Asadul Haque, Advocate For the State: JC to GA (Mr. Rajesh Shankar) --06/ 11.03.2014 In the instant case, there are 48 petitioners who claim themselves to be ExInstructors under the Non-Formal Education Project which was closed by the Central Government in May 2001 as also by the Government of Jharkhand. They are seeking absorption in any Class-III post under the respondent Government of Jharkhand relying upon a judgment of the Patna High Court passed in CWJC No. 8418/2010. 2. According to the petitioner, earlier this Court had also directed the respondent to take a decision in respect of other similarly situated persons in view of the observation made by the Patna High Court in the aforesaid judgement. 3. Counsel for the State however points out that the judgment passed by learned Single of Patna High Court in the aforesaid case has been stayed by the order dated 10th April 2012 passed in LPA No. 1489/2011 and the case is still pending. The aforesaid fact is also not disputed by the counsel for the petitioner as well who submit that the said case is running in the monthly list of February 2013 for hearing. 4. In that view of the matter, at this stage, no order need be passed. The case is adjourned sine die, however with liberty to the petitioner to make a mention depending upon the outcome of the said LPA pending in Patna High Court. (Aparesh Kumar Singh, J) Ranjeet/
