Scott Schwartz, chef and owner of the 29 South Restaurant, said Monday he signed a 10-year lease with two five-year renewals for the former Florida National Bank building, often referred to as the “Marble Bank.” The full-service restaurant and bar will be named “The Bullbriar” after a North Florida native plant once used to make sarsaparilla and beer. The menu will feature upscale Southern-style food, with many ingredients obtained locally. Schwartz said it will be at least 12 months after building permits are issued for the renovation before he will be ready to print menus for the restaurant. But, he said, “anyone who has spent any time in the South will recognize the cuisine.” Plans include 175 seats in the restaurant, a bar and private dining rooms and a wine cellar in the former bank vaults in the basement. Schwartz said he is evaluating candidates to design the restaurant in keeping with the historic nature of the building and its ambiance. “When you walk into that building, it speaks to you,” he said. “It’s from an era of architectural elegance.” Steve Atkins, principal and Bullb riar... Hertz car-rental returning Downtown Nearly 850 dogs and cats found homes during the three-day Mega Pet Adoption over the weekend, including Tegan, a 9-yearold Labrador mix. Shay Benson went to the event with her boss, who was looking for a dog. Then Benson saw the note on Tegan’s cage that said the senior dog had been in and out of the shelter several times. Benson left, but couldn’t stop thinking about Tegan. She went back the next day and adopted Tegan. After a stop at Petco to get supplies, including a new bed, they went home. Benson’s husband said the 58-pound dog was too big, but she made it clear Tegan was staying. “She’s doing outstanding,” Benson said. “That’s my baby.” As for her husband, he’s been getting up early to take Tegan for walks. “I knew she was going to win him over,” said Benson, who is in the Navy. It’s those “most complex and interesting elements,” as board Chair Walt Bussells calls them, which could end up requiring changes to get through. The board met for about three hours Monday to take up a “candid, blunt” discussion about the deal agreed upon by Mayor Alvin Brown and fund administra- Public tor John Keane, then later tweaked by City Council. It was the first chance the fivemember board had to fully discuss the deal after council passed it this month. “We’re making progress,” Keane said late Monday. Bussells said preliminary votes showed unanimous approval for the majority of the reform package, including creating a fund investment advisory committee, expanding investment class and reaffirming disclosure procedures. Continued on Page A-4 Published for Hertz is returning Downtown and intends to open in the Police and Fire Pension Fund building at 1 W. Adams St. early next year. Fund Administrator John Keane said Monday that Hertz would lease space in the former Firehouse Subs location and use 10-15 spaces in the fund’s garage. He said Hertz should start renting cars there by Valentine’s Day. “We think it’s a good fit,” Keane said. The city is reviewing a building-permit application for the Hertz car-rental location. Adams Interior Contractors is the contractor for the $35,744 build-out of 650 square feet. Keane said it would take about 30 days for renovations after the permit is issued. Hertz approached the fund, whose board approved the deal in November, according to Keane. Keane said it has been at least 10 years since Hertz operated in Downtown. He said the agency operated at Monroe and Pearl streets before construction began for the Duval County Courthouse. Keane said the deal begins with a threeyear lease at $804.17 a month. Three fiveyear extensions with escalation rates would total about $200,000 over the 18 years. Keane said the location at 1 W. Adams St. is convenient for hotels as well as businesses that include the nonprofits at the Jessie Ball duPont Center under renovation at Adams and Ocean streets. He also said the lease will provide a “little income stream” to help pay down the unfunded liability for the fund. Hertz won’t be the only car-rental agency on the Northbank Downtown. Site plans show Thackeray Partners of Dallas owns the 12.42acre site. The building will comprise 10,000 square feet for offices and 116,948 square feet for warehouse space. City Council adopted a resolution for Ecolab to receive $214,000 in tax breaks to add 35 jobs in moving to the Tradeport site from Southside. Ecolab and the landlord committed to a $9 million investment at the site in the Jacksonville International Airport Community Redevelopment Area. Ecolab committed to a private capital investment of $1.5 million, with a landlord private capital investment of $7.5 million for construction. Ecolab is a water, hygiene and energy technologies and services company. It bought Microtek Medical, its medical device health care division, in 2007 and has been operating in an 88,000-squarefoot facility on A.C. Skinner Parkway. It employs 55 people there. No More Homeless Pets wants to start on clinic First Coast No More Homeless Pets is taking the first steps toward developing the Westside property it bought in November to develop a clinic, warehouse and offices to serve as a second location to its Northwest Jacksonville headquarters. The nonprofit, whose mission is to end the killing of dogs and cats in shelters, applied with the city to demolish the interior of a 10,412-square-foot building at 464 Cassat Ave. First Coast No More Homeless Pets bought three buildings at the site. The complex will be redeveloped as The First Coast No More Homeless Pets Mary Lou Russell Animal Welfare Complex and one of the three buildings there will become the Joseph A. Strasser Veterinary Hospital. Russell and Strasser are major donors toward the project. Arwood Waste Inc. is shown as the contractor for the interior demolition at a project cost of $43,400. That building is planned as the clinic. The city is reviewing the nonprofit’s plans at the 1.23-acre site at Cassat and Highway avenues. Founder and Executive Director Rick DuCharme said previously the project, estimated at a total investment of about $2.3 million, should be completed by July. The nonprofit is based at 6817 Norwood Ave., where it offers spay/neuter services; a low-cost veterinary clinic; adoption information; and more. The site is called The Joseph A. Strasser Animal Health & Welfare Building. The Cassat Avenue project will allow the nonprofit to expand its low-cost veterinary services, although all spay/neuter services will continue to be done at Norwood. Equality Florida, a prominent group supporting legalization of same-sex marriage, issued a news release Monday that said clerks “have a legal obligation to issue marriage licenses to samesex couples –– or risk expensive litigation, including liability for damages and attorney fees.” The release largely was in response to a memo issued last week by attorneys for the Florida Court Clerks & Comptrollers that advised county officials statewide against issuing marriage licenses. The memo said a federal judge’s decision striking down Florida’s ban on same-sex marriage only applies to issuing licenses in the Panhandle’s Washington County, where one of the gay couples involved in the challenge to the ban lives. The clerks in the 4th Judicial Circuit, comprising Clay, Duval and Nassau counties, have said they would follow the advice from the attorneys and not issue licenses for same-sex marriages. But Equality Florida said attorneys and legal organizations that support moving forward with same-sex marriage will provide pro-bono services to clerks concerned about the memo. Also, the group warned clerks that they will face legal battles if they do not issue marriage licenses to same-sex couples. “Clerks can stand in the doorway and try to block equality or they can welcome gay couples who have waited for decades for this moment,” Nadine Smith, chief executive officer of Equality Florida, said in a statement. “We expect every clerk to uphold their oath and protect the constitutional rights of gay couples seeking marriage licenses. No legal firm’s memo overrides their clear legal obligation,” the statement continued. U.S. District Judge Robert Hinkle in August found that Florida’s voter-approved ban on same-sex marriage is unconstitutional. Hinkle’s ruling came amid appeals in similar cases from other parts of the country, and he placed a stay on his decision. That stay will expire at the end of the day Jan. 5. Attorney General Pam Bondi sought an extension of the stay, but the U.S. Supreme Court late Friday turned down her request. In a prepared statement Friday night, Bondi said her goal was to have “uniformity throughout Florida” until final resolution of numerous challenges to the samesex marriage ban. “Nonetheless, the Supreme Court has now spoken, and the stay will end on January 5,” Bondi said in the statement. The memo last week for the Florida Court Clerks & Comptrollers was issued by four attorneys with the firm Greenberg Traurig. They advised clerks statewide not to issue marriage licenses “until a binding order is issued by a court of proper jurisdiction” and warned the clerks that they could be subject to criminal prosecution if they allow gay couples to wed. “We realize that it may seem to many that Judge Hinkle’s federal district court ruling that Florida’s same-sex marriage ban is unconstitutional and violates fundamental rights would permit all Florida clerks of court to lawfully issue marriage licenses to samesex couples,” the lawyers wrote. But, they also wrote, “our review of the law indicates that an order and injunction issued at the federal trial level is not binding on any person, including a clerk of court, who is not a named party in the action.” But the news release Monday from the groups supporting same-sex marriage blasted the memo. “Any Florida clerk who refuses to follow the Constitution’s command and who withholds marriage licenses from couples once the stay expires is on the wrong side of history and the wrong side of the law,” Shannon Minter, legal director for the National Center for Lesbian Rights, said in a statement. Atkins said Monday he continues to work on securing about $8 million of the four-building project’s $70 million budget from the city to cover the public portion of the proposed public-private partnership. After Atkins presented the project in September to the World Affairs Council, Downtown Investment Authority CEO Aun- dra Wallace said the city did not have that much capital available for the project. Two weeks ago, Wallace said he has been in negotiations with SouthEast, but “it’s really difficult to try to make the numbers work.” Atkins and his partners own the Laura Street Trio “debt-free.” But for the hotel and restaurant to move forward, he said, the city needs to commit to the entire project, including renovation of the former Barnett Bank building. Jacksonville Jaguars owner Shad Khan loaned the developers $3 million to buy the building. “The trio is still on hold until the city decides its involvement,” he said Monday. Wallace placed a deadline of April 1 for the city to make a “go or no go” decision on whether to contribute funds to the project. Those three points of reform will be hashed out during a Jan. 5 workshop, 10 days before the fund’s deadline on the reform package. If the board members don’t see eye-to-eye enough to receive the needed three votes on any particular point, Bussells said it would then be on to the next step. “I’m reasonably confident the majority will be able to suggest an alternative,” he said. That would mean those changes, once approved, would head back to council for another round of approvals. One item that could possibly come into play: Bussells said the board was told its reserves have close to $80 million in them, more than the $61 million or so it anticipated. The $61 million is slated to head to the city as part of a reform deal to pay down the more than $1.65 billion in the plan’s unfunded liability. Other than that, no funding has been identified. There have been talks about a partnership with JEA that has the utility and city both borrowing $120 million and applying that plus the pension fund reserves to quickly pay down that outstanding figure. The only dispute involved a brief dustup with a state official over the exact spot on the floor to place the display. The falling-angel diorama, which a year ago was barred from the Capitol because it was deemed “grossly offensive” by the Department of Management Services, is the latest in a series of irreverent holiday displays from groups motivated by the state’s acceptance of Christian nativity scenes the past two years. John Porgal, a Tallahassee resident and member of the Satanic Temple, said the group threatened legal action this year if it again was blocked. It also offered not to put up its display if the Florida Prayer Network and International House of Prayer Tallahassee wouldn’t put up their nativity scenes. “If the nativity scene never came in here in the first place we would never had done this,” said Porgal, who is also a member of the American Atheists of Tallahassee. “We don’t want to be insulting. We just want our rights, the separation of church and states or equal rights.” The group’s name, the Satanic Temple, is simply to draw attention to its efforts. “The Satanic Temple does not worship the devil in any way, shape or form,” Porgal said when asked. The temple’s display this year joined entries from the American Atheists of Tallahassee, the Madison, Wis.-based Freedom From Religion Foundation, the Church of the Flying Spaghetti Monster, and a South Florida political blogger who for the second year put up a 6-foot stack of empty beer cans to represent Festivus, a sitcom-based festival “for the rest of us.” The Florida Prayer Network’s nativity, which went up Dec. 15, was taken down Monday. Nearby a framed poster of the nativity by the International House of Prayer Tallahassee was put up Monday. Both groups are represented by Pam Olsen, who questioned the motives of those opposed to the nativity scene but said she supports the open forum for holiday displays. Olsen added she wouldn’t remove the nativity scenes if that would keep out many of the more “outlandish” displays. “They’re here to shut down Christianity,” Olsen said. “They’re here to fight the display of Christ and Christmas. Whether we have a display here or not, guess what, Christ is in Christmas.” Olsen noted that the opposition groups have been silent regarding the placement of a Hanukkah menorah or Christmas trees, which have been displayed for years on the first floor of the Capitol. The menorah is up this week inside the rotunda. The trees are inside the entries to the offices of the governor and the members of the Cabinet, the same as in past years. The temple’s display includes the phrase “Happy holidays from the Satanic Temple” atop a diorama of an angel falling into hell. On Monday, the temple demanded its table-top display be placed in the middle of a hallway leading toward the offices of Attorney General Pam Bondi and Gov. Rick Scott. The spot had been occupied by the Florida Prayer Network’s wooden nativity scene. A Department of Management Services official told Porgal that the display needed to be closer to a column, a couple of feet away and out of the central walkway. After Porgal vehemently protested, the official departed without speaking to the gaggle of media attending the temple’s arrival. “We wanted to make sure we got front and center just like the manger scene did,” Porgal said.
