AUDIT REPORT
Barbara Henderson introduced Mr. Steve Buckner from Crowe Horwath, LLP. Mr.
Buckner presented the Sutter County Superintendent of Schools’ audit report for
the year ended June 2014 to the Board. It was noted the report contained no audit
findings.

QUARTERLY SURPLUS REPORT – NOVEMBER 12, 2014 AND DECEMBER 8,
2014
Gail Atwood presented a quarterly list of surplus property (November 12, 2014 and
December 8, 2014) to be removed from inventory. The Board reviewed the lists
and inquired about the process to remove vehicles from inventory. Ms. Atwood
explained the process outlined in Board Policy and explained to the Board she was
considering lease options for our vehicles versus purchasing.

ADOPT RESOLUTION NO. 14-15-VI RESOLUTION ON LOCAL RESERVES CAP
The Sutter County Board of Education is calling upon the Legislature and the
Governor to repeal SB 858, Section 27/California Education 42127.01.

President June McJunkin announced at 6:00 p.m., the Board was going into closed
session to discuss the liability claim.

REPORT OF ACTION TAKEN IN CLOSED SESSION
President McJunkin reported the Board in closed session instructed Gail Atwood,
Assistant Superintendent of Administrative Services, to deny the claim of Samantha
Terriss and Jade Talamo against the Sutter County Board of
Education/Superintendent of Schools.

ITEMS FROM THE SUPERINTENDENT/BOARD
17.1 SHADY CREEK UPDATE
Bill Cornelius reported Shady Creek staff is in the process of visiting local
schools to promote the Shady Creek Outdoor School.
Board members were invited to attend the Sutter Yuba Community
Foundation’s 4th Annual Banquet, Saturday, January 24, 2015, Walnut
Avenue Community Center, 1431 Walnut Avenue, Yuba City, at 5:30 p.m.
17.2
LEGISLATIVE UPDATES
ESEA (Special Education) – Bill Cornelius reported CCSESA supports
adequate funding for special education, as well as proposals to improve the
quality of instruction and outcome for students with disabilities. The
CCSESA legislative task force is working on a draft proposal to take to
Washington D.C., in April 2015, to address these concerns.
E-rate – Bill Cornelius reported the E-rate Modernization Order expands WiFi networks in schools and libraries across America; however, additional
funds are needed to fully implement these services.
Nuestro Elementary School District, Winship-Robbins Elementary School
District, and Marcum-Illinois Union School District were recipients of an Erate grant.
Career Pathway Grant – Bill Cornelius explained the Tri-County ROP
program is working with five other counties on the Career Pathway grant.
Recently, the Governor has proposed matching funds for CTE in his budget.

OTHER
Leadership Blueprint – June McJunkin and Victoria Lachance reported they
attended the Leadership Blueprint workshop with our county office
employees. They were appreciative of the opportunity to attend and
encouraged other Board members to attend in the future.

CSBA – Annual Conference – June McJunkin and Victoria Lachance shared
information regarding the Brown Act and “Critical Legal Issues Facing
Schools” they received while attending the Annual CSBA Conference in
December.

CODE § 48920 REGARDING STUDENT EXPULSION APPEALS
The Sutter County Board of Education entered into closed session to hear the expulsion
appeal of Student ID No. 91603 from the Yuba City Unified School District at 1:04 p.m., at
the administrative office of the Sutter County Superintendent of Schools, located at 970
Klamath Lane, Yuba City, CA. The purpose of the hearing is to determine whether to
uphold the expulsion of Student ID No. 91603, by the Yuba City Unified School District.

Policy 5060.6 regarding the Sutter County Board of Education’s scope of expulsion appeal.

HEARING ON AN APPEAL OF THE EXPULSION OF A STUDENT BY THE
YUBA CITY UNIFIED SCHOOL DISTRICT
The Sutter County Board of Education proceeded with the expulsion appeal hearing of
Student ID No. 91603 from the Yuba City Unified School District.

BOARD REVIEW OF THE EVIDENCE PRESENTED REGARDING THE EXPULSION
PROCEDURE CONDUCTED BY THE YUBA CITY UNIFIED SCHOOL DISTRICT
President, June McJunkin, listed the records filed with the Sutter County Board of
Education and made them part of the record.

RECONVENE TO OPEN SESSION – CALL TO ORDER
President, June McJunkin, announced at 3:44 p.m., the Board would reconvene to open
session.
President, June McJunkin, addressed the objection by the Yuba City Unified School District
that the Sutter County Board of Education did not have the authority to extend the timeline
for an expulsion appeal. The letter of appeal was received by the Sutter County Board of
Education on January 5, 2015, and the date of expulsion was December 9, 2014, which
met the 30 day deadline to appeal an expulsion. Sutter County Board of Education Board
Policy states the hearing shall be held within 20 schooldays after the County
Superintendent receives the appellant’s appeal unless a postponement has been granted.
In addition, the Yuba City Unified School District’s letter to the appellant, dated December
12, 2014, stated the appellant had 30 days from the day of notice of the expulsion.
Therefore, the Sutter County Board of Education worked within the guidelines of their
Board Policy 5060.6.

expulsion of Student ID No. 91603 by the Yuba City Unified School District.

Series 6000 – Instruction
Academic Standards
The Sutter County Board of Education (Board) shall adopt the California Common Core
State Standards (CCCSS) for English Language Arts (ELA) and Mathematics; the Next
Generation Science Standards (NGSS); and the English Language Development (ELD)
Standards for student achievement which challenge all students to reach their full
potential and specify what students are expected to know and to be able to do at each
grade level and in each area of study. These standards shall reflect the knowledge and
skills needed for students to be adequately prepared for postsecondary education,
employment, and responsible citizenship.
The Superintendent or designee shall provide the Board with the adopted standards
which used a process that involves teachers, school site and administrators, students,
parents/guardians, representatives from business/industry and postsecondary
institutions, and/or community members. He/she shall ensure the proper articulation of
standards between grade levels and the alignment of the standards with the Sutter
County Superintendent of Schools’ (SCSOS) vision and goals, graduation requirements,
college entrance requirements, and other desired student outcomes. He/she also shall
ensure that the standards are easily understandable and measurable.

The SCSOS’ standards for English language arts, English language development,
mathematics, science, health education, history-social science, physical education,
visual and performing arts, world languages, career technical education, and preschool
education shall meet or exceed statewide model content standards adopted by the
State Board of Education or the State Superintendent of Public Instruction as
applicable.

SCSOS’ curriculum, instruction, student assessments, and evaluations of the
instructional program shall be aligned with SCSOS standards. In accordance with
Education Code 44662, standards of expected student achievement also shall be used
in evaluating teacher performance.

to students and their parents/guardians to inform them of the expectations for student

Types of Complaints
The district shall use the procedures described in this administrative regulation only to
investigate and resolve the following: (Education Code 35186; 5 CCR 4680-4683)
The Sutter County Superintendent of Schools (SCSOS) shall use the procedures
described in this administrative regulation only to investigate and resolve the following:
(Education Code 35186; 5 CCR 4680-4683)
1. Complaints regarding the insufficiency of textbooks and instructional materials
including any complaint alleging that:
a. A student, including an English learner, does not have standards-aligned
textbooks or instructional materials or state- or districtcounty-adopted textbooks
or other required instructional materials to use in class.
b. A student does not have access to textbooks or instructional materials to use at
home or after school. This does not require two sets of textbooks or instructional
materials for each student.
c. Textbooks or instructional materials are in poor or unusable condition, have
missing pages, or are unreadable due to damage.
d. A student was provided photocopied sheets from only a portion of a textbook or
instructional materials to address a shortage of textbooks or instructional
materials.

2. Complaints regarding teacher vacancy or misassignment, including any complaint
alleging that:
a. A semester begins and a teacher vacancy exists.
b. A teacher who is not EL authorized to teach English learners cannot be assigned
to teach a class with one or more English learners.

c. A teacher is assigned to teach a class for which the teacher lacks subject matter

Teacher vacancy means a position to which a single designated certificated
employee has not been assigned at the beginning of the year for an entire year
or, if the position is for a one-semester course, a position to which a single
designated certificated employee has not been assigned at the beginning of the
semester for an entire semester. (Education Code 35186; 5 CCR 4600)
Beginning of the year or semester means the first day classes necessary to
serve all the students enrolled are established with a single designated
certificated employee assigned for the duration of the class, but not later than 20
working days after the first day students attend classes for that semester. (5 CCR
4600)
Misassignment means the placement of a certificated employee in a teaching or
services position for which the employee does not hold a legally recognized
certificate or credential or the placement of a certificated employee in a teaching
or services position that the employee is not otherwise authorized by statute to
hold. (Education Code 35186; 5 CCR 4600)

3. Complaints regarding the condition of school facilities, including any complaint
alleging that:
a. A condition poses an emergency or urgent threat to the health or safety of
students or staff.
Emergency or urgent threat means structures or systems that are in a condition
that poses a threat to the health and safety of students or staff while at school,
including, but not limited to, gas leaks, nonfunctioning heating; ventilation; fire
sprinklers; air-conditioning systems; electrical power failure; major sewer line
stoppage; major pest or vermin infestation; broken windows or exterior doors or
gates that will not lock and that pose a security risk; abatement of hazardous
materials previously undiscovered that pose an immediate threat to students or
staff; structural damage creating a hazardous or uninhabitable condition; or any
other condition deemed appropriate. (Education Code 17592.72)
b. A school restroom has not been cleaned, maintained, or kept open in accordance
with Education Code 35292.5.
Clean or maintained school restroom means a school restroom has been cleaned
or maintained regularly, is fully operational, or has been stocked at all times with
toilet paper, soap, or paper towels or functional hand dryers. (Education Code

Open restroom means the school has kept all restrooms open during school hours
when students are not in classes and has kept a sufficient number of restrooms
open during school hours when students are in classes. This does not apply
when the temporary closing of the restroom is necessary for student safety or to
make repairs. (Education Code 35292.5)

Filing of Complaint
A complaint alleging any condition(s) specified in the section "Types of Complaints"
above shall be filed with the principal or designee at the school in which the complaint
arises. The principal or designee shall forward a complaint about problems beyond
his/her authority to the Superintendent or designee in a timely manner, but not to
exceed 10 working days. (Education Code 35186; 5 CCR 4680)
Investigation and Response
The principal or designee shall make all reasonable efforts to investigate any problem
within his/her authority. He/she shall remedy a valid complaint within a reasonable time
period not to exceed 30 working days from the date the complaint was received.

Complaints may be filed anonymously. If the complainant has indicated on the
complaint form that he/she would like a response to the complaint, the principal or
designee shall report the resolution of the complaint to him/her at the mailing address
indicated on the complaint form within 45 working days of the initial filing of the
complaint. At the same time, the principal or designee shall report the same information
to the Superintendent or designee. (Education Code 35186; 5 CCR 4680, 4685)
When Education Code 48985 is applicable and the complainant has requested a
response, the response shall be written in English and in the primary language in which
the complaint was filed. (Education Code 35186)
If a complainant is not satisfied with the resolution of a complaint, he/she has the right to
describe the complaint to the Governing Board at a regularly scheduled meeting.

For any complaint concerning a facilities condition that poses an emergency or urgent
threat to the health or safety of students or staff as described in item #3a in the section
"Types of Complaints" above, a complainant who is not satisfied with the resolution
proffered by the Superintendent or designee may file an appeal to the Superintendent of

Public Instruction within 15 days of receiving the district's SCSOS response. The
complainant shall comply with the appeal requirements specified in 5 CCR 4632.

Reports
On a quarterly basis, the Superintendent or designee shall report, to the Sutter County
Board of Education at a regularly scheduled public Board meeting, summarized data on
the nature and resolution of all complaints. The report shall include the number of
complaints by general subject area with the number of resolved and unresolved

Forms and Notices
The Superintendent or designee shall ensure a Williams complaint form is available at
each school. However, complainants need not use the district's Sutter County
Superintendent of Schools complaint form in order to file a complaint. (Education Code
35186; 5 CCR 4680)
The Superintendent or designee shall ensure that each district's sites’ complaint form
contains a space to indicate whether the complainant desires a response to his/her
complaint and specifies the location for filing a complaint. A complainant may add as
much text to explain the complaint as he/she wishes. (Education Code 35186; 5 CCR
4680)
The Superintendent or designee shall ensure that a notice is posted in each classroom
in each school containing the components specified in Education Code 35186.

NOTICE TO PARENTS/GUARDIANS, STUDENTS, AND TEACHERS:
COMPLAINT RIGHTS
Parents/Guardians, Students, and Teachers:
Pursuant to Education Code 35186, you are hereby notified that:
1. There should be sufficient textbooks and instructional materials. That means each
student, including an English learner, must have a textbook or instructional materials, or
both, to use in class and to take home.
2. School facilities must be clean, safe, and maintained in good repair.
3. There should be no teacher vacancies or misassignments. There should be a
teacher assigned to each class and not a series of substitutes or other temporary
teachers. The teacher should have the proper credential to teach the class, including
the certification required to teach English learners, if present.
Misassignment means the placement of a certificated employee in a teaching or
services position for which the employee does not hold a legally recognized certificate
or credential or the placement of a certificated employee in a teaching or services
position that the employee is not otherwise authorized by statute to hold.
Teacher vacancy means a position to which a single designated certificated employee
has not been assigned at the beginning of the year for an entire year or, if the position is
for a one-semester course, a position to which a single designated certificated
employee has not been assigned at the beginning of a semester for an entire semester.
4. A complaint form may be obtained at the school office or district office Sutter County
Superintendent of Schools Office (SCSOS), or downloaded from the school or district
Sutter County Superintendent of School’s web site. You may also download a copy of
the California Department of Education complaint form from the following web site:

Bids
In order to ensure transparency and the prudent expenditure of public funds, Sutter
County Superintendent of School (SCSOS) shall award contracts in an objective
manner and in accordance with the law. SCSOS equipment, supplies, and services
shall be purchased using competitive bidding when required by law or if the
Superintendent determines that it is in the best interest of SCSOS to do so.
When the Superintendent has determined that it is in the best interest of SCSOS,
SCSOS may piggyback onto the contract of another public agency or corporation to
lease or purchase equipment or supplies to the extent authorized by law. (Public
Contract Code 20118)
Bid specification shall be carefully designed and shall describe in detail the quality,
delivery, and service required.
To assist the SCSOS in determining whether bidders are responsible, the
Superintendent may require prequalification procedures as allowed by law and specified
in administrative regulation.
The Uniform Public Construction Cost Accounting Act (UPCCAA)
The Uniform Public Construction Cost Accounting Act (UPCCAA) allows SCSOS to
follow its procedures to change both the dollar amount limitations and the advertising
procedures ordinarily applicable in competitive bidding. Rather than the usual $15,000
bid limit for public projects applicable to Counties, under the Act, public works projects
may be performed as follows:
1. Projects of $45,000 or less may be performed by force account, negotiated
contract, or purchase order
2. Projects of $175,000 or less may be left to contract by so-called “informal bidding
procedures” established in the Act
3. Projects of more than $175,000 remain subject to standard formal bidding
procedures
Existing law governing public contracts establishes procedures that public agencies, as
defined, are required to follow when performing public works projects, and authorizes
the governing body of the SCSOS to adopt a resolutions, by a 4/5 vote, to award the

contract at $187,500 or less to the lowest responsible bidder when all informal bids on
the public works project are in excess of $175,000.
In electing to become subject to the Act, SCSOS must implement and adhere to
detailed notice and accounting systems published in the Cost Accounting Policies and
Procedures Manual published by the California Uniform Public Construction Cost
Accounting Commission.

Advertised/Competitive Bids
Sutter County Superintendent of Schools (SCSOS) shall seek competitive bids through
advertisement for contracts involving an expenditure of $175,000 or more for a public
project. Public project means construction, reconstruction, erection, alteration,
renovation, improvement, painting, repainting, demolition, and repair work involving
SCSOS owned, leased, or operated facility. (Public Contract Code 20111, 22002)
The SCSOS shall also seek competitive bids through advertisement for contracts
exceeding the amount specified in law, and as annually adjusted by the Superintendent
of Public Instruction, for any of the following: (Public Contract Code 20111; Government
Code 53060)
1. The purchase of equipment, materials, or supplies to be furnished, sold, or
leased to the County
2. Services, not including construction services or special services and advice in
accounting, financial, legal, or administrative matters
3. Repairs, including maintenance that is not a public project
Maintenance means routine, recurring, and usual work for preserving, protecting, and
keeping any SCSOS facility operating in a safe, efficient, and continually usable
condition for the intended purpose for which it was designed, improved, constructed,
altered, or repaired. Maintenance includes, but is not limited to, carpentry, electrical,
plumbing, glazing, and other craft work designed to preserve the facility, as well as
repairs, cleaning, and other operations on machinery and other permanently attached
equipment. This definition does not include, among other types or work, janitorial or
custodial services and protection provided by a security forces, nor does it include
painting, repainting, or decorating other than touchup. (Public Contract Code 20115)
Unless otherwise authorized by law, contracts shall be let to the lowest responsible
bidder who shall give such security as the Governing Board requires, or else all bids
shall be rejected. (Public Contract Code 20111)
When letting a contract for the procurement and/or maintenance of electronic data
processing systems and supporting software, the Board may contract with any one of
the three lowest responsible bidders. (Public Contract Code 20118.1)

The Board shall secure bids pursuant to Public Contract Code 20111 and 20112 for any
transportation service expenditure more than $10,000 when contemplating that such a
contract may be made with a person or corporation other than a common carrier,
municipally owned transit system, or a parent/guardian of students who are to be
transported. The Board may let this contract to other than the lowest bidder. (Education
Code 39802)
No work, project, services, or purchase shall be split or separated into smaller work
orders or projects for the purpose of evading the legal requirements of Public Contract
Code 20111-20118.4 for contracting after competitive bidding. (Public Contract Code
20116)
Instructions and Procedures for Advertised Bids
The Superintendent or designee shall call for bids by placing a notice at least once a
week for two weeks in a local newspaper or general circulation published in the County,
or if no such newspaper exists, then in some newspaper of general circulation,
circulated in the county. The Superintendent or designee also may post the notice on
the County’s website or through an electronic portal. The notice shall state the work to
be done or materials or supplies to be furnished and the time and place and website
where bids will be opened. SCSOS may accept a bid that has been submitted
electronically or on paper. (Public Contract Code 20112)
The notice shall contain the time, date, and location of any mandatory pre-bid
conference, site visit, or meeting. The notice shall also detail when and where project
documents, including final plan and specifications, are available. Any such mandatory
visit or meeting shall not occur within a minimum of five calendar days of the publication
of the initial notice. (Public Contract Code 6610) Bid instructions and specifications
shall include the following requirements and information:
1. All bidders shall certify the minimum, if not exact, percentage of post-consumer
materials in products, materials, goods, or supplies offered or sold. (Public
Contract Code 22152)
2. All bids for construction work shall be presented under sealed cover and shall be
accompanied by one of the following forms of bidder’s security: (Public Contract

b. A cashier’s check made payable to SCSOS

The security of unsuccessful bidders shall be returned in a reasonable
period of time, but in no event later than 60 days after the bid is awarded.

3. When a standardized proposal form is provided to SCSOS, bids not presented
on the standard form shall be disregarded. (Public Contract Code 20111.5)
4. Bids shall not be accepted after the advertised bid opening time, regardless of
whether the bids are actually opened at that time. (Public Contract Code 20112)
5. When two or more identical lowest or highest bids are received, the Board may
determine by lot which bid shall be accepted. (Public Contact Code 20117)
6. If SCSOS requires that the bid include prices for items that may be added to or
deducted from the scope of work in the contract, the bid solicitation shall specify
which one of the following methods will be used to determine the lowest bid. In
the absence of such a specification, only the method provided in item a below
shall be used. (Public Contract Code 20103.8)
a. The lowest bid shall be the lowest total of the bid prices on the base
contract without consideration of the prices on the additive or deductive
items.
b. The lowest bid shall be the lowest total of the bid prices on the base
contract and those additive or deductive items that were specifically
identified in the bid solicitation as being used for the purpose of
determining the lowest bid price.

c. The lowest bid shall be the lowest total of the bid prices on the base
contract and those additive or deductive items that, when taken in order
from a specifically identified list of those items in the solicitation, and
added to or subtracted from the base contract, are less than or equal to a
funding amount publicly disclosed by SCSOS before the first bid is
opened.
The lowest bid shall be determined in a manner that prevents any
information that would identify any of the bidders or proposed
subcontractors or suppliers from being revealed to SCSOS before the
ranking or all bidders from lowest to highest has been determined. (Public
Contract Code 20103.8)
7. Any subsequent change or alteration of a contract shall be governed by the
provisions of Public Contract Code 20118.4.
8. After being opened, all submitted bids become public records pursuant to
Government Code 6252 and shall be made available for review pursuant to law,
Board policy, and administrative regulation.
Alternative Bid Procedure for Technological Supplies and Equipment
Rather than seek competitive bids, the Superintendent may use competitive negotiation
when it makes a finding that SCSOS procurement is for computers, software,
telecommunications equipment, microwave equipment, or other related electronic
equipment and apparatus. Competitive negotiation shall not be used to contract for
construction or for the procurement of any product that is available in substantial
quantities to the general public. (Public Contract Code 20118.2)
The competitive negotiation shall include, but is not limited to, the following
requirements: (Public Contract Code 20118.2)
1. The Superintendent or designee shall prepare a request for proposals (RFP) that
shall be submitted to an adequate number of qualified sources, as determined by
SCSOS, to permit reasonable competition consistent with the nature and
requirement of the procurement.
2. Notice of the RFP shall be published at least twice in a newspaper of general
circulation, at least 10 days before the date for the receipt of the proposals.

3. The Superintendent or designee shall make every effort to generate the
maximum feasible number of proposals from qualified sources and shall make a
finding to that effect before proceeding to negotiation if only a single response to
the RFP is received.
4. The RFP shall identify all significant evaluation factors, including price, and their
relative importance.
5. The Superintendent or designee shall provide reasonable procedures for the
technical evaluation of the RFPs received, the identification of qualified sources,
and the selection for the award of the contract.
6. The Superintendent or designee shall award the contract to the qualified bidder
whose proposal meets the evaluation standards and will be most advantageous
to SCSOS with price and all other factors considered.
7. If the Superintendent or designee does not award the contract to the bidder
whose proposal contains the lowest price, then the Superintendent shall make a
finding setting forth the basis for the award.
8. The Superintendent, at its discretion, may reject all proposals and request new
RFPs.
9. Provisions in any contract concerning utilization of small business enterprises
that are in accordance with the RFP, shall not be subject to negation with the
successful proposer.
Bids Not Required
Without advertising for bids and upon a determination that it is in the best interest of
SCSOS, the Superintendent may authorize, by contract, lease, requisition, or purchase
order, and other public corporation or agency to lease data-processing equipment or to
purchase materials, supplies, equipment, automotive vehicles, tractors, and other
personal property for SCSOS in the manner that the other public corporation or agency
is authorized to make the leases or purchases form a vendor (“piggyback”). (Public
Contract Code 20118)
Alternatively, if there is an existing contract between a public corporation or agency and
a vendor for the lease or purchase of personal property, SCSOS may authorize the
lease or purchase of personal property directly from the vendor by contract, lease,

requisition, or purchase order and make payment to the vendor under the same terms
that are available to the public corporation or agency under the contract. (Public
Contract Code 20118)
Supplementary textbooks, library books, education films, audiovisual materials, test
materials, workbooks, instructional computer software packages, or periodicals may be
purchased in any amount without taking estimates or advertising for bids. (Public
Contract Code 20118.3)
Perishable commodities, such as foodstuffs, needed in the operations of cafeterias may
be purchased through bid or on the open market. (Education Code 38083)
In an emergency when any repairs, alterations, work, or improvement to any school
facility is necessary to permit the continuance of existing school classes or to avoid
danger to life or property, the Board may, by unanimous vote and with the approval of
SCSOS, contract for labor and materials or supplies without advertising for or inviting
bids or may authorize the use of day labor or force account for the emergency purpose.
(Public Contract Code 20113)
Bids shall also not be required for day labor under circumstances specified in Public
Contract Code 20114. Day labor shall include the use of maintenance personnel
employed on a permanent or temporary basis. (Public Contract Code 20114)
Sole Sourcing
In any contract for the construction, alteration, or repair of school facilities, the
Superintendent or designees shall not draft the bid specification in a manner that, either
directly or indirectly, limits bidding to any one specific concern or calls for a designated
material, product, thing, or service by a specific brand or trade name, unless the
specification designating the specific material, product, thing, or particular brand name
is followed by the words “or equal” so that bidders may furnish any equal material,
product, thing, or service. In such cases, the bid specification shall provide a time
period, before and/or after the award of the contract, for the contractor to submit data
substantiating the request for substituting the designated material, product, thing, or
service. If no such time period is specified, the contractor may submit the data within 35
days after the award of the contract. (Public Contract Code 3400)
When the bid is for a roof project, a material, product, thing, or service is considered
“equal” to the one designated if it is equal in quality, durability, design, and appearance;
will perform the intended function equally well; and conforms substantially to detailed
requirements in the bid specification. (Public Contract Code 3002)

However, the Superintendent or designee may designate a specific concern, material,
product, thing, or service by brand or trade name (sole sourcing), if the Board has made
a finding, described in the invitation for bids or RFP, that a particular material, product,
thing, or service is designated for any of the following purposes: (Public Contract Code
3400)
1. To conduct a field test or experiment to determine its suitability for future use
2. To match others in use on a particular public improvement that has been
completed or is in the course of completion
3. To obtain a necessary item that is only available from one source
4. To respond to the Board’s declaration of an emergency, as long as the
declaration has been approved by four-fifths of the Board when issuing the
invitation for bid or RFP
Prequalification Procedure
For any contract for which bids are legally required, the Superintendent may require that
each prospective bidder complete and submit a standardized questionnaire and
financial statement. For this purpose, the Superintendent or designee shall supply a
form which requires a complete statement of the bidder’s financial ability and
experience in performing public works. The information shall be verified under oath in
the manner in which civil law pleadings are verified. The questionnaires and financial
statements shall not be public records and shall not be open to public inspection.

Prospective bidders shall submit the questionnaire and financial statement at least five
days before the date fixed for public opening of sealed bids. (Public Contract Code
20111.5)
The Superintendent or designee shall establish a uniform system for rating bidders on
the basis of completed questionnaires and financial statements in order to determine
the size of contracts on which each bidder is qualified to bid. Bidders must be deemed
prequalified by SCSOS at least one day before the fixed bid-opening date. (Public
Contract Code 20111.5)

SCSOS may establish a procedure for prequalifying bidders on a quarterly basis and
may authorize that prequalification be considered valid for up to one calendar year
following the date of the initial prequalification. (Public Contract Code 20111.5)
California Uniform Public Cost Accounting Protocol
SCSOS is subject to the uniform construction accounting procedures set forth in Article
2 (Public Contract Code commencing with Section 22010) which states SCSOS shall
enact an informal bidding ordinance to govern the selection of contractors to perform
public projects pursuant to subdivision (b) of Section 22032. The ordinance shall
include all of the following:
1. In November of each year, the SCSOS shall maintain a list of qualified
contractors, identified according to categories of work. Minimum criteria for
development and maintenance of the contractors list shall be determined by the
commission.
2. All contractors on the list for the category of work being bid or all construction
trade journals specified in Public Contract Code, Section 22036, or both all
contractors on the list for the category of work being bid and all construction
trade journals specified in Public Contract Code, Section 22036, shall be mailed
a notice inviting informal bids unless the product or service is proprietary.
3. All mailing of notices to contractors and construction trade journals pursuant to
subdivision (b) of Section 22032 shall be completed not less than 10 calendar
days before bids are due.
4. The notice inviting informal bids shall describe the project in general terms and
how to obtain more detailed information about the project, and state the time and
place for the submission of bids.
5. The Superintendent may delegate the authority to award informal contracts to the
Assistant Superintendent of Business Services.
6. If all bids received are in excess of one hundred seventy-five thousand dollars
($175,000), the Board of the SCSOS may, by adoption of a resolution by a fourfifths vote, award the contract, at one hundred eighty-seven thousand five
hundred dollars ($187,500) or less, to the lowest responsible bidder, if it
determines the cost estimate of SCSOS was reasonable.

Protest by Bidders
A bidder may protest a bid award if he/she believes that the award was inconsistent with
Board policy, the bid’s specifications, or was not in compliance with law. A protest must
be filed in writing with the Superintendent or designee within five working days after
receipt or notification of the contract award. The bidder shall submit all documents
supporting or justifying the protest. A bidder’s failure to file the protest documents in a
timely manner shall constitute a waiver of his/her right to protest the award of the
contract.
The Superintendent or designee shall review the documents submitted with the bidder’s
claims and render a decision in writing within 30 working days. The Superintendent or
designee may also convene a meeting with the bidder in order to attempt to resolve the
problem.
The bidder may appeal the Superintendent or designee’s decision to the Board. The
Superintendent or designee shall provide reasonable notice to the bidder of the time for
Board consideration of the protest. The Board’s decision shall be final.

School Calendar
For each county program, the Sutter County Board of Education (Board) shall
adopt a school calendar that meets the requirements of law as well as the needs
of the community, students, and the work year as negotiated with the county's
teacher associations. As appropriate, the Superintendent or designee shall
ensure that the proposed calendar is aligned with assessment and accountability
schedules in order to support the Sutter County Superintendent of Schools’
(SCSOS) goals for student achievement.

Each school calendar shall show the beginning and ending school dates, legal
and local holidays, staff development days, minimum days, vacation periods, and

The Sutter County Board of Education (Board) shall fix the length of the school
day subject to the provisions of law. (Education Code 46100)

The length of the school day shall apply equally to students with disabilities
unless otherwise specified in the student's individualized education program or
Section 504 plan.

The schedule for elementary schools shall include at least one daily period of
recess of at least 20 minutes in length in order to provide students with
unstructured but supervised opportunities for physical activity.

In establishing the daily instructional schedule for each secondary school, the
Superintendent or designee shall give consideration to course requirements and
curricular demands, availability of school facilities, and applicable legal

learning, provide more intensive study of core academic subjects or extended
exploration of complex topics, and reduce transition time between classes.

Kindergarten
Except as otherwise provided by law, the average school day established for
kindergarten students shall be at least three hours, including recesses but
excluding noon intermissions, but no longer than four hours, excluding recesses.
(Education Code 46111, 46114, 46115, 46117)
Recess may be counted as instructional minutes for purposes of determining the
maximum school day if teacher supervision occurs.
In any Sutter County Superintendent of Schools’ (SCSOS) county office program
operating an early primary program pursuant to Education Code 8970-8974, the
kindergarten school day may exceed four hours, excluding recess, if both of the
following conditions are met: (Education Code 8973)
1. The Sutter County Board of Education (Board) has declared that the
extended-day kindergarten program does not exceed the length of the
primary school day.
2. The extended-day kindergarten program includes ample opportunity for both
active and quiet activities within an integrated, experiential, and
developmentally appropriate educational program.
Grades 1-8
Except as otherwise provided by law, the school day for elementary and middle
school students shall be:
1.
At least 230 minutes for students in grades 1-3, unless the Board has
prescribed a shorter school day because of lack of school facilities requiring
double sessions, in which case the minimum school day shall be 200
minutes. (Education Code 46112, 46142)

At least 240 minutes for students in grades 4-8 (Education Code 46113,
46142)

In determining the number of minutes for purposes of compliance with the
minimum school day for students in grades 1-8, both noon intermissions and
recesses shall be excluded. (Education Code 46115)
Grades 9-12
The school day for students in grades 9-12 shall be at least 240 minutes.

However, the school day may be less than 240 minutes when authorized by law.
Programs that have a minimum school day of 180 minutes include, but are not
necessarily limited to:

A student in grade 12 who is enrolled in work experience education and is in

Classroom Interruptions
In order to allow students to take full advantage of learning opportunities while in
the classroom, school staff shall ensure that interruptions are kept to a minimum.
Strategies to reduce classroom interruptions include, but are not limited to, the
following:
1.
Keep announcements made through intercom or public address systems to a
minimum, limit announcements to specific times during the day, and only use
the intercom or public address systems for announcements that apply to all
students or groups of students. Announcements that apply to individual
students or staff members should be distributed in writing.
2.
Establish a fixed time for the delivery of written messages to students and
staff, except in cases of emergencies.
3.
Schedule school maintenance operations involving noise or classroom
disruption, as well as deliveries of equipment and supplies, to classrooms
before or after school hours whenever possible.
4.
Inform school visitors that, whenever possible, they should make
appointments in advance, in accordance with district policy.

5.
Notify parents/guardians that they should go to the school office rather than
the classroom when they are dropping off their child late, picking him/her up

“ADOPT CALIFORNIA UNIFORM PUBLIC CONSTRUCTION
COST ACCOUNTING (CUPCCAA) PROGRAM”
WHEREAS, Prior to the passage of Assembly Bill No. 1666, Chapter 1054, Statues 1983,
which added Chapter 2, commencing with 22000, to Part 3 of Division 3 of the Public Contract
Code, existing law did not provide a uniform cost accounting standard for construction work
performed by local public agencies: and
WHEREAS, Public Contract Code 22000 et seq., the Uniform Public Construction Cost
Accounting Act (the “Act”) established such a uniform cost-accounting standard;
WHEREAS, the Act provides for the implementation of uniform, construction cost accounting
procedures and informal budding procedures for all public agencies electing to participate,
together with instructions for their adoption and implementation by such public agencies;
WHEREAS, pursuant to Public Contract ode 22010 and 22017, the California Uniform
Construction Cost Accounting Commission (the “Commission”) developed and recommended to
the California State Controller uniform construction cost accounting and informal budding
procedures (the “Uniform Procedures”), consistent with the Public Contract Code 22031 and
22017, for consideration;
WHEREAS, pursuant to Public Contract Code 22019, the California State Controller adopted
the Uniform Procedures;
WHEREAS, the Act only applies to a public agency whose governing board has by resolution
elected to become subject to the uniform procedures and has notified the California State
Controller of that election;
WHEREAS, Public Contract Code 20150. 1(b), authorizes County Offices to participate in the
Uniform Public Construction Cost Accounting Act.
NOW THEREFORE, the Governing Board of the Sutter County Superintendent of Schools
hereby resolves as follows:
1.
That the above recitals are all true and correct
2.
That the County hereby, pursuant to Public Contract Code 22030, elects to
become subject to the uniform procedures set forth in the Act and to the
Commission’s policies-and-procedures manual and cost accounting review
procedures, as they may each from time to time be amended, and directs County
staff to notify the California State Controllers of this election.
3.
That the notice inviting informal bids shall describe the projects in general terms
and explain how to obtain more detailed information about the project, and state
the time and place for submission of informal bids.
4.
That the superintendent or superintendent’s designee is authorized to award
informal contracts pursuant to this resolution.
5.
That this resolution shall take effect immediately upon its adoption.
