Environment Canada’s contribution to your request for specialist advice is based primarily on the mandated responsibilities of Section 36(3) of the Fisheries Act, the Canadian Environmental Protection Act, Species at Risk Act (SARA), and the Migratory Birds Convention Act. Comments and Recommendations • • Meeting the requirements of the Federal Fisheries Act is mandatory, irrespective of any other regulatory or permitting system. Section 36(3) of the Fisheries Act specifies that unless authorized by federal regulation, no person shall deposit or permit the deposit of deleterious substances of any type in water frequented by fish, or in any place under any conditions where the deleterious substance, or any other deleterious substance that results from the deposit of the deleterious substance, may enter any such water. The proponent shall not deposit nor permit the deposit of slash, debris or sediment into any water body. These materials shall be disposed of above the high water mark in such a fashion that they do not enter the water. Section 4.5, Drilling, Completion and Evaluation “Drilling waste Icuttings and fluid) will be placed in a sump. A test-pit will be left for a 24-hour period to assess water infiltration and to ensure that ground conditions are sufficient prior to the installation of a sump.” • A properly engineered sump, constructed in a suitable location should provide effective containment. However, there are a number of factors that can lead to potential instability and sump failure. These should be considered in the sump 2 Therefore, to fully design, site selection, construction and closure methods. assess the potential impacts of a proposed in-ground sump, Environment Canada requires the following information be include for review: 1. Surficial soil type, local topography, ground thermal temperatures and permafrost conditions, flooding potential, distance to surface waterbodies and drainage channels 2. Sump site selection criteria design, construction and final closure procedures 3. Long-term monitoring and management plan Chemical additives or drilling mud used in connection with this drilling program shall be disposed of such that they do not enter any waterbody either by surface or ground water flows. The drilling fluid sump should be located on the high side of the lease with sufficient space for expansion of the original sump. To minimize surface disturbance within continuous/discontinuous permafrost zones the sump should be excavated deeper rather than wider with an adequate freeboard. A list of drilling fluid products to be used in the drilling program should be submitted to and approved by the regulatory agency. The list should include the intended use of the product, the approximate concentration to be formulated in the mud system, and expected concentrations to be found in the sump supernatant. The use of non-toxic mud additives does not guarantee the final drilling effluent will be non-toxic (cumulative toxic effects). Therefore, it is the proponent’s responsibility to demonstrate that the drilling waste is non-deleterious and in compliance with Section 36(3) of the FisheriesAct. , • • The Canadian Wildlife Service (CWS) has also reviewed this project description and provides comments and advice pursuant to the Migratory Birds Convention Act and the Species at Risk Act. • • The proposed drilling period of August would result in no significant disturbance to migrating waterfowl. The proposed drilling site, off-loading and staging of equipment is not likely to impact waterfowl habitat given the nature of the shoreline at that location. Changes in the proposed or permitted activities associated with this land use and water licence applications would require further review. Grandview Summer Drilling Program, Land Use Permit Application SO4A-005 and Water Licence Application SO4L1005 DFO Letter of Advice — Dear Mr. Cheyne: The Department of Fisheries and Oceans, Fish Habitat Management Western Arctic Area (DFO) has received Land Use Permit Application SO4A-005 and Water Licence Application 504L1-005 for Devian Exploration’s proposed Grandview summer drilling program. I have reviewed the applications as part of the MVRMA preliminary screening of the project and am providing the following Letter of Advice on behalf of DFO. — It is my understanding from the information provided that: • The proposed project involves the drilling of one exploratory well, anticipated to be an oil producer, approximately 120 kilometres north of Fort Good Hope near Little Chicago. This program is scheduled to be conducted in the summer of 2004 (August 1 -September 18). • The proposed water source for the drilling program is the Mackenzie River. No other water source will he required except for potable water that will either be obtained from a water well on site, or be barged in from Norman Wells. • Equipment will be barged on the Mackenzie River. and then an existing cutline will be utilized to access the lease area from the barge landing site. The Dura-Base Composite Mat system will he used to protect the barge landing site and access, and wood and steel rig mats will be used to protect the campsite and lease from surface disturbance. The lease area is approximately 330 metres from the shoreline of the Mackenzie River. • Drilling waste and camp waste was to he deposited in a sump. However, site investigations have determined that the site does not meet the required 11.1 anaua 1 ‘ SC04025 Page 1 of 4 conditions for a sump and therefore another option must be used. Will the sewage be hauled to the municipal treatment facility in Norman Wells, and the drilling waste hauled out of the NWT to an appropriate disposal facility as per the contingency plan outlined in the project description? Q • Bulk fuel will be stored in double walled tanks, and fuel caches will be located a minimum of 100 metres from the high water mark of any water body. This 100 metre setback distance does not take into account the fuel that will be stored in internal tanks on the barge for the duration of the program. • Some fuel spill equipment (sorbent pads, scoop shovels, empty drums) will be available on site, and discussions are under way with a major operator in the area to provide second line spill equipment in the event of a larger spill. If these discussions are not successful, it must be ensured that Devlan has an adequate spill response plan with the appropriate equipment to deal with any potential spill scenario. • No watercourses (creeks or draws) will be crossed during this program. • In the project description it states that “erosion prevention measures will be implemented on disturbed areas during clean-up! reclamation, if required.” If areas are identified as prone to erosion, preventive measures should be implemented at the beginning of the program. In addition, monitoring of erosion control measures during and after project completion should be conducted to ensure that they have been successful. • An application has been made to construct a borrow pit on the lease site. Material would be utilized to level the area prior to placing the wood and steel rig mats. No material will be removed from below the high water mark of the Mackenzie River, and as the borrow pit will be on the lease, it will be a minimum of 300 metres away from the bank of the Mackenzie River. If this is not accurate, please clarify with DFO prior to the construction of the borrow pit. Since the proposed work will occur on and/or near waterbodies, including the Mackenzie River, I have concluded that the proposed work may result in the harmful alteration, disruption or destruction of fish habitat. The following mitigation measures, if implemented. should prevent any potentially harmful impacts to fish and fish habitat. This list includes measures outlined in the proposal. • Every effort should he made to retain riparian vegetation, as it is critical for the protection of littoral and riparian fish habitats as well as for providing cover and enhancing hank stability. 1I•I SC04025 Page 2 of 4 Q . Water intakes should be properly screened with fine mesh of 2.54mm (1\l0”) to prevent the entrainment of fish. Please refer to the Freshwater Intake Endof-Pipe Fish Screen Guideline (DFO. 1995) which is available upon request. • Reclamation activities should include hank stabilization and re-vegetation as required, including access points to the Mackenzie River. Depositing deleterious substances into fish bearing waters is prohibited as stated under subsection 36(3) of the Fisheries Act. The following additional mitigation measures are intended to prevent the deposition of deleterious substances and possible habitat disturbance or loss: • All activities including maintenance procedures and vehicular refuelling should be controlled to prevent the entry of petroleum products, debris, slash, rubble, or other deleterious substances into the water. • The welisite should be set back a minimum of 100 metres from the high water mark of any waterbody including ephemeral drainages, if possible. • All wastes, drill cuttings, sewage and wastewater containments, should be located a minimum of 100 metres from any water body including ephemeral drainages if possible, and be sufficiently bermed or otherwise contained to ensure that these substances do not enter any waterbody. • Due to concerns with the potential for sump failures, DFO encourages alternate waste disposal methodologies. As previously noted, it is assumed that sumps will not be utilized due to the lack of appropriate soil conditions. • Fuel storage should have secondary containment (such as doubled walled tanks, berms etc.) that is sufficient to ensure that fuel will not be able to enter any waterbody. • A spill contingency plan should be made available to all persons required to work on site and followed in the event of a spill. • Spills of oil, fuel or other deleterious material should be reported immediately, as per existing reporting protocols, to the NWT/Nunavut 24hour Spill Report Line at (867) 920-8130, including all spills near or into a water body. If the proposed work is carried out as described in the plans provided to DFO and mitigation measures are implemented as required, the proposed work will not he considered as contravening subsection 35(1) of the Fisheries Act which reads: ‘No person s/ia!! cirr’ on an’ work or undertaking that results in 11w harmful alteration, disruption or destruction of/is/i habitat. uanaua SCO4()25 Page 3 of 4 Q Therefore. an Authorization under subsection 3 5(2) of the Fisheries Act will not he necessary. If the harmful alteration, disruption or destruction of fish habitat and/or the deposition of deleterious substances into fish bearing waters occurs as a result of an unapproved change in the plans for the proposed works or failure to implement the necessary mitigative measures, prosecution under subsection 35(1) and/or subsection 36(3) of the Fisheries Act may he initiated. Please note that this Letter of Advice does not release the proponent of the responsibility for obtaining any other permits that may he required. This Letter of Advice will apply to this project for the period outlined in Land Use Permit Application SO4A-005 and Water Licence Application SO4L1-005 if issued.
