Agreement: follows: Your host Art and Karen Hooven (owners) and tenant(s) agree as Above Tenants(s) is an adult and will be an occupant of the unit during the entire reserved period. Other occupants will be family members, friends or responsible adults, but no more than the maximum numbers of adults are allowed to stay and occupy the unit. Use of the premises will be denied to persons not falling within the aforementioned categories, and as a result, they would have to vacate the property immediately without refund. Tenant shall NOT sublease the unit. No business of any kind shall be conducted in the unit. Keys will not be issued to anyone who is not an adult. Keys will only be issues to the person(s) who have completed and signed this Rental Agreement. 2. Check-In: 3:00 P.M. and Check-Out: 11:00 A.M. Please plan your arrival for late in the day, as your accommodations will not be ready prior to 3:00 p.m. The Property Manager will meet you at the pre-appointed time, or at 3:00 p.m. for normal check-in. At check-in the Property Manager will conduct an informal walk-through of the home to advise you of important information pertaining to the home. Please plan your departure for 11:00a.m. so that our housekeeping staff may have time to properly prepare the unit for our next guest. By 11:00 a.m. on the day of your departure, your vacation home should be empty of your personal belongings, trash out and in the proper receptacles, all dishes washed and left in a generally neat and orderly condition. Please be certain that you have taken with you all personal items, the Owners and/or Property Mangers(s) cannot be responsible for items left behind. Keys should be returned to the Property Manger, unless other arrangements are made. A $46/hr fee will be charged for each hour (or portion thereof) past the required check-out time. A $25 per item fee will be charged for each key lost. 3. PETS: Not Allowed. No dogs are allowed on the premises without the prior written consent of the property owners. If a pet is approved, an additional rental fee, and a substantial damage deposit will be required. You MUST clean up after your pet. That includes proper disposal of all waste materials. You must also maintain control of your pet at all times, and NEVER leave a dog unattended. If you are leaving for the day and do not want to take the dog with you, you must put it in a local kennel, or find alternative solutions to leaving the dog alone at the property. You must depart the home in the same clean condition you found it upon arrival; including removal of pet hair--so that it is not visible. Any complaints from neighbors regarding excessive noise, or other nuisances from your pet, may be a cause for immediate termination of this rental agreement and forfeiture of the remaining rental fee. CATS ARE NEVER ALLOWED---NO EXCEPTIONS! 4. SMOKING: Not Allowed---No Exceptions! If the Tenant(s) leaves evidence of smoking and/or smoking odors inside the home, any sanitizing and deodorizing of carpet, upholstery, window coverings, etc., will be at the expense of the Tenant(s)—charged against the security deposit. 5. SECURITY DEPOSIT: The security deposit is due 7 DAYS prior to your stay—in the form of a cashier’s check. This includes Pet Deposit if applicable. Cancellation of your reservation will occur if you fail to pay your Security Deposit within this time frame. Your Security Deposit is fully refundable, and will be refunded within 14 days of termination of occupancy, provided that real and personal rented property are vacated in the same condition as the commencement of the rental. 6. ADDITIONAL TENANT(S) LIABILTY: Tenant(s) will be held liable for replacement and/or repair of items that are damaged, and not attributable to normal wear and tear. Tenant(s) will be responsible for any damages caused by willful or malicious acts occurred during their stay. Tenants(s) agree to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant(s) or Tenant’s guest, including, but not limited to: furnishing, landscaping, misuse of appliances, and/or equipment. If damages are in excess of the security deposit being held, Tenant(s) agree to reimburse the Hosts, Art and Karen Hooven (owners), for cost incurred to repair/replace damaged items. We appreciate you reporting all maintenance items, and we will respond to them as soon as possible. Please understand that if your actions have caused a maintenance call, your damage deposit will be charged. 7. CANCELLATION: No Refunds. There are no refunds for cancellation of your scheduled stay. If you are forced to cancel your reservation, you will forfeit your rental fee. Every effort will be made to re-rent the property. If the property is re-rented to someone else, at the same rate, for the same time period, we will refund your rental fee, less $100 for administrative fees. Your security deposit is fully refundable. 8. WEATHER CONDITIONS: No Refunds. We do not offer refunds for inclement weather conditions during your stay—we are providing the accommodations only. 9. CLEANING: Each Property will be inspected, sanitized and cleaned prior to your arrival, and after your departure. Your rental fee provides up to three hours of normal cleaning after you depart, so that you may enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition as when you arrived, by making sure dishes are washed and put away, towels and linens are washed and dried, and the home is generally “picked up” and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit at the rate of $46/hr. 10. TELEPHONES and FAX: The telephone number is 480-563-3441. Long distance telephone service is blocked. YOU MUST USE A CREDIT CALLING CARD, or CALL COLLECT WHEN MAKING LONG DISTANCE TELEPHONE CALLS. Telephones may be used to make as many local calls as you wish. Additional phone jacks are available throughout the home for use with computers, etc. The Fax number is 480-563-1941 – it also requires a calling card, just press the speaker phone on fax and enter the card number. 11. WHAT WE SUPPLY: The property is fully furnished, and is equipped to include: bedspreads, linens, blankets, pillows, towels, as well as a fully equipped kitchen, TV’s and satellite system, laundry room, air conditioning, built in barbeque and outdoor furniture. WE MAY NOT HAVE ALL THE ITEMS YOU ARE ACCUSTOMED TO HAVING AT YOUR OWN HOME. If there is a specialty item that you are accustomed to using (such as a special type of cooking utensil, etc.) please provide for those items by bringing them with you. If you have any questions about what is provided with the home, please contact the Property Manger prior to your arrival. 12. WHAT YOU SHOULD BRING: You must bring with you such items as bath soap, shampoo, and all personal toiletries. 13. SLEEPING CAPACITY/DISTURBANCES Tenant(s) and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: 1) Occupancy exceeds the sleeping capacity stated on the reservation confirmation; 2) Using the premises for and illegal activity including, but not limited to, the possession, serving, or consumption of alcoholic beverages, by or to persons not allowable by law; 3) Causing damage to the premises or to any neighboring property, and 4) Any other act(s) which interferes with any surrounding neighbor’s right to quiet enjoyment of their property. We love our guest, but loud and unruly tenants will not be tolerated. The home is located in a residential area, and may not be used for weddings, wedding parties, receptions, or other large group functions without written approval from the owners. The home may be located in a homeowners association, where failure to comply with regulations concerning parking, noise or other disturbance, may result in being asked to leave and/or loss of your remaining rental funds and security deposit. 14. UTILITIES: Weekly Rentals: Owner will pay for basic phone and cable service, water/trash, and association fees. Tenant agrees to pay long distance telephone charges, gas and electricity (in excess of $125.00 billed during your rental period) All additional charges that are the responsibility of the tenant(s) will be deducted from the security deposit as they are incurred. No Monthly Rentals. Pool: (Heating the pool is costly during the winter but well worth it) If you choose to heat the pool the cost will be deducted from your security deposit (up to $250.00 a week). You will be in charge of turning the pool on upon arrival and turning it off when you depart, unless other arrangements are made prior to arrival. Do not throw any sanitary napkins or tampons into the toilet. Do not dispose of any harsh chemicals/detergents, or bleach in large amounts down the sink drain. Do not place any metal or aluminum foil objects in the microwave oven. Please do not spill fats or grease down the sink drain or toilet. 15. SWIMMING POOL, PATIOS AND FIRE ADOBE: Tenant(s) hereby acknowledges that the property that they are renting includes a fire adobe (and/or swimming pool). Tenant is fully aware, 1) fire adobe and pool can be dangerous (drowning or burning hazard), 2) deck/patio can become slippery when wet, and that injury may occur to anyone who is not careful, 3) Tenant(s) are fully aware of their responsibility of all the doors and gates that are leading out to the patio and pool, 4) Tenant(s) should adhere to all the rules and policies as posted at the property, and/or given verbally by the Property Manger(s). Tenant(s) accepts with full knowledge, these warnings, and accepts and assumes all risks involved in or related to the use of the fire adobe, swimming pool and deck/patio areas. 16. . HOLD HARMLESS: The Owners, Art and Karen Hooven, and their assigned Property Managers do not assume any liability for loss. Tenant(s) are aware that this home has stairs and they can possibly become a problem for small children and the elderly or handicapped. Tenant(s) agree to hold harmless, the aforementioned entities, for damage or injury to persons or their personal property during the duration of their rental. It is understood that they are not accountable for liability of any inconveniences arising from any temporary defect or stoppage in supply of water, gas, electricity or plumbing that is beyond their control. Further, they cannot be held liable for any loss or damage to Tenant(s) personal property caused by weather conditions, natural disasters, or other events beyond their control. The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owners and Property Mangers from any and all claims, demands and causes of action, by reason of any injury or damage which has or have occurred, or may occur to the undersigned, or any of his/her guest as a result of, or in connection with, the occupancy of the premises, and agrees to hold Owner and Property Managers free and harmless of any claim or suit arising. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entilited to recover reasonable attorney fees and cost. 17. PAYMENT BY CASHIER’S CHECK: Payment of rental fee and security deposit will be accepted in guaranteed funds only, such as a Cashier’s Check or Money Order. Personal checks are not accepted, and will not secure your reserved rental dates (dates will be released for re-rental, until guaranteed funds are provided). Your reservation will NOT be confirmed until the rental agreement has been received and the rental fee check (paid in guaranteed funds) has been cashed. 18.
