President’s Report
“…Not By Bread Alone”
I call your attention to the most
recent edition of the AFM International
Musician (March 2015). Don’t miss reading President Ray Hair’s article on new
symphonic and film agreements, AFM Vice-President of
Canada, Alan Willaert’s piece on YouTube, and RMA President,
Marc Sazer’s feature on film scoring in the US. All three have
to do with electronic media, its use, and ways to prevent exploitation of its use in various ways so deadly to our profession.
President Hair reports on newly achieved AFM successor agreements for symphonic media and films. They are the
Integrated Media Agreement (IMA), and the Motion Picture
and Television Film Agreement (Film Agreement). These agreements reaffirm the AFM’s supremacy regarding electronic
media, despite efforts of the industry to eliminate national media
standards, do away with upfront payment, and be granted
unlimited electronic media rights free.
I first brought the previous IMA to the Las Vegas Philharmonic when David Itkin was its music director, and even
more recently in 2014, to LVP, CEO, Jeri Crawford, and the LVP
Orchestra Committee, as it has many features, particularly
in regard to video recording which would benefit the orchestra.
The new IMA is even more user friendly, and would certainly
help the LVP. I will be getting copies of the new IMA to the
LVP and the LVP Orchestra Committee (OC) as soon as it’s
available. I’ve spoken with Debbie Newmark, AFM Director of
Symphonic Electronic Media, and she’ll be most happy via a
conference call, to walk LVP management and the OC through
the agreement. As the LVP is already signatory to the AFM
Audio-Visual Agreement (AV), signing the IMA will expand the
LVP’s electronic capabilities, and be perhaps helpful in its
promotional areas. The new IMA also prevents the commercial
encroachment of ICSOM and ROPA orchestras into each
other’s territories, especially when called upon to backup nonclassical vocal artists.
has several pending actions against it for copyright infringement. There is no end in sight, as Google (which owns
YouTube), has launched another website called Key Music,
through which it seeks to gain contractual control of the
Indies and further, distribution of their products.
RMA President Marc Sazer’s piece illuminates how
federal and state laws creating incentive policies could be a
boon to the music industry, not just in California or New York,
but for any state. It was most unfortunate that the tax break
provided to Tesla Motors for a soon to be Reno battery manufacturing plant, compromised certain tax breaks that would
have been given as incentives to develop more film production (including film music) in Las Vegas. Meanwhile, he
cites the Los Angeles Alliance for a New Economy (LAANE)
www.laane.org, a research and public policy organization
whose recent report, Keeping the Score, not only identified
the reasons for film scoring attrition away from the United
States, but more importantly, offered a brilliant solution to
address the issue.
I visited the LAANE website and perused several of its
articles on various subjects, not just the music industry. Its
identification of problems is unique, and its suggestions to
fix them are novel and fascinating. The site is really worth a
visit! Las Vegas could certainly use an organization like this.
Local 369 is regularly asked questions pertaining to audio
or video recording, and why it can’t be free, considered as part
of the payment for the live performance? The purchaser will
introduce all sorts of rationale, but none of it making sense
from our professional view. The challenge is that because
of the Internet, and things like YouTube, there is so much
expectation of getting music for free. It would probably take a
simultaneous mass rebellion by every professional musician
all over the world to convince both the public and the business
world that it’s wrong. What’s free for everybody else is economic
imprisonment for us!
In other words, while live performance may be the
bread and butter of our industry, we must never be compromised or deprived of its steak and lobster provided
by electronic media!
The last part of President Hair’s article looks into the Film
Musicians Secondary Markets Fund (FMSMF), and sheds
light on some deleterious, perhaps even nefarious practices
in that sector, reading like a detective mystery in film scoring;
don’t miss it! Curiously enough, heavy blame falls on the
film composers and their staff of musicians in regard to abuse
of the FMSMF.
Canadian Vice President, Alan Willaert’s article focuses
on YouTube [but there are other websites too], citing the
miniscule revenues delivered to “Indie” artists who are lured
by the hopes of instant fame via YouTube exposure. Also,
some major artists have received mere pittances from Pandora,
like Bon Jovi, who received 6.5 million “hits” in three months
for “Livin’ on a Prayer,” ending up splitting $110 with his two
co-writers for a total of $36 a piece. Let’s not forget Taylor
Swift leading the charge away from Spotify. YouTube also

F.Y.I. – TWO UPDATES
Greetings members,
Ground breaking times.
2015 begins with three major productions breaking ground here in our
Local’s jurisdiction requesting Local
369 musicians. Showstoppers, Frank
the Man and His Music featuring Bob Anderson, and Duck
Commander.
Please actively and continuously support shows that employ
our members.
Frank the Man and His Music at the Palazzo, Showstoppers
at the Wynn, Jersey Boys at Paris, Million Dollar Quartet at
Harrahs,
Duck Commander the musical stage show opening at the Rio
under a Local 369 AFM CBA, the Las Vegas Philharmonic,
and most of the Broadway touring productions that come
through the Smith Center. Most productions offer discounts
for Locals. Purchasing a ticket is the greatest show of support
we can extend to our fellow performers.
The 21st Century eBay mentality for live music?
United, we are strong and effective. Divided, we are in the
race to the bottom.
To bargain within our ranks instead of bargaining with
employers is a path to unsustainable lower wages.
Our collective challenge is to amicably achieve a working
relationship with those who wish to hire us, while at the same
time at least maintaining our standards, if not raising them.
This challenge extends to the music community at large. The
Union representing professional wages for professional work,
is a fundamental concept worthy of instilling in music students,
and also our non-union collogues. DC al Coda. (Thus united,
our minimum standards are a bargain for the employer.)
Once again, I’m pleased to report to
the membership that the filling of the
vacancies on Local 369’s Executive
Board went smoothly and in strict
compliance with our bylaws.
There were seven candidates for two positions, plus
three additional applicants who did not meet the eligibility
requirements.
Each board member spoke about the various candidates,
which was followed by a secret ballot vote. The two who
were elected received an equal majority of the votes cast.
They were Eric Tewalt and Greg Van Boven. Welcome aboard
Eric and Greg!
The other important event is the exchange of formal letters
between the Union and the Las Vegas Philharmonic concerning the desire to set a time to commence negotiations for a
successor Collective Bargaining Agreement.
The Players Committee (Orchestra Committee) will survey
the members of the orchestra in order to obtain their thoughts
on a new contract.
It is anticipated that formal negotiations will start sometime
in early April.
I am looking forward to a productive outcome.

Coda: It is of the utmost importance that each of us hold close
at heart and ready on our lips, the amount of time we’ve
invested in order to become professional musicians; the
years of practicing, the amount of $$$$ spent for fine professional instruments and gear, and the ongoing investments
of the aforementioned. Music is a second language; the
musician is bilingual; the reading musician is tri-lingual; and
the sight-reading musician is an expert tri-linguist, notwithstanding playing multiple instruments! Continue practicing
as to perform at the highest level and resolutely understand
you are a premium musician, deserving at least the area
standard determined by your peers, Local 369 Professional
Musicians Union.

Tris Beezley is a 10-year veteran
drummer & vocalist for the all-girl, awardwinning classic rock cover band, The
UnderCoverGirls, based in Los Angeles.
She is also a session and orchestra
drummer & percussionist, most recently playing in “The Mystery
of Edwin Drood”, and “1940's Radio Hour”, both with the Actor’s
Co-Op in Hollywood, CA. Tris is also a cast member on VH1’s
series, “Rock and Roll Fantasy Camp", where she had the honor of
performing with Paul Stanley and Sammy Hagar, among many other
rock legends. Tris is a jazz and orchestra drummer at heart,
influenced by Buddy Rich and Gene Krupa. She is a brand new
resident of Vegas and is excited to be a member of the Local 369

ANDREW BOOSTROM
TROMBONE/VOCALS
Andrew began his collegiate studies with
the great studio trombonist, Jim Pugh, at
the University of Illinois. He would receive
his BFA in Jazz Studies and go on to
travel the world visiting every continent
playing trombone. After working extensively with Norwegian & Princess Cruise
Lines, Andrew would spend time freelancing in St Louis, MO. He
formed his own original soul music band, Soul Boost, as singer and
songwriter. For the last 3+ years, he was the trombonist and
Assistant Conductor for the Ringling Brothers Barnum & Bailey
Circus.
ALAN CATES

Alan Cates is a bass and tenor trombone
player originally from Southern California,
who majored in trombone performance
at the California State University at Long
Beach and also at California State
University at Fullerton. Alan studied with
Bob Sanders, as well as with Carl Posch
and Greg Woll.
SAMANTHA CIARLO
VIOLIN
Samantha Ciarlo was born and raised in
Las Vegas, NV. She studied under the
tutelage of Shakeh Ghoukasian, through
Nevada School of the Arts Suzuki training.
Among competing through local competitions and being a part of orchestras,
Samantha became a Liberace Scholar
at UNLV. She is currently studying under Wei-Wei Le, and performs
with local stars like Frankie Moreno.
MARLANE COKER
PIANO/VOCALS
Jazz pianist and vocalist Marlane Coker
originally hails from Los Angeles where
she joined Local 47 at age 16. She has
brought her sound to audiences the
world over and began touring with bands
when she was a mere eighteen years
old in America and overseas. She is also
very active with a number of jazz ensembles in the Las Vegas area
and has composed a number of original jazz and blues tunes.
MARK CORBIN

COMEDY
Mark Corbin was born in Reno, Nevada
in September 1987. He began playing
the drums at the age of 12. Mark currently
lives in Las Vegas, NV where he has been
an in-demand performer for many shows
and acts throughout the city. Mark has
performed with many world renowned artists including Joe Lano,
Gary Stockdale, Thomas Warrington, Dave Loeb, Lon Bronson,
Bobby Shew, Vincent Falcone and Kurt Rasmussen among many
others. Mark has a Bachelors Degree in Jazz performance from
the University of Nevada-Las Vegas. Mark released his first album
titled "On The Way Home" in October 2011. In 2012 he performed
on the soundtrack to the film "Two Hundred Thousand Dirty"
which was an official selection for the Rome and Manhattan film
festivals (among others). He is currently performing on The Rat
Pack is Back Show at the Rio in Las Vegas, NV.

BRENDA COWART
PIANO/VOCALS
Brenda is an experienced pianist/keyboardist/vocalist with an extensive background performing diverse musical styles.
She has studied under some of the most
respected artists and educators in the
country including Mike Montano, Frank
Leone, Al Semola, Tom Ferguson and
Don Hannah. While earning a BA in music theory composition at
UNLV Brenda was the principal pianist for the world renown UNLV
Jazz Ensemble under the direction of Frank Gagliardi and performed
with some of the top jazz musicians in the world, including Carl
Fontana, Don Menza, Marlena Shaw and late blues legend Joe
Williams. She also holds a Juris Doctorate from California Western
School of Law.
Brenda's professional career has been rich and varied. Her ability to
play and sing a wide variety of music led to work with entertainers
Susan Anton and Gordie Brown as well as classic Las Vegas
shows "City Lites," "Folies Bergere" and "Lido de Paris" and more
recently ground-breaking street-style show, "MADhattan," and
the controversial "History of Sex," an off-Broadway style musical.
As a featured singer and keyboardist for Sunset Strip, a high
energy show-band produced by industry veteran Glenn Medas
and directed by Emmy award winner Michael Chambers, Brenda,
along with the group, had the honor of being the opening act for
Barry Manilow's "Music and Passion" tour.

While working with the award winning contemporary jazz band
Steven Lee Group at the Bellagio Hotel, Brenda shared the stage
with international smooth jazz artists Boney James, Johnathan
Butler and Richard Elliot. She also co-produced and co-wrote
much of the material on Steven Lee Group's critically acclaimed
debut CD, "From the Ground Up."
For the last 6 years, Brenda has been the Assistant MD/keyboardist
for Cirque du Soleil's cabaret style production "Zumanity" where
her duties included not only performing on keyboards/piano and
running the show, but writing charts and executing computer
generated music clips using Ableton as well.
Currently, Brenda is working with a talented cast of 35 singers and
dancers performing Broadway's greatest musical hits and backed by
30-plus piece orchestra in spectacular "Steve Wynn's Showstoppers."

Rebecca Gray has served as principle
cellist of several universities, and
assistant principle of the Texas Music
Festival orchestra.
As a dedicated teacher, Ms. Gray
currently teaches at Cannon Junior
High School and maintains a private studio.
Ms. Gray is a graduate of UNLV, with a Master’s in cello
Performance. She has studied with cellists such as Andrew
Smith, Robert Tueller, and Hamilton Cheifetz.

John Pollock is a native to the Las Vegas
Valley. He started playing the Viola when
was 10 years old and has studied with
Carlene San-Filippo, Beverly Bias, Matt
Johnson, Tianna Harjo, and Helen Callus.
He attended the Las Vegas Academy
and UNLV and while at UNLV he was a
member of the Liberace Scholars Quartet and was a two time
recipient of an Honors Jury. He is an active freelance musician,
teacher, and a member of numerous ensembles.

Mike Smith has been drumming professionally for about 10 years. Originally
from North Dakota, he obtained his BA
from the University of Mary, Bismarck,
ND. He moved to LV in 2011 to pursue
a graduate degree at UNLV and
graduated in 2014. While in LV, he has
subbed on “Legends in Concert” as well as “Vegas! The Show.”
JAMES A SPOTO

Jim is a graduate of the Eastern School
of Music. He has performed in large and
small ensembles, pit orchestras and
circus jobs during his college years.
After graduation, Jim toured the US with
various show bands. In 1988 he arrived in
Las Vegas and performed in all the major casinos with Smokey
Robinson, Frankie Valli, Jerry Lewis, Marie Osmond, Lorna Luft,
and numerous R&B artists. Jim toured Southeast Asia three
times as musical director of an international singer. He also
traveled to Japan many times with his duo and worked on cruise
ships as a featured artist. Currently, Jim performs in local country
clubs, casinos, and restaurants as a single, dueo, and a sa
member of various bands. He plays all of the saxes, flute,
clarinet, electric wind instrument and keyboards.

Tyler Swick, recipient of 2nd & 3rd place
in the 2013 Percussive Arts Society
Composition Contest, attended The Las
Vegas Academy where he premiered
his first arrangement for percussion
ensemble. While in high school, Swick
joined the Calypso Coyote Steel Drum Band, directed by Robert
Bonora, and began his pursuit of the steel pan. Swick premiered
multiple works before being accepted into the University of Kentucky
where he studied with Provost Distinguished Director, James B.
Campbell. Professor Campbell coached Swick in composition for
percussion ensemble and steel band, allowing Swick to premier
pieces with the UK Steel Band and recitals. After receiving his
Bachelors in Music Education, Swick proceeded to the University of
Iowa where he earned his Master’s Degree in percussion
performance under jazz vibraphonist, Dr Dan Moore. Swick has
been a featured pan soloist with the University of Kentucky Steel

Paul was born and raised in Toronto,
Canada and became a US citizen in
2003. Gained a lot of experience in
Canada playing with the Toronto
Symphony Orchestra, Edmonton
Symphony Orchestra, Rob McConnell
Boss Brass, Peter Appleyard Big Band,
Musical Director of CN Tower Toronto, and numerous jingles and
recording. Been very fortunate to work with an array of stars:
Maynard Ferguson, Woody Herman, Ella Fitzgerald, Mel Tormé,
Doc Severinson, Tony Bennett, Bob Hope, Vic Damone, Jack Jones,
Michel Legrand, Allan Jones, Eddie Fisher, Gene Krupa, Luci Arnaz,
Buddy Greco, Paul Anka, Florence Henderson, Four Freshmen, and
Marlene Dietrich to name a few. Played three years and recorded
three albums with the Stan Kenton Orchestra. Last year, did a two
month tour with the Glenn Miller Orchestra to New Zealand, Hawaii,
and Thailand. In Branson, lead trumpet for the Bobby Vinton show,
Lawrence Welk show, Les Brown and the Band of Renown. Andy
Williams as featured trumpet soloist for 10 years including world
tours. Stars with Andy’s show included Glen Campbell, Petula Clark,
Charo, and Ann Margret.
Teaching includes 10 years of high school, many adjudication of
jazz festivals including Missouri State University, Mid-Western,
Wichita, Canadian Stage Band Festival, and guest soloing with
University bands.
Looking forward to being part of the Las Vegas musical team.
SARAH WALTON

A native of Gainesville, Georgia, Sarah
Walton received her Bachelor of Music
in horn performance from the University
of Alabama, with additional studies in
music education at Columbus (GA) State
University. Sarah is currently pursuing her
Master of Music degree at the University
Sarah has performed with the Northwinds Symphonic Band (GA),
Gainesville Symphony Orchestra (GA), Gadsden Symphony
Orchestra (AL), Henderson Symphony Orchestra, and the Las
Vegas Philharmonic. In 2010, she had the privilege of performing
in Oxford, England, where she also sang with the Christ Church
Cathedral Singers. Most recently she held the horn position for
the Utah Shakespeare Festival.
Sarah has had the opportunity of sharing the stage with notable
artists including Phil Smith, Charlie Vernon, Joseph Alessi, David
Bilger, Robert Sullivan, Peter Nero, and Kansas. Her primary
teachers include Kristen Hansen, John McGuire, Lauren Varley,
Charles “Skip” Snead, and Bill Bernatis.

Hello. I’ve played drums for not quite 20
years, and in that time I’ve been to
Manhattan School of Music, California
Institute of the Arts, and UNLV. More
importantly, from all genre's of jazz, to
pop, to musical theatre, to contemporary
classical. I’ve logged enough hours that my primary goal is to make
the musicians good as it can possibly be. I look forward to meeting

Chang Yue earned a degree in Cello
Performance from UNLV, with the
honor of summa cum laude. Under the
mentoring of Andrew Smith, Mr. Yue
made his solo appearance with UNLV
chamber orchestra playing Haydn Cello
Concerto in D major under Maestro
Alexander Treger. Mr. Yue is a active student over the summer,
attending many music festivals in Italy, Spain, Luxembourg, and
New York; which he performed on the prestigious Merkin Hall.
Mr. Yue also works very closely with American Cellist Daniel
Gaisford in Utah.
Chang has appeared in masterclasses with Mischa Maisky, Matt
Haimovitz, Alexander Rudin, Vagram Saradjian, and Zuill Bailey.
In the fall of 2015 Chang will start his master degree with full
scholarship at Cal State Fullerton under Professor Bongshin Ko.

HOW TO BECOME ELIGIBLE
Getting my benefits: When you start working, you have to work a minimum of 360 hrs in the first
three months (about 30 hrs per week) to become eligible.
If you meet the 360 hrs during those three months then there will be a waiting period of one month
and you will have coverage on the first day of the following month.
Example: If you start work in January, you will have to work at least 360 hrs in January, February
and March. Then April will be the waiting month and your coverage
will begin the first of May.
Please also refer to the table on the right.
HOW TO KEEP THE ELIGIBILITY
Once you get coverage, you have to work a minimum of 240 hrs
every two months to keep your benefits. That’s about 30 hrs per week
WHAT HAPPENS IF I DON’T WORK THE MINIMUM HRS?
Self-Pay: If you don’t work the 240 hrs that are required in the two month period, you can pay the
Culinary Health Fund for the hrs that you are short.
Example: If you only worked 220 hrs during the two month period, you are short by 20 hrs. You can
pay the Culinary Health Fund for the 20 hrs you are short to keep your benefits.
How will I know that I am short in hrs?
You will get a notice in the mail for the Self-Pay. It has to be paid before the due date to keep your coverage*. (See the chart above)

The following is to remind you of your rights and responsibilities.
BUSINESS POLICY NO. 15;
ADOPTED JUNE 19, 2013; REV. SEPT. 11, 2014
“FAIR-WEATHER MEMBER” RE-AFFILIATION
Definition & Procedure: 1) A “Fair-Weather Member” is a former
AFM member seeking re-affiliation in order to reap the benefits of
Union membership after having resigned in good standing to avoid
the financial obligations incumbent on membership. 2) Local 369’s
Executive Board on a case-by-case basis shall consider the merits
of the application for re-affiliation. This opportunity shall be afforded
only once per individual.
NOTE: AFM Bylaw No 11, Section 2 (a) i, mandates that review,
determination, and adjudication for EMS violations falls under the
purview of the AFM, International Executive Board, not the Local.
WEINGARTEN RIGHTS:
This is something very few working people are aware of. Simply
put, should anyone in a supervisory capacity (Leader, Contractor,
Conductor, Personnel Manager, Etc.) engage an employee in
conversation which the employee believes could result in some
form of disciplinary action, the employee has the right to demand
the presence of a union representative and refuse to continue the
conversation until the request is complied with.
If granted, the individual shall pay membership dues for one full
year (four quarters), plus any quarterly third(s), and any applicable
AFM (FIF) and/or Local 369 (LIF) initiation fee(s).
MEMBERS’ RESPONSIBILITIES:
Members are reminded that, in accordance with Article 8, Section
3 of the AFM Bylaws “Members shall not render musical services
for organizations, establishments, or people who have been placed
on the International Unfair List. Any member who violates this
Section shall be subject to penalties in accordance with Article 11,
Section 13 [of the AFM Bylaws].”
BUSINESS POLICY NO. 2: ADOPTED APRIL 14, 2004
FIRST CALL TO LOCAL MEMBERS
The Executive Board believes that on all engagements contracted
within the jurisdiction of this local, first opportunity for employment
should be offered to members of Local 369.
In addition, according to Article 13, Section 4 of the AFM Bylaws,
“Before accepting any Traveling Engagement, members shall be
responsible to ascertain that the organization, establishment, or
person for whom they propose to render musical services has
not been placed on the International Unfair List.
Should any leader/contractor (including those of other locales)
believe that no local member is available who can meet the specific
musical requirements of a particular engagement, the board feels it
is in the best interest of the membership to call the local to make
certain that no member has inadvertently been overlooked.
EXECUTIVE BOARD MEETING—OBSERVER PROTOCOL:
In accordance with the Bylaws of Local 369, AFM, and Robert’s
Rules of Order, any member wishing to address the Executive
Board, must make an appointment in advance in order to be
placed on the agenda. This shall be done either by phone, letter,
or by email, stating the subject of the appointment. When recognized
by the Chair at the meeting, the member is strictly limited to the
subject of the appointment. Unless having said appointment, per
protocol, observers will not be recognized to participate.
Furthermore, it is morally and ethically incumbent upon all AFM
members, whether contractors, leaders, or musicians seeking
substitutes, to utilize only AFM members.
ARTICLE III, E — WORK DUES:
Except for services otherwise expressly specified in the Bylaws
of the Federation as requiring the payment of Work Dues directly
to the Federation, and/or establishing different rates, every
member shall be required to pay work dues of four percent (4%)
based on earnings to the Local. Said dues shall include the
amount due the AFM (Federation Work Dues) on all musical
services that the member renders within the geographical jurisdiction
of the Local. (See Article I-C) Work Dues shall be due and payable
not later than the 15th day of the month following the month in which
the member received payment for the service(s). Four percent
(4%) Work Dues shall be payable on any service, of any nature
or source, under any contract (or absent the same), and without
regard to the AFM status of any other Musician(s) with whom or
for whom the member is performing. Termination of membership
shall not affect in any way the obligation to pay Work Dues on
services performed while a member. Work Dues for electronic media
employment shall be payable at the rate set forth by the AFM of
applicable AFM Electronic Media scales, currently four and one-half
percent (4.5%).
RIGHT TO WORK:
The fact that Nevada is a “Right to Work" state is relevant to
issues of collective bargaining and in no way gives a union
member license to circumvent their obligations to uphold the
Bylaws of Local 369.
ELECTRONIC MEDIA:
Providing service for Electronic Media without an AFM EM contract
filed in advance is a gross violation, subject to charges. The signing
of waivers, release forms, “buyouts," or other compensatory
agreements involving EM is strictly forbidden by the AFM. Decline
any of the foregoing, and call a union officer immediately!

SUSPENDED MEMBERSHIP:
A member who has not paid membership dues and assessments
for the current Quarter shall be suspended subject to the requirement of Art. 9, Sec. 25 of the AFM Bylaws that state: “A member
may not be suspended until at least 30 days after the first day of
the period for which the dues would be paid.” A Suspended
member shall not be in good standing and shall forfeit all rights,
privileges, and benefits of membership in the Local, but shall
continue to be responsible for the obligations of membership
during such suspension. Upon payment of all accrued dues and
other financial obligations to the Local, plus the Reinstatement
Fee set forth in Article III-F, and complying with all lawful orders
of the Board, a suspended Member shall be reinstated to full
membership.
RESIGNATION AND REINSTATEMENT:
A member may resign in good standing upon submitting a written
letter of resignation, and paying any financial obligations to the
Local as of the date of resignation. A former member who has
resigned, and who applies for readmission one year or less from
the date of his/her resignation, and who has not in the
interim been engaged in the profession of music to the
detriment of the AFM (or any Local thereof), may be reinstated
upon payment of the current Quarterly dues, plus the
Reinstatement Fee set forth in Article III-F). A former Life Member
so reinstated, shall be restored to Life Membership. A former
member who has resigned, and who applies for readmission after
one year from the date of resignation, and who has not in the
interim been engaged in the profession of music to the detriment of
the AFM, or any Local thereof, may be readmitted to membership
by the payment of the current Initiation Fee(s). A former member
having resigned in good standing, shall have the status of a new
member excepting that Federation Initiation Fees will be waived.

Saturday, November 21, 2015 ~ General Election
(Both the Nomination Meeting & Election will be held at Union Headquarters.)
November of each odd numbered year means it is election
time once again at Local 369. If you qualify under Section G
and would like to become more involved in the direction your
Union pursues in the entertainment marketplace, please
consider exercising your right and privilege as not only a
voter, but perhaps as a candidate as well.

Article VII
General Elections
A. Time of Elections: A General Election of all Officers and an
additional *Delegate(s) and alternates to the AFM International
Convention shall be held on the third Saturday in November of each
odd-numbered year. The polls shall be open from 8:00 a.m. to
8:00 p.m. at a location designated by the Executive Board. The
Secretary/Treasurer shall give due notice to the membership of
the time and place of the election. * Note: Provided meeting AFM
membership requirements entitling an additional Delegate(s)
to the AFM International Convention; these are not “offices.” [See
Article 1-E]
B. Notice: The Secretary/Treasurer shall publish a notice of the
nominating and voting procedures in each issue of the Desert Aria
during each election year up to the final issue prior to the date of
the election. In accordance with *DOL (US Department of Labor)
regulations, all election notices must be sent utilizing USPS (regular
mail). Therefore in order to comply with Federal Law, any requests
for notices to be sent via email or otherwise cannot be honored.
Summarily, in an election year, the Desert Aria shall also be mailed
to those who have chosen to receive it by email only.
C. Nominations: Nominations shall take place from the floor at a
Special General Meeting called the “Nominations Meeting” (no
quorum required), on the third Saturday of September of each
Election year. At that meeting, any member in good standing may
nominate qualified members (as set forth in Article IV-B) who do
not have a conflict of interest (as defined in Article IV-E). Each
nomination shall require a second. No member may be a candidate
for more than one office, nor may any nominator place more than
one candidate in nomination for each position. The nominator may
speak on behalf of the candidacy of the nominee for a period of
not more than two minutes; and the candidate may also give an
acceptance speech of not more than two minutes.
D. Acceptance of Nomination: Each candidate must accept
nomination in person at the Nominations Meeting; unless any
prospective candidate unable to be present, shall have filed prior to
this meeting, a written statement of willingness to accept the sought
after nomination with the Secretary/Treasurer.
E. Committee Chair’s Selection: As its first act following its
appointment, the Election Committee shall elect its Chair.
F. Local’s Involvement: The Election Committee shall arrange
for a special Election Supplement to the Desert Aria, within which
each candidate shall have up to 125 words to make a campaign
statement confined to the candidate’s background and platform. In

addition, for campaign purposes, the Local shall provide at any
candidate at his/her request and cost (as calculated by the Board),
a set of mailing labels of all current members. Apart from these
items, no funds or property of the Local shall be used in any way
to assist individual candidates in their election efforts.
G. Examination of Eligibility: Immediately following the close
of the Nomination Meeting, the Chair of the Election Committee
shall obtain from the Secretary/Treasurer the names of all members
who have been nominated. The Committee shall investigate the
eligibility of each of these members, and shall present a written
statement regarding eligibility not later than the close of the first
business day subsequent to the Nomination Meeting. No member
shall be eligible to be a candidate who would be ineligible to hold
office on the day of Nomination Meeting—i.e., one who has (1) less
than two years of continuous membership in good standing immediately prior to that date, (2) a conviction for violating the Local
or AFM Bylaws during that time, (3) a conflict of interest as set forth
in Article IV-E of the Local’s Bylaws, in AFM Bylaws, or in labor law.
The foregoing eligibility requirements also apply to the time period
between the nomination meeting and the assumption of office.
H. Ineligibility: If any member who has been nominated is
declared ineligible, the Chair shall notify that party by *Certified
Mail—Return Receipt Requested of the Committee’s decision,
and not later than two business days after the Committee has
determined that a candidate is ineligible.
*Certified Mail-Return Receipt Requested. Certified or Registered
Mail Requirement. 1) The law recognizes as equal, all professional
forms of receipted delivery; i.e., FedEx, UPS, etc., and also personal
delivery, with any party of the address, resident or employee, signing
and dating a receipt reflecting the sender’s name, or by signing a
duplicate of the document(s) (reading unnecessary) as having been
received. Such signing is proof of receipt only, and not necessarily
any disposition as to the document’s contents, determination of its
intent , or having been read on the part of the signer, unless the
addressee. 2) There is legal precedent that receipted correspondence
to a last known address, when refused, avoided, or unclaimed, is
nevertheless considered by the court as if having been received.
I. Appeals: Any nominee the Committee determines to be ineligible
may appeal for a review of that decision by the Committee at its
next meeting. The Committee shall review the case carefully and
render a final decision based on all the facts. This decision shall be
final and binding, pending an appeal of the decision to the AFM as
provided in its Bylaws.
J. Ballot Preparation: At least two weeks prior to the election
date the Election Committee shall prepare an official Ballot containing
the legal names of all eligible candidates in alphabetical order by
last name. A candidate shall have the right to have a pseudonym or
professional name added in parentheses to the legal name. The
official ballot shall have consecutively numbered stubs at the top,
which shall either be perforated or shall have a cut-off line. The
Secretary/Treasurer shall arrange, under the guidance of the

Committee, the printing of the ballots and shall obtain other voting
materials necessary for the election.
K. Absentee Ballot Requests: Any member in good standing may
request an Absentee Ballot in writing (including email belonging to
the member), in person, by fax, or on such forms as the Local may
provide. There shall be no automatic mailings of Ballot Requests (or
Absentee Ballots themselves) to any members of the Local, either
resident or non-resident, nor shall the Local accept requests by
telephone. The Local shall not hand out blank Ballot Requests (or
Ballots themselves), either individually or in groups, to any Employer
(including Personnel Managers, Contractors, and Leaders). Only
the member who will be casting the actual vote can request an
Absentee Ballot.
L. Publication of Request: In the last regular issue prior to the
Election Supplement, the Desert Aria shall contain an Absentee
Ballot Request together with instructions clearly indicating that it
may be cut out or photocopied and mailed or faxed to the Local at
the voter’s expense. The instructions shall include a reminder that
any member requesting an absentee ballot shall not be permitted to
vote in person, including by presentation of an absentee ballot.
M. Absentee Ballot Mailing: No voter shall receive an Absentee
Ballot from the Local Office at the time the member signs an
Absentee Ballot Request in person. The Election Committee shall
instead, keep all Requests and mail all Absentee Ballots in one group
not earlier than ten days after the date the Post Office receives the
Election Supplement for mailing to the membership.
N. Post Office Box: The Election Committee shall secure its own
Post Office box for the exclusive purpose of receiving and retaining
all Absentee Ballots, which must be contained in the Post Office
box at the time of the Absentee Ballot Transfer (see “Q.” following).
The key or combination of said P.O. Box shall remain in the possession
of the U.S. Postal Service.
O. Absentee Ballot Return: The Committee shall enclose three
numbered envelopes with each Absentee Ballot: (#1); a Secret
Ballot Envelope, (#2); a Security Envelope, and (#3); a Return
Envelope. The Ballot Envelope shall have nothing on it except
the words #1, SECRET BALLOT. After completing the Absentee
Ballot, the voter shall place it and then seal it in the Secret Ballot
Envelope, and then—place the #1 Secret Ballot Envelope in the
#2 Security Envelope, which shall have two lines in the outer upper
left hand corner; one for the voter’s printed name and a second
for the voter’s signature. The voter shall place these envelopes
in the #3 Return Envelope [**As prepared] addressed to the
Election Committee at its own Post Office Box. The #3 Return
Envelope address and its Return Address shall be identical, with
a block in the upper right hand corner stating “First Class Postage
Required.” The Local is not obliged and therefore shall not provide
postage for the return. [**As prepared, the Absentee Ballot packet
shall include the voting Instruction Sheet and sample ballot as
provided in the Appendix, see page 34.]
P. Deadlines: The Local office must receive any request for an
Absentee Ballot not later than 15 days prior to the election unless a
member is ill, hospitalized, unexpectedly out of the jurisdiction, or
has properly applied for an absentee ballot and failed to receive
one. In these cases, the member may make an Absentee Ballot
Request directly to the Election Committee no later than five days
prior to the election date and vote by Absentee Ballot.
Q. Absentee Ballot Transfer: At 11:45 a.m. on the day following
the election, and not before, the Committee Chair plus at least two
other members of the Committee shall take all Absentee Ballots
from the Post Office and deliver them to the polling place. At the
polling place, the Committee shall void and set aside any Security
Envelope that does not have both the printed name and the voter’s

signature. It shall remove the remaining Ballots, still enclosed in
the Ballot Envelopes, from the Security Envelopes and place these
in a sealed Ballot Box until the counting of the Ballots. It shall place
the outer envelopes with the voided envelopes and preserve these
all as part of its official records.
R. Absentee Ballot Lists: The Committee Chair shall maintain a
list of members who have requested Absentee Ballots, and shall
check this list against the Absentee Ballots returned. The Committee
shall keep a list of the members to whom it has furnished Absentee
Ballots, and a copy of this list shall remain in the Committee’s
possession during the election. The Committee shall not allow any
member whose name appears on the list to cast a vote in person.

Article IV
Officers
A. Identification: The Officers of the Local shall be a President,
a Vice-President, a Secretary/Treasurer, and six Trustees, all of
whom shall be elected at a biennial General Election, or in the
event of a vacancy during a term of office, as per Article V-L. All
Officers shall perform the duties prescribed by these Bylaws and
Policies, and by the Parliamentary Authority, plus such other duties
as the Board may assign. The President, Vice-President, and
Secretary/Treasurer shall be known as the “Titled-Officers.” The
President and Secretary/Treasurer shall also be known as the
“Full-time Officers.” [Note: Also, see Article I-E Delegates]

Article I
Organization and Object
E. Delegates: The President and the Secretary/Treasurer (unless
also an AFM officer) shall by virtue of office, each be a Delegate to
the AFM International Convention. If meeting the current membership requirements of the AFM Bylaws (Rev. 09/15/2010) Article
17, Section 4(a), [subject hereafter to any AFM revisions of its
Bylaws], entitling additional *Delegate(s) and *Alternate(s) to the
AFM International Convention, the Delegate(s) shall be elected at
the Local’s biennial General Election regardless of AFM Convention
dates. For any other body, the President shall have the right to
be a delegate or otherwise represent the Local. The Board may
appoint any other *delegate(s) to which the Local is entitled. [*Note:
These are not “offices.”]

We are musicians who are dedicated to their art, those who take pride in their performance and
guarantee quality with a contract.
We are pooling our funds with other musicians to assist each other in marketing.
We support current collective bargaining agreements that ensure musicians are compensated for their
employment and contracted guaranteed rights.
We are helping to create new collective bargaining agreements that will give musicians a voice in their
work place and ensure fair treatment.
We encourage the general public to purchase live music where they will get quality at a fair price.
We help educate the general public on the value of live music in our community.
We stay connected to what is going on in the local music business.
We help to create more work opportunities for musicians at a fair price.
We strive to create an environment that encourages young musicians to develop their skills and become
professionals.

AFM LESTER PETRILLO FUND
Started in 1951 with a $10,000 personal contribution from then President James C. Petrillo in memory of his late son, the
Lester Petrillo Memorial Fund for Disabled Musicians is a charitable trust fund that provides financial aid to disabled
members. This fund is not intended to replace health insurance or provide general loans, but does supply modest
amounts of assistance to qualified applicants on an emergency basis.
The Trustees have complete discretion in determining eligibility and amount of the benefit, except that no benefits shall be
paid to or on behalf of a person who is not physically or mentally disabled (as that term is defined by the Trustees) and
who is not a member in good standing of the AFM.
Locals are asked to forward applications, Local recommendations and supportive medical documentation to the Office of
the International Secretary-Treasurer for consideration. Members will receive only one benefit check in any calendar year.
However, Local Secretaries may submit applications for assistance on behalf of members in subsequent years if needed.
