters and pacers are different, it's a different breed, etc. Once the glassy eye stares are over I usually try to change the subject ASAP by asking "W hose deal" or "W here's the Jalapeno chips?" On Derby day I continue to get sad. I watch the owners and trainers, rich and famous, all dressed up, looking like a million bucks. Ladies dressed to the nines with fancy hats. Men in jackets and ties. Sports stars and celebs like Tom Brady, Boyz II Men, Richie Sambora, Ken Griffey, Jr., Boy George, Aaron Rogers, Phil Hellmuth, Scottie Pippen, Angela Bassett and a variety of other B-list celebrities from film, television, sports, politics, publishing, fashion and corporate America…and maybe even a Kardashian or too, roaming the paddock, walking the red carpet and attending parties. Keep in mind Louisville, Kentucky is not that easy to get to from either coast, nor is it in the greatest of neighborhoods. I also got sad when I watched one of the harness Triple Crown races last year, and in the winner's circle the track owner presented the trophy wearing a short-sleeve button-down shirt, shorts and flip flops. I was mortified. Yes it was hot out. But then I realized that only 1,100 or so fans were in attendance and maybe a few hundred online. So, thankfully, not many people witnessed it. I get sad when I see the Kentucky Derby attendance figures published. Last year almost 165,000 fans went to the race and wagered a "hold-on-to-your gaudy Derby Hat" $124 million on the race alone ($180 million on the entire card). FYI Derby admission is $60 ($55 in advance). In fact, Derby attendance has been 140,000+ every year since 1995. Fast forward a few months to the 2014 Hambletonian. A paltry crowd of just under 21,000 (the lowest since the race was moved to New Jersey in 1981) saw the race, with a handle of about $9 million. That's for the entire card, not the race itself. Yes, the weather was gloomy following a morning rain. In terms of the winner's circle celebration, the trophy was presented by none other than one of the Jonas brothers! Not even sure which one. Perhaps the one that lives in Denville. A little disappointing considering the Meadowlands is in the shadow of New York City with access to some of the biggest movers and shakers in the world. Another reason I am sad is the lack of consistency in the harness triple crown races. Although I haven't been to a live thoroughbred track since the Carter administration, I know that the Derby is the first Saturday in May; the Preakness is two weeks hence; and the Belmont in 3 weeks after that. However, I'm not sure I know when the harness Triple Crown races are. Everyone know the Jug is the third (or is it fourth?) Thursday in September. And the Meadowlands Pace is in early….oops. sorry not a TC race. The Pepsi North America Cup kicks off….oops, sorry not a TC race. The Cane Pace was a mainstay at Yonkers until the track closed to make room for the one-armed bandits. It then moved to Freehold for many years. Then Tioga (other than the year of the flooding and it went to Pocono Downs). Now I think it's going to The Meadowlands, but not sure if it's this year or next. Pretty sure on Hambletonian day. As far as the Kentucky Futurity, I think it's the last day of the Lexington meet on a Friday. Or maybe Saturday. Night? Not sure. The Yonkers Trot has been raced before the Hambletonian, yet last year was in October. I think. As far as the Messenger Stakes, it started at Roosevelt, then Yonkers, then Freestate, then The Meadows, then Harrington, and now Yonkers. I just have no idea when. I'll be sad again tomorrow, when Bob Costas and the Governor of Kentucky present the trophy to the well-dressed owners in front of 160,000+ fans. Philip Sporn HarnessRacingUpdate.com • 5/3/15 PAGE 8 of 15 My Thoughts I enjoy reading your Harness Racing Update on line over the years. I like reading about individual ideas on how to improve the sport. I have a few thoughts. 1) For me, I like the Meadowlands. One reason it’s the only local track that gets a handle and you don’t have situations like you have at Yonkers, where a 4-1 horse with 0 minutes to post goes off as the 8/5 favorite. W hat good is having 0 minutes to post with more than 8 minutes till the race goes off? 2) I like to bet on line using my Nassau OTB account. For me to travel to the Meadowlands, from Long Island, is over $20 in tolls and close to $10 in gas. I bet on average $40 a night. W ith my computer I put the Meadowlands feed right up on my 55' TV. I can have my favorite beverage right there and its so much more convenient. Obviously, live attendance is non-existent. There are some nights at Yonkers where you can bring one pizza pie and feed everyone. 3) Racing on a mile track is so much better than on a half-mile track. It should be a crime at Yonkers to be sitting in the 3 hole around the 2nd turn (first time around) and not "pull." This tells me than the driver has no intention of trying to win the race. Coming into the stretch, the horse finally gets clear and rallies to get 2nd or 3rd. W ith purse money more than double, with a third of the handle, this tells me all the driver is doing is milking the purse. He's just out to pick up a check. Finishing 2nd or 3rd is better sometimes better than winning a cheaper purse at the Meadowlands. Favorites at Yonkers come in at almost 40%. You get more consistent and honest racing on a mile track. 4) The "Gural" rule. The sport has become too much about breeding. There are limited stars because horses are retired before they prove they weren't that special to begin with. By keeping a horse active till 4 or 5 allows the cream to rise to the top. This "bologna" about setting up special races for 4 year-olds only is stupid. Unless my math is incorrect, doesn't that mean that a now 4 year-old will be competing against the same horses he raced against as a 2 year-old and a 3 year-old? 5) The sport needs stars. It cannot be that a horse is worth more money in the breeding shed than on the race track. This is short sighted. If I understand the rules correctly, a stallion is limited to 150 off spring a breeding season. There are baby races in which there could be 5-6 horses with the same sire all in the same race. Are all going to be as good as the sire? Absolutely not, some will be good, some average and some that can't put one foot in front of the other. The sport has become the same formula, win a few stakes races, get a good resume and get off the track before you prove your horse wasn't that special and clean up in the breeding shed. Horses aren't fully matured till their 5-year-old season. 6) Obviously, racing a 4 year old vs 5 year olds and up is a disadvantage. However what other form of measurement is there? If your horse was great at 2 and 3 and now is up against it as a 4 year old, well that tells you something. If he can race as a 5 year old and win consistently then that's something to hang your hat on. This would eliminate the "flash in the pans." There is big difference between good and great. 7) Too much racing and too many tracks. There is no season and nothing to get excited about. The sport presently, beside the Meadowlands, survives on "slot money." You cannot last if you need another product for you to survive. At present the "Racinos” are required to have harness racing. As time goes by and the states get used to the tax money generated by the "racinos,” there will come a day that the racinos will say we don't need the harness racing, it a drain on our bottom line. W hat do you think the states will say when that happens? Bill Hartenstine Clearing Up Some Ohio Matters In reading a few items of note from Ohio I would like to provide clarification for two issues that were brought to my attention. First, the "Brush and Crush" column written by Mr. Towers: As the "Ohio Horsepeople representative: quoted in that column I would like to clarify exactly what the opposition in Ohio to the proposed whipping rule is and clarify some facts. The quote attributed to me in the Plain Dealer article was as follows: "I think (Schmitz) has the right idea," said Renee Mancino, new executive director of the Ohio Harness Horsemen's Association. "W e do need to worry about the public perception of whipping a horse during a race. The new rules, however, are being upgraded to a level of absurdism." As a private practice attorney I do take note of what other jurisdictions do and what they have implemented, and we thoroughly researched the issue before we provided a proposed "model rule" to the Racing Commission for consideration. I am very methodical and thorough and prepared as if I were handling a court case from an evidentiary perspective for a client. The difficulties I faced in preparing however, were a bit surprising, the data and statistics necessary to combat what regulators nationwide are saying is simply not there. Not only is it not there, in most jurisdictions it isn't even gathered during the normal course of business. W hen the proposed Ohio whip rule was introduced in February 2015 we immediately reviewed the whipping rules in place in Pennsylvania, New York, New Jersey, Indiana, Ontario (including all resolutions), and Great Britain. I have the packet we distributed to our driver's colonies attached here. I personally called the Indiana Racing Commission, Pennsylvania Racing Commission and Ontario Racing Commission, and their affiliated Horsemen's Associations and requested statistics on racing being safer (or not) post stricter enactment. I also asked for evidence of higher fines and/or penalties associated with passage of stricter rules or evidence of pro-public perception comments received. Each Racing Commission directly said they did not keep (continued on next page) HarnessRacingUpdate.com • 5/3/15 PAGE 9 of 15 accident statistics at all whether it be pre-enactment or post-enactment and as far as fines or penalties were concerned I could request that information from the USTA. Most offered opinion testimony, however, as in a normal court that isn't admissible. In contacting the USTA they were very helpful. However, they could only provide me with generic accident data and violations from their database, it wasn't notated on any of their records whether an infraction or accident was whip related or not. So without the ability to obtain reliable factual evidence from within the industry we simply set about drafting a comprehensive model rule assuming what regulators were saying was true. That it was necessary to enact stricter rules. After much back and forth and meetings with the OHHA and its' Ohio Drivers, a clear and comprehensive model rule was proposed, which the Ohio Driver's Colony was behind. In the rule we included a penalty chart so the drivers knew the penalties that would be associated with a violation. Further, the penalty chart was bifurcated for normal versus excessive abusers. And in the interest of public perception (with our highest purse races likely to be broadcast) we proposed a sliding scale based on purse to deter a rogue driver if in fact the rule was not followed in the Ohio races with the highest likelihood of public viewing. Although there was a split on many different aspects of this model rule from individual drivers, they felt this was a rule they could live with due to the fact that all other jurisdictions were tightening down their regulations as well. You read the rule we proposed and make the decision as to whether the Ohio Drivers were being unreasonable or were out-of-touch with what they advanced. Contrary, the "level of absurdism" that I was quoting above was precisely because it is clear that the current proposed rule is in fact internally inconsistent, vague, and ambiguous both in regulation and with no penalty chart at all associated with it. That was one aspect of the Pennsylvania rule that the Ohio Drivers liked, clear notice and penalty provisions that could be applied uniformly. Those ambiguities are what we worked very hard to clear up with our proposed model rule. And from what was incorporated into the final proposed Resolution as passed by the Ohio Racing Commission March 30, 2015, very little was used from what was offered. Second, I would also like to provide information on one of my Members, Dan Noble in regard to the excerpt from March 29, 2015: Dan Noble in Jail Top Ohio driver Dan Noble was arrested March 25 for driving under the influence and is currently locked up in the Warren County (Ohio) Jail. Noble's last drove on March 22 at Miami Valley. He was also arrested in 2014 for DUI. No further details were available at time of publication. This wasn't a second arrest, Mr. Noble was taken into custody for that March 2014 arrest, after final disposition in his court case was reached by trial March 25, 2015. They took him into custody to serve the 10 days of a 180 day suspended sentence on March 25th after verdict. His case information (TRC 1400797A) from Lebanon Municipal Court provides that information below in the official court record.
