The Borrower’s obligations under the Loan Agreement are secure by an agreement of pledge (mortgage) of certain real estate assets of the Borrower (the Mortgage Agreement). The Borrower fails to make due repayment under the Loan Agreement and bankruptcy proceedings are initiated against it.
