LIST OF POLITICAL PRISONERS in the Russian Federation March 16, 2015 2 A POLITICAL PRISONER is a person criminally persecuted for reasons of his/her political views, religious beliefs, national origin, citizenship, as well as for activities aimed at the protection of civil, political and socio-‐economic rights of citizens, if these activities were carried out peacefully and were not combined with calls for specific acts of violence. Political prisoners are persons who have been forced to engage in illegal acts for the necessary self-‐defense or to protect the rights of citizens against unlawful actions of the authorities (in the wording of Chapter 8 of the Criminal Code "In the circumstances excluding criminality"). Political and civil activists are also considered political prisoners, regardless of the nature of the charges brought against them, if there is a selective application of the law, misuse of the criminal law, violation of criminal procedural law in criminal cases and sentencing, with the aim of forcing the repressed to cease their activities. A political prisoner is a person who a) is serving a sentence passed down by a court in the form of deprivation or limitation of freedom, or b) is under investigation on charges punishable by a sentence in the form of deprivation or limitation of freedom. Political prisoners can serve their sentence in: - corrective colonies - colonies-‐settlements - pre-‐trial detention centers - psychiatric hospitals (compulsory treatment) Political prisoners can also be conditionally sentenced with a mandatory registration in the Russian Ministry of Internal Affairs; they can be released from a corrective labor colony on parole; they can be under investigation with a measure of restraint in the form of house arrest or travel ban. In this list also persons are included for whom an arrest warrant has been issued, but who are currently hiding from the investigation. 3 The total number of people persecuted for their views– 181 persons. (a) for political views – 60 persons; (b) for participation in civic activities and in the activities of NGOs – 21 persons; (c) for expressing views in blogs – 19 persons; (d) for religious beliefs – 65 persons; (e) foreigners abducted from the territory of foreign states – 16 persons. Of these, (a) 88 persons are in pre-‐trial detention (b) 11 persons are under house arrest (c) 18 persons are under investigation with a measure of restraint in the form of travel ban (d) 23 persons serve their sentence in corrective colonies (e) 5 persons serve their sentence in colonies-‐settlements (f) 10 persons are sentenced conditionally (g) 2 persons are on compulsory treatment in psychiatric hospitals (h) 14 persons are hiding from the investigation and are wanted (i) 10 persons are under investigation without restraint Compared with the previous List (October 2014), this List is characterized by a sharp increase of repression against the political opposition, civil society activists and religious dissidents. This is evidenced by: (1) A significant increase in the number of persons persecuted for political reasons in the criminal procedure. Compared with the previous List, their number grew by almost 60 % (67 people). The number of persons persecuted for their political beliefs is increased by 43 % and the number of persons persecuted for their religious beliefs by 82 %. (2) Increase in the average term of imprisonment. If in October last year the average term was 4 years and 6 months, it is now 5 years and 10 months. (For comparison, the average term of imprisonment in 1980-‐82 in the USSR, was 4 years and 5 months -‐ for "anti-‐Soviet agitation and propaganda", Art.70). (3) The return of the Stalinist practice of making the laws retroactive. The charges are currently brought against persons whose actions were not a criminal offence at the time when they were taken. For example, the community leaders of the Crimean Tatars were arrested on charges of allegedly illegal actions that took place in February 2014, when Crimea was officially part of Ukraine, and jurisdiction of the Russian Federation did not extend to it. Another legally absurd case was the accusation of the resident of Crimea, Alexander Kostenko, in participating in Euromaidan protests in Kiev last winter. 4 (4) Another Soviet practice that returned to the current legislation -‐ criminal penalties for actions for which the person has already been punished administratively, which violates a basic legal principle of "one cannot be punished for the same offence twice". Today it is done in accordance with the new Art. 212.1 of the Criminal Code, which envisages initiation of criminal cases against activists who were punished administratively twice for participation in street protests (in Moscow such cases were initiated against three people). (5) The Soviet tradition of recurrent repression has returned into judicial practice -‐ when criminal cases are initiated against persons who have already been punished for the same action. Some examples are: the second criminal case of already convicted blogger Boris Stomakhin, for information that was posted in the Stomakhin blog already when he was in prison, as well as Alexei Navalny new sentence. (6) There is also the return of a typical Stalinist tradition of "hostage taking" -‐-‐ punishment of relatives of political opponents, even if they were not engaged in political activity. The first such case was the conviction of the brother of Alexei Navalny, Oleg, to 5 years of imprisonment on questionable charges with the explicit aim to force his brother to abandon political activity. Another case was the accusation of Alexandrina Markvo, the wife of Vladimir Ashurkov, the financial manager of Alexei Navalny election campaign for Mayor of Moscow. (7) There is further increase in number of foreign nationals held in pre-‐trialdetention in the Russian Federation on charges of a political nature. There is a new case against a foreigner, Nikolai Karpyuk, a Ukrainian citizen, who was kidnapped from the country and is currently in pre-‐trial prison in Russia. (8) The emergence of a new category of “secret prisoners”. As a rule, these persons are held incommunicado for months, they are deprived of the opportunity of choosing a lawyer, the official information about the nature of the charges is scarce. In such a situation it is difficult and sometimes impossible to determine the actual value of the charges, despite the fact that the charges are usually serious (espionage, terrorism, treason, etc.) Unfortunately, the List does not reflect increased repressions of extrajudicial nature. 5 One can witness the return of another Soviet form of repression -‐ expulsion abroad. Last spring, the leader of the Crimean Tatar People, Mustafa Dzhemilev, was denied the right to return to Crimea. Later, several Crimean Tatar activists were sent into exile. There is considerable pressure (including direct methods of terror) on the Crimean Tatars to force them to emigrate to Ukraine. Therefore, it can be assumed that these actions are a prelude to the impending ethnic cleansing in Crimea. Neither the growing number of kidnappings is reflected in the list, committed allegedly by law enforcement officials, or "death squads". Today, we know names of the seven abducted Crimean Tatars, some of whom have already been found dead. Kidnapping and secret killings are continuing in the North Caucasus, especially in Dagestan. Finally, one cannot overlook the growing number of killings of opponents of the regime. First of all, it is a symbolic murder of the leader of the party RPR-‐PARNAS and of one of the most popular opposition leaders Boris Nemtsov. The practice of political assassinations in the Caucasus, where they happen almost weekly, has its own specifics. Security officers kill political undesirables there, and then put weapons, explosives and Islamic literature to the place of murder, so that the murder is officially declared "the elimination of the terrorist." Both statistics and the new methods of repression demonstrate that the current political regime has a strong resemblance to the regime that existed in the USSR in its later period. This is not surprising if we take into account that the current rulers of the country are the same people who during their service in the KGB were the agents of state repression against dissidents. PERSONS PERSECUTED FOR THEIR POLITICAL BELIEFS THE BOLOTNAYA SQUARE CASE In May 2014 several criminal proceeding have been instituted against participants of the opposition demonstration on Bolotnaya square, which, due to the illegal actions of the police and the FSB, ended with the mass clashes of protesters with the police. Although the Foundation Inostrannyi Agent became active under this name only recently, its history goes back to the 1970s and 1980s of the last century, when a committee was established in Amsterdam to obtain the release of Vladimir Bukovsky, at that time one of the most famous Soviet dissidents and political prisoners in the Soviet Union. After Bukovsky’s release in 1976 the committee was changed into the Bukovsky Foundation, which saw it as its main task to defend Soviet political prisoners, campaign for their release and assist political prisoners and their families to the best of its ability. As a result of the political developments in Russia the foundation was revived in the summer of 2013, initially with a small board consisting of former activists of the Bukovsky Foundation/Second World Center. A number of well-‐known people have agreed to lend their name to the foundation, thereby supporting its goals and at the same time adding their status to the organization’s credibility. The foundation has set itself the following goals: • To document human rights abuses in the former USSR • To inform the general public through publications, social media and public events • To organize campaign in defense of human rights in the target region • To support persons and organizations who have run into trouble as a result of their work in defense of human rights in former Soviet republics and who deserve our support.
