Email: [email protected] Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 2 WEEK IN REVIEW Roger Derrington QC (Editor) RETIREMENT OF HER HON CHIEF JUDGE PATSY WOLFE Last Friday, a Valedictory Ceremony was held to mark the retirement of Her Honour, Patsy Wolfe, the Chief Judge of the District Court of Queensland. Her Honour was appointed to the District Court in 1995 and was appointed the Chief Judge of the Court in 1999. Her Honour’s tenure as Chief Judge was the longest of any Chief Judge since the Court was established. In his speech the Attorney-General and Minister for Justice, the Hon Jarrod Bleijie MP, thanked her Honour on behalf of the Government for the years of service given to the Court. The Attorney recognised her Honour’s achievements in developing the Court as a “modern, progressive and professional court with a wide range of specialist responsibilities outside its criminal and civil jurisdictions” as well as her Honour’s dedication to her responsibilities with formidable skill and intellectual rigor. The speech of the Minister is well worth reading in full as it outlines the Chief Judge’s wide range of remarkable achievements. RETIREMENT OF HIS HON JUDGE ROBIN QC Last Friday was also the last day on the Bench for his Honour Judge Robin QC who turned 70 on last Sunday. His Honour coincidentally sharing the same date of birth as the Chief Judge. Judge Robin had served on the District Court for 24 years, having been appointed in 1990. His Honour was well known for his great intellect, industry and his unfailing politeness in court. He was skilled across all areas of the law and, in particular, in commercial matters. He will be missed by the whole of the profession. It is understood that his Honour chose not to have a Valedictory Ceremony. NEW DISTRICT COURT APPOINTMENTS The Attorney-General and Minister for Justice, the Hon Jarrod Bleijie MP has announced a number of new appointments to the District Court of Queensland. They are: • Judge Paul Smith who has been appointed as the Judge Administrator of the District Court. • Helen Bowskill QC who has been appointed a District Court Judge for Brisbane; • Dean Morzone QC who has been appointed a District Court Judge for Cairns; • Suzanne Sheridan who has been appointed a District Court Judge for Brisbane; and • Federal Circuit Court Judge Michael Burnett who has been appointed a District Court Judge for Rockhampton and will replace Judge Smith in that District. THE QUEENSLAND REPORTS ONLINE – REDUCTION IN COST OF THE QUEENSLAND REPORTS – MODERNISING LAW REPORTING The Incorporated Council of Law Reporting (ICLR) has made a number of important announcements relating to the Queensland Reports and the remodelling of reporting taking into account modern trends in legal research and access to justice obligations: Reduction in the cost of the Queensland Reports The ICLR has announced a dramatic reduction in the cost of subscribing to the Queensland Reports as from 1 January 2015. The cost of a standard subscription will fall from $420.00 per year (for bound volumes) to $132.00 per year. That equates to $66.00 per volume. The same rate will apply to the loose parts subscription which was previously $526.00 per year. This is identified by the ICLR as being, effectively, the cost of printing and distributing the reports. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 3 Sale of remaining stocks of Queensland Reports The ICLR has also announced the sale of its remaining stocks of printed reports at heavily discounted prices. A full set of the reports is now available at a cost of $3,300 (being about $25 per volume) and single volumes to replace lost volumes or discontinued sets can be acquired for a similarly low price. Once the customer demand for back editions has been completed the ICLR will discard the remaining stock and customers needing to replace missing books will have to acquire them through a print on demand service at the prevailing costs. All enquiries about subscriptions to the Queensland Reports or purchasing back volumes should be directed to the Secretary of the ICLR, Mr Jason Rogers, at [email protected]. On-line availability of the Queensland Reports The ICLR has also announced that it will be publishing the Queensland Reports on line as part of an attempt to make the authorised reports more widely available to the profession and litigants. Previously, the only on-line availability was through a subscription with LexisNexis. From January 2015 the ICLR in conjunction with the Supreme Court Library will be providing low-cost access to a basic set of all Queensland case law – including a full set of the Queensland Reports. For as long as it is feasible to do so this service will be made available free of charge for all users. Further information will be made available towards the end of the year. RECENT PRACTICE DIRECTION – CLAIMED COSTS OF COMPLYING WITH SUBPOENA AD TESTIFICANDUM AT $45,000 – WHETHER REASONABLE? Parry v Kennedy [2014] QCA 239 Court of Appeal (Fraser JA and Applegarth and Boddice JJ) 24 September 2014 In this matter the appellant applied in the trial division for an order pursuant to UCPR 417 that the respondent pay the appellant the sum of $45,000.00 as being the appellant’s costs of complying with a subpoena which required that the applicant attend at Court to give evidence. After an extended hearing the primary judge ordered that the respondent pay the appellant $800; being his costs of complying with the subpoena; and that the appellant pay the respondent’s costs of the application. The appellant was a solicitor and the bulk of the costs claimed for complying with the subpoena were the costs of obtaining advice from his own firm and from senior and junior counsel as to the issue of whether or not he was entitled to claim legal professional privilege when he gave evidence. The primary judge held that it was not appropriate for the solicitor to seek advice about this topic. The appellant appealed. On appeal the Court of Appeal noted that, as a matter of practice, it was misguided to attempt to construct reasons for judgment from the comments made by a judge during argument. This was particularly so when reasons are delivered later. In relation to substantive matters it was relevant to the Court that the trial in which the appellant was giving evidence was one in which his former client was a party and that person was legally represented. It followed that, if a question of privilege was raised, it was a privilege of that former client and that person’s legal representatives were able to claim privilege if desired and, if necessary, argue the merits of the claim. The only advice the appellant required was whether he was able to rely upon the client’s counsel to make a claim for privilege. The Court of Appeal upheld the finding that it was not reasonable for the appellant to have sought legal advice as to his compliance with the subpoena and it was further found that there was no merit in any of the grounds of appeal. In relation to the question of costs, the Court of Appeal detected no error in the primary judge awarding costs against the appellant where the appellant had failed on the only substantive issue before the Court; being the question of the amount to be awarded in relation to complying with the subpoena. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 4 The appeal was dismissed. The court ordered that the appellant pay the respondent’s costs on an indemnity basis, primarily because the appeal had been commenced on the erroneous basis – that the reasons for decision might be detected from the judge’s comments during argument – and persisted in when it was identified that actual reasons had been delivered by the Court. The Court also took into account the lack of merit in the appeal. JUDICIAL SPEECHES – JUDGE RICHARD KOPF OF THE FEDERAL DISTRICT COURT OF NEBRASKA – JUDICIAL DUTY IN DEATH PENALTY CASES The death penalty and the matter of factual innocence The Queensland Law Reporter does not normally reference the musings of legal scholars, judges or practitioners found in on-line blogs. The reason is that most blogs contain little more than streams of consciousness or ephemeral thought bubbles which are too hastily conceived and posted. However, the same cannot be said of the blog of Federal Court Judge, Richard Kopf of the Federal District of Nebraska. His website and blog requires an exception be made to our general practice. In an entry published on his Honour’s blog, “Hercules and the Umpire”, in early September, Kopf J expressed his carefully considered, albeit controversial position on the death penalty and particularly how he would approach a case where he believed that a petitioner for habeas corpus was factually innocent. It is a fact of life that, as a federal judge in a state which has the death penalty, there is a chance that Kopf J will condemn an innocent person to death – this fact, however, is one which his Honour accepts as a necessary part of the system of democratic governance followed and “aggressively” protected by the citizens of the United States. The role of a judge in the United States, his Honour contends, is to be a “weak, small and seldom used brake on the passions of the electorate” – given that the electorate has considered that death is in certain circumstances an appropriate punishment, it is not for the judiciary to then impose their will under the misguided impression that the electorate does not have the capacity to knowingly make these types of determinations, but rather its role is to “fulfil the will of the electorate when it comes to the death penalty even if the unintentional sacrifice of a small number of innocents is the cost of maintaining a system that the people have intentionally elected”. He observes that he agrees with the statement of Mr Justice Holmes that “If my fellow citizens want to go to Hell I will help them. It’s my job”. Following this articulation of his understanding of the judicial role, his Honour then concluded that were he was confronted with a case where he knew or believed the petitioner was factually innocent, but that there was no federal legal remedy available to stop the execution, he was unsure what he would do, except to the extent that he “would move heaven and earth to stop the execution, but . . . would not play games with the law to do so”. His Honour, however, then goes on to state that in three specific hypothetical scenarios he knows what he would do. 1. In a case where the petitioner was believed to be factually innocent of murder and there was no federal legal remedy available to stop the execution, Kopf J would allow the execution to proceed if satisfied that there was precedent that compelled this result; ie that factual innocence is not, alone, sufficient to warrant stopping the process. 2. In a case where the petitioner was believed to be factually innocent of murder and there was no federal legal remedy available to stop the execution, Kopf J would allow the execution to proceed if satisfied that the petitioner could resort to a fair and speedy pardon process prior to the execution. 3. In a case where the petitioner was factually innocent of murder and there was no legal remedy available to stop the execution, Kopf J would allow the execution to proceed “if satisfied that the petitioner had ‘sat on his rights’ thus contributing to the absence of a legal remedy to address his innocence”. Though to Australians all of this is controversial, it is the last of these scenarios which has sparked the most debate on his Honour’s blog. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 5 JUDICIAL SPEECHES – THE HON JUSTICE PERRY OF THE FEDERAL COURT OF AUSTRALIA – THE IMPLICATION OF AUTOMATED DECISION MAKING iDecide: The legal implications of automated decision-making In a paper, presented at the recent Cambridge Centre for Public Law Conference 2014, her Honour, Justice Mellisa Perry, of the Federal Court, considered the use of automated decisionmaking processes in government and particularly in what circumstances it was appropriate that they be employed. Automated decision-making processes are a common feature in the execution of government business, yet there is currently only a very limited understanding of the administrative law implications of the use of these processes. In this presentation her Honour focused upon the legality of automated decision-making processes. Her analysis of the potential impacts on procedural fairness and the need to safeguard access to merits and judicial review are contained in the paper which has been submitted for publication. Turning firstly to a consideration of the fundamental principle that the actions of the State must have positive authorisation, Perry J considered that it was incorrect to assume that because power was lawfully vested in a senior public servant, this authority automatically extended to an automated system. Instead, Perry J argued that delegation to an automated process must be express, though this delegation itself raises its own, unique set of problems not limited to determining who exactly is the “decision-maker” and whether the concept of “delegation” is appropriate in this context. Her Honour went on to highlight another “challenge” posed by the adoption of automated decision-making processes, namely the need to ensure the accuracy of the substantive law applied by these automated processes. Of particular concern for her Honour was the potential for serious coding errors created, in part, by the often fluid nature of the law, and compounded by the fact that those “translating” the law into code are often unfamiliar with the law. Further, while the strength of automation is its capacity to deliver greater efficiencies of scale, this is also its weakness, as even a minor programming error would be replicated across many thousands of decisions. Lastly her Honour spoke on the circumstances in which it was appropriate to use these automated processes, and questioned whether though more efficient and cost-effective, it was an appropriate means of making many administrative decisions given that this type of decision-making has traditionally been marked by the extensive application of decision-maker discretion. Justice Perry concluded by acknowledging the many benefits that employing automated decision-making has on the consistency, accuracy and timeliness of the decision-making processes of government, however, her Honour cautioned that these efficiencies must not be allowed “to compromise society’s commitment to an administrative law system that is fair, transparent and accountable”. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 8 EDITORS’ SELECTION OF NEW CASES The following cases have been selected for reporting in the Queensland Reports this week: TRAFFIC – SPEEDING DETECTED BY PHOTOGRAPHIC DETECTION – VEHICLE BEING USED BY PERSON OTHER THAN THE OWNER Berry v Commissioner of Police [2014] QCA 238 Court of Appeal (Holmes and Morrison JJA and North J) 23 September 2014 This recent decision of the Court of Appeal outlines the requirements of “reasonable control” as it pertains to liability arising under s 114 of the Transport Operations (Road Use Management) Act 1995 (“the Act”). Section 114(1) provides that where an “offence happens and the offence is detected by a photographic detection device, a person is taken to have committed the offence if the person was the person in charge of the vehicle that was involved . . . at the time the offence happened even though the actual offender may have been someone else”. A person may successfully defend this charge, however, where they are able to prove, inter alia that they were not the driver and they have notified the commissioner or chief executive that the person did not know and could not, with reasonable diligence, have ascertained the name and address of the person in charge of the vehicle at the time the offence happened (s 114(3)(b)(ii)). The person must also notify the commissioner of the matters in s 114(3)(b)(ii) and show that at the time of the incident they were exercising reasonable control over the vehicle’s use and had reasonable way of finding out the name and address of the person in charge of the vehicle at any given time and that after the event they had taken proper steps to find out the identity of the driver. This appeal arose out the appellant’s conviction for a speeding offence in Brisbane involving a vehicle registered to her. At the time of the offence the appellant was interstate, and the relevant vehicle was stored, locked, in her garage and the keys were hidden in her house. Whilst she was away, some of her family were staying in her house, however they had not asked, nor been given permission, to drive the vehicle. [5]–[13]. Following the commission of the offence the appellant tried to ascertain who had been driving the vehicle – she questioned those with access to her house whether they had used the car or knew who had – though she was unsuccessful in obtaining this information. [14]–[22]. Her nephew was subsequently, charged with other offences relating to using the vehicle during this period, though he was ultimately found not guilty through want of adequate identification. [25]. Following her conviction in the Magistrates’ Court, the appellant appealed to the District Court which upheld the conviction on the basis, inter alia, that her statutory declaration was deficient, [34], and further that even were it sufficient the defence was not established because the appellant had failed to exercise “reasonable control as against her relatives holding house keys and especially against those who were housesitting”. [35]. It is this decision that was the subject of the present appeal. In undertaking this review, the Court initially addressed the issue of whether, for the purposes of s 114(4), the appellant’s statutory declaration was deficient given that it “made no reference whatsoever to any system in place for identifying the driver, nor did it disclose the reasonable exercise of control of the use of the car”. [34]. Upon reviewing the relevant statutory provisions the Court concluded that as the legislation merely required that the statutory declaration notify the commissioner “about the matters specified,” the appellant was not required to “set out the entirety of the evidence that might be called to prove [these] matters,” [54], and consequently held that the primary judge had erred and that leave to appeal ought be granted. See [46]–[60]. The Court then turned to the critical question of whether the evidence provided established that the appellant had exercised “reasonable control” over her vehicle’s use at the time of the offence. [61]. The term “reasonable” implies a standard that differs depending upon the specific circumstances of the situation. [62]. Particularly significant, in this case, was the fact that the vehicle in question was a private vehicle used for private purposes, [64], [73]. Given these circumstances and the evidence led by the appellant (at trial) that the vehicle was locked, the keys hidden and no one was granted permission to use the vehicle the Court concluded that the Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 9 appellant had been exercising reasonable control. [64]–[65]. Further, the Court also considered that given the private nature of the vehicle it was unnecessary for the appellant to have any “positive system” in place for determining the driver of the vehicle, [73], see also [66]– [74], and further, that her questioning of the potential drivers, by phone, after-the-fact was sufficient to satisfy the final element of the s 114(6) defence. [75], [78]–[80]. Given this conclusion, the Court allowed the appeal. CRIMINAL LAW – JURY MEMBER WRONGLY DISCHARGED – CIRCUMSTANCES WHEN APPROPRIATE TO QUESTION JURY MEMBERS R v PAR [2014] QCA 248 Court of Appeal (Fraser JA and Atkinson and Jackson JJ) 3 October 2014 In this recent appeal against conviction, the Court considered the manner in which complaints about jurors should be dealt with and the circumstances which would warrant the discharge of an individual juror. This question arose by way of an appeal of conviction by PAR (the “applicant”) who argued that, inter alia, there had been a miscarriage of justice during his trial because: (a) there had been a “fundamental irregularity in the conduct of the trial, namely, the way in which a juror was discharged from it,” and (b) “because the information provided to the trial judge about the [the juror in question] was insufficient to support her discharge”. [40]. The relevant facts of this matter are as follows. During the initial trial a note was passed up to the judge expressing the concern of a number of jurors about the suitability of juror 4, whom they alleged did “not seem to understand the importance of this task [being a juror] and ha[d] no input with discussions”. [41]. Following receipt of this note the judge and both counsel questioned a number of the jurors, including the speaker regarding their impressions of juror 4 and (obliquely) her capacity to make a decision. They also questioned juror 4. [42]–[49]. The appellant, in the present application, alleged that: (a) the information received by the judge did not justify the subsequent individual interrogation of the jurors; [51], and (b) even if this conduct had been warranted, the information obtained did not justify the discharge of juror 4. [52]. Though acknowledging the difficulties faced by trial judges when circumstances such as these arise, see [54], the Court ultimately concluded that the “enquiry which preceded the discharge of juror number 4 miscarried”. The Court reasoned that the initial note received by the judge did not suggest that juror 4 lacked “deliberative capacity”, rather, that it merely expressed an opinion about her attitude to her role, [55], and the fact that at the particular stage of the proceeding she had not engaged in any discussion about the case was not significant given that the evidence had not been completed. [56], see also R v Roberts. While some action was required to respond to the note and the concerns of some of the jurors, the Court considered that instructions to the jury as a whole may have been more appropriate, though it did not fault the trial judge for separately questioning the note’s author – this conduct fell within the trial judge’s discretion. [58]. The trial judge did, however, fall into error when he proceeded to separately question the other jurors as the circumstances giving rise to the risk that a “true verdict” would not be reached and that questioning was confined to the issue of the “deliberative capacity” of a single juror which could have been determined from information supplied by a reliable source, [62], or through precise and careful questioning of juror 4 by the trial judge. See also [67]. Though a trial judge has the discretion to permit counsel to question a juror in relation to the possible discharge of that or another juror, the circumstances in which this would be appropriate are rare. [63]. Further, the risks associated with individually questioning numerous jurors, for example that the information obtained will be contradictory – as was the case here – mean that it is a very rare situation where multiple jurors are separately interrogated. [61], [64]. Despite, however, the determination that the process engaged in by the trial judge, with the consent of both counsel, was flawed and the necessity for the order discharging the juror arose from these errors, it concluded that the order was appropriate and lawful. [68]–[69]. Further, the Court considered that there had not been a miscarriage of justice as there was no “failure to observe a mandatory legislative provision relating to the constitution or authority of the jury”, [73], and despite the errors, the appellant was found guilty by a properly constituted jury following a fair trial. The term of the lease was renewed and the guarantee applied to that renewed lease. The respondent was the responsible entity of a managed investment scheme under Chapter 5C of the Corporations Act 2001 (Cth), and the premises were an asset of the fund of that scheme. Sections 601FB(1) and 601FB(2) relevantly provide that a responsible entity is to operate the scheme and perform the functions conferred on it, and that it may appoint an agent to do anything that it is authorised to do. Section 601FC(2) relevantly provides that a responsible entity holds scheme property on trust for scheme members. In 2003 the respondent as the responsible entity of the scheme appointed P as its agent to provide custodial services pursuant to a custody agreement, and by 2008 P became the registered owner of the legal title to the premises and acquired the reversion under the renewed lease. The respondent (and not P as registered owner) sued the applicants for rent and other moneys payable under the renewed lease and the guarantee. The application by the applicants to strike out the respondent’s statement of claim for want of proper parties was dismissed. The applicants sought leave to appeal against that decision. Held, per Jackson J (Fraser and Gotterson JJA agreeing), granting leave to appeal and allowing the appeal: (1) That a money claim for rent and other moneys under a lease is a contractual cause of action. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 66 GENERAL INFORMATION ICLRQ The Incorporated Council of Law Reporting for the State of Queensland (ICLRQ) is a charitable institution which was founded in 1907. Under its constitution, the principal object of the ICLRQ is “the preparation and publication in a convenient form, at a moderate price, and under gratuitous professional superintendence and control, of Reports of Judicial Decisions of the Supreme Court in the State of Queensland.” In pursuit of this object, the ICLRQ publishes a set of authorised reports of the key decisions of the Supreme Court of Queensland (Queensland Reports) and a weekly supplement to these reports (Queensland Law Reporter). Under the constitution of the ICLRQ, all surplus funds from its operations are used to benefit the Supreme Court of Queensland Library. The members of the Council serve on a voluntary basis. Queensland Law Reporter – 24 October 2014 – [2014] 41 QLR 67 QUEENSLAND LAW REPORTER The Queensland Law Reporter has been published since 1908 as a weekly supplement to the Queensland Reports. It is published, both in print and electronic format, every Friday save for a period during the court vacation (from late December to early January). The QLR includes a summary by the editors of this week’s most significant developments in Queensland law, including brief summaries of recent cases which have been identified as potentially suitable for reporting in the Queensland Reports and information about the progress of appeals in reportable cases. The Queensland Law Reporter is a publication which has been approved by Practice Direction of the Supreme Court for the publication of various public notices. It is approved under r 599(4) of the Uniform Civil Procedure Rules 1999 (Qld) for the purposes of giving notice of intention to apply for a grant of probate or letters of administration under Chapter 15 Part 2 of the UCPR. It is also approved under r.12(3)(b) of the Supreme Court (Legal Practitioner Admission) Rules 2004 (Qld), for the purposes of giving notice of intention to apply for admission as a legal practitioner.
