Mechanical Breakdown Warranty Plan A Summary The following is summary of the Mechanical Breakdown Warranty Plan A. Full Terms and Conditions shall be provided to you upon purchase and are available upon request. Plan A In order to be eligible for cover under this Warranty Your Vehicle: Must be less than 6 years old and have less than 80,000 miles on the odometer at the start date of the Warranty. Must not be one of the following: all American, Australian and Canadian cars (unless built for the UK), AC, Aston Martin, Bentley, Bristol, Ferrari, Lamborghini, Lotus, Maserati, Morgan, Porsche (not Boxster), Rolls Royce, TVR, stretched limousines, kit cars, cars modified outside manufacturer’s specification. Must not be used for hire or reward, commercial use, professional instruction, competition or off-road use, motor rally, speed or duration tests or any practice for these events. What parts are covered? All mechanical and electrical components are covered against sudden Mechanical Breakdown of the Vehicle provided the conditions of the Warranty are complied with. A summary of items excluded from Plan A are listed below: General - All bodywork, handles and hinges, interior/exterior trim, brightwork, paint, glass, weatherstrips, rubber seals, sheet metal, sun roof panels, carpets, seat belts, wiper arms/blades, wheels and tyres, wheel alignment/balancing, adjustments. Service items and other components subject to routine maintenance or periodic repair or replacement. Working materials – Unless working materials and supplies such as oils, filters and anti-freeze are required as a direct result of the failure of a Warranted Part. This does not include lubrication of chassis points, hinges, linkages and topping up fluid levels. Clutch – Where the condition is due to wear and tear or the clutch is burnt out. Contaminated Fuel – The clearing of fuel lines, filters, carburettors and pumps/ nozzles. Electrical Accessories – Bulbs, lamps/lenses, batteries, fuses, car telephones, etc. – Any in-car entertainment units, unless factory fitted (up to £50 repair on each occasion). Miscellaneous Items – Water ingress, exhaust system, auxillary drive belts, brackets, mountings, tappings, supports, fixings and fastening devices, fuel tank, corrosion, rubber hoses, pipes and unions, air bags, decarbonisation and failures caused by the build up of carbon deposits (including burnt valves). Please note, any items that do not form part of the manufacturer’s original specifications of the Vehicle are excluded from cover. A full list of exclusions are detailed in the applicable Warranty Terms and Conditions. Vehicle Assistance If a repair to Your Vehicle is required You may benefit from the following additional benefits: 1) Car hire Costs for car hire for up to 7 days at a maximum of £50 per day (inclusive of VAT) will be covered subject to the following conditions:i) ii) iii) iv) v) vi) You accept responsibility for the entire cost of the first 24 hours of car hire; and the cost of the car hire is within the overall Warranty limit; and the failure has completely disabled the Vehicle; and the hired Vehicle is of a like kind and quality rented from a bona fide rental operator; and the hire period is limited to the period the Vehicle is in the workshop undergoing repairs or a maximum of 7 days, whichever is less; and the daily claim amount includes VAT, but excludes fuel and insurance. 2) Recovery We will pay for towing charges up to £50 including VAT (where applicable). 3) Overnight accommodation We will pay up to £50 per occurrence including VAT, if: i) Mechanical Breakdown occurs outside a 50 mile radius of your address or your intended over-night accommodation; and ii) the Vehicle cannot be repaired during the day of the Mechanical Breakdown; and iii) a relief Vehicle is not available. 4) Continental use The Warranty shall apply for up to 60 days in any 12-month period while the Vehicle is in any country of the EU or EFTA. The most we will pay is restricted to the equivalent UK rate for labour charges, and for parts at the manufacturer’s list prices which are current at the date of the Mechanical Breakdown. Repair requests and queries : In the event that you wish to make a repair request or have any queries, please contact the Adminstrator on 0844 871 7763. You may cancel this Warranty at any time, however no refund will be due. Servicing Requirements: To keep your Warranty valid you must: - Keep the Vehicle serviced and repaired, at a repairer authorised to service Your make of Vehicle according to the Manufacturer’s Service Schedule and intervals for Your particular make, age and type of vehicle. Services must be carried out within 30 days or 1,000 miles of the due date, whichever occurs first. You must keep all receipts and invoices. Plan A Warranty Terms and Conditions 1. DEFINITIONS In this agreement, some words have defined meanings. They are shown below. Administrator - TWG Services Limited, The Aspen Building, Floor 2, Vantage Point Business Village, Mitcheldean, Gloucestershire, GL17 0AF. Registered number 3336853. Authorised Repairer – A repairer authorised by the Administrator to effect repairs on Your Vehicle. Mechanical Breakdown - The sudden and unforeseen failure of a Warranted Part, not by wear and tear, normal deterioration or negligence. We are not liable for Warranted Parts that have reached the end of their normal working lives because of age or usage. Purchase Price - The original purchase price of the Vehicle as detailed on the Schedule. Vehicle - The vehicle details as set out on the Schedule. Warranted Part/s - All parts except for those listed as exclusions in section 4 below. Warranty Period - The warranty period stated on the Schedule. COVERAGE 3.1 Level of Cover - All mechanical and electrical Warranty cover We will pay for replacement parts and labour, should Your Vehicle require repairs following a sudden Mechanical Breakdown during the Warranty Period. This covers all mechanical and electrical parts other than those specifically listed as excluded under Section 4 below. Please note: Replacement of drive belts, filters, lubricants, antifreeze and fluids required because of the failure of a Warranted Part, is covered by the Warranty. Consequential damage to a part is covered if it is caused by a Warranted Part, but this excludes any damage which is cosmetic in nature. The Warranty will be valid for the duration of the Warranty Period, subject to the terms and conditions contained herein. There is no mileage limitation on the Vehicle while the Warranty is in place. The maximum Claim Limit per claim shall be the amount as detailed on Your Schedule. Our total limit of liability under the Warranty shall not exceed the Purchase Price of the Vehicle as detailed on the Schedule. 3.2 Additional Benefits If a repair to Your Vehicle is necessary under this Warranty You may benefit from the following: Car Hire Costs for car hire for up to 7 days at a maximum of £50 per day (inclusive of VAT) will be covered subject to the following conditions: i) ii) iii) iv) v) vi) You accept responsibility for the entire cost of the first 24 hours of car hire; and The cost of the car hire is within the overall Warranty limit; and The failure has completely disabled the Vehicle; and The hired vehicle is of a like kind and quality rented from a bona fide rental operator; and The hire period is limited to the period the Vehicle is in the workshop undergoing repairs or a maximum of 7 days, whichever is less; and The daily claim amount includes VAT but excludes fuel and insurance. Overnight Accommodation In respect of overnight accommodation, up to £50 per occurrence (inclusive of VAT) provided that: i) ii) iii) Mechanical Breakdown of the Vehicle has occurred outside a 50 mile radius of Your address or intended overnight accommodation; and The Vehicle cannot be repaired during the day of the Mechanical Breakdown; and A relief vehicle is not available. Continental Use The Warranty shall apply whilst Your Vehicle is in any country of the EU or European Free Trade Association (EFTA) for a period of not more than 60 days in any 12 month period, with the limit of cover restricted to the equivalent Untied Kingdom rate for labour charges and parts at manufacturer’s list prices as applicable at the date of the Mechanical Breakdown. 4. EXCLUSIONS The following parts are excluded from cover: General i. All bodywork, handles and hinges, interior/exterior trim, brightwork, paint, glass, weatherstrips, rubber seals, sheet metal, sun roof panels, carpets, seat belts, wiper arms/blades, wheels and tyres, wheel alignment/balancing, adjustments. ii. Service items – service items and other components subject to routine maintenance or periodic repair or replacement. iii. Items which do not form part of the manufacturer’s original specifications of the Vehicle. Timing belts – Unless there is proof that the manufacturer’s replacement recommendations have been complied with, and they are free from oil contamination. Casings – Unless damage has been caused to the cylinder block, gearbox and axle, as a direct result of the failure of a Warranted Part. Working materials – Unless working materials and supplies such as oils, filters and anti-freeze are required as a direct result of the failure of a Warranted Part. This does not include lubrication of chassis points, hinges, linkages and topping up fluid levels. Clutch – Where the condition is due to wear and tear or the clutch is burnt out. Brakes – Brake discs, brake pads, brake linings/shoes. Contaminated Fuel – The clearing of fuel lines, filters, carburettors and pumps/nozzles. Electrical Accessories – Bulbs, lamps/lenses, batteries, fuses, wiring harness, wiring terminals and remaking of disturbed electrical connections, car telephones. Any in-car entertainment units, unless factory fitted (up to £50 repair on each occasion). Miscellaneous Items – Water ingress, exhaust system (with the exception of catalytic convertor where the Vehicle is under 5 years old, with less than 60,000 miles registered on the odometer at the date of Mechanical Breakdown), auxillary drive belts, brackets, mountings, tappings, supports, fixings and fastening devices, fuel tank, corrosion, rubber hoses, pipes and unions, air bags, decarbonisation and failures caused by the build up of carbon deposits (including burnt valves). This Warranty does not cover any Mechanical Breakdown in the following circumstances: Consequential damage to a part unless it is caused by a Warranted Part in which case it will be covered, although cosmetic damage is excluded. We are not liable for consequential loss however caused. If the Vehicle is used for hire or reward, commercial use, professional instruction, competition or off-road use, motor rally, speed or duration tests or any practice for these events. The Vehicle’s performance gradually reduces as its age and mileage increase. This includes, but is not limited to, gradual loss of engine compression requiring the repair of valves or rings and the gradual increase in the oil consumption due to normal operating functions. This Warranty will not pay for deterioration of this type. If the fault causing the part failure existed before the Warranty came into effect, the Warranty will not pay that repair. The damage must not be caused by any of the following: fire; water ingress; corrosion; frost; floods; snow-affected roads or embedding in mud or sand; a recurring problem where You have not sought repair advice from an Authorised Repairer; failure to respond to a manufacturer’s recall; not maintaining Your Vehicle in a safe and roadworthy condition; improper repair; intentional damage or injury; loss or damage to the contents of Your Vehicle; the theft of Your Vehicle; participating in a criminal act; wilful exposure to danger; any type of accident; any failure of a cosmetic nature only; being under the influence of drugs (unless medically supervised) or alcohol; misuse or neglect; any unlawful act or omission; acts of war or God; nuclear explosion; sonic boom or radioactivity. Where the Warranty holder’s Vehicle insurance should pay for a repair or will deem the Vehicle to be a write-off, then the Vehicle insurance should be used and not the Warranty. 5. SERVICING REQUIREMENTS What to do to keep the warranty valid Keep the Vehicle serviced and repaired, at a repairer authorised to service Your make of Vehicle according to the Manufacturer’s Service Schedule and intervals for Your particular make, age and type of vehicle. Services must be carried out within 30 days or 1,000 miles of the due date, whichever occurs first. You must keep all receipts and invoices. Failure to comply with these requirements will invalidate Your Warranty. 6. REPORTING A MECHANICAL BREAKDOWN How to arrange repairs The Car Shop: Administration and Claims – 0844 871 7763 If you suspect a failure… DO NOT continue to use the Vehicle. This may aggravate the problem and cause greater damage, for which We will not be liable. If You consider the fault to be covered by the Warranty, DO NOT proceed with repairs until they have been authorised by the Administrator. 1. 2. a) b) c) d) e) 3. 4. 5. Take Your Vehicle to an Authorised Repairer. You must report any Mechanical Breakdown to us within 7 days of the incident occurring. The Authorised Repairer will be required to telephone the Administrator on 0844 871 7763 and gain the relevant Authority Number. At that time the following information will be required: Your Schedule with attached Terms & Conditions Current Vehicle mileage Nature of repair Maintenance details Total cost of repairs The Administrator may authorise repairs immediately or investigate the claim further and/or appoint an independent assessor to inspect the Vehicle. When repairs are authorised a Repair Authority Number will be given. However acceptance of liability is conditional on the terms and conditions of this Warranty having been adhered to, e.g. servicing of the Vehicle in accordance with the manufacturer's recommendations. On completion of repairs, the repairer will send the following documents to the Administrator, at the address above: A fully itemised invoice to The Car Shop C/O TWG Services Limited. 6. 7. Evidence of service history, including invoices, from the start date of the Warranty. The Administrator will reimburse You or the Authorised Repairer, subject to the terms and conditions of the Warranty. If a balance is due, You must pay it directly to the Authorised Repairer. Out of hours claims: The Administrator’s hours are 9am – 5pm Monday to Friday. If a claim arises outside these hours, the claim must be registered on the answering service on 0844 871 7763. The total value of the repair work completed during the Warranty Period is limited to the Purchase Price of the Vehicle. The cost of investigation work can only be authorised by the Vehicle owner, who will remain responsible for meeting that cost in the event that the repair is not covered by the Warranty. Claims will be handled by the Administrator and We reserve the right to have the Vehicle inspected by an independent engineer prior to any work being carried out. All replaced parts become the property of the Authorised Repairer. 7. GENERAL Additional Information Transfer: The Warranty can be transferred to the next owner of the Vehicle by calling the Administrator on 0844 871 7763 to request a Transfer of Ownership Form. The transfer fee is £25 including VAT. Misinformation: If any information provided to Us by You or anyone acting on Your behalf is inaccurate or if You fail to disclose any information which might reasonably affect Our decision to provide cover to You or Our assessment of Your claim, Your cover under this Warranty shall end and no refund shall be due. Governing Law: Both You and We are free to choose the law applicable to this contract. Unless specifically agreed to the contrary prior to Policy inception, this Warranty shall be subject to English Law. Telephone calls made in connection with Your Warranty may be monitored as part of training and quality assurance processes. 8. COMPLAINTS If You have a complaint regarding this Warranty You should in the first instance contact the Administrator at The Car Shop Administration Department, C/O TWG Services Limited, The Aspen Building, Floor 2, Vantage Point Business Village, Mitcheldean, Gloucestershire, GL17 0AF. If you are not satisfied with the response You may write to the Administration Director at the same address. You may also contact the Provider of the Warranty at The Car Shop, Ravens Way, Great Billing, Northampton, NN3 9UD. None of the above affects any right to legal action.
