REBELLION BAY RUM® - “WIN A TRIP TO QUEENSTOWN” PROMOTION
TERMS AND CONDITIONS
1.
Information on how to enter and the prizes form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2.
Entry is only open to Australian residents aged 18 years or over who are
available to travel to Queenstown, New Zealand sometime in late September
or early October 2015, on an exact date to be determined by the Promoter. The
Promoter reserves the right to determine the exact dates of travel.
3.
Employees (and their immediate families) of the Promoter, Participating
Retailers and agencies associated with this promotion are ineligible to enter.
Immediate family means any of the following: spouse, ex-spouse, de-facto
spouse, child or step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,
step-brother, step-sister or 1st cousin.

Promotion commences on 7TH April 2015 and ends at close of business (for
purchases) and at 11:59pm AEDST (for entries) on 31/7/15 (“Promotional
Period”).

To be eligible to enter, individuals must purchase any one of the following
Rebellion Bay® products from a Participating Retailer during the Promotional
Period and retain their receipt as proof of purchase to be eligible
 Rebellion Bay Rum ABV 37.5% 700ml
 Rebellion Bay &Cola ABV 6% 4 pack x 375ml
(each referred to as an “Eligible Product”).
For the purposes of this promotion, a “Participating Retailer” will be any
retailer in Australia that is displaying advertising material about this promotion
during the Promotional Period

To enter, individuals must then:
(a) Visit the Rebellion Bay Facebook page at
www.facebook.com/rebellionbayspicedrum (“Facebook Page”);
(b) Complete the competition entry form on the Facebook Page with all
requested details, submit your best adventure selfie photo and tell us what
your dream adventure would be and include the hashtags #justadventure
and #rebellionbayspicedrum. Entry must be submitted by 11:59pm
AEDST on 31/7/15
The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and to
disqualify any entrant who submits an entry that is not in accordance with these
Terms and Conditions or who tampers with the entry process. Errors and
omissions may be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights.
8.
Incomplete or indecipherable entries will be deemed invalid.
9.
Multiple entries permitted, subject to the following: (a) only one entry permitted
per Eligible Product purchased; (b) each entry must be submitted separately
and in accordance with entry requirements; (c) unrecognised barcode numbers
will be deemed invalid; and (d) a maximum of two (2) entries per person per
day permitted.
For the sake of clarity, in the event that an individual purchases a Rebellion Bay
product that is a multi-pack, they will only be eligible to receive one (1) entry in
respect to that multi-pack (and not one (1) entry per each unit contained in the
multi-pack).

Entrants must retain their original purchase receipt(s) and their original Eligible
Product barcode(s) for all entries as proof of purchase. Failure to produce the
proof of purchase for all entries when requested may, in the absolute discretion
of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture
of any right to a prize. Purchase receipt(s) must clearly specify the store of
purchase, that an Eligible Product was purchased, and that the purchase was
made during the Promotional Period but prior to entry.
11.
If there is a dispute as to the identity of an entrant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the entrant.
12.
The Promoter will select the two best adventure selfie photos, with the hashtags
mentioned, as the winners of the competition by 3:00pm AEDST on 5/8/15. The
Promoter may select additional reserve entries and record them in order in case
an invalid entry or ineligible entrant is selected.
13.
Winners will be notified in writing and by telephone, and their names will be
published in The Australian on 7/8/15.
14.
The Promoter’s decision is final and no correspondence will be entered into.
15.
There are two prizes for this promotion nationally. Each prize is worth $8,000
each depending on the point of departure. Each of the two valid entries selected
as the winners will win a trip to Queenstown, New Zealand for two (2) adults.
Each prize includes:
 12 nights in New Zealand win share accommodation for two (2) adults
(exact hotel(s) to be determined by the Promoter);
 11 day Adventure Tour for two (2) adults (package to be determined by
the Promoter) including 4 days in Queenstown;
 1 x Rebellion Bay Rum ABV 37.5% 700ml
 Rebellion Bay prize pack comprising of 2 x Rebellion Bay trucker caps,

2 x Rebellion Bay USB’s, 2 x Rebellion Bay lanyards
 Return economy airfares for two (2) adults from the winner's nearest
capital city in Australia to Christchurch (New Zealand)
 $2,500 spending money (to share between both adults).
Additional spending money, travel insurance, transfers within New Zealand,
meals, transport to and from departure point, additional transfers, items of a
personal nature, in-room charges and all other ancillary costs are not included.
Prize must be taken on dates nominated by the Promoter. The Promoter will
endeavour to provide adequate advance notice of when the prize must be taken
but the Promoter’s nomination is final and binding. Any prizes that cannot be
taken on the date so nominated by the Promoter will be forfeited.
16.
Each winner and their companion must depart from and return to the same
departure point and travel together. Frequent flyer points will not form part of
the prize. Prize is subject to the standard terms and conditions of individual
prize and service providers. The winners may be required to present their credit
card at time of accommodation check in.
17.
As part of the Adventure Tour, the winners and their companion may elect to
undertake certain experiences in Queenstown that may be of a dangerous
nature (“Activities”). The winners and their companion acknowledge that if
they elect to engage in the Activities they do so at their own risk and that
undertaking such Activities may result in injury or death. The Promoter is in no
way liable for any loss, injury, expense, damage or other claim in relation to the
undertaking of the Activities and strongly recommends the winners and their
companion take out their own travel insurance and seek appropriate advice.
18.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged
consumers are advised to consider the safe drinking levels recommended in
the National Health & Medical Research Council Australian Alcohol Guidelines
that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm .
Entry and continued participation in this promotion is subject to the licensee’s
liquor serving policy.
21.
Subject to the unclaimed prize draw clause, if for any reason a winner does not
take a prize (or an element of the prize), then the prize (or that element of the
prize) will be forfeited.
22.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize
or cash to the equal value and/or specification, subject to any written directions
from a regulatory authority.
23.
Total estimated prize pool value in Australia $16,270
24.
Prizes, or any unused portion of a prize, are not transferable or exchangeable
and cannot be taken as cash.
25.
If a prize remains unclaimed by 19/8/2015, the Promoter retains the discretion

to select an alternative prize winner. Winners of the unclaimed prize will be
notified in writing and by telephone, and their names will be published in The
Australian on 21/8/2015.
26.
Entrants consent to the Promoter using their name, likeness, image and/or
voice in the event they are a winner (including photograph, film and/or recording
of the same) in any media for an unlimited period without remuneration for the
purpose of promoting this promotion (including any outcome), and promoting
any products manufactured, distributed and/or supplied by the Promoter.
27.
If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, including but not limited to technical difficulties,
unauthorised intervention or fraud, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify,
suspend, terminate or cancel the promotion, as appropriate.
28.
Any cost associated with accessing the Facebook Page is the entrant’s
responsibility and is dependent on the Internet service provider used.
29.
The use of any automated entry software or any other mechanical or electronic
means that allows an entrant to automatically enter repeatedly is prohibited and
will render all entries submitted by that entrant invalid.
30.
Nothing in these Terms and Conditions limits, excludes or modifies or purports
to limit, exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties
under the ASIC Act or similar consumer protection laws in the States and
Territories of Australia (“Non-Excludable Guarantees”).
31.
Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability (including
in negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any
way out of this promotion including but not limited to: (a) any technical
difficulties or equipment malfunction (whether or not under the Promoter’s
control); (b) any theft, unauthorised access or third party interference; (c) any
entry or prize claim that is late, lost, altered, damaged or misdirected (whether
or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in prize value to that stated
in these Terms and Conditions; (e) any tax liability incurred by a winner or
entrant; or (g) taking of and/or participation in the prize including but not limited
to undertaking the Activities.
32.
As a condition of accepting a prize, each winner (and their companion) must
sign any legal documentation (including but not limited to a Deed of Release)
as and in the form required by the Promoter and/or prize suppliers in their

absolute discretion reflecting the release referred to in these Terms and
Conditions.
33.
The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including
but not limited to agents, contractors, service providers, prize suppliers and, as
required, to Australian regulatory authorities. Entry is conditional on providing
this information. The Promoter may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or telephoning the
entrant to inform the entrant of the Promoter’s other publications, products,
services and events (including those of a related entity of the Promoter) and to
promote third party goods and services the entrant may be interested in. The
collection, use and disclosure of personal information provided in connection
with this competition is governed by the Promoter’s Privacy Statement found at
www.vok.com.au. Entrants should direct any request to opt out, access,
update or correct information to the Promoter. All entries become the property
of the Promoter
34.
Entry and continued participation in the promotion is dependent on entrants
following and acting in accordance with the Facebook Statement of Rights and
Responsibilities, which can be viewed at www.facebook.com/terms.php.
35.
This promotion is in no way sponsored, endorsed or administered by, or
associated with, Facebook. Entrants understand that they are providing their
information to the Promoter and not to Facebook. The information an entrant
provides will only be used for the purposes outlined in these Terms and
Conditions. Any questions, comments or complaints about this promotion must
be directed to the Promoter and not to Facebook. Facebook will not be liable
for any loss or damage or personal injury which is suffered or sustained by an
entrant, as a result of participating in the promotion (including taking/use of a
prize), except for any liability which cannot be excluded by law.
