County, on Wednesday, April 1, 2015, at 9:00 A.M.
2. All bidders must pre-register in order to bid at the sale. Pre-registration deadline is 4:30 P.M. on March 25, 2015. The
County reserves the right to refuse bids from anyone registering after this date. Registrations will not be accepted the day of the
auction. You may pre-register in person, mail a registration form to the Shawnee County Counselor’s Office, 200 SE 7th Street,
Room 100, Topeka, Kansas 66603, fax a completed registration form to the Shawnee County Counselor’s Office at 785-2914902, or email a completed registration form to [email protected].
3. If you have delinquent taxes, you will not be allowed to bid at the sale. Pursuant to K.S.A. 79-2812, “no person shall be
eligible to purchase real estate at any delinquent tax sale . . . if such person is the record owner of real estate upon which there are
delinquent taxes of a general ad valorem tax nature or delinquent special assessments in existence as reflected by the records of
the county treasurer.”

MAINTENANCE CODE (IPMC) AS ADOPTED BY THE CITY OF
TOPEKA, KANSAS
Now on this 4th day of February 2015, the complaint on the above
premises comes for hearing before Lloyd C. Swartz, Administrative
Hearing Officer. Notice of time and place of hearing having been
given as required by law to wit: service of notice was attempted via
certified mail on December 4, 2014, and published on December 15,
2014 and December 22, 2014.
There appears: Wendi Rieb, Property Maintenance Code Unit; there
were no other appearances.
The Administrative Hearing Officer, after hearing all of the evidence
and reviewing all exhibits presented, finds that said structure(s) located
on the following described real estate:
Commonly known as 1813 SW Lane St, in the City of Topeka, Shawnee
County, Kansas,
IS UNFIT FOR HUMAN USE OR HABITATION and does not meet
the minimum standards of the 2012 IPMC as adopted by the City
of Topeka, Kansas.
The repair, alteration or improvement to the house cannot be made
at a reasonable cost in relation to the value of the house. The cost to
replace the house is estimated to be $145,110.00; the repair costs to
the house are estimated to be $51,860.75; which, cost exceeds 30%
of the replacement value as, required by the 2012 IPMC as adopted
by the City of Topeka.
The property owner has provided the City with a copy of the demolition
agreement and is expecting the structure to be demolished in the next
few weeks. The City is asking for a 45 day continuance.
It is therefore ordered the hearing be continued and will reconvene
on April 1, 2015 at 3:30 pm.
Any person affected by an order issued by the Administrative Hearing
Officer may petition the Shawnee County District Court for an injunction
restraining the imposition of this order, and the court may, upon such
petition, issue a temporary injunction, pending the final disposition
of the case; provided, however, that such person shall petition such
court within thirty (30) days after the posting or service of the order
of the Administrative Hearing Officer.
