Outline
Filippo Lorenzon is a Professor of Maritime and Commercial Law at the University of
Southampton and the former Director of the Institute of Maritime Law (2010-2014). He
is also Visiting Professor at ECUPL in Shanghai and at the University of Cagliari (Italy)
as well as at several international training centres worldwide. He has a LL.D. (Triest,
Italy) and a LL.M. (Soton) and is fully qualified as an Avvocato in Italy and as a Solicitor
in England and Wales. Filippo is a Member of the ICC (UK) Committee on Transport
and Logistics, the Italian Maritime Law Association (AIDiM), the British Maritime Law
Association (BMLA), the European Maritime Law Organisation (EMLO) and the
International Bar Association (IBA). Filippo is a Consultant with Campbell Johnston
Clark Ltd. in London.
Until 2013, it was widely believed that the hire payment clause found in the NYPE form
was an innominate term, unable per se to allow termination in case of late payment. In
The Astra [2013] EWHC 865 (Comm), Flaux J concluded that a clause demanding
punctual payment of hire was a condition of the contract and therefore failure to
comply with it allows shipowners to terminate the charterparty. On 18 March 2015,
Popplewell J reached a different conclusion in Spar Shipping AS v. Grand China
Logistics Holding (Group) Co. Ltd [2015] EWHC 718; where timely payment of hire by
the charterers was held not to be a condition. Has Spar Shipping now restored the
