Rule 100 - Import Demurrage Rules
Port, Terminal and/or Rail Ramp Demurrage
All import containers held at carrier’s discharge port after carrying vessel has completed
discharge will be subject to free time and demurrage rules as noted below.

Whenever port, terminal, or rail ramp free time is less than that stated above, such port,
terminal or rail ramp free time will apply.
Free Time will commence per the applicable terminal or port tariff and/or the published rail
ramp free time, and will continue on a working day basis until expiration.
Free time excludes Saturdays, Sundays and legal holidays.
When rail ramps are open for receiving on Saturdays, Sundays and legal holidays, free time will
count as a regular working day.
For Los Angeles and Long Beach, free time will commence at 3 a.m. on the first business day
after each individual container is discharged from the vessel per the respective port and terminal
tariffs.
Multiple container rule: Free time applicable in accordance with the terminal tariff. After
expiration of the free time, the charges above will apply.
The demurrage charges outlined in this tariff are in U.S. Dollars per container per day.
Reefer Rail/CY Demurrage
All refrigerated Rail/CY demurrage charges will be applied in accordance with the following

For Import temperature controlled containers arriving at inland rail ramps and CYs in the US, the
daily equipment demurrage, monitoring and power supply will apply after expiration of the free
time period as noted in the above table. If the container arrives before 17:00 the free time will
begin on that day, otherwise the free time will begin on the following day with the exception of
NS and FEC facilities. If the container arrives at NS or FEC ramps before 12:00 the free time will
begin on that day, otherwise the free time will begin on the following day. The free time does
not include Sundays and Holidays unless stated.
Depot/CY/Trucker Demurrage
Whenever full containers are moved into a Yard whether it is a Depot, Trucker, or CY location, a
minimum pre-pull fee of $75 per container, or the actual pre-pull cost if higher will be charged,
and a daily storage rate of $100 per day will be applicable until the container exits the Yard
location.
Alternate Base Port Free Time & Storage
For the purposes of this Rule, “BASE PORT” shall be defined as a port at which Carrier calls in
normal liner service for load and discharge of cargoes.
For the purposes of this Rule, “ALTERNATE BASE PORT” shall be defined as a Container Yard or
Interchange facility in the geographic region of a port at which Carrier’s vessel does not call for
the specific trade or liner service on which a cargo was originally loaded.
Cargoes discharged at a BASE PORT and subsequently transported by Carrier overland to an
ALTERNATE BASE PORT (ABP) for delivery shall be subject to the following rules:
Free Time – Five (5) working days free beginning on day of arrival into ABP
Storage - $125.00 per container per day from day 6+
Customs
In the event cargo is placed on customs hold or quarantined while located at the discharge port
and an examination is required, detention or demurrage charges shall accrue during the period
of customs hold and/or quarantine.
In the event cargo is returned to the terminal following a customs exam the following rule shall
apply:
• Container will receive full demurrage free time while at Port of Discharge and/or exam
site
• Upon expiration of free time applicable demurrage charges will be applied for the
duration until container is fully released and picked up from the terminal
In the event cargo is moved to an inland location following a customs exam the following rule
shall apply:
• Container will receive full demurrage free time while at Port of Discharge and/or exam
site
• Upon expiration of free time a demurrage rate of $90 per container per day will apply
until the container leaves the exam site to move to the inland location
In the event cargo is delivered directly to the customer following a customs exam the following
rule shall apply:
• Demurrage free time will end once the container leaves the port
• Detention free time will commence once the container leaves the port
• Standard detention charges shall apply until container is returned empty

Port/CY Tie up
If the consignee is prevented from removing the containers from the Port/Cy by factors beyond
his control, such as, but not limited to, labor strikes, trucking strikes, or weather conditions
which affect the entire Port/CY area or a substantial portion thereof: free time and demurrage
will be calculated and demurrage assessed as follows:
1. Containers within free time at time of tie-up
a. Free time will be extended for a period equal to that allowed by the
respective Port Authority.
2. Containers within the first Demurrage period at time of tie-up
a. Demurrage will continue to be assessed but the first period will be extended
for a period equal to that allowed by the respective Port Authority.
Carrier Inability (Carrier Service Failure)
In the event the carrier is for any reason unable to deliver cargo within free time, the free time
shall be extended for a period equal to the duration of the delay of delivery. If cargo is already
in demurrage period, no demurrage or first period demurrage will be charged for a period equal
to the duration of the delay. This extension is related to Carrier Service Failures, weather
conditions, strikes, etc. This does not pertain to issues related to customer’s inability to receive
cargo or the absence of a full release.
