Kommunal- og moderniseringsdepartementet sender med dette på høring forslag til endringer i plandelen av plan- og bygningsloven. Endringene gjelder: Mer effektive planprosesser Det åpnes for at kommunen skal kunne stanse behandling av et privat planinitiativ allerede i forbindelse med oppstartmøtet, dvs. langt tidligere i planprosessen enn i dag. Forslaget skal sørge for at kommunene ikke behøver å bruke tid på urealistiske planinitiativ. Det foreslås dessuten en mer formalisert oppstartfase som skal sikre en forutsigbar planprosess. Oppstartmøtet skal styrkes og klargjøres for å gi tydelige rammer for det videre planarbeidet. Hvis kommunen ønsker å gå videre med et planinitiativ, skal kommunen i de fleste tilfeller ha plikt til å gjennomføre høring av private planforslag. Kommunen kan samtidig legge ved sitt eget alternative forslag. Enklere å endre og oppheve arealplaner Departementet foreslår at større planendringer enn i dag skal kunne gjennomføres uten full planbehandling. Kommunen skal i større grad kunne bruke planfaglig skjønn ved vurderingen av hvilken saksbehandling (varsling mv.) som er nødvendig for å gjennomføre endringer. Kommunen skal videre kunne oppheve eldre planer som ikke er i samsvar med overordnet plan uten å måtte følge krav til full planbehandling som i dag. Forslaget skal sørge for at kommunene uten mye ressursbruk kan oppheve eldre planer som er uten betydning i dag. Enklere dispensasjonsregler Det foreslås endringer i loven som gir enklere og tydeligere kriterier for kommunens behandling av dispensasjonssaker. Endringene vil gi større lokalt handlingsrom for mindre tiltak som ikke har nasjonal eller viktig regional betydning, og vil innebære at færre saker skal innom sektormyndighetene. Forslag om utvidet gebyrgrunnlag ved behandling av områderegulering Det forslås å gi kommunen hjemmel til å ta gebyr for sin behandling av forslag til områderegulering som er utarbeidet og bekostet av private. Siktemålet med forslaget er å gi kommunene et insitament til å utarbeide flere områdereguleringer ved at gebyrinntektene kan øke plankapasiteten. Forslaget legger opp til at gebyrgrunnlaget skal utvides til å omfatte kommunens arbeid med planforslaget til og med høring og offentlig ettersyn, herunder merknadsbehandling av høringssvarene. Forenklinger som gjelder regionale planer Departementet foreslår å oppheve dagens krav til sentral godkjenning av regionale planstrategier. Det foreslås også å fjerne kravet om obligatorisk oppdatering (rullering) av regionalt handlingsprogram. Forslagene må ses i lys av regjeringens ønske om å styrke det lokale handlingsrommet. Etablering av en frivillig sentral godkjenningsordning for planforetak Det foreslås at foretak som utarbeider private reguleringsforslag skal kunne søke om sentral godkjenning i en frivillig godkjenningsordning. Ordningen skal gjøre det enkelt for dem som lager planforslag å dokumentere sine faglige kvalifikasjoner og enklere for en oppdragsgiver å velge en seriøs aktør. Strengere krav til dokumentasjon av kvalifikasjoner vil gjøre at kommunene får planforslag av bedre kvalitet enn i dag, noe som sparer tid og ekstraarbeid for alle parter. Forslag om overgangsbestemmelse for planer i strandsonen uten byggegrenser Det foreslås å lovfeste Kommunal- og moderniseringsdepartementets fortolkning av overgangsbestemmelsen i pbl. § 34-2 fjerde ledd i forhold til kravet i § 1-8 tredje ledd om byggegrense i reguleringsplan innenfor 100-metersbeltet mot sjøen. Departementet syn er at kravet til byggegrenser ikke gjelder for planer utarbeidet etter tidligere plan- og bygningslover. Departementet viser til at Sivilombudsmannen i en uttalelse fra 2015 har kommet til at kravet til byggegrense må anses å gjelde alle planer i strandsonen, også planer vedtatt med hjemmel i tidligere lovgivning. Departementets forslag skal bidra til en rettslig avklaring på et punkt hvor det er ulike rettsoppfatninger i dag. Nye saksbehandlingsfrister som styrker rettssikkerheten for tiltakshaver i byggesaker Departementet foreslår endringer i loven som gjør at kommunen må behandle byggesaken på grunnlag av den planen som gjaldt da 12-ukersfristen for byggesaksbehandlingen utløp. Det Side 2 betyr at kommunen ikke kan bruke et nytt plangrunnlag eller legge ned byggeforbud etter at fristen er utløpt. Retting av mindre feil i plan- og bygningsloven Det forslås noen mindre rettinger av feilskrift mv. Gjennomføring av høringen Frist for å gi høringsuttalelse er 15. november 2015.
