amphitheatre. Walk up the dry riverbed of
Piccaninny Creek for a closer inspection of
the striped beehive domes. These distinctive
formations were shaped by active faults over
350 million years ago and carved by the wind
and rain. Your Driver-Guide will bring the domes
to life, describing both their cultural and

back to Kununurra. From the air see the Argyle
Diamond Mine which produces one-third of the

Day 1. Broome, Boab Prison Tree,
Tunnel Creek, Windjana Gorge. Depart
Broome this morning and begin your Kimberley
adventure. Make a stop in Derby to see the Boab
Prison Tree, believed to be more than 1,500
years old and measuring 14 metres in diameter.
Journey on the Gibb River Road, passing dusty
ochre-coloured ranges, dramatic gorges and
deep rock pools. At Windjana Gorge, spot
freshwater crocodiles lazing on the banks of the
Lennard River before you continue to Tunnel
Creek. With torch in hand, wade through the
cool waters to view a wonderful oasis beyond.

Your booking contract is with Australian Pacific Touring Pty Ltd
(APT). Your contract incorporates all of the following terms
and conditions. You should read and understand your
contract, and please ask APT or your travel agent if you
require any clarification.
Fares, Booking Confirmations
A 10% security deposit per person, per tour and the balance
of any airfares booked by APT is required within 7 days
of booking. Some seasonal special offers may require an
additional deposit, which will be advised at the time of
reservation. Balance is required 60 days before departure
for escorted touring and Independent Air Tours and 30 days
prior for Wilderness Lodge accommodation. Bookings made
within 60 days of the departure date will require full payment
at time of booking. All fares quoted are in Australian currency
and supersede all prices previously advertised. Stated duration
counts day of departure and day of return. Twin share prices
are per person unless otherwise stated. Credit card surcharges
apply. APT reserves the right to cancel any ticket or booking
or to refuse to carry any passenger where payment has not
been received by APT within the specified time. Prices
include Australian Government Goods and Services Tax
(where applicable).
Children Under 15 (Under 12 for Air Tours)
When sharing with one adult, discount is 20% off adult fare.
Children under 7 years of age are not recommended to
participate in tours. Children under 18 years must be
accompanied by an adult.
Credit Card Surcharges
If you pay APT by credit card, surcharges of between 1% and
3% will be added to the price of the holiday package.
Amendment Fees
A charge of $70 will apply to any addition or modification
requested after the original booking has been confirmed.

offer that includes air travel) airline cancellation fees will apply
as standard, as APT reserve the right to issue airline tickets to
our discretion once a deposit has been paid. In the event of
cancellation, these fees will be deducted from the deposit paid,
and therefore the credit being held. Deposit Cancellation Cover
applies to new bookings only. After five years, unused credit
funds will incur the original cancellation conditions as per
brochure. This does not replace travel insurance, which we
strongly recommend is organised at the time of booking.
Limitation of Liability
1. Our products include the services of operators, such as
airlines, hoteliers, cruise companies and other operators,
who are not agents, servants or employees of APT. Although
we take care in selecting the operators of services and the
optional tour excursions, we cannot and do not take
responsibility for the conduct of the operators, their servants
and agents or for any ramifications of that conduct. These
tours may include activities such as climbing, exploring,
swimming and snorkelling. The passenger accepts that these
activities involve varying degrees of risk.
2. No passenger will be permitted to continue on any tour
while their mental or physical condition is, in opinion of any

for carriers and operators used by APT in the tour and APT will
not be liable for failure to make connections with other services
or attractions beyond its control. Lodge bedding configurations,
furnishings and size of tented cabins are subject of availability
at time of booking, and are subject to variation.
3. APT accepts no responsibility for any death, injury, illness,
loss (including loss of enjoyment), damage, detention, delay
(including mechanical breakdown) beyond its reasonable control.
Maximum of Four Guests
Maximum of four guests refers to the ground touring portion
of APT Independent Air Tours. Passenger numbers on flight
portion of tour dictated by size of aircraft.
4. Any term, condition or warranty express or implied by
statute or otherwise for the products and/or services is
excluded to the full extent permitted by law. However, nothing
in this booking contract excludes, restricts or modifies the
application of the Competition and Consumer Act 2010 (Cth)
as amended, consolidated, supplemented or replaced.
5. To the full extent permitted by law, APT’s liability arising
under or in connection with this booking contract: (a) is limited
to the re-supply of the products and/or services or the payment
of the cost of re-supply of the products and/or services to you;
and (b) excludes liability for any indirect or consequential losses
suffered by you or any third party, howsoever caused, including
but not limited to pure economic loss or any special,
extraordinary or punitive damage to you or any other party.
6. Your travel agent will forward deposits and other payments
to us on your behalf, but your travel agent is not our agent for
the purpose of receipt of monies. Receipt of deposits and
subsequent payments by the travel agent does not constitute
receipt of those monies by us and the travel agent has no
authority expressed or implied to receive monies on our
behalf. There is no liability on the part of APT in respect to
any monies paid to your travel agent unless and until APT
notifies you (by way of a booking confirmation advice or
payment receipt advice) that monies have been received by
APT. APT reserves the right to cancel any ticket or booking or
refuse to carry any passenger where payment has not been
received by APT within the specified time.

Termination of Booking Contract or Change of Travel
Arrangements Due to Force Majeure
If APT, in its reasonable opinion, considers that any Force
Majeure event prevents APT (whether directly or through its
employees, contractors, subcontractors and agents) from lawfully
and/or safely providing any products and/or services subject of
the booking contract to you, APT may immediately by written
notice:(a) terminate the booking contract (in whole or in part);
and/or (b) change your travel arrangements as reasonably
practicable to ensure your safety and invoice you for any
additional costs of performing this service as mentioned above.
Limitation of Liability in the Event of Force Majeure
In the event that APT cancels or changes your travel
arrangements in any way due to a Force Majeure event, APT
will not be liable to you in contract, tort, statute or restitution for
any loss (including but not limited to loss of deposit or purchase
price and loss of enjoyment), damage, costs, charges, expenses
or injury resulting from or in connection with (whether directly
or indirectly):(a) the cancellation or change to your travel
arrangements; and/or (b) the Force Majeure event. For the
avoidance of doubt, APT is not liable to refund any part of the
deposit and/or purchase price paid by you if APT subsequently
changes or cancels your travel arrangements in connection
with a Force Majeure event. World weather, civil unrest and
terrorism are becoming more erratic and unpredictable and
these are risks beyond APT’s control. It is your responsibility to
purchase adequate comprehensive insurance to protect
yourself against these risks.
Flight Changes
The flight timings shown in our brochure, on our website and
detailed on your confirmation invoice are for guidance only
and are subject to alteration and confirmation. Flight timings
are set by airlines and affected by events outside our control.
Scheduled and charter flight timings, and days of operation are
also subject to change. APT will advise you of any significant
changes as soon as it is informed by the airline. Minor timing
changes will be shown on your flight tickets. Any change in the
identity of the airline, flight timings or aircraft type (if advised)
will not entitle you to cancel or change to other arrangements
without paying any applicable cancellation fees except where
specified in these booking conditions.
Itineraries and Accommodation
Itineraries are subject to alteration without notice and are a
guide only. Alterations may come about due to tidal or weather
conditions, strikes, public holidays, local festivals, renovations
or/and upgrades or other reasons. Any additional expense
incurred by the passenger is not APT’s responsibility. APT can

necessary to make alterations to your itinerary.
Smoking
Government regulations forbid smoking in tourist vehicles,
however frequent stops are made for those wishing to smoke.
Smoking is not permitted in twin share ‘matched’ rooms, tents
or lodges. Requests for smoking/non-smoking accommodation
will be passed on to hotels but cannot be guaranteed.
Medical Assistance
APT does not employ medical staff on our tours. If you require
medical attention, medical services will be contacted
immediately. You are responsible for all charges that result
from a visiting a medical facility, or for a medical practitioner
visiting you. APT is not responsible for the type or quality of
the medical services you may receive.
Health and Fitness
As tours visit remote areas and feature activities with varying
degrees of difficulty, it is vital to select a tour with an activity
level suited to your health and fitness. It is your responsibility
to carry any medication you require for the tour’s duration.
We recommend carrying medication in your hand luggage
from the time you leave home.
Passengers Needing Special Assistance
Any disability or medical condition requiring special attention
must be reported to APT at the time of booking. Touring
vehicles and light aircraft are not equipped with wheelchair
ramps. Wheelchairs and walkers cannot be carried on
vehicles and light aircraft due to space limitations. For safety
reasons, passengers in wheelchairs cannot be carried on to
vehicles and light aircraft. APT is unable to provide individual
assistance to any passenger for walking, dining, boarding or
alighting coaches or other transportation vehicles or other

Responsible Service of Alcohol
Our staff are trained in the Responsible Service of Alcohol
and are obligated by law to refuse service to any guest who,
in their reasonable opinion, appears to be or in intoxicated,
or behaves in an aggressive manor.
Special Requests
Where a special request (eg. diet, room location,
twin or double bedded room, a particular facility at an
accommodation, flight seat requests and/or particular meals)
is an important factor in your choice of holiday, you must
advise us when your booking is made. APT will pass your
request onto the accommodation, airline or other supplier but
cannot guarantee that it will be accommodated. The provision
of any special request does not constitute a term of your
contract with us. Confirmation that a special request has been
noted or passed on to the supplier or the inclusion of the
special request on your confirmation invoice or any other
documentation is not confirmation that the request will be
met. Unless and until specifically confirmed, all special
requests are subject to availability.
Service Inquiries
If a problem occurs during your tour, advise your Lodge
Hosts or crew so that steps can be taken to resolve the
matter immediately. If you remain dissatisfied, any complaint
must be made in writing to us within 30 days.

Travel Insurance
APT is not liable for lost or damaged baggage and
personal property. Fully comprehensive travel insurance
is strongly recommended.

KIMBERLEY 4WD & AIR TOURS
Luggage Limits
Air travel within the Kimberley is in a small aircraft which has to
comply with very strict total weight limits (for both passengers
and luggage). For tours entailing air travel, only luggage and
personal effects up to 10 kg can be guaranteed carriage on
the aircraft. For Air Tour packages from Kununurra, excess
luggage can be left with hotel or stored at the airline terminal.
Any additional costs associated with excess luggage will be
passed on to the passenger. Touring is in small 4WD vehicles
with limited luggage capacity. Each passenger is requested to
limit their luggage to one small/medium soft bag or suitcase
weighing no more than 16 kg (35 lb approx). Cameras, make
up bag etc. should be carried separately.
