Law Council considers children in detention report
The Law Council of Australia notes the release of the Australian Human Rights Commission’s
Report on its National Inquiry into Children in Immigration Detention 2014 on 12 February 2015.
The Law Council will consider the Report’s findings and recommendation in detail and prepare
an appropriate response.
Law Council President Duncan McConnel noted a number of the Report’s recommendations
reflect positions suggested by the Law Council in its submission to the National Inquiry into
Children in Immigration Detention, including the recommendations that all children be removed
from closed immigration detention facilities and an independent guardian be appointed for
unaccompanied children seeking asylum in Australia.
The Law Council’s Asylum Seeker Policy outlines that Australia should act in accordance with its
voluntarily assumed obligations under international law, and that immigration detention must
adhere to the rule of law.
