Q: Dear Attorney:
I have a tenant who hasn’t paid me rent for five months.
I went to an attorney to start an eviction but I just received
a letter that the tenant filed for bankruptcy. My attorney
says I can’t file the eviction now and that I may not get the
back rent I’m owed. Is there anything I can do to get the
tenant out and collect the money that I’m owed? - Ann
A: Dear Ann:
The answers to your questions are yes and maybe. You
didn’t indicate in your letter what chapter of bankruptcy the
tenant filed. However, whether you’re dealing with a
Chapter 7 or Chapter 13 bankruptcy, there is an automatic
stay in effect which prevents you from starting the eviction
proceeding while the bankruptcy case is pending. If your
tenant filed a Chapter 7 bankruptcy, you can either wait until
the case is closed and then start the eviction proceeding or
you can make a motion to the bankruptcy court for permission to lift the stay and proceed immediately. However, you
will have to pay an attorney to make the motion and since a
typical Chapter 7 case only takes about three months to be
discharged and closed, it may make more sense to just wait
until the end of the case. With respect to the rent that you
are owed, that debt will likely be wiped out in the Chapter 7,
so although you will still be able to evict the tenant, you
probably will not be able to get a money judgment for the
back rent. The one exception may be if there are nonexempt
assets belonging to the tenant that the Chapter 7 trustee is
liquidating. In that case, you would be notified by the trustee
to file a proof of claim for the amount you are owed and you
may receive some money. Similarly, if the tenant filed a
Chapter 13 bankruptcy, you will have the opportunity to file
a proof of claim and possibly collect the back money as well
as the go-forward rent payments. Feel free to contact my

A: Dear Barb:
Unfortunately, no. While you can both file for bankruptcy,
you would have to file separate cases since you are not
legally married.

REP. LEE ZELDIN HONORS TOWN
OF SOUTHOLD ON 375th
ANNIVERSARY
On January 17, 2015, at Brecknock Hall in Greenport,
Congressman Zeldin presented a Certificate of
Congressional Recognition to the Town of Southold in
honor of the town's 375th Anniversary. This was
Congressman Zeldin’s first public speaking event in
district since being recently sworn in.
Brecknock Hall was once the summer home of
William Floyd’s son. William Floyd was one of four New
Yorkers to sign the Declaration of Independence and
was also the first Congressman from the First
Congressional District. Congressman Zeldin happens
to be a graduate of William Floyd High School in
Mastic Beach.

BE PREPARED FOR WINTER WEATHER AND STORMS
The winter season is upon us, and Legislator Tom
Muratore (R-Ronkonkoma) would like to offer residents helpful tips in preparation of extreme cold
weather and winter storms. “We have already been
hit with one freezing cold spell, and winter is long
from over,” stated Legislator Muratore. “It is important to take some simple precautionary measures to
keep your family safe and protect your home and
personal property.”
• Maintain heating equipment and chimneys by
having them cleaned and inspected every year.

• Keep fire extinguishers on hand, and make sure
everyone in your house knows how to use them.
House fires pose an additional risk, as more
people turn to alternate heating sources without
taking the necessary safety precautions.
• Insulate pipes with insulation or newspapers and
plastic and allow faucets to drip a little during cold
weather to avoid freezing. Running water, even at a
trickle, helps prevent pipes from freezing.
• All fuel-burning equipment should be vented to
the outside and kept clear.
WINTERIZE YOUR HOME
• Winterize your home to extend the life of your fuel
supply by insulating walls and attics, caulking and
weather-stripping doors and windows, and
installing storm windows or covering windows with
plastic.
• Learn how to shut off water valves (in case a pipe
bursts).
• Insulate your home by installing storm windows
or covering windows with plastic from the inside to
keep cold air out.
• Winterize your house, barn, shed or any other
structure that may provide shelter for your family,
neighbors, livestock or equipment. Clear rain
gutters; repair roof leaks and cut away tree
branches that could fall on a house or other
structure during a storm.

the roof to sustain unusually heavy weight from the
accumulation of snow - or water, if drains on flat
roofs do not work

Herb and Regina Johnson from Westhampton Beach
attended the fair on behalf of their eighteen-year-old
son who has autism. They were looking for guardianship information but after visiting all of the tables, they
had two bags filled with brochures, pamphlets, business cards, and more. Mr. Johnson said, “The fair was
very beneficial. Everything was here, all in one place.
We got very useful information about social security,
and now we know what we need to do, where to go,
and who to talk to for our son.”
The Annual Agency Services Fair sponsored by
Eastern Suffolk BOCES (ESBOCES)Student Support
Services provided an opportunity for parents, school
social workers, school psychologists, and teachers to
connect with a wide-variety of service providers to
prepare for their child’s/student’s future.
ESBOCES School Social Worker Jennifer FarnumWeber said, “The goal of the fair is to make
connections between school districts and outside
community agencies. We hope to fit the needs of our
students and our component school districts to the
best of our ability.”
Jennifer’s role is to partner with the community and
outside agencies to keep social workers and psychologists up to date with the most recent trends.
Program Administrator Elizabeth Melichar said, “It’s
never too early for parents and schools to think about
transitioning their child/student. In essence, the social
workers make the connections. They are the conduit to
give parents names and information about services and
programs. As part of the New York State Education
Department regulations, we need to provide parent
training and education on a regular basis. This fair is a
perfect forum.”

Two traveling angels stopped
to spend the night in the home
of a wealthy family.
The younger angel was infuriated and asked the older
angel how could you have let this happen? The first man
had everything, yet you helped him, she accused.
The family was rude and
refused to let the angels stay in
the mansion's guest room.
The second family had little but was willing to share everything, and you let the cow die.
Instead the angels were given a
small space in the cold basement.
"Things aren't always what they seem," the older angel
replied.
"When we stayed in the basement of the mansion, I noticed
there was gold stored in that hole in the wall.
As they made their bed on the hard floor, the
older angel saw a hole in the wall and repaired it.
Since the owner was so obsessed with greed and unwilling
to share his good fortune, I sealed the wall so he wouldn't
find it."
When the younger angel asked why, the older angel
replied, "Things aren't always what they seem"
The next night the pair came to rest at the house of a very
poor, but very hospitable farmer and his wife.
"Then last night as we slept in the farmers bed, the angel of
death came for his wife I gave him the cow instead. Things
aren't always what they seem."
After sharing what little food they had the couple let the
angels sleep in their bed where they could have a good
night's rest.
Sometimes that is exactly what happens when things don't
turn out the way they should. If you have faith, you just
need to trust that every out come is always to your advantage. You just might not know it until some time later.
When the sun came up the next morning the angels found
the farmer and his wife in tears? Their only cow, whose
milk had been their sole income, lay dead in the field.

GRAND RE-OPENING OF
SKY TAN SALON IN SELDEN
On January 10, Councilman Kevin LaValle attended
the Grand Re-Opening of the Sky Tan tanning salon in
Selden. The salon, which originally opened on
November 11, 2013, was in business only 42 days when
an arsonist set fire to the shopping center, gutting the
salon and another business. The owners vowed to
rebuild and after a year, the salon is back in business.
Councilman LaValle said, “After being faced with such
a devastating loss, I’m happy to welcome Sky Tan back
into the Selden community and wish them the best of
luck in the future.”

TOWN PRESENTS “DOGS PLAYING
FOR LIFE” TRAINING SEMINAR AT
BROOKHAVEN ANIMAL SHELTER
NEW!
On January 7, the Town of Brookhaven Animal
Shelter presented its first “Dogs Playing for Life”
seminar, an introduction to a training program for
shelter dogs featuring canine play groups. The
program, which has been introduced to more than 50
shelters across the United States and Canada, utilizes
play groups as an assessment, enrichment, training
and adoption enhancement tool. The goal of the
program is to demonstrate how play groups can
improve the quality of life for dogs and the people who
work and volunteer at shelters. Pictured left to right at
the seminar are Councilman Dan Panico, Animal
Shelter Director Ashley Boyd and “Dogs Playing for
Life” founder Aimee Sadler, who is also the Director of
Training and Behavior for the Southampton Animal
Shelter Foundation.

What’s it like to work at a high-end advertising agency?
Eastern Suffolk BOCES (ESBOCES) students from Islip
Career Center had the opportunity to find out when they
visited Austin & Williams Advertising in Hauppauge. Chief
Creative Officer and partner, Rick Chiorando welcomed
the students from the Computer Graphic Arts Program to
the award-winning agency. Teacher Cora WeuleSparwasser said, “Mr. Chiorando engaged the students in
a game of “guess the logo” using a pop-art inspired typographic painting on the wall of the boardroom and Henry
Luhmann, director of production services, provided the
students with a thorough tour of the advertising agency.”
Special Education Career students enrolled in

publishing, graphic design, and photo retouching.

Kindergarten Students Exercise
in a Winter Wonderland
Kindergarten students at Middle Country Central
School District’s Unity Drive Pre-K/Kindergarten
Center did more than walk in a “Winter Wonderland”
during gym classes. Students moved station-to-station
riding sleds and toboggans, “ice skating,” “fishing” in a
frozen lake, throwing “snowballs” and sliding down
“Unity Hill.” Completing these activities helped
students build strength, endurance, coordination and
motor planning skills, while encouraging activelearning
at a young age. Students pulled their classmates in
toboggans and sleds attached to scooters; used carpet
squares to simulate ice skating; fished in a frozen lake
using fishing rods, metal washers and magnets; threw
whiteballs to simulate snowballs; and went for a sleigh
ride down “Unity Hill” using scooters and snow disks.
Middle Country Central School District Celebrates
Computer Science Education Week
The Middle Country Central School District students
recently completed an “Hour of Code” as part of a
nationwide initiative to involve millions of students in
computer programming education. “Hour of Code”
aims to encourage students to explore computer
science career opportunities and stress the need to
integrate computer programming lessons into
everyday school instruction. Students districtwide
participated and completed hands-on activities that
taught coding basics including simple algorithms,
conditional statements, or coding language. The
students also learned the fundamentals of repeatlooping, which allows a student to repeat a code.
“Computer literacy has become vital for completing
daily tasks, let alone career readiness,” said
Superintendent Roberta Gerold. “We must begin to
provide computer science lessons to students in order
to encourage critical thinking and prepare our students
for the ever growing digital world.”
The “Hour of Code” encouraged computer science
research among students beginning at the elementary
level up through the high school. Similar to adopting
foreign languages, younger students are able to grasp
computer language concepts more effectively. This
nationwide initiative helped to lay the groundwork for
increased computer literacy throughout the district.

drop off location in the lobby of Town Hall to thank staff

residents stay warm this winter.
The Coat Drive began on January 12 and runs
through February 13. Residents are asked to drop off
gently used and clean infant to adult sized coats,
scarves, hats and gloves at the following locations:

right through again. She turned to the other woman

Middle Country Cosmetology Class Receives
Professional Advice from The Peter Coppola Company
Peter Coppola, a world-renowned icon in the beauty
industry, of the Peter Coppola Company, recently visited
a class of 25 cosmetology students at Middle Country
Central School District’s Newfield High School. Coppola
and his staff performed product and hair technique
demonstrations and taught students tips for pursuing
cosmetology careers.
The school visit served as a launch pad for the Peter
Coppola Company Education Team’s new InSchoolPro
Program. The new program provides educational tutorials online, invitations to manufacturer and professional
symposiums, and job placement opportunities.
