EMPLOYMENT LAW UPDATE, SAME-SEX MARRIAGE, AND THE MODERN WORKPLACE
This session will provide a brief review of key employment law developments from the past year. We
will also update employers on the latest federal and state laws and court decisions concerning samesex marriage. Finally, our presentation will cover Executive Order 13672 prohibiting discrimination on
the basis of “sexual orientation” and “gender definition” by federal contractors and subcontractors.

WHERE’S THE FIRE? THE NLRB’S PROPOSED “AMBUSH ELECTION” RULES
On February 6, 2014, the National Labor Relations Board (NLRB) reissued proposed rules that would
fundamentally change the NLRB’s long-standing union representation election procedures. While
the new, so-called “ambush election” rules do not establish fixed time frames, they streamline (or in
some cases delay until after the election), the procedures used to resolve disputes. The net effect is
that employers are facing elections in 10 to 21 days after unions file their petitions. Of equal concern,
these rules may result in elections being held before important questions about voter eligibility are
resolved. While the rules may not yet be final, it is clear that changes are coming. During this session,
we will walk you through each change, comparing the old rules with the new rules and explaining the
resulting impact.

THE FCRA: LABOR AND EMPLOYMENT’S NEWEST FOUR-LETTER WORD
Like its four-letter precursors—the FLSA and the FMLA—the Fair Credit Reporting Act (FCRA) has
many traps for unwary employers, and the consequences can be severe. This session will explore
those traps, provide ideas for avoiding liability, and address how employers may defend themselves
from these claims.

AN UPDATE ON THE FMLA, ADA, AND THE EEOC’S PREGNANCY DISCRIMINATION
GUIDANCE
This session will provide a comprehensive legal overview of the statutes, regulations, and agency
interpretations implicated by an employee’s taking a leave under the Family and Medical Leave Act
(FMLA) or seeking an accommodation under the Americans with Disabilities Act (ADA), and outline
specific steps employers should take when faced with FMLA and ADA interplay. We will also address
the U.S. Equal Employment Opportunity Commission’s (EEOC) July 14, 2014 updated enforcement
guidance on pregnancy discrimination and related issues.

WATCH YOUR STEP! AVOIDING HAZARDS WITH EMPLOYEE BENEFIT PLANS,
FIDUCIARY DUTIES, AND SERVICE-PROVIDER AGREEMENTS
If fiduciary duties related to 401(k) and other employee benefit plans are not handled properly,
employers may face severe liability. Things done (and left undone) when administering 401(k) plans,
developing investment menus, and working with providers can have disastrous consequences. This
session will review some developing law, explain how fiduciary liability arises, and what your fiduciary
liabilities mean on a practical, day-to-day basis.
