Executive Director’s Report Bruckner reported: The process to obtain advertisers for our CCPCA 2015 Installation Dinner Program Book has begun. The proceeds from these advertising revenues are a significant source of funding for the Installation Dinner and we are again asking each member to provide a lead to a potential advertiser in the program book. Please send the names of potential advertisers to me immediately so that we can initiate a contact letter to them. I will need their name, title, company/organization, address, phone number and e-mail if available. Associate Members. We would ask that you consider placing an ad in the 2015 program book for your business or organization. As a result of the retirement of Associate Member Bob Sorin we were in need of a new tax preparer. Associate Member Jim Lineweaver has offered the services of his firm for our tax preparation but due to certain legalities he was unable to perform an annual audit of the Associations finances, The Board has decided to form an Audit Committee to perform an annual audit. This committee will be appointed in 2015 and will consist of the incoming President, the incoming Secretary -Treasurer and the incoming Junior Governor. CLEVELAND The General Membership meeting of the Cuyahoga County Police Chiefs Association was called to order at 1212 hours by President Gilles. Roll Call Chief Baumgart led the Pledge of Allegiance and Chaplain Kevin Nietert led the Invocation. Secretary Treasurer Lee called the roll of officers. Governor Malley was absent. Members and guests introduced themselves. President Gilles thanked Director Carolyn Williams, Chief Ben Davis and the Federal Reserve Bank for hosting today’s meeting. Director Williams welcomed the membership to the Federal Reserve Bank. Approval of Previous Meeting Minutes A motion to accept the minutes of the regular membership meeting of September 18, 2014, as distributed, was made by Chief Upperman and seconded by Chief LaGatta. Motion Passed. Financial Report Secretary Treasurer Lee reported that our account balances are as follows: $ 13,372.99 General Fund $ 5,374.46 Scholarship Reserve $ 20,586.46 Checking $ 39,333.91 Total A Motion to accept the Financial Report was made by Chief Lee and seconded by Chief Reid. Motion Bob Legal update Steve Parisi. Cincinnati v. Ilg, Slip Opinion No.2014-Ohio-4258. The approval of a breath analyzer machine (Specifically the Intoxilyzer 8000 in this case) by the director of the Ohio Department of Health as a device to test breath-alcohol concentration does not preclude an accused from challenging the accuracy, competence, admissibility, relevance, authenticity or credibility of specific test results or whether the specific machine used to test the accused operated properly at the time of the test. The IACP has issued guidelines concerning the use of videos. Steve suggests consulting this sample policy as well as estimating costs before issuing department policy regarding the use of videos. Steve recommends that each department establish policy concerning the collection of DNA samples from persons arrested for felony offenses. Steve recommends that each department establish policy concerning access to the operation of the Ohio Attorney General’s facial recognition program. Speakers for Today’s Meeting Walter S. Topp, Administrator, Cuyahoga County Office of Emergency Management. “Services Available to Cuyahoga County Police Departments.” His office supports local Police and fire departments through planning, preparation and training. Their job is preparation and coordination of resources, not response. They are the conduit for additional state or federal aid. The agency encompasses CECOMS and all 911 PSAPS. Page 2 Dr. Thomas Gilson, Cuyahoga County Medical Examiner. “Current Status of the County Crime Laboratory” Dr. Gilson advised that the lab is now complete and as of January 1, 2015 there will be no cost to all county users except CPD and CMHAPD. He needs a central evidence contact for each police department. Please call that information in to Hugh Shannon at the Medical Examiners Office. Available services have been expanded and evidence courier service is now available. Tim McGinty, Cuyahoga County Prosecutor. “Currrent Status of the Prosecutors Office.” Prosecutor McGinty advised that he is trying to improve transparency in the Prosecutor's Office. The Rape Kit Task Force in his office has completed 200 prosecutions and another 300 are expected. He advises that police departments may require a DNA swab from arrestees without a court order, the same as fingerprints are taken. His office is taking over felony and misdemeanor charging of juveniles. Committee Reports Membership: Two new membership applications have been received. Chief Kevin M. Wyant, Moreland Hills Police Department has been approved for Active Membership by the Board. A new application has been received for Associate Membership from John P. Frain, Director of Risk management, Cleveland Browns. A motion to approve the membership application of John P. Frain was made by Chief Miller and seconded by Chief Maddox. Motion passed. Chief Jim Foster, Brook Park PD and Chief Kevin Bielozer, Westlake PD have indicated an interest in running for the open governor’s position. Other interested Chiefs may also still apply. Rick Bell, Cuyahoga County Prosecutor’s Office advised that DNA profiles have been used for John Doe indictments by the Prosecutor’s Office. He advises that all departments should ensure that their DNA samples have all been tested at BCI. Giles Falinski, South University is looking for information on utilizing student volunteers with the “Cold Case Institute”. Contact him directly if you have any information.
