LICENSOR LINES A Newsletter from Sherburne County Health & Human Services: Child Care Licensing October 2014 Does Your Daycare Have Openings? We can help! We have daycare openings posted on our website! Give Heather or Callie a call with the number of infants, toddlers, preschoolers, and school-agers you have openings for, and we will put that information on the website. If your daycare is full, please tell us that, too, so you don’t receive disruptive calls from parents looking for care. One more 2014 Change – Supervise New Staff You must supervise all new substitutes/assistants until their background study clears. Please document the date you submitted their background study to us, and the date they first worked by themselves. Heather will be checking for this documentation at licensing visits. Legally Speaking Please remember that according to the Minnesota Background Study Law, providers must immediately notify Licensing when anybody they’ve done a background study on in the past has a new criminal charge or maltreatment finding on their record: Minnesota Statutes 245C.05, Subd. 6B If a background study is initiated by an applicant, license holder, or other entities as provided in this chapter, and the applicant, license holder, or other entity receives information about the possible criminal or maltreatment history of an individual who is the subject of the background study, the applicant, license holder, or other entity must immediately provide the information to the commissioner. In the above Statute citation, “the commissioner” means “Sherburne County.” Please do not hide this information from us – we do find out about it eventually, and you could receive a negative licensing action for withholding information. We will do our best to assist you in working through criminal charges and to help you retain your license. DATA PRIVACY ISSUES - FACEBOOK, BLOGS, WEBSITES While the general use of these sites is not prohibited, disclosing records or pictures of children served in licensed programs without written permission is prohibited. The following Rule part addresses this issue. Please remember that licensed providers are prohibited from posting information about a child or their family on a personal blog, website, Facebook page, etc. without written permission. 9502.0345 AGENCY RECORDS Subp. 2. Data privacy. The agency, department, and the authorized agent shall have access toprovider records on children in care to determine compliance with parts 9502.0315 to 9502.0445. The provider shall not disclose any records on children in care to any persons other than the parents of the child, the agency, the department, the persons required by part 9502.0375, subpart 1, and medical or public safety persons if information is necessary to protect the health and safety of the child. The only acceptable way for a licensed provider to post ANY information and/or pictures regarding person served by their program, is to obtain WRITTEN permission from a parent/guardian, even if the provider uses “assumed” names to attempt to avoid others from recognizing the individual. If providers insist on using any of these sites, we RECOMMEND the following guidelines be followed: Even with written permission, proceed with caution in posting pictures and information. The information is now public and may be accessed by anyone for any reason. Family Child Care providers, in particular, should self-regulate regarding the amount of time spent on these sites, and the time of day information is posted. Supervision of children should NEVER suffer because a provider is busy posting information or blogging. In some cases, DHS has issued licensing sanctions when it has been determined that the above-referenced Rule has been violated. 14 Licensor Lines Post Test October, 2014 Worth 0.5 hours of training credit from Sherburne County Health & Human Services Licensor Lines post-tests will still “count” toward annual training requirements, but will not count as Child Growth & Development/Behavior Guidance, or Supervising for Safety training. 1.
