Inaugural symposium of the Société Française de Psychologie Juridique Paris Sud University– Jean Monnet Faculty– April 10, 2015 Argument There is a natural tendency to make a clear distinction between psychology and law, in the most comprehensive sense of these words. The links between these two fields, these two “worlds”, are far from obvious. Psychology concerns man, and his mental state, whether normal or pathological. This field is shared to varying degrees of harmony with clinical psychology, psychoanalysis, psychiatry, social psychology, neurosciences or even philosophy and linguistics. Law, on the other hand, focuses on the social domain, on society. Its aim is to regulate social interactions, the various relationships which take shape and unfold between subjects of law. This regulatory activity results, in particular, in the development of closer links with the normative, the powers in charge and, more fundamentally, with justice. To these first elements of distinction between psychology and law, we can further add different educational backgrounds, different trades, different habitus and at first glance, different interests and fields of research. Although they do not necessarily arise spontaneously, links do exist between psychology and law. Starting with the very object of both these fields: Man, analysed as much on an individual as on a social level. Further links can be established. For one, it is Law which frames the therapeutic activities of the psyche’s specialist, or in a different register, which is sometimes selected, along with justice, as a field of study for researchers in psychology. For another, the importance of psychology in the global economy of Law cannot be underestimated, whether it relates, for example, to a psychological element in the individuals concerned (willpower, consent, intent…), to carrying out of a psychological or psychiatric expertise, detecting a bias in a judge, or evaluating the psychological impact of law and justice on an individual. To these few reconciling factors between law and psychology can be further added some common interests and methods, or even epistemological pursuits, as well as professionals partaking in both specialties. The links between psychology and law have been, for some time, the object of well-deserved scientific attention. Essentially developed abroad, the study of these research papers has mostly made an impact on the medical and criminal areas (psychology and law, psycholegal studies, legal psychology, forensic psychology, criminology…). Further tracks remain to be explored: psyche’s law, psychological analysis of law, law and neurosciences, psycho-legal disorders, querulousness, therapeutic impact of law, psychological violence, psychosociological risks, legal thinking, normality, unconscious, subliminal, sadomasochism, parapsychology and zetetic (scientific doubting), mediation procedure, artificial intelligence, personal development... This symposium aims to grasp some of the existing links – or the ones that should be called into being – between psychology and law. It aspires to be a contribution to Psychology and Law studies, an emerging discipline, intending to investigate in a systematic manner the relationship between psychology and law, in their broadest sense.
