The 2009 Bonds were issued on May 27, 2009; certain of the 2009 Bonds (denoted in italicized, underlined text below) matured prior to the date of this material event notice. Portions of the Letter also request information with respect to the Authority’s $26,925,000 Student Loan Revenue & Refunding Bonds (CUSIP numbers 56040PAE8, 56040PAF5 and 56040PAG3) (collectively, the “2002 Bonds”), as certain of the 2009 Bonds refunded certain of the 2002 Bonds. The 2002 Bonds were issued on November 15, 2002 and are no longer outstanding – the 2002 Bonds associated with CUSIP 56040PAE8 matured on June 1, 2005, the 2002 Bonds associated with CUSIP 56040PAF5 matured on May 1, 2009 and the 2002 Bonds associated with CUSIP 56040PAG3 were refunded with proceeds of certain of the 2009 Bonds. The Letter requests that documentation be provided by April 1, 2013. The Letter also notes that the IRS has no reason at this time to believe that the Authority’s 2009 Bonds fail to comply with applicable federal tax requirements, but that the IRS does reserve the right to expand the examination to any aspect of the Authority’s debt issuance. The Authority will cooperate with the IRS’ examination of the 2009 Bonds.
