Notification of cancellation or withdrawal from individual courses or a packaged program must be made in writing to Shafston prior to the start date of the packaged program. 2. Application and Accommodation Placement fees are not refundable. 3. Cancellation in writing at least 4 weeks before the student’s original packaged program start date attracts a full refund of fees paid except as in points 2 and 6. 4. Cancellation in writing less than 4 weeks before the student’s original packaged program start date attracts a refund except as in points 2 and 6 and less a $500 cancellation fee per course. 5. Cancellation after the student’s original packaged program start date will not attract a refund. The exception to this is noted in point 9. 6. Once you have arrived in Australia (on a Student visa granted to study at Shafston), no refund is available to students who withdraw. The exception to this is noted in point 9. 7. If you notify us of your intention to withdraw from individual courses or a packaged program before your arrival in Australia (on a Student visa granted to study at Shafston) then you are eligible to receive a refund minus a $500 cancellation fee per course and point 2. 8. All refund applications must be submitted using the Shafston Student Refund Form available on the Shafston website. 9. Students who withdraw and are not eligible for a refund as per the above terms and conditions may apply if the student can provide exceptional circumstances or show extreme personal hardship. Independent documented evidence such as medical certificates will be required. The decision to grant a refund based on exceptional circumstances or extreme personal hardship is wholly at the discretion of the Director. In that case, fees may be refunded on a pro-rata basis, minus the $500 cancellation fee per course and application fees. However, should participants wish to resume their studies at a later date, the original fee payment can be used as credit towards that course within twelve months of initial payment. 10. If a discounted application fee was offered and the student withdraws and is eligible for a refund the full application fee will be deducted. 11. If you notify us of your intention to withdraw before your original start date and are eligible for a refund as per 3 and 4 above, then the refund will be paid within four weeks of Shafston receiving your notification of withdrawal and completed refund application form. 12. Any refund will be paid to the person or entity that originally paid the course fees and, where possible, in the same currency in which the fees were paid. 13. In the case of visa refusal, a refund will be given up to the original program start date as long as written proof is presented, minus the application fee. 14. If a student has withdrawn and is not eligible for a refund as per the above terms and conditions Shafston will hold the students funds in trust for up to twelve months for the student to transfer to a Shafston course of study in the future. 15. No refunds will be given to students who are expelled for unacceptable behaviour or non-compliance with visa conditions. 16. There are no refunds for public holidays or days you miss due to sickness or other reasons. 17. Fees are not transferable between students. 18. It is a course requirement that all fees as invoiced must be paid upfront in full for courses 24 weeks or less 19. It is an ELICOS course requirement that no single ELICOS course or period of study exceed 24 weeks. An additional ELICOS course or period of study is required for study program requests of 25 weeks or more. 20. It is a Vocational Education and Training course requirement that courses 25 weeks and longer in length as indicated on the Students Offer Letter will be required to pay 50% of course fees upfront for each enrolled course of study. Balance of course fees will be payable 10 days prior to each course or study period start date. 21. Your program or packaged program is indicated by the course start and end dates on your Shafston Offer Letters. 22. All fees & charges are payable as invoiced. Students may be precluded from sitting exams, receiving results or attending classes if fees are not paid by the due date specified on the invoice. 23. Students who have not been required to pay full fees upfront as invoiced will be required to pay balance fees by invoiced due dates. Students failing to make balance payments by invoiced due dates will have their course cancelled, results withheld and if Student visa holders be reported to DIAC for non payment of fees. 24. Cambridge Preparation course candidates must pay all exam fees applicable. 25. When issuing CoE’s for student visa applicants, Shafston will attach the Agency to the Student’s CoE. 26. Students will be tested for their current English level on arrival and Shafston will place them in a suitable class level according to this test result. 27. Shafston will monitor student’s progress through their course and suitable classes or courses of study will be recommended to students. 28. Student default will apply for students who do not commence on the agreed course or packaged program start date as indicated on the students Letter of Offer. 29. Students who do not commence their course on the agreed course or packaged program start date as shown on their Letter of Offer and do not submit an approved request for suspension or deferral will have their course cancelled and any pre-paid fees held in trust for up to twelve months. Shafston is obliged to also cancel any related Confirmation of Enrolments ‘CoE’s’ for non commenced courses or packaged programs. 30. No academic penalty will be incurred if you notify us of your intention to withdraw from individual units or a program before the individual unit or program has commenced. 31. Where an international student obtains residency/citizenship status then local fees will apply from the semester following the date of their residency/citizenship. 32. Fees may be subject to change without notice. 33. All units of study offered subject to sufficient numbers. All students will receive written notification from Shafston if a scheduled course is not delivered, as enrolments may be deferred into another cohort or course. 34. Student visa holder students will be required to maintain satisfactory course attendance during ELICOS course/s of study and maintain satisfactory academic course progression during Vocational Education and Training course/s of study at Shafston. 35. Shafston has made public on the Shafston website the Shafston Grievance and Appeal Policy and Procedure for students. 36. Payment is considered acceptance of all Shafston Terms and Conditions of Enrolment, Refunds, Deferrals, Suspensions and Transfers. Suspension and Deferral of Study 37. Students requesting to suspend their course or defer their course start date after their Student visa has been granted will be required to show compassionate or compelling circumstances (for example, illness where a medical certificate states that the student is unable to attend classes); supported by independent documentation before Shafston may approve a course suspension, deferred course or packaged program start date. 38. Deferral requests after the Student visa has been granted must be made in writing to Shafston House College on the Shafston deferral application form with independent supporting documentation within 5 working days of the agreed start date. The decision to grant a suspension or deferral based on compassionate or compelling circumstances is wholly at the discretion of Shafston. 39. In the case of a student needing to return home urgently, the remainder of their course may be suspended or deferred and the fees may be held for up to one year in trust. Documented proof is required. 40. Students requesting to suspend or defer their course of study will be required to pay a minimum $500 tuition fee deposit towards the course or period of study they wish to defer if fees are unpaid. This deposit fee will be allocated against the tuition fees for the study course or period and is non refundable. 41. Students who have been issued Confirmation of Enrolment ‘CoE’ for student visa applications must notify Shafston within 5 working days of the agreed course or packaged program start date if unable to commence. Students must notify a deferred course start or withdraw from the course or packaged program. 42. A refund, deferral, suspension or transfer of your course of study may affect your Student visa. DIAC will assess your situation individually in accordance with DIAC student visa policies. Students are advised to first seek advice from DIAC before making any changes to their courses. 7 Provider and Course Transfer 43. Tuition fees remaining, less $500 transfer fee, will be transferred to another institution if a student reaches the required IELTS score for higher studies entry before the end of their Shafston enrolment. The transferable amount will be adjusted so that the weekly fee rate paid is in accordance with the actual number of weeks studied. The new course must not have an ELICOS component. 44. Students are required to provide written proof that their level of English has been accepted unconditionally by the institution or provide proof of their achieved official IELTS test score or equivalent recognised official English test score. 45. All tuition fees from Shafston ELICOS courses may be transferred to other Shafston programs (i.e., Shafston School of Business). No transfer fee will be incurred for the first course transfer. The transferable amount will be adjusted so that the ELICOS weekly fee rate paid is in accordance with the actual number of weeks studied. Free weeks of study are nontransferrable. 46. Shafston may apply a course transfer fee to a student who requests more than one course transfer/change after they have commenced their packaged program. 47. Tuition fees cannot be transferred to other services. 48. Students requesting to transfer to another Provider before first completing 6 months of their principal course of study at Shafston are required to apply for release from Shafston via the student transfer request form. Students are advised to first read Shafston’s student transfer policy and procedure before applying for a student transfer and release request. APPLICATION FORM 2015 - BRISBANE & GOLD COAST Written Agreement SHAFSTON Provider Default (CRICOS Provider Code: 01542F) In the case of provider default, such situations are covered by the ESOS Act 2000 and subsequent amendments to the Act and the Education Services for Overseas Students Legislation Amendment (Tuition Protection Service and Other Measures) Act 2012. You will be offered enrolment in an alternative course with Shafston at no extra cost to you or you will be offered a refund of all the course money you have paid to date but have not yet studied. Refunds will be calculated on a pro rata basis and students will be eligible for a refund of future course money that has not yet been delivered. The refund will be paid to you within 2 weeks of the day on which the course ceased being provided. Alternatively, you may be offered enrolment in an alternative course at another provider. You have the right to choose whether you would prefer a full refund of undelivered course fees, or to accept a place in another course. If Shafston is unable to provide a refund or place you in an alternative course the Secretary and Tuition Protection Service (TPS) Director will be responsible for placing you in a suitable alternative course at no extra cost. If you are an international student and the Tuition Protection Service (TPS) is unable to place you in a suitable alternative course, the Overseas Students Tuition Fund (OSTF) will then attempt to place you in a suitable alternative course or, if this is not possible, you will be eligible for a refund as calculated by the Overseas Students Tuition Fund (OSTF). Please Note: “This agreement, and the availability of complaints and appeals processes, does not remove your right to take action under Australia’s consumer protection laws”. Accommodation Terms and Conditions Homestay 1. One week’s written notice to the Homestay Manager is required if you wish to leave your Homestay. The first change of Homestay will be free of charge, all subsequent changes will be charged a placement fee of $59. 2. One week minimum booking. There is no refund if you leave your homestay before this. 3. Students on a student visa with welfare provided by Shafston are required to remain in Shafston approved Homestay accommodation during this period. Students with welfare provided by Shafston who do not reside in Shafston approved Homestay accommodation will have their welfare arrangement with Shafston cancelled and Shafston is obliged to advise DIAC. Students and their legal guardian will be required to notify and satisfy DIAC of their new welfare arrangements. 4. Students residing in Shafston approved Homestay accommodation are required to pay Homestay accommodation related fees in advance at all times. 5. No additional placement fee will be charged if the College agrees that your Homestay is unable to provide a satisfactory environment. Apartment Accommodation (Independently owned and operated providers) 1. A copy of each accommodation providers terms and conditions of stay are available from each provider and are included on accommodation confirmation documentation. Airport Greeting and Transfer 1. Notification of cancellation of an Airport Greeting and Transfer must be made twenty four (24) hours prior to the advised arrival flight details. Notification of cancellation should be made to the Homestay department via email and via phone to the emergency driver phone number provided on the Airport Greeting and Transfer confirmation. No refund will be payable if cancellation is not received. 2. Notification of amended arrival times of an Airport Greeting and Transfer must be made prior to the advised arrival flight details. Notification of amended arrival times and flight details must be made to the Homestay Manager via email and via phone to the emergency driver phone number provided on the Airport Greeting confirmation. Notification of amended arrival times after the advised arrival flight details will incur an additional Airport Greeting fee. Confidentiality and Privacy Policy The College is not permitted or authorised to give out your private addresses or the address of other students unless requested within the law. Your personal information may be made available by the provider (Shafston House College Ltd) to the Australian Government and designated authorities and, if relevant, the Secretary and Tuition Protection Service Director. This information includes personal and contact details, course enrolment details and changes, and the circumstance of any suspected breach by the student of a student visa condition. The College is not permitted to give out personal information or the contact addresses of staff members.
