What HR Managers Need to Know to Protect Employers from
I-9 Violations
Every employer in the U.S. is responsible for preparing and retaining I-9 Forms. The U.S. Department of
Homeland Security, Immigration and Customs Enforcement, continues to conduct I-9 Form audits. Employers
are required to maintain accurate I-9 Forms under IRCA (passed in 1986). ICE audits have resulted in significant fines against employers that have been found to be non-compliant. This presentation will allow HR Professionals to hear from several private attorneys that handle I-9 Form audits (and litigation) how they can
avoid employment verification (I-9) preparation and retention compliance issues. The presentation will include
updates OCAHO case updates and methods for dealing with the I-9 audit process and for potential methodologies for penalty reduction in the event of a Notice of Intent to Fine issued by ICE.
Presenters:
David H. Nachman, Esq. is one of the Managing Attorneys at the Nachman Phulwani Zimovcak (NPZ) Law
Group, P.C., a pre-eminent International Immigration and Nationality Law Firm dedicated to providing a wide
array of business and family immigration law services for skilled U.S.-and Canada-bound workers. Nachman
assists international businesses with L-1 intracompany transfers, I-9 Forms, DOL Wage & Hour Audits and
consular processing of immigrant and nonimmigrant visa applications throughout the world. Nachman is a
former Chair of the NJ Chapter of the American Immigration Lawyers Association (AILA). Nachman is widelypublished. He an Adjunct Professor of Paralegal Studies at FDU and at BCC. Nachman earned a JD from
CWRU in 1988 and an MBA 1989.
Felicia Zeidman, Esq., Barrister & Solicitor, Canada, is an Attorney with the U.S. and Canadian Divisions of
the NPZ Law Group. She has been a practicing lawyer for almost 13 years in addition to her articles
(apprenticeship) at the City of Toronto, Canada. Felicia Zeidman is admitted to practice in NY, NJ, and
Canada. She graduated from York University in Canada cum laude and Osgoode Hall Law School. She is a
member of the NY City Bar, AILA and the Law Society of Upper Canada (LSUC). She assists U.S. clients with
complex marriage applications and interviews; large corporate "L" and "H" applications; and criminal
entry/waivers. She assists clients with criminal records and other bars seeking to enter Canada, skilled-worker
clients, and family-based immigrants to Canada. Felicia Zeidman has a specialty in cross-border issues such
as health, criminal, and financial bars.
