The above sanction is subject to fulfillment of following conditions:The grant for recognition is Class not extendable and does not in any way imply any obligation to
recognize/affiliate beyond Class VIII.
The school shall by the provisions of Right of Children to Free and Compulsory Education Act, 2009
and the Haryana State Right of Children to Free and Compulsory Education Rules 2011.
3. The school shall admit in class I, to the extent of the Strength of that class. Children belonging to
weaker section and disadvantaged group in the neighborhood and provide free and compulsory elementary
education till its completion :
Provided, that in case of pre primary classes also, this norm shall be followed.
4.For the children referred to in paragraph 3, the school shall be reimbursed as per sub section (2) of
section 12. To receive such reimbursements school shall provide a separate bank account.
5. The school shall not collect any capitation fee and subject the child or his or her parents or guardians
to any screening procedure.
6.The school shall not deny admission to any child for lack of age proof. If such admission is sought
subsequent to the extended period specified for admission, the same shall not be denied and the child
shall not be discriminated on the ground of religion, caste or race, place of birth or any of them.
The school shall ensure that :(I) no child admitted shall be held back in any class or expelled from school till
the completion of elementary education in a school;
no child shall be subjected to physical punishment or mental harassment;
no child is required to pass any board examination till the completion of
elementary education.

the teachers are recruited with minimum qualifications as laid under section 23(1) of

Hon'bie Punjab and Haryana High Court in CWP No. 23701 of 2013
(O&M) titled as Sheesh Ram Sharma & others Vs State of Haryana & others, vide its
order dated 28-10-2013 has directed as under:"The claim raised in this petition is for including the special
incentives on account of computing the retrial benefits.
Learned counsel states that this matter is covered by the decision of
this Court in the matter of Rameshwar Kaushik Vs. State of Haryana
and others, passed in CWP No. 8058 of 2009, decided on
25.02.2010, wherein also the similarly situated petitioner had
claimed this benefit to be counted toward retiral benefits. He further
states that he would be satisfied at this stage if in the first instance
a direction is issued to the respondent No 1 to decide the claim of
the petitioners by passing a speaking order thereon within any
reasonable time.
I find this to be a fair request. Resultantly, the respondent No. 1 is
directed to decide the claim of the petitioners by passing a speaking
order thereon within a period of three months from the dated of
receipt of certified copy of this order."

Brief facts of the case are that the petitioner no. 1 Sh. Sheesh Ram has
retired for the post of S.S. Master from GSSS Mandhana (Panchkula) and petitioner
no. 30 Sh. Rameshwar Dass has retired for the post of S.S. Master from GSSS
Lalheri Kalan (Yamuna Nagar) during their service, they underwent sterilization.
Further, they were granted a special increment in the form of personal pay for
promoting small family norms, in view of instructions issued vide Finance
Department letter no. 6/1(8)/79-1FR-I dated 20.07.1981 as amended in the year
1985. Needless to mention here, the said scheme was discontinued w.e.f.
01.03.1991 vide Finance Department letter no. 6/1(1)/87-3FR-I, dated 28.02.1991.
The term 'emoluments' reckoned for pension is governed by Rule 6.19 - C of
Punjab Civil Services Rule Volume - H, as applicable to Haryana. Further, the term
'emoluments' for the purpose of said Rule 6.19-C mean 'pay' as defined in Rule
2.44 of Punjab Civil Services Rule Volume -I Part I. Haryana Government Finance
Department vide notification no. GSR-31/Const./Art.-309/2001, dated 07.12.2001
has amended Rule 6.19-C of Punjab Civil Service Rule Volume -II, so as to bring
the definition of 'emoluments' in respect of Haryana Government employees, on the
pattern of Fundamental Rules applicable to Central Government employees and the
same has been substituted as 'pay' defined in Rule 2.44(a) (i) in place of Rule 2.44.
As consequence of the same, Special Pay, Personal Pay, Ov,erseas Pay, do not form
part of the pay for the purposes of emoluments. Accordingly, personal pay given on
account of incentives in the form of advance increment for promoting small family
norms, clo not form part of the emoluments for calculating pensionary benefits. The
said writ petition is the outcome of the same.

After going through to the contents of writ petition, Hon'ble Punjab and
Haryana High Court order 28-10-2013, relevant provisions of Punjab Civil Services
Rule (CSR), Volume I Part I & Volume II and various instructions issued in the
matter from time to time by the Haryana Government, the vital issued in the
matter is what is the effect of amendment dated 07.12.2001, made in Rule 6.19-C
of CSR Volume II, for calculating emoluments for pensionary benefits. There is not
a scintilla of doubt that before the amendment made in CSR Volume II vide.
notification dated 07.12.2001, 'personal pay' used to form part of pay including
pay, so as to calculate emoluments for pensionary benefits. However, after the
amendment made in Rule 6.19-C of CSR Volume - II, wherein for calculating
emoluments for pensionary benefits, the definition of 'pay' has been limited to the
pay defined in Rule 2.44(a) (i) instead of various kinds of pay enunciated in
composite Rule 2.44 containing overseas pay, special pay and personal pay. Thus,
personal pay given as consequence of incentive in the form of advance increment
for promoting small family norms has been discontinued w.e.f. 07.12.2001 for
calculating pensionary benefits.
In the light of above, the claim of the petitioners is hereby rejected.
