It is verily a triumph of her karmic equanimity and poised positivity in the face of concerted campaigns. And it is a victory duly delivered in the court of law, which makes it all the more laudable. And politically speaking, this is the most sensational of all comebacks and all those who had written her political obituary have been proved hasty and wrong. On to the facts of the verdict. Justice C R Kumaraswamy, not only acquitted Jayalalithaa and three others in the case, but also specifically said in his order: ‘Litigation made by persons who advance the political gain and to settle the scores under the guise to fight a legal battle should not be entertained.’ Forget the sentence construction, the fact of the matter is Justice Kumaraswamy also felt that the case was foisted on her and others for political motive. It is a charge that Jayalalithaa has been making from day one. It now redounds to her credit that the High Court also felt that way. It is pertinent to note that the HC said there was no ‘acceptable evidence’ to point out that Jayalalithaa spent Rs 3 crore on her foster son’s wedding. ‘Just because Accused No.1 was Chief Minister at that time, we cannot saddle all the marriage expenses on her part...Arriving at Rs.3,00,00,000/- towards marriage expenses and fixing liability of Rs.3,00,00,000/- to A-1 (Jayalalithaa) alone is not proper. It also removed ‘the exaggerated value of cost of construction’ from her income. ‘If we remove the exaggerated value of cost of construction and marriage expenses, the assets will work out at Rs. 37,59,02,466. The total income of the accused, firms and companies is Rs. 34,76,65,654. Lack of proportion amount is Rs. 2,82,36,812. The percentage of disproportionate assets is 8.12 per cent,’ Kumaraswamy said knocking the stuff out of the case against Jayalalithaa. In essence, the High Court concluded that the prosecution and trial court had erred by underestimating Jayalalithaa’s actual income and overestimating her expenditure on the marriage of her foster son and on property that was allegedly owned by others on a benami basis. After recalculating her income and expenditure, the HC concluded that the quantum of disproportionate assets in her possession amounted to only 8.12 per cent of her income, a figure below the 10 per cent threshold for conviction. Away from the legalities, Jayalalithaa has once again proved that people who write her off do so only at their own peril. Ever since the verdict of the trial court in September, she had maintained a stoic silence, Knowing her time will come, she removed herself from the scene with admirable phlegmatism. It was the proverbial grace under pressure. Now it has all paid dividends. Jayalalithaa has come out with her dignity intact and her political reputation enhanced. The US Geological Survey initially said the quake had a magnitude of 7.1 and struck 42 miles (68km) west of the town of Namche Bazaar, close to Mount Everest. The quake was upgraded to a magnitude of 7.4 minutes later. Shockwaves were felt as far away as Delhi, West Bengal and several parts of north India. The quake’s epicentre was close to Everest base camp, 83km (52 miles) east of Kathmandu, which was evacuated after an avalanche triggered by the 25 April quake killed 18 climbers. ‘The quake measured 7.4 on richter Chennai feels impact scale with epicentre somewhere in Nepal,’ an IMD official said. Immediately after the quake at around 12:35 pm, panic- stricken people were seen rushing out of buildings in Delhi. NT Bureau Chennai, May 12: Giving a clean chit to AIADMK general secretary Jayalalithaa, the Karnataka High Court on Monday held that the judgement and finding recorded by the trial court convicting her and three others suffers from infirmity and it is not sustainable in law. Acquitting Jayalalithaa and three others of ‘all the charges levelled against them’, the single bench judge Justice C R Kumaraswamy set aside the trial court’s conviction, allowing the criminal appeals filed by the four convicts. In his 916-page judgement, Justice Kumaraswamy also quashed the order of the trial court relating to confiscation of the properties both movable and immovable. ‘Taking into consideration overall circumstances and material placed on record, in my view, the judgement and finding recorded by the trial court suffers from infirmity and it is not sustainable in law,’ the judge said in a verdict that has paved the way for Jayalalithaa to return to Chief Ministership. On disproportionate assets, the judge held that ‘it is relatively small. In the instant case, the disproportionate asset is less than 10 per cent and it is within permissible limit.’ In his 916-page judgement, Justice Kumaraswamy also quashed the order of the trial court relating to confiscation of the properties both movable and immovable ‘Therefore, the accused are entitled to acquittal. When the principal accused (Jayalalithaa) has been acquitted, the other accused, who have played a lesser role, are also entitled to acquittal,’ the court said. The judge said it is a well-settled law that according to the Krishnanand Agnihotri case, when there is disproportionate asset to the extent of 10 per cent, the accused are entitled to acquittal. The margin of 10 to 20 per cent of the disproportionate assets has been taken as a permissible limit, taking into consideration the inflationary measures. ‘Since the value of apparels and slippers and others (of Jayalalithaa) were of ‘insignificant value’, I did not deduct this amount from the assets of DV & AC (Directorate of Vigilance and AntiCorruption,’ the judge said. He held that the prosecution has mixed up assets of accused, firms and companies. ‘If we remove the exaggerated value of cost of construction and marriage expenses, the assets will work out at Rs.37,59,02,466’. ‘In this case, the trial court has ignored the Income Tax proceedings as minimum evidentiary value. The trial court has not appreciated the evidence in a proper perspective,’ Justice Kumaraswamy said. He said though the trial court in its judgement mentioned that the accused availed loan by the Indian Bank, it has not considered the same as income. Therefore, the trial court has erred in not considering the loans as income. He said, ‘We have already seen a demand for them steadily increasing over the years. Less than a decade ago, we had less than a 1,000 students at our school. The last two years have seen over 5,000 to 6,000 students enrolled and graduating. This number is expected to double in the coming years.’ The institute recently received the National Skill Development Corporation’s recognition for its courses. ‘The Construction Workers’ Safety Act is being implemented very strictly now. We have seen our students constantly being placed in major construction companies because a construction site can no longer operate wiithout a qualified safety officer,’ Thomas said. And now, newly graduated safety officers earn salaries in excess of Rs 25,000 a month within a year at their jobs. Those who go abroad earn even more. ‘This may not sound very high, atleast for those who work in India. But considering the profile of the students, it is substantial,’ Thomas said. The courses offered by TUV Rheinland NIFE span across Fire Safety and Lift Technology, which run for a year, and Fibre Optics and Inventory and Stores, which run for four months. The eligibility for both courses is just a Class 10 pass certificate as per NSDC rules. The fee is Rs 80,000 for Fire Safety and Lift Technology and Rs 40,000, for the other two. She has been responsible for taking up multiple challenging assignments for India and several other countries. ‘I shall strive towards making AMCHAM a more credible voice for American business in India’, Narayanan said. Uninor CFO steps down New Delhi, May 12 (PTI): Uninor’s chief financial officer Vivek Anand has resigned, about a year after joining the company. Anand had joined Uninor in May 2014 after its then CFO Prasoon Sinha was elevated to handle Group Finance function at headquarters in Oslo. ‘Uninor’s chief financial officer Vivek Anand has decided to pursue his future aspirations outside of our company. Vivek has been instrumental in streamlining the finance deliveries for Uninor’, the company said in response to an e-mail query. Before joining Uninor, Anand was chief finance officer at Unilever Bangladesh. Last week, Norwegian telecom company Telenor’s Indian arm Uninor had posted an operating loss of about Rs 127 crore in the first quarter ended 31 March, 2015. PIO appointed SoftBank President Tokyo/New Delhi, May 12 (PTI): Indian-origin Nikesh Arora was on Monday appointed as president and COO of Japan’s SoftBank and may become the next CEO, as the telecom major expands its presence in overseas market including India. Arora will assume his new role on 19 June. Speaking at the company’s earnings conference, CEO Masayoshi Son said the former Google executive is a ‘strong candidate’ to lead the company in future, ‘He’s 10 years younger than me, and he has more abilities than me’, he said. ‘The last nine months I’ve spent with him have made me sure of that... Nikesh and I will lead SoftBank in its second stage’, he said. Son added that Arora’s experience and insight on the global Internet business model will help SoftBank grow further. Over the top trouble New Delhi, May 12 (PTI): Bringing over-the-top (OTT) players like WhatsApp and Skype under a licensing regime will result in ‘negative unforeseen consequences’ for technology start-ups and ecosystem, internet service providers have said. ‘The hasty imposition of an additional regulatory framework on internet in India, without full consideration of its implications for the Indian digital economy, is almost certain to result in negative unforeseen consequences for internet-based innovation and the still nascent internet startup ecosystem in India’, industry body IAMAI said in its counter-comments submitted to TRAI. Telecom Regulatory Authority of India (TRAI) on 27 March came out with a consultation paper on Net Neutrality with 24 April and 8 May as the last day for submission of comments and counter comments, respectively. The regulator received over 10 lakh comments from various telecom firms, associations and individuals. It received 42 counter-comments from industry lobbies including COAI, NASSCOM, IAMAI and operators including Vodafone, MTNL and RCOM apart from individuals. TRAI, which is examining the comments, is yet to give its final recommendations on the Net Neutrality. Moody’s optimistic on credit conditions New Delhi, May 12 (PTI): Rating agency Moody’s on Monday said credit conditions are likely to improve for rated Indian corporates over the next 12-18 months on the back of upturn in economic activities, government’s reform push and transmission of monetary easing. In a report, the global agency said that over the next 12 to 18 months, credit conditions are likely to improve forrated Indian corporates and infrastructure debt issuers in a number of pro-cyclical industries, such as industrials, transport infrastructure, metals and automotives. ‘These industries stand to benefit from an upturn in economic growth, gradual transmission of monetary easing, weaker commodity prices and the government’s pro-growth policy agenda’, it said. better quality of service’. It is almost like a time bomb ticking vigourously waiting to explode and create mayhem on the 22 yards. On Monday night at Hyderabad was one such night when Warner not just exploded but blew away the Kings XI Punjab bowlers to all parts of the ground. This, not before he played out the first over watchfully; the overs to follow were dealt with severity though. We have been so good at death bowling but it seems as though when we get close to dominating the opposition we finish off a lit bit slow. We have to work on the execution of death bowling. When you have 60 odd runs to play with in 18 balls you should be winning these games with atleast 15 to 20 runs to spare. But the bowlers were fantastic tonight. Credit has to go to Moises Henriques for the way he bowled. It was a great spell of bowling. Four overs for 16 runs and three wickets is a phenomenal effort on this pitch. But some batsmen you don’t want to bowl to as a bowler is David Miller at the end. His striking of the ball is fantastic. Q: You very much looked in the zone to get a century. Dejected to miss out on a well deserved ton? A: It is a bit frustrating. I try to bat as deep as I could there. There was a little bit of an error in my mind thinking that I could try and scoop it. It is just not my style of play and my game. That’s why I was frustrated. I should have just backed myself to hit straight. I got a well executed yorker but it was my fault I got out the way I did because I was trying something that I shouldn’t have done. Q: Leading run-scorer and consistent in the tournament, is captaincy one of the reasons behind it? A: Not really. I think I can play with the freedom that I do because me and Shikhar Dhawan have been getting off to a good start. Even though we lose quick wickets we still back our ability. That is our job; our job is to score runs and if it comes off it comes off. If not you can’t rely on that specific group of the top order. We all have to keep working together and at the moment the middle-order is coming off really well. They are playing fearless cricket and that is what we have asked for from them. Q: Next you face Royal Challengers Bangalore and then there is the AB factor. Do you think you almost pulled off an innings similar to his tonight? A: (Smiles) I am not in the same category as AB de Villiers. He is a guy that comes out and gets himself in and then all of a sudden he just switches from slow motion to the extreme rocket or something like that. Whatever he is eating, we want some of that. That’s the way he plays; it is fearless cricket. The thing is, he is able to do that because his top two are scoring the runs. It allows your middle order to play in when your top three are scoring runs. Q: Just to put you on a spot, if you had to pay to watch three players in international cricket, who would that be? A: I would pay to watch Mitchell Starc bowl, AB de Villiers bat and I would say David Miller if he is batting while chasing. Steyn yearns for another WC David Warner is all admiration for AB de Villiers, who he said played fearless cricket and was among the guys he would pay to watch Hyderabad: Dale Steyn has expressed willingness to play one more World Cup and suggested that he may not be available for South Africa’s full tour of Bangladesh in July. The South Africa pace bowler is aware that at 31, his career may wind up soon and he wants to save his best for all leading tournaments. ‘At this stage of my career, I’d rather be saving myself to go and participate in the major tournaments, rather than wasting the few balls I have left in my career in a Bangladesh match,’ Steyn told Wisden India in an interview. ‘I’d rather go to Bangladesh to help and support future South African bowlers, and use what is left of the 10,000 or 20,000 deliveries that I have in my body for the big tournament. That’s where I’m at personally. But at the beginning of my career, I would have done everything. I would have gone every tournament and to every place. But I’ve done it all now.’ Steyn admitted that as his career reaches its twilight, he might no longer be able to continue bowling with the same intensity throughout. Raghava has just delivered a hit with his latest Tamil directorial Kanchana 2. ‘I’m taking a break from direction. I’ll be acting in the remake of Pataas. Raghava Lawrencce ‘American Idol’ ending with season 15 The upcoming 15th season of popular singing talent hunt ‘American Idol’ will mark the end of the reality TV series. Fox announced that it had renewed the ageing singing competition, and the current judges roster of Jennifer Lopez, Keith Urban and Harry Connick, Jr will all return with it - as will long-running host Ryan Seacrest, said the Hollywood Reporter. The network did not mince words in its announcement of the renewal, confirming No 15 would be the last for the one-time behemoth and referring to it as a ‘season-long celebratory event.’ It’s been expected for some time that this renewal would be Idol’s last, as the show has seen both its ratings and relevance fade in an increasingly crowded landscape.
