Terms & Conditions for Boarding your Dog(s)
In this boarding agreement terms and conditions:
Property means 8 Billinghurst Road, Argyle Western Australia;
We/Us means Patrick Charles Butterly, Fiona Rae Butterly, Down South Boarding Kennels
and The Butterly Family Trust.
You/Your means the person acknowledging have read and agreed to these terms and
conditions via Down South Boarding Kennels website www.downsouthboarding
kennels.com.au or; signing a hard copy of this agreement.
Dog(s)/they means one or more of the Canis lupus familiaris that you leave in the care of
Down South Boarding Kennels.
C5 means the canine vaccination for parvovirus, distemper, canine infectious hepatitis,
bordetella and canine parainfluenza virus.
C3 means the canine vaccination for Parvovirus, Distemper and Canine infectious hepatitis.
KC means the canine vaccination for bordetella and canine parainfluenza virus.
Veterinarian means a veterinary surgeon registered with the Veterinary Surgeons Board of
Western Australia.
1. Down South Boarding Kennels reserve the right to refuse to board any dog that the
owners of Down South Boarding Kennels or their agents deem to be unsuitable for
kennelling at Down South Boarding Kennels. This right may be invoked at any time
prior to, on or after the date you drop off your dog(s) at Down South Boarding
Kennels. If this right is invoked, you are responsible for arranging the collection of
your dog(s) by the close of opening hours on the day you are notified.
2. All board rates are charged on a calendar day basis and the full period booked will be
charged. Refunds or credits for early holiday returns are at the discretion of the
operators of Down South Boarding Kennels. No refunds will be provided for peak
periods such as school holidays, public holiday periods and long weekends.
3. In order to confirm your booking, a deposit of $100 must be received by Down South
Boarding Kennels within 48hrs of us confirming via phone or email that we have
made a tentative booking to board your dog(s) for the dates requested by you. If a
$100 deposit is not received within this time frame, and we are unable to contact
you, Down South Boarding Kennels reserves the right to cancel your booking without
notice.
4. All boarding fees and associated charges quoted will be paid prior to or at the time
of your dog(s) arrival at Down South Boarding Kennels.
5. Your dog(s) must be dropped off and picked up within the advertised operating
hours of Down South Boarding Kennels. Any out of hour’s actions are at the
discretion Down South Boarding Kennels and may be charged for.
6. Your dog(s) must have a current C5 (or C3 + KC) vaccination certificate to sight on
arrival. Re-Vaccinate Date must not have expired. Any dog that has been given an
intranasal spray as part of this vaccination will not be accepted until 14 days have
passed since the administration of the intranasal spray. Failure to provide evidence
of vaccination record(s) on arrival will result in refusal to board your dog(s) at Down
South Boarding Kennels.
7. If your dog(s) were born on or after the 1st November 2013, or you became
responsible for your dog(s) on or after the 1st of November 2013, they must be
microchipped. By 1st November 2015, all dogs must be microchipped. Evidence of
your dog(s) microchip number where applicable is required on drop off.
8. If your dog(s) have fleas on arrival, they will be given a bath and appropriate flea
control medication, this will be charged for without notice.
9. If upon arrival your dog(s) are dirty and/or mattered to the point where it is causing
them obvious discomfort, we will take any and all action required to rectify this for
the comfort of the dog(s), including but not limited to a brush, bath and matt
removal, this will be charged for without notice.
10. If your dog(s) require veterinary attention whilst in the care of Down South Boarding
Kennels you shall be liable for all costs and out of pocket expenses related to the
dog(s) treatment and transport.
11. The selection of a veterinarian for treatment shall be at the discretion of Down South
Boarding Kennels. In the event of serious illness or accident where you cannot be
contacted, the veterinarians’ decision relating to the treatment of the dog(s) will be
final.
12. You agree to pay all costs and charges incurred during & relating to the dog(s) stay at
Down South Boarding Kennels (including any additional boarding fees, veterinary
expenses, special services requested & any other charges incurred). These charges
must be paid before the dog(s) leaves Down South Boarding Kennels.
13. If your dog(s) are not collected within 3 days of the departure date agreed upon
when your booking is confirmed by Down South Boarding Kennels, and with no word
from the you to make arrangements that are acceptable to us for the dog(s) to be
collected, the dog(s) become the property of Fiona Rae Butterly and Patrick Charles
Butterly and you give permission for us to re-home the dog(s) as we see fit.
14. All persons entering the Property do so at their own risk and all dogs boarding at the
Property do so at the risk of their respective owners. Except as required by law and
only to the extent so required, neither we nor any of our agents or employees shall
in any way be liable directly or indirectly to any person or body for any loss or
damage, cost or expense whatever including without limitation any personal injury
or the death of any person or dog in or on or near the Property. Every person who
enters the Property releases us and our agent and employees from all liability, loss,
cost or expense incurred in connection with damage to or loss of anything or injury
or death to any person or dog in or on or near the Property except to the extent that
we caused or contributed to this by our negligence.
