SAMPLE CONTRACT
CGtouring Group Contract
BETWEEN
TOUR GROUP LEADER
and
CGTOURING
1. Acceptance of the Contract
Upon acceptance the basic tour package, the terms and conditions set forth herein become a
binding contract between the tour group leader and CGtouring.
Purchaser represents by tender of payment that the itinerary has been reviewed and that it
meets Purchaser's expectations and request.
BASIC TOUR PACKAGE ITINERARY – ARRIVAL AND DEPARTURE
Groups will arrange travel to arrive at Zurich International Airport on SATURDAY JULY 16,
2016.
Groups will arrange travel to depart from Zurich International Airport on SUNDAY JULY 23,
2016.
CGTOURS WILL ADVISE ON TIMING OF TRAVEL RESERVATIONS AFTER JANUARY 1.
2016 to coordinate motor coach travel to and from the airport
2. Reservations and Payment
Acceptance of the initial contract occurs deposit of $300 per person is received by CG touring.
Payments must be submitted by check or electronic funds transfer.
Deposits and payments are due according to the schedule below. If this final installment is not
paid when due, CGtouring reserves the right to treat the reservation as canceled.
PAYMENT SCHEDULE
DEPOSIT - $300.00 per participant due before SEPTEMBER 15, 2015.
FIRST PAYMENT – due before FEBRUARY 15, 2016*
FINAL PAYMENT – due before MAY 15 2016*
*Payment amounts will be determined by activity choices, minus the deposit.
4. Participation and Activity Choices
The Tour Group Leader is responsible for selecting activities appropriate to group member's
health, physical abilities and interests.
CGtours will provide an activity planning guide and consultation on selection of activities.

CGtouring reserves the right to decline to accept or retain a person as a tour member for any
reason which affects the operation of the tour or the rights and welfare or enjoyment of the other
tour members.
5. Price of Tour Package
The final price of the tour package will be determined (including charges for planning, operation
and servicing the tour package) in consultation with the tour group leader. Prices do not
include airfare.
Prices are subject to change, due to fluctuations in tariffs, exchange rates and other factors
beyond CGtouring's control. If the group falls below the minimum participation requirement,
the trip is subject to cancellation or re-pricing.
CGtouring has no obligation to provide information concerning the costs utilized in establishing
the price of the tour package, either before, during or after the tour is completed.
Price does not include charges for passports, excess baggage charges, trip cancellation or
interruption, accident and baggage insurance, or transportation not included in the itinerary,
optional tours, items of a personal nature, items not specifically listed as included.
6. Cancellation Policy
Cancellations can only be made for the entire group, not for individual participants.
Refunds for group cancellations are made as follows:

5 months prior to arrival date
40% of deposit and payments.
4 months prior to arrival date
20% of deposit and payments.
Group cancellations within four months (120 days) prior to the date of arrival, refunds at the
discretion of CGtouring.
We strongly ENCOURAGE you to purchase trip CANCELLATION insurance soon after
registering for a trip. In the event that you must cancel your trip due to illness, family crisis or
other emergency, this insurance reimburses you for the non-refundable trip costs. This
insurance also provides for limited accident and baggage coverage.
7. Refunds
No refunds are given for any unused pre-paid services included in the tour package or any
changes made in the itinerary while on route.
8. Changes in Itinerary by CGtouring
CGtouring reserves the right to make changes or cancellations in services where such changes
are made necessary by circumstances beyond CGtouring's control or to cancel any group

reservation due to inadequate participation which makes the trip economically infeasible to
operate. In such cases, a full refund of the cancelled trip cost is the limit of CGtouring's liability.
9. Warranty Disclaimer
No guarantees or warranties express or implied, are made that the tour package will meet all of
the traveler's expectations.
10. Airfare Considerations
CGtouring cannot be responsible for any part the itinerary missed because of the cancellations
or delays of commercial airlines.
11. Release
CGtouring acts solely in the capacity as agents in all matters of transportation and activities, and
their liability is limited to the terms of transportation or activity providers.
Tour group leaders, and tour participants, individually and jointly, release CGtouring from any
and all liability and responsibility, known or unknown, present or future, for any and all loss,
injury to person, damage to property, or accident, or which may be the result of any delay or
change of itinerary, or irregularity connected with the tour package purchased, which is beyond
its control, included but not limited to, acts of God, transportation problems, fire, machinery or
equipment malfunction or failure, government actions, wars, civil disturbances, labor disputes,
riots, thefts, sickness or weather, and which includes all expenses or damages, direct or
consequential, claimed or sustained by tour group leaders, and tour participants, and waive
CGtouring based on any claim of negligence by any of the suppliers of services included in the
tour package.
Passenger tickets shall constitute the sole contract between and the purchaser of these tickets
and/or passenger. All baggage shall be carried at participants own risk.
This release is binding upon group organizers, tour participants, travelers, their representatives,
heirs and assigns.
12. Choice Of Law And Venue
All questions of law in any action based upon any claim of breach of this agreement shall be
determined in accordance with the laws of the State of Pennsylvania as existing at the time of
such action. Any action brought by either party based on any claim arising under or as a result of
this contract or based on the tour package of which it is a part, shall be brought in a court of
competent jurisdiction in Chester County, Pennsylvania.
13. Tour Group Leader Terms and Conditions
The Tour Group Leader is solely responsible for ;
All administrative tasks involved in assembling and representing a group of participants to
CGtouring, including;

Collecting and accounting for participant payments.

Issuing group payments (no individual payments will be accepted or accounted for by
CGtouring.). Payments may be in the form of institutional or personal checks, direct
transfer of funds (no credit card payments are accepted.)
Any and all approvals, permissions, or other documentation related to the group’s travel
arrangements and participation including;


Securing parental permission for any minor participants.
Medical clearance if required.
It is the tour group leaders responsibility to inform CGtouring of any dietary
requirements, medications, or medical conditions that may impact an individual’s
participation.


Passports or other travel documents required.
Any and all organizational approvals, permissions, documents, letters of introduction,
etc. if required.
The preparation of participants for and conduct during the tour including;




Observation of group institutional standards of behavior and comportment.
Monitoring the health and fitness of participants and, in case of injury or illness,
securing appropriate medical attention.
Seeing that every participant has the appropriate gear for planned activities.
Taking measures as required to assure that the group is able to meet the constraints of
the itinerary schedule.
