SPECIAL PRE-INSTITUTE EVENT
>>>monday patent damages roundtable
Monday
March 23, 2015
1:00 PM
Roundtable Registration Opens
1:30 PM to 6:00 PM
Patent Damages Roundtable
3:45 PM to 4:05 PM
Networking Break
This roundtable, consisting of damages experts,
litigators and in-house counsel who are thought
leaders on patent damages, is one of three similar
discussions being held across the United States.
The panelists will engage in an open exchange of
ideas to improve the manner in which the financial
and damages aspects of cases are handled and
creatively explore methodologies and best practices
for determining reasonable royalty damages in a
way that makes sense, is fair and is practical.
If we could determine a perfect paradigm for
determining reasonable royalty damages, what
would it look like? What role, if any, would the
Georgia-Pacific factors, the hypothetical negotiation
construct, apportionment, the definition of the
smallest saleable patent practicing unit, prior
licenses, surveys and other currently-used tools
have in that ideal paradigm?
A separate Roundtable registration and fee is
required. Seating is limited, so register early!

Important Developing Copyright Issues
for Software and the Internet:
Oracle v. Google and Beyond
This panel of business and legal experts will examine the
implications of Oracle v. Google for current online and
software technologies and business models, including
whether it represents a major shift in copyright law.
The panelists will discuss whether the Federal Circuit
effectively expanded what may be owned in software
or related technologies, including in areas critical to
interoperability and compatibility among the products
of different companies; whether the decision represents
a significant shift in the copyright rules applicable to
copying and the use of interfaces; the potential role of
fair use, waiver and licensing principles; the extent to
which the decision contradicts the Supreme Court’s 4-4
split decision in Lotus v. Borland; and how companies
might guide their future actions.

How New Technologies are Changing
Lanham Act and Copyright Act Analyses
While the rise of social media, the cloud and mobile
technologies have changed the way brands advertise
and reach consumers, it has also changed the
traditional Lanham Act and Copyright Act analyses
used in determining the boundaries of fair use, the
use of logos and native advertising. The panelists will
discuss the evolving fair use standards; the benefits
and potential liabilities of native advertising; the
use of social media and the use of mobile devices to
build and protect brands; and the impact of social
media and the use of mobile devices on a brand’s
cease and desist strategy.

The Supreme Court’s Impact on the
Development of Intellectual Property Law
A panel of renowned advocates who have argued
recent IP cases to the Supreme Court and academics
who follow the Court will explore in depth how the
Justices approach IP issues. This uniquely informed
panel will discuss recent IP cases and explain such
issues as how the Justices decide which IP cases to
accept; approaches to presenting IP issues to the
Court in briefing and argument; the extent to which the
Court looks to precedent based on old technologies in
addressing unique issues raised by new technologies;
when IP cases are likely to get sui generis treatment;
what to expect in future cases; the extent to which
companies might anticipate future developments in
their current decision-making; and how companies and
industries might develop effective strategies to obtain
review and influence IP legal developments.
