AUCTION TERMS
1. This is a 7% BUYER’S FEE SALE/AUCTION. The high bid price/offer plus a 7% BUYER’S FEE shall equal the total purchase
price.
2. Registration &Financing Requirements: You are responsible for the cash at closing within 30 days of the date of
this auction or accepted offer. Owner Financing is available with 1/3rd down at closing. See packet for details. The
successful highest bidder is required to pay $3,000 nonrefundable earnest money PER LOT with cash, cashier’s
check, money order, or approved personal check the day of this auction or accepted offer to purchase. Upon accepted
offer, all earnest money becomes non-refundable. Do not enter into the bidding process unless you intend to purchase
according to the Terms & Conditions of this auction/sale.
3. The sale will be subject to existing zoning, ordinances, roads, restrictions of record, and easements of record. Real Estate
taxes for the year of closing will be prorated to the date of closing. Seller will provide and arrange for all title evidence. All
contracts will be prepared by listing broker to be entered into the date of the auction/sale. Seller will convey title by
warranty deed free and clear of all liens and encumbrances.
4. Webb Auction & Appraisal Company has been contracted to offer this property at auction. The property is being offered
“ASIS” and “WHERE IS” with no warranties to buildings, wells or septic systems.
5. All bidding is open and public to qualified bidders that have $3000.00 Earnest money for the lot being bid on and received a
bid number. To bid during the auction, just bid number and call out your bid or instruct the auction team to do so on your
behalf.
6. The successful highest bidder will be required to sign the approved real estate agreement to purchase immediately upon
conclusion of the bidding.
7. All offers subject to seller’s confirmation, the seller reserves right to accept or reject or counter any offer.
8. The sale will close within 30 days of the date of auction or accepted offer at which time purchaser will pay the balance of the
purchase price. Any exceptions must be made prior to the sale.
9. The real estate agreement to purchase, and addendum, if any, that will be used for this sale will be available for review prior
to the start of the auction.

14. When a property is offered, the highest bidder is contractually bound from the moment the auctioneer announces that bid,
identifies the purchaser by bidder number or name, and announces the amount of the highest bid. In the event the buyer
refuses to tender the earnest money deposit and sign the purchase agreements, the auctioneer may resell the property,
using his sole discretion, and the original buyer shall be responsible for any damages and expenses for resale and
collection, including reasonable attorney’s fees. The only condition under which the earnest money and prepaid closing
shall be refunded, is if the seller fails to confirm or accept the bid, or is unable to deliver clear title. If buyer refuses for any
reason to close the earnest money and prepaid fees will be forfeited. All earnest money, less incurred expenses, will be
given to the seller. Upon acceptance of both parties, earnest money becomes non-refundable.
