Fölen är selekterade av Heinz Meyer som även selekterar fölen till Zangersheides och
Schockemöhles A.O.S. auktioner. Hästarna är selekterade av stall Katrinelund och stall
Schockemöhle. Filmer och övrig information på hästarna finns i F.O.S. monter i tältpaviljongen.

Hästarna är veterinärbesiktigade och röntgade. Intygen finns att tillgå i F.O.S. monter.
Det kan finnas anmärkningar på veterinärintyg eller/och röntgenundersökning. F.O.S. och Agria
rekommenderar att intresserade köpare tar del av intygen före auktionen. Veterinär besiktigar
fölen på auktionsdagen samt finns på plats i F.O.S. monter för intresserade köpare.

Budgivningen startar strax efter att hästen har kommit in.
Observera att moms tillkommer på hästar med momspliktiga säljare, se katalogen.
Utöver inropningspriset tillkommer 6 % + moms i avgift till auktionen.

Before the auction
The foals have been selected out of Heinz Meyer, who also selects the foals to Zangersheides and
Schockemöhles A.O.S. auctions. The horses are selected from the stable Katrinelund and stable
Schockemöhle. You can find videos and other information in the F.O.S. stand in the tent pavilion.
All horses are veterinary examined and x-rayed. The health certificates are available in the
F.O.S.stand. There may be remarks on the veterinary health certificate or/and the X-ray
examination. F.O.S. and Agria recommend that potential buyers take part of the health certificate
before the auction. Veterinarian will inspect the foals on auction day and will be on site in the
F.O.S. stand for potential buyers.
The horses and foals are stabled in an auction barn that is open to visitors during daytime.
Contact us if you would like to try one of the horses or see a horse or foal outside the box.
During the auction:
The foals will be shown in hand and the older horses under rider.
The bidding will start right after the horse has arrived in the indoor.
Please note, VAT will be added to the price of each horses with owners subject to VAT,
see the catalog. A 6% commission + VAT will be added on the knockdown price.

Villkor för F.O.S. auktion
Flyinge lördagen den 21 november 2015
Allmänt
1. Dessa auktionsvillkor ska gälla vid hästoch fölauktion (Auktionen) anordnad av PS
Flyinge & Partners AB (Auktionsförrättaren)
på Flyinge lördagen den 21 november 2015.
Budgivare, köpare och säljare accepterar genom sitt deltagande vid Auktionen tillämpning av dessa auktionsvillkor, samt att auktionsvillkoren ska gälla som avtalsvillkor vid
köp av häst och föl på Auktionen.
7. Budgivning ska ske i SEK. Bud ska avges
med hög och tydlig röst eller genom tydligt
tecken. Auktionsutroparen bestämmer nivå
med vilket bud måste höjas för att godtas
som nytt bud. Auktionsutroparen har rätt att
bortse från bud samt, om oklarhet föreligger
beträffande det sist avgivna budet, att besluta
att budgivningen ska återupptas. Auktionsutroparen beslutar då på vilken nivå budgivningen ska återupptas.
2. Auktionsförrättaren utser auktionsutropare för auktionen.
8. Bud som avges under auktionen ska anses
avgivet exklusive inropsavgift och lagstadgad
moms. Budgivaren är bunden vid avgivet bud
till dess annat högre bud avgetts. Om flera
lika höga bud avgetts som slutbud, ska det
bud som avgavs först anses utgöra högsta bud.
3. Med säljare avses i detta avtal den som är
ägare till häst eller föl erbjuder hästen/fölet till
försäljning på auktionen.
Information och undersökning före köp
4. Information om hästen/fölet finns i auktionskatalogen. Häst/föl veterinärbesiktigas
på auktionsdagen. Häst har röntgats före
auktionen. Kopia av veterinärutlåtande finns
tillgängligt för köparen innan auktionen. På
grund av fölets ålder röntgas det inte före auktionen. Häst/föl säljs i befintligt skick.
5. Köparen uppmanas att bedöma och undersöka hästen/fölet före auktionen. Frågor
om hästen/fölet kan ställas till säljaren eller
dennes representant.
Utropspris och budgivning
6. Utropspriset för häst är SEK 70.000 och för
föl SEK 30.000. Före utrop anger auktionsutroparen om säljaren är registrerad för mervärdesskatt (moms) eller inte.

Pris
9. Den som avgivit högsta budet vid auktionsutroparens klubbslag har till detta pris
(Klubbat pris), inropsavgift samt lagstadgad
moms, ingått bindande avtal om köp med
säljaren. Inropsavgift som ska betalas av köparen till auktionsförrättaren, utgår med 6 %
plus moms på Klubbat pris. Klubbat pris plus
moms samt inropsavgift plus moms utgör således Totalpriset för hästen/fölet.
Skriftligt avtal och äganderätt
10. Säljaren och köparen ska underteckna
skriftligt köpeavtal avseende hästen/fölet om
en av dem begär det. Äganderätten till hästen/
fölet övergår från säljaren till köparen när köparen erlagt full betalning till av Totalpriset
till Auktionsförrättaren.
Betalning
11. Betalning av Totalpriset ska erläggas till
Auktionsförrättaren mot faktura. Betalning
ska ske senast 5 bankdagar efter Auktionen.
Vid sen betalning utgår dröjsmålsränta enligt lag. Där jämte har säljaren rätt att kräva
att köparen fullgör köpet.
Avhämtning och registrering
12 Köparen ska, om inte annat överenskommits med säljaren, avhämta hästen efter
Auktionens avslutande samt full betalning
erlagts. Köpare av föl, ska om inte annat
överenskommits med säljaren, avhämta föl
hos säljaren senast 14 dagar efter avskiljningsdagen, som infaller när fölet uppnått
6 månaders ålder. Köparen har inte rätt att
avhämta föl innan avskiljningsdagen samt
full betalning skett. Vid avhämtning ska
säljaren överlämna hästens/fölets registreringspass. Ägarförändring ska registreras av
köparen på dennes bekostnad.
Vårdplikt och kostnader
13. Säljaren är skyldig att på sin bekostnad
väl vårda hästen/fölet till dess avhämtning
skett. Köparen ska dock stå för samtliga
veterinärkostnader och extraordinära kostnader för hästen/fölet som uppstår under
den tid efter Auktionen som hästen/fölet är
i säljarens vård.
Försäkring kan tecknas med Agria Djurförsäkring under Auktionen. Kontakta Agrias
representant på plats.
Övriga villkor
15. Säljaren svarar ensam för fel och brist
i hästen/fölet. Reklamation av fel eller brist
i anledning av köpet ska framställas till
säljaren inom två veckor från det köparen
uppmärksammade eller rimligen borde ha
uppmärksammat felet eller bristen.
16. Säljaren ansvarar för att information om
hästen/fölet i auktionskatalogen samt information som lämnas på annat sätt av säljaren
eller dennes representant före auktionen är
korrekt. Säljaren är ensam ansvarig för att
denne har rätt att sälja hästen/fölet på auktionen. Säljaren ansvarar för att uppgift om
momsregistrering är korrekt.
17. Auktionsförrättaren ansvarar inte för
information om föl och fölets medicinska
status och inte heller för veterinärbesiktning
eller veterinärutlåtande. Beträffande häst
ansvarar auktionsförrättaren inte för veterinärbesiktning eller veterinärutlåtande.
Tillämplig lag och tvist
18. Tvist i anledning av auktionen och köp
av häst/föl ska avgöras enligt svensk rätt vid
svensk domstol.
Riskens övergång
14. Risken för hästen/fölet övergår från säljaren till köparen vid klubbslaget. Köparen
är skyldig att hålla hästen/fölet försäkrat
fram till dess avhämtning skett.

Terms and conditions for F.O.S. auction
at Flyinge, Sweden, Saturday 21 November 2015
General conditions
1. These auction terms and conditions apply
to the horse and foal auction (the “Auction”)
arranged by PS Flyinge & Partners AB (the
“Auction Organizer”) at Flyinge on Saturday,
21 November 2015. Through their participation at the Auction, bidders, buyers and sellers agree to be bound by these auction terms
and conditions and that the auction terms
and conditions shall apply as contract terms
and conditions in conjunction with purchases
of horses and foals at the Auction.
2. The Auction Organizer shall appoint the
auctioneer for the Auction.
3. As used in this agreement, “seller” means
the party which is the owner of the horse or
foal, offering the horse/foal for sale at the
Auction.
Information and inspection
prior to purchase
4. Information regarding the horse/foal is set
forth in the auction catalog. The horse/foal
is examined by a veterinarian on the auction
date. The horse has been x-rayed prior to the
Auction. A copy of the veterinarian’s opinion
is made available to the buyer before the Auction. Due to the age of the foal, it will not be
x-rayed before the Auction. Horses/foals are
sold “as is”.
5. The buyer is encouraged to consider and
examine the horse/foal prior to the Auction.
Questions regarding the horse/foal can be posed to the seller or its representative.

Opening price and bidding
6. The opening price for horses is SEK 70.000
and for foals SEK 30.000. Prior to the opening
of bidding, the auctioneer states whether or
not the seller is registered for value added tax
(VAT).
7. Bidding takes place in SEK. Bids must be
given with a loud and clear voice or through
clear signs. The auctioneer decides the amount
by which a bid must be higher than the previous bid in order to be accepted as a new bid.
The auctioneer is entitled to disregard bids
and, in the event of uncertainty regarding the
last bid given, to decide that bidding shall be
resumed. In such case, the auctioneer decides
at what level bidding will be resumed.
8. Bids given during the Auction shall be
deemed to have been given excluding the
purchase fee and statutory VAT. The bidder is
bound by any bid given by him/her until such
time as a higher bid has been given. Where
several equivalent bids have been given as the
final bid, the bid given first shall be deemed to
be the highest bid.
Prices
9. The party giving the highest bid at the time
the auctioneer strikes his hammer has entered
into a binding agreement of sale with the seller at this price (Hammer Price), purchase fee
and statutory VAT. The purchase fee which
shall be paid by the buyer to the Auction Organizer is payable in the amount of 6%, plus
VAT, on the Hammer Price. Consequently,
the Hammer Price, plus VAT, together with
the purchase fee, plus VAT, constitute the Total Price for the horse/foal.
Written agreement and title
10. The seller and buyer shall on request by
either of them enter a written agreement of
sale regarding the horse/foal. Title to the
horse/foal is transferred from the seller to the
buyer upon full payment by the buyer to the
Auction Organizer of the Total Price.
Payment
11. Payment of the Total Price shall be made
to the Auction Organizer upon invoice. Payment must be made not later than 5 business
days after the Auction. In the event of late
payment, penalty interest is payable as provided by law. The seller shall also be entitled to
demand that the buyer perform the purchase.
Collection and registration
12. Unless otherwise agreed with the seller,
the buyer shall collect the horse after the close
of the Auction and payment in full has been
made. Unless otherwise agreed with the seller, a buyer of a foal must collect the foal from
the seller not later than 14 days after the separation date, which occurs when the foal is six
months of age. The buyer shall not be entitled
to collect the foal before the separation date
and before payment in full has been made.
Upon collection, the seller shall surrender
the registration passport for the horse/foal.
Changes in ownership shall be registered by
the buyer at buyer’s expense.
Duty of care and costs
13. The seller is obligated, at its own expense,
to properly care for the horse/foal until such
time as collection has occurred. However, the
buyer shall bear any and all veterinary costs
and extraordinary costs for the horse/foal
which arise during the period of time after
the Auction during which the horse/foal is in
the care of the seller.
Passing of the risk
14. Any risk associated with the horse/foal
shall pass from the seller to the buyer at the
time the hammer strikes. The buyer is obligated to maintain insurance on the horse/foal
until such time as collection has occurred.
Insurance may be purchased from Agria
Djurförsäkring during the Auction. Please contact Agria’s representative on location.
Other terms and conditions
15. The seller shall be solely liable for any defects and deficiencies in the horse/foal. Any
claims regarding defects or deficiencies as a
consequence of the purchase must be presented to the seller within two weeks from such
time as the buyer became aware, or reasonably should have become aware, of the defect
or deficiency.
16. The seller shall be liable for ensuring that
any and all information regarding the horse/
foal contained in the auction catalog, as well
as any information otherwise provided by the
seller or its representative prior to the Auction, is correct. The seller shall be solely responsible for ensuring that it is entitled to sell
the horse/foal at the Auction. The seller shall
be responsible for ensuring that information
regarding VAT registration is correct.
17. The Auction Organizer is not liable for
any information regarding the medical status
of the foal or for any veterinary examination
or veterinarian’s opinion. With respect to horses, the Auction Organizer is not responsible
for veterinarian examinations or veterinarian
opinions.
Applicable law and disputes
18. Any dispute arising as a consequence of
the Auction and purchase of a horse/foal shall
be resolved according to Swedish law by a
Swedish court of law.
