SUBJECT: REQUEST FOR REMOVAL OF ADOPTED INFRASTRUCTURE CHARGE - CARETAKERS RESIDENCE - 2/12 BASSETT STREET CALLEMONDAH Responsible Officer: Director Engineering Services Council Meeting Date: 15 October 2013 Purpose: The purpose of this report is to allow the Council to consider a request for removal of the Adopted Infrastructure Charge for a Caretakers Residence at 2/12 Bassett Street, Callemondah. Officer's Recommendation: That Council advise Mr Barry Attewell that the request for removal of the Adopted Infrastructure Charge of $18,080 for DA/914/2013 being a Caretakers Residence at 2/12 Bassett Street, Callemondah be denied. Background: On 6 September 2013 a Material Change of Use application was deemed properly made for a 'Caretaker's Residence' at 2/12 Bassett Street, Callemondah. The application sought approval for a 32m2 Caretakers Residence within the existing building footprint of Shed 2 with a kitchen, bathroom and bedroom on a mezzanine floor. The application was to rectify an existing unlawful use on the site. Refer Figure 1 & 2 below. Page 1 Figure 1 - Floor Plan Figure 2 - Photo of Caretaker's Residence Page 2 The application progressed through the IDAS process and on 11 September 2013 was approved under Delegated Authority, subject to conditions. A Decision Notice along with an Adopted Infrastructure Charge Notice in the amount of $18,080 was issued dated 11 September 2013. The Adopted Infrastructure Charge was calculated as follows: Charge Area 1 Caretakers Residence = AIC Use of "Residential (1 bedroom)" $20,000/dwelling Credit of $1,920 applied o Industry, $50/m2 GFA + $10/m2 Impervious o 32m2 GFA, 32m2 Impervious Therefore $20,000 less $1,920 = $18,080 On 23 September 2013, a request to Negotiate Condition No. 4 was received. This request was assessed under Delegated Authority and on 25 September 2013 it was decided to agree to the representations in full. As such a Negotiated Decision Notice (Attachment 1) was issued. On 23 September 2013, correspondence was received from Barry Attewell (Attachment 2), requesting the removal of the Infrastructure Charge. This correspondence is the subject of this report. Consideration: Shed 2, No. 12 Bassett Street, forms part of a strata titled, 6 Local Industry Shed complex (Refer Figure 3). These storage sheds came from a Building Works application (DA/3309/1993) which was strata titled on 17 May 1994. Given the application was in 1993/1994, no planning application would have been required, therefore, no infrastructure charges would have been applicable. Figure 3 - Locality Plan The correspondence from the owner/developer states that he has lived at the address for several years, due to a series of events including the high cost of rentals in the Gladstone region. Further, that Shed 2,12 Bassett Street is an existing property, the Shed is an existing structure, all developments on the site were approved prior to Page 3 construction and all site and development costs were paid by the builder, and the mezzanine floor would have little if any net impact on Council's infrastructure. Adopted Infrastructure Charge Resolution (No. 2) - 2011 has the site contained within Charge Area 1 (Refer Figure 4). A 1 bedroom Caretakers Residence in Charge Area 1 attracts an Infrastructure Charge of $20,000. As the existing site contains an existing industry use, a credit was applied based on the AIC category of 'Industry', ie. $50/m2 GFA + $10/m2 impervious. Figure 4 - AIC Charge Area It is recommended that as the calculation was undertaken correctly and in accordance with Adopted Infrastructure Charge Resolution (No. 2) - 2011, the request for removal of the infrastructure charge should be denied. Communication and Consultation (Internal/External): Planning Section. Legal Environmental and Policy Implications: Option 1 (recommended) - NIL - is in accordance with the AIC Resolution. Option 2 Not in accordance with the AIC Resolution. Financial and Resource Implications: Option 1 (recommended) - NIL - is in accordance with the AIC Resolution. Option 2 - Financial implication of a $18,080 Council subsidy. Commentary: Nil. Summary: In deciding this matter, it is considered that Council has two options. One - to deny the request (as recommended) or two - to remove the infrastructure charge based on the Page 4 fact that the approval is only for a 1 bedroom Caretakers Residence within an existing industrial shed within an existing industrial complex. Option 1 - That Council advise Mr Barry Attewell that the request for removal of the Adopted Infrastructure Charge of $18,080 for DA/914/2013 being a Caretakers Residence at 2/12 Bassett Street, Callemondah be denied. Option 2 - That Council advise Mr Barry Attewell that as the development approval is for a 1 bedroom caretakers residence within an existing industrial shed within an existing industrial complex, that the Adopted Infrastructure Charge of $18,080 has been deleted.
