RESPONSIBILITY FOR CHARGES 5.1. The customer is responsible for all charges arising out of the use of or in conjunction with any services furnished to him by the Company, including collect toll messages which have been accepted at the customer’s telephone number. 5.2. When installation of service has been started prior to the cancellation, a cancellation charge equal to the minimum service charge shall apply. Installation or special construction for a customer is considered to have started when the Company incurs any expense in connection with the installation which would not otherwise have been incurred. CUSTOMER TERMINATION OF SERVICE 8.1. The customer may terminate service prior to the expiration of the initial contract period after giving notice to the Company pursuant to Rule 6.20 of the Commission's General Service Rules. When non-published or non-listed service is to be furnished, the customer may be required to execute an agreement which holds the Company harmless from any damages which might arise and which absolves the Company from any responsibility for the failure of the customer to receive calls because of the non-published or non-listed arrangement. 1.2.13. Non-published and non-listed service customers will be required to maintain such service until the first issuance of a directory in which a requested change may be published, or until telephone service is discontinued. 1.2.14. Billing for such services will be discontinued with the last regular bill dated before the issuance of the directory in which the change is made. 1.2.15. Non-published or non-listed service customers may not change from one to the other without incurring a change charge. 1.2.16. The Company's liability arising from errors in or omission of directory listings shall be limited to and satisfied by a refund not exceeding the amount of the charges for such if the customer's service is affected during the period covered by the directory in which the error or omission occurred. In no event shall the Company be responsible for any consequential damages arising out of any error or omission related to directory service. The Company is not required, and does not warrant or guarantee, that any or all types of customer-provided equipment is compatible and/or will operate or properly function on the Company's facilities. It shall be the sole responsibility of the customer to ensure that customer-provided equipment is compatible with the Company's facilities that provide service to the customer, and the Company shall not be responsible for any loss or damage due to or caused by the failure of customerprovided equipment to function on the Company's facilities. GENERAL Where requested by local government authorities, and subject to the availability of facilities, the Company will provide a universal number “911” dialing to its Customers for simplified emergency access police, fire and other emergency services. 911 calls will be routed for answering to a Public Safety Answering Point (PSAP) as designated by the local government unit authorized to establish and operate such systems. The Company does not undertake to answer and forward 911 calls, but furnishes the use of its facilities to enable the local government unit or its designee to answer and respond to such calls. The 911 Calling Party, by calling 911 Service, gives consent for the Company to provide 911 information consisting of the name, address, telephone number, and other calling party information when available, to Law Enforcement Agencies and other emergency service providers on a call-by-call basis for the purpose of enabling those agencies or service providers to respond to emergency calls for assistance. Database inquiries for 911 information consisting of name, address, telephone number and other information when available, will only be allowed for purposes of dispatching or responding to 911 emergency calls or integrity verification as prescribed by the applicable state codes, rules or legislation. Customers with Unlisted or Non-published numbers as well as those customers who have been requested per line blocking forfeits the privacy afforded by these services on calls made to 911. The provision of 911 Service by the Company shall not be interpreted, construed, or regarded as being for the benefit or creating any Company obligation, either express or implied, toward any third person or legal entity other than the customer. The Company’s entire liability to any person for interruption or failure of 911 Service shall be limited to the terms specified in this tariff by statute. The Digital Centrex Service line rates for customers with 2-99 lines apply as specified. The monthly rate for Digital Centrex Service lines and features covered under a monthly service period plan is guaranteed against Company-initiated change and will apply for the selected service period. The minimum service period is 12 months. 4.5. If the service is canceled in whole or in part by the customer after installation of the service but prior to the completion of the service period, the customer shall be obligated to pay the remaining payments, as contracted. 4.6. The prepayment of charges in no way constitutes a purchase of the equipment, and the Company retains full ownership of all equipment covered by the prepayment. 4.7. Digital Centrex Service station lines may be terminated in a customer-provided PBX system. Such lines may be either ground start or loop start and may have any standard treatment. Transmission quality over Digital Centrex Service lines of this type is not guaranteed. Common Control Switching Arrangement (CCSA) Access - Enables station line users in the customer group to gain access to the CCSA by using special access codes and dialing reserved number exchange (RNX) patterns. 5.12. Convenience Dialing - Allows MVP subscribers to place calls by dialing a speed calling code from a shared list of up to 30 stored numbers (normally 20-49) instead of dialing all digits of the desired number. Telemarketer Do Not Disturb - When activated, callers are informed that the TDND subscriber does not want to receive telemarketing calls. When the calling party attempts to call a line with TDND, the caller receives a recorded announcement indicating that non-telemarketing callers must dial the digit "1" to complete the call. Once the “1” is dialed, the call is completed. If any other digit is entered the calling party receives a busy tone. Calling Name and Number Delivery (CNND) -This is a feature that enables the customer to receive the calling directory name and number on incoming calls. The calling name and number will be delivered to the called party’s customer premise equipment. When CNND is activated on a customer’s line, the directory name and number of an incoming call will be sent to the display of the customer premises equipment during the first long silent interval of the ringing. 2.18. Anonymous Call Rejection (ACR) – When activated, incoming calls are examined to determine whether presentation of the calling party’s directory number is allowed or restricted. If presentation is allowed or if the presentation status is unavailable, the call is completed to the ACR subscriber. If presentation is restricted, the incoming call is routed to the ACR denial recorded announcement or tone. The ACR subscriber does not receive alerting tones for incoming calls that are rejected. Issued: GENERAL DESCRIPTION 1.1 Advanced Digital Services is a public network-based set of communications services that make it possible to send, receive, and modify information using regular telephone lines. These services are based on the National Integrated Services Digital Network (ISDN) standards. ISDN provides end-to-end digital communications and gives the ability to transmit data and voice over the same telephone line simultaneously ( a user can send information from a personal computer and talk to the person on the other end of the line at the same the). This functionality is provided via channelized transport facilities. The ISDN architecture consists of digital central office switching systems which connect Basic Rate Interface (BRI) lines to customers' premises. 1.2. Advanced Digital Services BRI is an optional service arrangement that can be used in conjunction with a customer's residential service, individual business line or Centrex service. It uses the ISDN architecture to provide the customer with the capability to transmit voice and data simultaneously over the same digital line. Under various optional arrangements, BRI provides the customer with access to CircuitSwitched Voice Services and Circuit-Switched Data Services. 1.3 An Advanced Digital Services BRI arrangement obtains its capabilities from an ISDN-capable, Telephone Company central office switch. The BRI ISDN arrangement provides two communications channels (but using only one physical line) between a telephone (or computer, fax machine or other equipment) and the digital central office. These channels are called Bearer, or B Channels. Another channel, called the Delta, or the D channel, is used for signaling purposes. The complete BRI ISDN line is known as 2B+D. CIRCUIT SWITCHING SERVICE DESCRIPTIONS Circuit Switching is a switching arrangement in which an entire circuit or, in a digital switch equipped for ISDN, a specific selection of channels is dedicated to a given call. Circuit-Switched Service provides the ability to originate and receive circuit-switched voice and/or data calls over a 64 kbps B Channel, The customer may choose among the following Circuit-Switched features based upon application needs: Issued: 2.1 Clear Channel Capability - A characteristic of the transmission paths on the B Channels that allows the fill bandwidth of 64 kbps to be available to the customer. Using appropriate terminals or terminal adapters, it is also possible to bridge two B Channels together to achieve data transmission speeds of 128 kbps. However, ISDN interconnection to or through non-ISDN equipped central offices will potentially be subjected to analog transmission or sub-rated to 56 kbps per channel. 2.2. Additional Call Offering - This feature allows the user to be notified of additional call when the telephone set is busy. Similar to conventional Call Waiting, multiple incoming calls to a directory number or secondary telephone number (if purchased) can be terminated to the telephone. 2.3. Multiline Hunt Service - This feature allows incoming calls to a busy directory number to search though a predetermined list of directory numbers. This may be an Advanced Digital Services directory number on a different BRI or (for voice calls) an analog he. The hunting arrangement may be series completion, linear, uniform distribution, or circular. 2.4. Directed Call Pick-Up - This feature allows the user to dial a special code plus an extension number to answer calls directed to other stations. Call Hold - This feature allows the user to place a call on hold by pressing the appropriate button on the telephone set. As an option, multiple independent calls may be retained on hold with this feature. 2.7. Three-way Calling - This features allows the user to add a third party to an existing voice call by pressing a feature key, and thus enables a conference between parties at multiple locations. The user may also disconnect the last party added by depressing the appropriate button on the telephone set. 2.8. Call Transfer - This feature allows the user to transfer a voice call to another directory number. 2.9. Call Forwarding - This feature allows voice calls to be redirected from one ISDN telephone (based on DN and call type) to another telephone (either an analog or an ISDN telephone). 2.10. Automatic Callback/Monitoring - Also called Repeat Dialing, this feature extends the concept of the Automatic Callback feature to calls originated at Advanced Digital Services lines. When the calling party encounters a busy condition with the called party, the calling party can dial an access code to cause the switch to monitor the called party. When the called party is no longer busy, the switch will notify the calling party of this condition. 2.12. Caller ID - Number - This feature allows h e calling party's directory number to be displayed on a properly equipped telephone set. 2.13. Caller ID - Name - This feature (where available) allows the listed name of the calling party (along with the caller's number) to be displayed on a properly equipped telephone set. 2.14. Display Capability - This feature allows an appropriately equipped telephone set to display a variety of information. For example, when idle, the time and date are displayed. When the user is making a call, call progress information is displayed. The following information is also provided. 2.14.1. Caller ID - As described under Advanced Calling Services in this tariff, Caller ID - Number is provided. Caller ID - Name is also displayed if subscribed to. 2.14.2. Transmission Specifications The standard transmission parameters for an Advanced Digital Services line utilizing an ISDN Basic Rate Interface (BRI) consists of: A maximum of 38.5 db loop loss at a 40kHZ test tone terminated into a 135 ohm impedance. The 38.5db loss includes all central office facilities, outside plant facilities and inside wiring. 3.2. Customer Premise Equipment and Facilities Compatible customer premise equipment is required to utilize Advanced Digital Services. All equipment used to interface with these services is required to conform with National ISDN guidelines as referenced in the following Bellcore specifications. These services are furnished subject to the central office switching capacity, capability, and the availability of outside plant facilities. 4.2.1 The availability, functionality, and capabilities of Advanced Digital Services may vary, or may not be available, dependent upon type of serving central office switch, related software controlling that switch, and associated outside plant. 4.2.2. Where facilities are not available, or unused expenditures are involved in making them available, the customer may be required to pay additional charges to cover the unusual expenditure, or to contract for services beyond the normal service term, or both. 4.2.3 4.3 Payment for Service 4.3.1 Issued: Distance Extension Service: Advanced Digital Services may be provided to a customer's location served beyond the normal transmission range of the serving central office. In such cases, in addition to the charges and rates for Advanced Digital Services, Distance Extension Service rates and charges are applicable.
