In pursuance of the objective of the Gulf Cooperation Council to achieve integration and coordination between the member states in all areas in order to work towards its greater unity, and in line with the objectives of "Unified Economic Agreement" between the countries of the Council - which has laid down the basis of the Gulf Common Market - to develop common working methods among the Council member states - and which has set out the steps towards economic integration, starting with the establishment of a Free Trade Zone and then a Customs Union, followed by the completion of the Gulf Common Market and ending with economic monetary union and the unification of the commercial, industrial and customs legislation applicable within it; 2. Whereas to achieve the Gulf Cooperation Council (GCC) objectives, to establish Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) to strengthen the economic integration aligned with the requirements to establish the Customs Union by the harmonization of the standards and metrology and ensuring the safety and quality of the commodities entering the markets of the members states, which will be to the advantage of their citizens, and to unify the various standardization activities and monitoring their implementation and compliance contributing in the development of the productive and service sectors and the development of trade between them, and to protect the consumer and the environment and public health, and also to encourage Gulf agricultural industries and products so as to support the Gulf economy and protect the gains made by the GCC states (member states) and to participate in removing the technical barriers to trade in order to meet the objectives of the Customs Union and the obligations of the countries under WTO agreements; 3. To execute the resolution of the Financial & Economic Cooperation Committee adopted at its seventy-second meeting (held on 4 - 5 November (2006) concerning "the urging of the Standardization Organization of the Gulf Cooperation Council to complete its effort to lay down unified procedures for applying the standards in the member states so that they can be enforced in a unified manner at the secondary entry points to support the enforcement of the requirements of the Customs Union within the specified time and to facilitate the free movement of commodities"; 4. To execute the resolution of the board of directors of the Standardization Organization adopted at its sixth meeting held on 5 June 2007 which approved the start of the implementation of the recommendations of the project to develop the Regional Conformity Assessment Scheme (RCAS) in the member states, such as "the approval of the concept that the compulsory compliance must be with the essential requirements for the products (safety, health and environment) as a basis for enshrining the new Gulf program in legislation; Conformity Assessment Technical Regulation for Children’s Toys Page 3 of 19 Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) TR No. : BD07070502 Issue no. : 1 Issue Date : 27/11/2007 5. Whereas it is evident that the laws and legislation and methods of supervision enforced in the member states, especially in relation to the safety children’s’ toys, vary in scope and content, and that these differences constitute an impediment to trade because there is thus a discrepancy in the competitive conditions within the unified market which is aspired to by the member states but without those difference producing any tangible benefit in terms of consumer protection against the risks which arise from those products; 6. Whereas it is clearly necessary to remove the barriers to the establishment of the unified market aspired by the member states offering the sale of harmless products which possess a sufficient degree of safety. 7. It is thus necessary to ensure that there is harmonization between the member states in the essential requirements and unified rules laid down to protect the health and safety of the consumer, in order to ensure that all children’s toys placed in the market are safe and may move freely within the area of the Customs Union. 8. Whereas the scientific point of view on the toxicity and ecotoxicity of chemical compounds has been taken into account in setting the maximum limits of metallic components in toys in relation to its effects on children's health. 9. Whereas it is necessary to ensure that children's toys which are placed in the unified market do not cause damage to the direct user or others. 10. Whereas the safety standards for children's toys must specify the maximum standard limits of the intended use of them, but allowance should also be made for any foreseeable use, bearing in mind the normal behavior of children who do not generally show the same degree of care as adults. 11. Whereas the safety standards for children's toys must be considered when toys are marketed and are applied throughout the foreseeable and normal period of use of the toy. 12. Whereas the Standardization Organization of the GCC has the responsibility for developing, approving, updating, publishing the technical regulations and Gulf Standard and regional conformity assessment procedures for commodities, products, measuring and calibration instruments, definitions, codes technical terminology, enforcement conditions, sampling, inspection, testing, and calibration in accordance with the technical regulations issued for that purpose. Therefore this technical regulations have been issued in respect of children's toys which set out the essential requirements that must be meet for children's toys, whether manufactured locally or imported to any of the member states, and any of these products are permitted to circulate freely in member states markets without any hindrance by the customs authorities - unless there are there are other reasons unrelated to non-conformity with the essential requirements. This technical regulation relate to children's toys. Children's toy means any product or material which is designed exclusively or is explicitly intended for use as a toy by children under 14 years of age. 2. For the purpose of this regulation, the products listed in Appendix No. 1 shall not be dealt with as children's toys. ARTICLE TWO 1. This technical regulation is intended to protect the users of toys, and also the people around them, from health risks or physical injury when the toy is being used for the purpose it has been designed for, or in a manner which could be expected - taking into account the behavior of an ordinary child. 2. Children's toys must meet the essential requirements laid down in this regulations when the items are in, or enter the member states markets, taking account the lifespan for use. 3. The member states must take all necessary measures to ensure that those children's toys which are placed on the member states markets conform to the essential requirements set out in Appendix No. 2 of this regulations. Note : The offering of a commodity in the member states markets includes the activities of both sales and distribution. ARTICLE THREE 1. The member states must take all necessary measures to ensure the free movement of children's toys which do meet the requirements of Article Two of this regulation, including Appendix No. 2 (the essential requirements of children’s toys), and not hinder them on the grounds of safety. ARTICLE FOUR 1. Children's toys which are manufactured in accordance with the Gulf Standards or those specified by GSO shall be deemed to meet the essential requirements stipulated in this regulation. 2. All member states accept that children's toys which bear the Gulf conformity mark (or any other declared equivalent mark) do conform to all conditions laid down in this regulation, including the conformity assessment procedures. ARTICLE FIVE 1. If it happens that any of any member states find that the standards referred to in the previous Article do not include all the essential requirements laid down in this regulation, the matter should be referred to GSO for study. 2. After the matter has been studied and an opinion expressed, the members states will be notified to update the Standards if that is what is required. In case that any member state confirms that some of the children's toys which bear the Gulf conformity mark (or any other declared equivalent mark) poses any danger to the health and safety of the user, thus immediately take all measures necessary to withdraw those products from the market and must also inform GSO of such measures explaining the nonconforming results found, whether: a. failure to meet the essential requirements of the technical regulation / or the standard. b. incorrect application of the standard c. shortcomings in the standard 2. GSO will then study the matter with the other members states and if it is found that the measures taken by the country concerned are correct then the GSO will take the necessary action, taking into consideration what is stipulated in Article Five. ARTICLE SEVEN 1. The Gulf conformity mark (or any other declared equivalent mark) must be affixed (printed) on a children's toy – or its packaging - which has been manufactured in accordance with the Gulf Standard or any standards specified by GSO before they are put into the markets of the countries of the Council. In affixing the mark, this constitutes a declaration by the manufacturer or his licensed representative that the toy conforms to the essential requirements laid down in this regulation. 2. The manufacturer or his licensed representative must maintain technical file containing the following information, which must be ready for inspection: 2.1 A description of the method (test report etc....) by which the manufacturer has confirmed that the product does in fact meet the essential requirements mentioned in Article Two, and he must also – where appropriate - retain a certificate of the model (or equivalent mark) issued by an notified body "and" copies of the documents submitted to that notified body "and" a description of the means by which the manufacturer has ensured that it conforms to the approved model. 2.2 The addresses and places of manufacture and storage 2.3 Details information about the design and the manufacture. 3. If neither the manufacturer nor his representative are present in the GCC states, the responsibility will fall upon the party which introduced those products into the member states markets to prove the compliance with the requirements of item 2 above. In the event of non-compliance, the member states will require the manufacture or his representative to pay the costs of any test in order to ensure that his products satisfy the requirements of item 1 of this Article. ARTICLE EIGHT 1. The manufacturer must affix the Gulf conformity mark (or any other declared equivalent mark) to children's toys – or its packaging - which are not wholly or partially manufactured in accordance with the Gulf Standard or those standard specified by GSO. This mark constitutes a declaration by the manufacturer or his licensed representative that he has followed one of the methods of conformity assessment stipulated for in Appendix 3 through one of the Notified Bodies authorized by GSO. 2. In this circumstance, the manufacturer or his licensed representative must retain the following information ready for inspection: a. A description of the product. b. A description of the method (such as a test report, technical file) by which the manufacturer has confirmed the way in which the product conforms to the sample which was tested. c. The addresses and places of manufacture and storage d. Copies of the documents which were submitted to the notified body in accordance with what is stated in Article Seven. e. The test certificate for the sample, or a copy of it. 3. If neither the manufacturer nor his representative are present in the GCC countries, the responsibility will fall upon the party which introduced those products into the member state markets to ensure that they comply with the requirements of item 2 above. 4. In the event of non-compliance, the member states will require the manufacture or his representative to pay the costs of any test in order to ensure that his products satisfy the requirements of item 1 of this Article. ARTICLE NINE The selection by the manufacturer or his representative to the Notified Bodies must be made in accordance with Reference No. 15 of Appendix 4. ARTICLE TEN 1. The testing of the specimen (if the case requires this) shall be done by one of the Notified Bodies, confirming that the specimen of the toy does indeed conform to the essential requirements set out in Appendix 2 of this regulation. 2. A request to "test a specimen" shall be submitted to one of the Notified Bodies by the manufacturer and his licensed representative in the member states. 3. The request must include the following: 3.1 A description of the toy. Conformity Assessment Technical Regulation for Children’s Toys Page 7 of 19 Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) TR No. : BD07070502 Issue no. : 1 Issue Date : 27/11/2007 3.2 The name and address of the manufacturer or his representative and the place of manufacture. 3.3 Details of the engineering design of the toy shall be accompanied by a model of the toy to be manufactured 4. The Notified Body shall investigate the conformity of the specimen in the following manner: 4.1 Ensure that all the documents requested are present. 4.2 Ensure that the toy does not expose the user to any danger and that it does not have any effect on health or safety. 4.3 Carry out all the tests required (using the Gulf Standards or those standard specified by GSO, as well as any other specifications) in order to ensure that the specimen satisfies the essential requirements of this regulation. 4.4 The Notified Body may request additional specimens so that further investigations can be carried out. 5. If the specimen successfully passes the tests, then the notified body will issue a certificate of conformity for the specimen. Any of the members states (through GSO) may obtain a copy of that test certificate. ARTICLE ELEVEN As far as the conformity mark is concerned (the shape, method of affixing etc...) refer to the reference material contained in Appendix No. 4. ARTICLE TWELVE Samples checks, market surveillance and the reports preparation by member states concerning the application of this regulations is performed by the standards organisations in the member states or by those authorities designated by each state. ARTICLE THIRTEEN The members states shall notify GSO of all the actions taken to apply this regulation, so that the Standardisation Organisation can ascertain whether there are any discrepancies in the procedures being followed within the GCC countries. ARTICLE FOURTEEN GSO must be notified of any action relating to the withdrawal or halting of any product falling under this regulation within the member states. Decorations for festivals and occasions. 2. Detailed scale models for adult collectors 3. Equipment intended to be used collectively in playgrounds 4. Sporting equipment. 5. Water equipment designed for use in deep water. 6. Folk dolls, Decorative dolls and other similar items which are collectables for adults. 7. Professional toys erected in public places (shopping centres, stations, etc.) 8. Puzzles and thought game with 500 pieces or without a picture, designed for 9. specialists. 10. Air guns and rifles. 11. Fireworks, including explosive caps (with the exception of caps specifically designed for use in children's toys, without prejudice to more stringent conditions applicable in some member states (if any). 12. Projectiles and catapults. 13. Sets of arrows with metallic tips. 14. Electric stoves and irons and other functional products which operate at a nominal voltage of greater than 24 volts. 15. Products containing heating elements intended for use under the supervision (control) of an adult for educational purposes. 16. Vehicles and aircraft with an internal combustion engine. 17. Toy Steam engines. 18. Bicycles designed for sports use or for travel on public highways. 19. Video games which play through a video screen and which operate at a nominal voltage of greater than 24 volts. 20. Babies' dummies 21. Products which are replicas of real firearms. 22. Children's jewellery items. (2) THE ESSENTIAL REQUIREMENTS FOR CHILDREN'S TOYS 1. GENERAL PRINCIPLES Serial No. Essential requirements 1 The users of toys, and also those people around them must be protected against health risks or physical injury when the toy is being used for the purpose it has been designed for, or in a manner which could be expected - taking into account the behaviour of an ordinary child. Those risks are: a. which are connected with the design and formation and composition of the toy; b. which are inherent in the use of the toy and cannot be completely eliminated by altering the formation and composition of the toy without actually changing its function or causing it to lose its essential properties. 2 a. The degree of risk present in the use of a toy must be commensurate with the ability of the users, and where appropriate their supervisors, to cope with it. This applies in particular to toys which, by virtue of their functions, dimensions and characteristics, are intended for use by children of under 36 months. b. To observe this principle, a specified -where appropriate- minimum age for users of toys and/or the need to ensure that they are used only under adult supervision. 3 It must be ensured that the labels of toy or its packaging should draw the attention of the users, or their supervisors, to the risks associated with the toy when it is being used and the ways of avoiding those risks. 4 Children's toy or its packaging should not contain any pictures and/or forms which offend the religion of Islam. PHYSICAL AND MECHANICAL PROPERTIES Serial No. Essential requirements 1 In the case of a fixed toy, the toy and its anchorages must have the requisite mechanical strength and, where appropriate, stability to withstand the stresses to which they are subjected during use without breaking or becoming liable to distortion at the risk of causing physical injury. 2 Accessible edges which may be touched, protrusions, wires and cables and connecting parts of the toy must be designed and constructed in such a way that the risk of physical injury through contact with it is minimised as far as possible. 3 The toy must be designed and constructed in such a way that the risk of physical injury arising from the movement of its parts is reduced to the lowest possible level. 4 Where it is possible for the components and parts of the toy to be separated, and where the toy is expressly intended for use by children under the age of 36 months, the dimensions must be such as to prevent their being swallowed and/or inhaled. 5 Neither the toy, nor its parts nor its packaging it comes in for retail sale purposes should present any risk of strangulation or suffocation. 6 Toys intended for use in shallow water which are capable of carrying or supporting a child on the water must be designed and constructed so as to reduce as far as possible, taking into account the recommended use of the toy, any risk of loss of buoyancy of the toy and loss of support afforded to the child. 7 A toy which can be entered into and which thus constitutes an enclosed space for anyone entering it, must also contain an exit which can easily be opened from the inside. 8 A toy which affords movement to the user must incorporate where appropriate a braking system which is suited to the type of toy and is commensurate with the kinetic energy developed by it. Such a system must be easy for the user to operate without risk of ejection or physical injury for the user or for third parties. 9 The form and composition of projectiles and the force of the movement they generate when being fired from a toy designed for that purpose must be taking into account the nature of the toy - there is no unreasonable risk of physical injury to the user or others. Conformity Assessment Technical Regulation for Children’s Toys Page 11 of 19 Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) 10 TR No. : BD07070502 Issue no. : 1 Issue Date : 27/11/2007 A toy containing heating elements must be constructed in such as s to ensure that: The maximum temperature of any accessible surfaces will not cause burns if touched. liquids and gases contained within toys do not reach temperatures or pressures which are such that their escape from a toy, other than for reasons essential to the proper functioning of the toy, might cause burns, scalds or other physical injury. 3. FLAMMABILITY Serial No. Essential requirements 1 The children's toy must not contain any element which could be flammable in the child's environment. Consequently, it must be ensured that it be made from materials as follows: 1. They must not ignite if they are exposed directly to a flame or a spark or any potential fire base; or 2. It must not be easily flammable (flame goes out as soon as the fire cause disappears). 3. if it do ignite, it should be slow-burning and the flame should only spread slowly; or 4. Regardless of the chemical composition of the toy, it should be treated so as to delay the combustion process. Those combustible materials should not pose a risk to the other materials used in the toy. 2 Children's toys which - for reasons essential to its functionality - do contain dangerous materials or mixtures, in particular substances and equipment relating to chemical experiments, model assembly, making ceramic moulds, enamelling, photography or similar activities must not – in themselves contain substances or preparations which can become flammable as a result of the loss of non-flammable volatile components. 3 Children's toy must not be explosive or contain elements or substances which can explode when they are used. This condition does not apply to toy percussion caps, and reference should be made to point 3 above. 4 Children's toys - and in particular chemical children's toys must not contain the following substances or mixtures: Conformity Assessment Technical Regulation for Children’s Toys Page 12 of 19 Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) TR No. : BD07070502 Issue no. : 1 Issue Date : 27/11/2007 1. Which - when they are mixed - can possibly explode:a. through chemical reaction or through heating; b. When mixed with oxidising substances; 2. Which contain volatile components which are flammable in air and liable to form flammable vapour or explosive air mixture. 3. CHEMICAL PROPERTIES Serial No. Essential requirements 1 Children's toy or its packaging must not contain any products derived from pigs. 2 Children's toys should be designed and constricted so that when they are used in the manner detailed in Article Two of this regulation will not present any risk to health or physical injury by ingestion, inhalation, contact with the skin, mucous tissues or eyes. They must in all circumstances comply with the legislation related to particular categories of products, or prohibitions, restrictions of use or labelling of certain dangerous substances and mixtures. 3 In particular - in order to protect children health –bioavailability arising from the use of the children's toy - as an objective - must not exceed the following levels / day: 0.2 micrograms for antimony 0.1 micrograms for arsenic 0.25 micrograms for barium 0.6 micrograms for cadmium 0.3 micrograms for chrome 0.7 micrograms for lead 0.5 micrograms for mercury 5.0 micrograms for selenium or any other value stipulated whether for those substances or other substances in the legislation of the Cooperation Council based on a scientific justification (scientific evidence). Note: Bioavailability of these substances means the soluble extract of those substances having toxicological significance. In all circumstances, it is strictly forbidden for a toy to contain dangerous substances or mixtures if they are intended to be used as such while the toy is being used. On the other hand, where there is a limited number of substances or mixtures which are essential for the toy to function properly, in particular substances and equipment for chemical experimental sets, model assembly, plastic and ceramic moulding, enamelling, photography or similar activities, it is permitted to use them up to the level of the maximum concentration specified for each substance or mixtures. 5. ELECTRICAL PROPERTIES Serial No. Essential requirements 1 Children's electrical toy must not be powered by electricity of a nominal voltage exceeding 24 volts and no part of the toy may exceed 24 volts. 2 Parts of the children's toy which are connected to or liable to come into contact with a source of electricity capable of causing electric shock, including cables or other conductors through which electricity is conveyed to those parts, must be well insulated and mechanically protected so as to prevent the risk of electrical shock. 3 Children's toy must be designed and constructed so as to ensure that the maximum temperatures reached by all directly accessible surfaces (which it is easy to reach) do not cause burns when those surfaces are touched. 6. HEALTH REQUIREMENTS Serial No. Essential requirements 1 Children's toy must be so designed and manufactured as to meet the requirements of hygiene and cleanliness in order to avoid any risk of infection, sickness and contamination. RADIOACTIVITY Serial No. Essential requirements 1 Children's toy must not contain any elements or substances in forms or proportions likely to be detrimental to a child's health 8. LABELING Serial No. Essential requirements The information written on the toy shall be in Arabic language or in both Arabic and English languages in a non-erasable manner stating the following: (or any other required information stipulated in the GCC regulations): 1 Manufacturer name and /or trademark and the place of manufacture. 2 3 4 The appropriate age of the child to use the toy. Mentioning whether the toy requires the supervision or monitoring of adults. Product identification code (batch or code no.) 9. INSTRUCTION MANUAL REQUIREMENTS Serial No. Essential requirements The toy must be accompanied by appropriate clearly legible warnings written in Arabic language or in both Arabic and English languages, in order to reduce inherent risks in their use as described in the essential requirements, and specifically the following: 1 Toys not intended for children under 36 months Toys which might be dangerous for children under 36 months of age shall bear a warning, for example: ‘Not suitable for children under 36 months’ or ‘Not suitable for children under three years’ together with a brief indication, which may also appear in the instructions for use, of the specific risks calling for this restriction. This provision does not apply to toys which, on account of their function, dimensions, characteristics, properties or other cogent grounds, are manifestly unsuitable for children under 36 months. The age warning must be written as the text cited Age Warning Symbol above or by using a symbol indicating the same information and taking the following form: Conformity Assessment Technical Regulation for Children’s Toys Page 15 of 19 Standardization Organization of the Cooperation Council for the Arab States of the Gulf (GSO) TR No. : BD07070502 Issue no. : 1 Issue Date : 27/11/2007 2 Slides, suspended swings and rings, trapezes, ropes and similar toys attached to a crossbeam Such toys shall be accompanied by instructions drawing attention to the need to carry out checks and maintenance of the main parts (suspensions, fixings, anchorages, etc.) at intervals, and pointing out that, if these checks are not carried out, the toy may cause a fall or overturn. Instructions must also be given as to correct assembly of the toy, indicating those parts which can present dangers if it is incorrectly assembled. 3 Functional children's toys Functional toys or their packaging shall bear the marking ‘Warning: to be used under the direct supervision of an adult’. In addition, these toys shall be accompanied by directions giving working instructions as well as the precautions to be taken by the user, with the warning that failure to take these precautions would expose the user to the hazards — to be specified — normally associated with the appliance or product of which the toy is a scale model or an imitation. It will also be indicated that the toy must be kept out of the reach of very young children. ‘Functional toys’ means toys which are used in the same way as, and are often scale models of, appliances or installations intended for adults. 4 Children's toys containing dangerous adhesive substances or preparations in them, chemical children's toys a. Without prejudice to the application of the provisions laid down in instruction guides on the classification, packaging and labelling of dangerous substances or mixtures, the instructions for use of toys containing inherently dangerous substances or mixtures shall bear a warning of the dangerous nature of these substances and mixtures and an indication of the precautions to be taken by the user in order to avoid hazards associated with them, which shall be specified concisely according to the type of toy. The first aid to be given in the event of serious accidents resulting from the use of this type of toy shall also be mentioned. It shall also be stated that the toys must be kept out of reach of very young children. b. In addition to the instructions provided for in (a), chemical toys shall bear the following marking on their packaging: ‘Warning: for children over (1) years of age only. For use under adult supervision’. In particular, the following are regarded as chemical toys: chemistry sets, plastic embedding sets, miniature workshops for ceramics, enamelling or photography and similar toys. * Age to be decided by the manufacturer. Moreover, the instructions for use shall contain a reminder that the toy must be used with caution, since it requires great skill, so as to avoid falls or collisions causing injury to the user and third parties. Some indication shall also be given as to recommended protective equipment (helmets, gloves, kneepads, elbow-pads, etc.). 6 Children's toys intended for use in the water Children's toys intended for use in the water detailed in Article 2 (physical and mechanical properties), item 6 must contain a warning which matches the specification stipulated for in normative reference 11. ‘Warning! Only to be used in water in which the child is within its depth and under supervision’. (3) THE CONFORMITY ASSESSMENT PROCEDURES In order for a children's toy to obtain the Gulf Conformity Mark, it must successfully satisfy one of the following two options: Option One: Internal production control module "A" This covers the internal design and monitoring of the product. This module not require a Notified Body to take action. It requires own declaration of conformity (SDoC). Option Two: Type Approval testing "B" for the design phase, followed by module "C": Conformity to Type for assessment of the production phase. Refer to the Gulf Guide for Conformity Assessment Procedures (Appendix 4) which provides "sequence and details of the conformity assessment procedures" for the abovementioned options. This means that the manufacturer has the right to select the appropriate procedures in order to obtain the Gulf Conformity Mark, either select module "A" which does not require a Notified Body, or he can combine two modules "B" - which requires a Notified Body - and "C" which does not require a Notified Body.
