TERMS AND CONDITIONS
Eligibility Criteria
1.
Information on how to enter the Win The Ultimate #ROCKSTARLIFE promotion
(Promotion) and prizes form part of these terms and conditions. Submission of entry
is deemed acceptance of these conditions of entry. Any entry which does not comply
with these terms and conditions is invalid.
2.

Entry into the Promotion is open to Australian residents, 16 years old or over
(Eligible Entrants). Eligible Entrants under 18 years old must have parental/guardian
approval to enter and further, the parent/guardian of the entrant must read and
consent to these Terms and Conditions. Parents/guardians of Eligible Entrants under
the age of 18 years old may be required by Frucor Beverages (Australia) Pty Ltd
(Promoter) to enter into a further agreement as evidence of consent to the minor
entering the Promotion.
4.
Employees of the Promoter, participating retailers and associated companies,
employees of any agencies associated with this Promotion and the immediate
families of any such employees are not eligible to enter.
Promotional Period
5.
The Promotion commences at 9:00am AEST on Monday 11th May 2015 and
concludes at 6:00pm AEST on Sunday 5th July 2015 (“Promotional Period”).
How To Enter
6.
This is a game of skill and chance plays no part in the determination of winners.
Each entry will be individually judged according to its merits on the basis of originality
and creativity as determined by the Promoter in its sole discretion.
7.
To be eligible to enter, individuals must during the Promotional Period purchase any
Rockstar product including:
-Rockstar Guava Punched
-Rockstar Original
-Rockstar Fruit Punch
-Rockstar Tropical Fruit Zero Sugar
-Rockstar XDurance Berry
-Rockstar Sours Bubbleberry, Blue Raspberry, Green Apple
-Rockstar Guava 4 x 500mL multi pack
-Rockstar Sparkling Peach Blast, Citrus Ice
from any participating retailer nationally (“Eligible Products”). For the purposes of
this promotion, a participating retailer will be any retailer displaying material
advertising this promotion during the Promotional Period.
8.
To enter: take a photograph of your ‘Rockstar can living the Rockstar Life’,
featuring the Rockstar can in the photo.

Entrants must then, during the Promotional Period, either:
(a)
upload the photograph to Facebook, Twitter and/or Instagram account(s)
accompanied by the hashtag: #ROCKSTARLIFE; & like or follow Rockstar Australia,
OR
(b)
visit www.rockstarlife.com.au and follow the prompts to enter the requested details
and upload the photograph.
10.
If a social media platform is used to enter, the entrant must ensure that settings on
their account and/or post featuring the photograph are configured such that the entry
photograph is publicly viewable and the entrant must follow or “like” the Rockstar
Australia account on the social media platform used.
11.
The Promoter is not responsible for failure to receive any entry for any cause beyond
its control. Incomplete, indecipherable, or illegible entries will be deemed invalid.
Any incorrect entrant details submitted may render the corresponding entry invalid.
12.
All entries are deemed received at the time of being submitted across all platforms.
Entries received after 6.00pm and before 9.00am AEST will count for judging at
9:01am the next day.
13.
Entrants may enter more than once, provided that a different photograph is
submitted separately and in accordance with the entry requirements.
14.
Entrants must retain their original purchase receipt(s) and original product
barcode(s) for all entries as proof of purchase. Failure to produce the proof of
purchase for all entries when requested may, in the absolute discretion of the
Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any
right to a prize. Purchase receipt(s) must clearly specify the store of purchase, that a
Rockstar product was purchased, and that the purchase was made during the
Promotional Period but prior to entry.
Daily Prizes
15.
The entry judged the best valid entry each day during the Promotional Period by the
Promoter will win a daily Prize. The judging panel will be comprised of two (2)
representatives of the Promoter.

Judging will take place at 61-63 Great Buckingham St, Redfern, Sydney, NSW 2016.
The winner will be the entrant who submits the “best photo upload of the day” as
assessed by the judging panel. The “best photo upload” is the photo that best
-3captures the #ROCKSTARLIFE branding for the purpose of this photographic
promotion.
18.
There will be 56 daily winners in total. Daily winners will be notified within two (2)
business days of judging by direct message on the social media platform used to
submit the winning entry or email/phone if entered via www.rockstarlife.com. The
direct message will ask the winner to provide their name, proof or purchase, mobile
phone number, address and email address to the Promoter within seven (7)
business days to claim their prize. If the winner is unable to produce proof of
purchase for their winning entry then they will forfeit any right to the prize.
19.
Daily prizes consist of the following 14x Rockstar long skate boards valued at
$299RRP, 16 x Rockstar surfboards valued at $799RRP, 16 x Rockstar BMX bikes
valued at $599RRP & 10 x Rockstar wake boards valued at $499RRP and will be
awarded as follows:

Major Prize
21.
The 56 daily winners judged “best photo upload that day” will be put forward for final
judging for the Major Prize component of the competition. The “top three (3) best
judged photo uploads” will win the Major Prize. Final judging will take place on 9th
July 2015 at 61-63 Great Buckingham St, Redfern, Sydney, NSW 2016
22.
Winners will be notified within two (2) business days of the judging date via direct
message on the social media platform used to submit the winning entry or via
email/phone if entered at www.rockstarlife.com.au
23.
All decisions made by the Promoter are final and no correspondence will be entered
into.
24.
All winning photos will be uploaded and the names of the daily prize and major prize
winners will be announced on the Rockstar Australia Facebook page by 16 July
2015. Only the winners may claim their allocated Prize.
25.
If for any Prize is unclaimed by a winner 30 days after a winner is announced on the
Rockstar Australia Facebook page, the Promoter will conduct a second round of
-4judging on 14 August 2015 and choose a second winner. The second round
winner(s) will be notified by the same process described above and announced on
the Rockstar Australia Facebook page on 28 August 2015.
26.
The top three (3) judged winning photo entrants of the Major Prize will win a trip for
four (4) people from the choice of the following holiday package options each valued
at up to $20,000:

Unless otherwise stated in these terms and conditions, all other costs including
meals, additional spending money, taxes (excluding airline and airport taxes),
insurance, passports, visas, vaccinations, transport to and from the departure point,
additional transfers, items of a personal nature, in-room charges, any costs or
charges consequential to the trip, and all other ancillary costs incurred by the winner
and his/her nominated traveling companions are the responsibility of winner and are
not included in the Prize.
28.
Winner/s who choose the New Zealand Heli-ski Experience prize trip are advised
that the ‘3 x mountain run heli-ski experience for 4’ is aimed at an intermediate level
run experience. If a winner or accompanying guests are novice skiers/snow boarders
they may not be able to participate in the heli-ski experience. Winner/s will be asked
at the time of booking their prize if they feel confident to take part in this prize
experience inclusion. Once the prize package is booked there will be no changes
permitted.
29.
The total Major Prize pool is valued at $60,000 (GST inclusive). Prize values are
correct at the time of printing but no responsibility is accepted for any variation in the
value of any part of the Major Prize.
30.
All travel is subject to availability at all times and maybe dependent on select seat
class with airlines or specific room category availability with accommodation
partner. Travel is valid until 30th July 2016. Blocked out periods include all Australian
school holidays and public holidays along with all other special event periods
including but not limited to Sydney Mardi Gras, Splendour in the Grass and Blues
and Roots Festival Byron Bay. Bookings must be made a minimum of 45 days in
advance of requested departure dates. All bookings and documentation regarding
the prize must be made via Free-2-Travel Holidays Pty Ltd or their
agents. Redeeming the prize is conditional on acceptance of the terms and
conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline
carriers in accordance with normal travel practices. No portion of the prize is
redeemable for cash. The prize is non refundable or transferable. If the winner is
under the age of 18 years at the time of the judging, the Prize will be awarded to the
winner's nominated parent or guardian on the winner’s behalf. If the winner of the
-6Prize or any of his or her guests is under the age of 18 years for any part of the
duration of the trip that forms the subject of the Prize, a nominated parent/guardian
must accompany that person for the duration of the trip. Winner is responsible for
any amendments fees issued by airlines or suppliers once booking confirmed and
ticketed. It is the winner’s responsibility to organise transport to/from the airport
departure/return point. Prize winner and travel companions must have valid travel
insurance for their period of travel.
31.
Winners who select the Gold Coast V8 Superstars Experience must travel on the
dates specified arriving 23 October 2015 – departing 27 October 2015. If the
winner/s are unable to travel on these dates they will forfeit this prize package.
32.
Once confirmed in writing, travel dates and names of those traveling are not
changeable.
33.
It is the responsibility of the winner and the winner’s guests to ensure that they each
have valid travel documentation. Any fines, penalties, payments or expenses
incurred as a result of travel documents not meeting the requirements, will be the
sole responsibility of the winner or the winner’s guests. International travel advice
can be obtained from various sources, including government and local consular
offices and the Australian Department of Foreign Affairs and Trade website at
www.dfat.gov.au.
34.
The winner and the winner’s guests must provide proof of identity.
35.
The winner and the winner’s guests must have a valid passport, which must be valid
for at least six (6) months from the date of departure if they have chosen the NZ Heliski Experience trip. The winner and the winner’s guests must depart from and return
to the same departure point in Australia and must travel together. The itinerary is to
be determined by the Promoter in its absolute discretion. Frequent flyer points will
not form part of the Prize. Winner may be required to present their credit card at the
time of check in to accommodation.
36.
Each the winner and his or her guests acknowledge that it is a condition of taking the
Major Prize that they must agree in writing, in a form determined by the Promoter in
its absolute discretion, to the use of his or her image and name for publicity
regarding the Promotion and in any advertising of the Rockstar product, without
additional compensation.
37.
The Promoter is not liable for any loss or damage, including indirect or consequential
loss or damage, or personal injury suffered during the course of accepting or using
the Prize, except for any liability that cannot be excluded by law.
38.
The winner and his or her guests will be required to sign a waiver of liability and
indemnity in favour of the Promoter in respect of the Major Prize, in the form
determined by the Promoter, in its absolute discretion.
General
39.
By submitting your photograph to the Promoter, you grant the Promoter a nonexclusive, irrevocable and royalty-free licence to exercise all rights in perpetuity
throughout the world of your photograph and all other material provided by you to the
Promoter pursuant to this Competition at any time. All entrant details will be held in
-7accordance with the Promoter’s privacy policy which can be viewed at the
Promoter’s website at www.frucor.com.au.
40.
The Promoter may refuse to allow a winner and/or any of the winner’s guests to take
part in any or all aspects of the Major Prize if the Promoter determines that the
winner or any of the winner’s guests are not in the mental or physical condition
necessary to be able to safely participate.
41.
The Promoter may engage third party providers to assist in completing fulfillment of
the Major Prize.
42.
The total Prize value is up to AU$66,544. Prizes, or any unused portion of a prize,
are not transferable or exchangeable and cannot be taken as cash, unless otherwise
specified. If the winner is unable to take the trip component of the Prize for any
reason, the winner forfeits the whole Prize.
43.
The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age, and place of residence) and to
disqualify any entrant from the Promotion who submits an entry that is not in
accordance with these Terms and Conditions or who tampers with the entry process.
Entries that contain errors or omissions may be accepted at the Promoter's
discretion. Photograph entries that, in the sol opinion of the Promoter, have been
digitally or otherwise altered or tampered with will be disqualified from the Promotion.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights.
44.
If any part of the Prize is unavailable despite the Promoter’s reasonable endeavours
to procure it, the Promoter may substitute a different Prize item of equal or greater
value.
45.
If the Promotion is not able to be run as planned, whether caused by computer virus,
line drop-out or congestion, tampering, unauthorised intervention, fraud, technical
failures or other cause beyond the control of the Promoter which affects the
administration, security, fairness or integrity of the Promotion, the Promoter reserves
the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify
any entrant; or (b) subject to any written directions from a regulatory authority, to
modify, suspend, terminate or cancel the promotion, as appropriate.
46.
The winner should look to the manufacturer of products awarded as prizes for all
warranties. However, these terms and conditions do not exclude or limit the
application of any statutory provision (including a provision of the Australian
Consumer Law) where to do so would contravene that statute or cause any part of
these Terms and Conditions to be void.
47.
The Promoter is not responsible for any problems or technical malfunction of any
telephone, telephone or computer network, or lines, servers, or telephone or internet
providers, traffic congestion on any phone or computer network, or any combination
thereof, including any injury or damage to participants or any other person's handset
or computer related to or resulting from participation or sending or
receiving of any communication or of any materials in this Promotion.
48.
Any cost associated with accessing the promotional websites are the entrant's
responsibility and are dependent on the Internet service provider used.

Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act 2010, or any other implied warranties under the
Australian Securities and Investments Commission Act or similar consumer
protection laws in the States and Territories of Australia (Non-Excludable
Guarantees). Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) excludes all liability (including negligence), for any personal
injury or any loss or damage (including loss of opportunity), whether direct, indirect,
special or consequential, arising in any way out of the Promotion, including, but not
limited to, those arising out of: any technical difficulties or equipment malfunction
(whether or not under the Promoter’s control); any theft, unauthorised access or third
party interference; any entry or prize claim that is late, lost, altered, damaged or
misdirected (whether or not after its receipt by the Promoter) for any reason beyond
the reasonable control of the Promoter; any variation in the value of the prizes as
stated in these Terms and Conditions; any cancellation or delay of the awarding of
any element of a prize that is beyond the reasonable control of the Promoter; any tax
liability incurred by a winner or entrant; or use of a prize.
50.
The Promoter and its associated agencies and companies are not liable for any loss
or damage whatsoever which is suffered by entrants into the Promotion, including
but not limited to indirect or consequential loss and any personal injury suffered or
sustained during the course of accepting or using any of the prizes, except for any
liability which cannot be excluded by law.
51.
Entry and continued participation in the promotion is dependent on entrants following
and acting in accordance with the Terms Of Use for each social platform, which can
be viewed at www.facebook.com/terms.php, https://help.instagram.com, &
https://support.twitter.com/articles/68877-guidelines-for-contests-on-twitter

This promotion is in no way sponsored, endorsed or administered by, or associated
with, Facebook, Twitter or Instagram. Entrants understand that they are providing
their information to the Promoter and not to Facebook, Twitter or Instagram. The
information an entrant provides will only be used for the purposes outlined in these
Terms and Conditions. Any questions, comments or complaints about this promotion
must be directed to the Promoter and not to Facebook, Twitter or Instagram.
Facebook, Twitter or Instagram will not be liable for any loss or damage or personal
injury which is suffered or sustained by an entrant, as a result of participating in the
promotion (including taking/use of a prize), except for any liability which cannot be
excluded by law.
53.
By entering the Promotion entrants are deemed to have accepted these Terms and
Conditions and to have expressly consented to the use of their personal information
for the purpose of the Privacy Act, Spam Act and other related privacy legislation.
Entrants acknowledge and agree that the Promoter may collect their personal
information in order to conduct the Promotion and may, for this purpose, disclose
such information to third parties, including but not limited to, agents, contractors,
service providers, prize suppliers and, as required, to Australian regulatory
authorities. Entry into the Promotion is conditional on providing this information. The
Promoter may, for an indefinite period, unless consent is withdrawn by the entrant,
use an entrant’s personal information for promotional, marketing, publicity, research
and profiling purposes, including sending electronic messages to or telephoning the
entrant. Entrants should direct any request to opt out, access, update or correct their
personal information to the Promoter. All entries into the Promotion become and
-9remain the property of the Promoter. Personal information will only be used in
