How to Protect Your Company
Join GMTA, The McCart Group, and Freeman Mathis & Gary, LLP for a special one-day event for the trucking industry.
If your operation includes commercial motor vehicles, you don’t want to miss this seminar, which is designed to
educate attendees on compliance elements related to accident prevention, accident investigation, and litigation
following an accident. Seven (7) CEU credits will be granted for course completion. Truck industry managers,
insurance carriers, and other interested parties are welcome to join us at the Cobb Galleria Center on Thursday, April
21, 2011 from 8:00 a.m. – 4:30 p.m. for this informative presentation.
The morning session will include:

A presentation by Michael Nischan, a safety consultant with the McCart Group, who will describe the
importance of a fleet management program, Driver Qualification, Hours of Service, and Fleet Maintenance.
A mock accident scene and investigation with members of the Georgia State Patrol Specialized Collision
Reconstruction Team (SCRT); the Georgia Department of Public Safety Motor Carrier Compliance Division
(MCCD); and Heath Stewart, Impact Collision Analysis.

Heath Stewart, an accident reconstruction expert with Impact Collision Analysis, who will explain what is
involved in investigating a CMV accident.
Matt Stone, partner in charge of the transportation law practice group at Freeman Mathis & Gary, who will
discuss the details of defending a CMV accident case and will conduct a mock trial/cross-examination.
The event will close with a review of the mock accident scenario and a Q&A session.
There is no charge for this event; however the GMTA Foundation is accepting tax deductible donations on behalf of the
family of Georgia State Patrol trooper Chad LeCroy. Please make your gifts payable to the GMTA Foundation either by
check or credit card. All funds raised for this event will be given to the LeCroy Family Foundation. Trooper LeCroy
was killed in the line of duty on December 27, 2010 after a traffic stop and chase in metro Atlanta.

About Our Presenters
Michael Nischan, CDS, CCSP has 17 years experience in the transportation field. He is
responsible for The McCart Group’s transportation safety practice, and assists clients
with fleet compliance, safety, and security. After receiving a B.A. from Lenoir-Rhyne
College, he worked for a metropolitan law enforcement agency, where he spent most of
his time in traffic enforcement. He then served as Corporate Director of Safety for a
prominent southeast manufacturer, and then joined The McCart Group to create the
Firm’s first transportation safety and compliance practice.
With his experience in law enforcement, private industry, and consulting, Michael has a
genuine, well-rounded understanding of what it takes to operate a fleet safely and
profitably. Few insurance carriers and agencies have someone on staff as well-versed
in motor carrier issues as Michael. He is an instructor with the North American
Transportation Management Institute and provides professional training courses on
behalf of GMTA for transportation managers. He is the only CCSP (Certified Cargo
Security Professional) employed by an insurance or risk management firm in Georgia.
Mr. Nischan is a member of numerous organizations, including GMTA and SETSC
(South East Transportation Security Council).
Heath Stewart is the principal of Impact Collision Analysis, LLC and has 14 years of
experience in accident investigation / reconstruction. He began his career with Georgia
State Patrol, enforcing traffic laws and investigating minor to fatal crashes. The bulk of
his time as a trooper was spent with the Specialized Collision Reconstruction Team
(SCRT) responding to, investigating and reconstructing fatal crashes in order to ensure
successful prosecution for homicide by vehicle (1st and 2nd degree).
Mr. Stewart has been in private practice for 5 years, concentrating on consulting,
investigation, reconstruction, and expert witness work. He has experience investigating
well over 1,000 crashes on both the law enforcement and civil side. Mr. Stewart is
certified as a Georgia P.O.S.T. (Peace Officer Standards and Training) Instructor, forensic
mapping specialist, Bosch Crash Data Retrieval (CDR) Technician, Bosch CDR Analyst,
and Bosch CDR Technician Instructor. His teaching experience includes the following
courses: Accident Investigation On-Scene Level 2, Practical Applications for Physics, and
CDR Technician.
Mr. Stewart has received awards from the National Crime Victim's Rights, Operation
Drive Smart, and the Commissioner's Accommodation Award (DPS).
Matthew Stone is the partner in charge of the transportation law practice group at
Freeman Mathis & Gary and leads the firm’s 24/7 Emergency Response Team. He
received his undergraduate degree from the University of California at Los Angeles
(UCLA) and his law degree from Loyola Law School in Los Angeles. He is admitted to
practice in Georgia and California and has earned an AV (preeminent) peer review
rating from Martindale Hubbell.
His practice is devoted to defending motor vehicle liability claims against companies
and drivers in the trucking and transportation industry. He regularly represents short
and long haul motor carriers, sand and gravel haulers, municipal/county/regional bus
lines, residential and commercial waste management haulers, and emergency and nonemergency transportation service providers. He has tried cases in all of Georgia's
federal judicial districts and many of Georgia's 49 judicial circuits.
Mr. Stone regularly teaches in the trucking and transportation industry and is an
approved instructor for the North American Transportation Management Institute.
