Fresno Homeless Residents Win Settlement Over City’s
Destruction of Personal Property
FRESNO – United States District Judge Oliver W. Wanger gave
preliminary approval today to a $2.35 million class-action settlement
between a class of hundreds of homeless Fresno residents and the
City of Fresno and the California Department of Transportation.
“The Court’s ruling and the settlement should send
a strong message to other cities throughout our
country that if they violate the rights of their
most vulnerable residents, they will be
held accountable,”
said ACLU-NC staff attorney Michael Risher.

SECTION 1. Section 5.20.010 of the Code of the City of Wichita,
Kansas, is hereby created to read as follows: “Preamble.
WHEREAS, the City of Wichita has an important governmental
interest in ensuring the streets and public areas within the city are
readily accessible and available to residents and the public at large;
and
WHEREAS, the use of these areas for camping purposes interferes
with the rights of others to use the areas for which they were
intended; and
WHEREAS, the use of these areas for camping purposes can
constitute a public health and safety hazard which adversely
impacts commercial areas and neighborhoods; and
WHEREAS, the purpose of this chapter is to maintain streets,
parks and other public property and areas within the City of Wichita
in a clean, sanitary and accessible condition and to adequately
protect the health, safety and public welfare of the community,
while recognizing that, subject to reasonable conditions, camping
and camping activities associated with special events can be
beneficial to the cultural and educational climate in the city.
WHEREFORE, the city of Wichita enacts the ordinance codified in
Sections 5.20.010 through 5.20.070 prohibiting camping upon
public property within the city.
SECTION 2. Section 5.20.020 of the Code of the
City of Wichita, Kansas, is hereby created to read as follows:
“Unlawful Camping. It is unlawful and a public
nuisance for any person or persons to camp in or upon any public
property or public right of way, unless such person or persons have
been granted a temporary permit allowing such activity, or the
individual or individuals are deemed homeless and there are not
any appropriate shelters available for them as set forth in Section
5.XX.050 of this chapter.”

Housing First
Housing First is one of the few existing programs across the
United States with a retention rate greater than 80%. This means
that at least four (4) out of every five (5) clients taken into the
program remain in a stable living situation.
What does this mean for our community?
The annual taxpayer cost in Wichita is $54,000 for each
chronically homeless individual. These costs accrue from the use
of emergency room services, police, court, jail, fire, and
ambulance. Clients entering the Housing First Program typically
cease to use emergency and crisis services.
