This is an agreement between Pacific Link Housing Limited (ACN 074 394 648) (“Pacific Link”) of Level 1, Unit 1 153 Mann St Gosford NSW, and the borrower as described in the Schedule to this agreement. This is an agreement governing the terms of a loan from Pacific Link to the borrower for the purpose of funding the purchase by the borrower of a lap-top computer. 1. This agreement is a legally binding contract. 2. This agreement has been entered into by each party voluntarily and free from any threat, coercion or inducement. 3. The borrower agrees that in deciding whether or not to enter this agreement, they have not relied upon any representation (written or verbal) by Pacific Link (including its employees and agents) other than those contained in the advertising flyer attached to this agreement. 4. Pacific Link shall make available (through a nominated supplier as stated in the Schedule which forms part of this agreement) to the borrower a lap-top computer of the same or similar specifications as those contained in the advertising flyer attached to this agreement. The make and specifications of the lap-top may change due to availability or pricing constraints. 5. Pacific Link shall facilitate payment to a nominated supplier for one (1) lap top computer of the same or similar specifications as those contained in the advertising flyer attached to this agreement to the maximum loan value of the sum stated in the Schedule. 6. Should the borrower wish to apply the loan amount to a lap top of greater value to that specified then this is at the complete discretion of Pacific Link. 7. The borrower shall pay Pacific Link the minimum instalments as stated in the schedule until the loan is repaid in full. Payment shall be by direct debit from the borrower’s nominated account unless some other mode of payment is accepted by Pacific Link. The borrower shall sign all necessary documents to facilitate direct debit payments. Any fees incurred by Pacific Link due to any payment dishonour will be payable by the borrower and added to the loan amount. The first payment shall be due not later than 7 days after delivery. 8. No interest or other charges shall be payable on the loan however this will not affect Pacific Link’s right to sue for damages, interest, and costs should the borrower default on their obligations under this agreement. 9. The borrower may terminate this agreement by notice to Pacific Link in writing at any time prior to taking delivery of the lap-top. 10. Should for any reason Pacific Link deem (at its complete discretion) the purchase of the lap top unviable or it is unable to source a lap top to the same or similar specifications then it may terminate this agreement without being responsible for any loss incurred by the borrower. Should the borrower default on payment 2 consecutive times or a total of 4 times in any period Pacific Link may, by notice in writing, terminate this agreement whereupon the whole of the outstanding balance of the loan amount shall become due and payable within 7 days. 12. The borrower must be a current tenant of a property owned or managed by Pacific Link at all times during the loan term. Should the tenant vacate the property then the outstanding balance of the loan becomes due and payable in full in 30 days from the date of vacation. 13. The borrower shall attend upon the supplier as nominated by Pacific Link and the lap-top shall be purchased in the borrower’s name. 14. The borrower shall make all warranty or other claims with respect to the lap-top against the supplier. 15. The borrower forever releases Pacific Link (including its agents and employees) with respect to all liability, loss or damage the borrower may suffer in any way connected with the purchase or use of the lap top. 16. The borrower acknowledges that they have had an opportunity to investigate the proposed model and specifications of the lap top prior to purchase and that Pacific Link has made no representation as to the suitability or otherwise of the lap top for the borrower’s needs. 17. Should any part of this agreement be rendered void or voidable, that shall not affect the enforceability of any other part of this agreement. 18. The parties acknowledge that this agreement represents the entire agreement between them concerning the lap top. 19. The failure by Pacific Link to enforce any term of this agreement shall not operate as a waiver to enforce such term or terms at a later time. 20. By signing this agreement: a) The borrower is making an offer to Pacific Link to receive the loan; and b) This agreement is not binding until Pacific Link accepts the offer by signing this agreement; and c) The borrower acknowledges that they have read the agreement and are bound by its terms; d) The borrower has considered their individual circumstances and has satisfied themselves that they can meet the required repayments.
