In exercise of powers conferred under Rule 29 (3) read widX Rule 3 of Haryana School
Education Rules-2003 Education Department, Haryana hereby permit to add new proposed
classes for higher stage. However, it is made clear that such permission will not enable such school
to get recognition automatically for which the applicant shall have to fulfill the required
conditions.

(08sM), titled as Raghbir Kaur Vs. State of Haryana and others, vide its order dated
30.09.2014 has directed as under:"In view of the stand taken by learned counsel for the State, the present
petition is disposed of with a direction to respondent no. 1 to take a final
decision on the claim made by the petitioner for promotion to the post of
Principal within a period of four months from the date of receipt of a copy of
the order without being prejudiced by any decision taken earlier".
Brief facts of the case are that the petitioner - Smt. Raghbir Kaur was working
as Lecturer in Political Science. She was promoted as PrinciOal in HES-II cadre in
officiating capacity vide order no 4/30-2007- HRG(2) dated 20.07.2007. Vide
Armexure P - 2 dated 24.07.2007, while being posted as Lecturer Political Science in
GGSSS, Siwan(Kaithal), she declined promotion on grounds of medical treatment due
to pregnancy and entry of the same has been made in the service book. From the
perusal of service book, it is evident that she remained on duty till 31.10.2007 and
proceeded on maternity leave from 01.11.2007 till 29.04.2008., She again proceeded
on maternity leave from 01.12.2009 till 30.05.2010. Thereafter, she made a request
dated 05.02.2011 for giving her promotion as Principal. It is specific to mention here
that she retired from Government Service on 30.11.2011 after attaining the age of
superannuation i.e. 58 years and has filed Civil Writ Petition Only on 21.11.2011 i.e.
few days before her retirement.
After going through the entire file, Honble Punjab and Haryana High Court
order dated 30.09.2014, Government instructions issued from time to time and
relevant provisions of Haryana Civil Services (Assured Carrier Progression) Rules,
1998 issued by Haryana Government Finance Department vide notification no.
GSR/4/Const.,/Art./309/98 dated 07.01.1998, as amended vide notification no.
dated 1/19/98-4PR(FD) dated 18.07.2001, there is not an iota of doubt that at the
time of issuance of promotion order on 20.07.2007, the petitioner - Smt. Raghbir Kaur
was on duty and had been working as Lecturer in Political Science, GGSSS,
Siwan(Kaithal) and she proceeded on maternity leave on 01.11.2007. Further, it is
also clear that she had forgone her promotion on her own request as detailed above.
She finally made a request for promotion almost at the fag-end of her superannuation.
Needless to mention here, a high standard of commitment, devotion, zeal, integrity,
probity and rectitude are expected of a teacher, especially regarding studies of school
children. From the perusal of the entries in service book, it has been observed that
the said incumbent has been availing leaves of all types quite frequently and this
might have been adversely affecting the studies in the school. Further, it has been
clearly provided in Rule 11 of Haryana Civil Services (Assured Carrier Progression)
Rules, 1998 that in case the 'Government servant chooses to forego any functional
promotion on any ground whatsoever, while drawing his pay in any ACP scale with
reference to him,, he shall cease to be entitled to draw his pay in the ACP pay scales
and shall draw his pay in the functional pay scales prescribed ifor the post on which
he is substantively working from the date of such foregoing of promotion.

From the record, It is clear that she made a request on 05.02.2011 for giving
her promotion as Principal after
31/2 years
of foregoing of promotion. Though she has
claimed that she applied to the Department for grant of promotion vide representation
dated 02.05.2008 but from the official record, it is evident that said representation
had not been received. Her subsequent representation (Annexure P/6) was received in
the Department which is on file. In this representation, she has not at all referred to
her earlier representation dated 02.02.2008 and hence, it is proved that she is making
misrepresentation regarding her earlier representation. Had she really made a
representation on 02.02.2008 as claimed by her, she would have definitely mentioned
about this fact in her subsequent representation dated 05.02.2011 which is available
on file. She has also failed to explain as to why she waited for more than 2

after making the first representation. When her subsequent representation was
processed, same was rejected by the then Financial Commissioner, Secondary
Education on 22.10.2011. I have ascertained from official record that from 05.02.2011
i.e. when she submitted her subsequent representation till 30.11.2011 i.e. when she
retired from service, no teacher junior to her was promoted as Principal. The time
taken in processing her subsequent representation is reasonable. I am of the
considered opinion that she submitted subsequent representation in 2011 i.e. few
months prior to her retirement only for getting financial benefits. She had no interest
in working as Principal which is proved from the fact that she kept quiet for
after foregoing the promotion. She also kept quiet for morel than

allegedly submitted a representation dated 2 nd May, 2008. She was more interested 'in
availing leaves of all kinds instead of concentrating on her job. Therefore, in my view,
she has no claim for granting promotion as Principal with retrospective effect.
In the light of above, the claim of • the petitioner - Smt. Raghbir Kaur,
Lecturer (Retd.) is hereby rejected being devoid of merit.
