AWARDING BIDS FOR HUMAN SERVICES CENTER FIRST FLOOR
RENOVATION PROJECT - BUILDINGS AND GROUNDS
BY:
WHEREAS, Resolution #388 dated June 11, 2014 authorized the Purchasing Agent to solicit bids
for the 2013 Master Plan Project for the Human Services Center First Floor Renovation Project; and
WHEREAS, bids were opened January 15, 2015; however, no bids were received for the
Sprinkler Construction and, therefore, Sprinkler Construction bids were re-solicited and opened on
January 30, 2015; and
WHEREAS, the bids reflected herein represent the base bids and the selection of alternate #2,
(where applicable) per the recommendation of the Buildings and Grounds Committee; and
WHEREAS, with regard to the Sprinkler construction bid, not accepting alternate #1 resulted in a
tie bid and per County policy, the Purchasing Agent drew lots to determine the awardee on Tuesday,
February 17th at 2:30 p.m.; and

AUTHORIZING CONTRACT WITH INTERCOUNTY APPRAISAL SERVICES, INC. –

WHEREAS, Clinton County is considering a proposal from a national company specializing in
solar energy development to place a solar array on an 11-acre parcel of land at the Plattsburgh
International Airport; and
WHEREAS, the County believes this project will result in significant savings to the Airport and
to the County in terms of lower energy costs; and
WHEREAS, Clinton County is required to follow the Federal Aviation Administration’s landrelease process which requires the services of a New York State certified appraiser to conduct a real estate
appraisal for the determination of the fair market value lease rate; and

RESOLUTION #133 - 02/25/15
AUTHORIZING CONTRACT WITH MCFARLAND-JOHNSON, INC. –
PLATTSBURGH INTERNATIONAL AIRPORT
BY:
WHEREAS, the Plattsburgh International Airport (PBG) is required by the New York State
Department of Environmental Conservation (NYSDEC) to participate in the New York State Pollutant
Discharge Elimination System (SPDES) as part of a Stormwater Pollution Prevention Plan; and
WHEREAS, as a participant in this program, PBG maintains an individual SPDES permit and
contracts with a company to perform monthly water sampling and testing in order to complete required
documents; and
WHEREAS, the contracted amount for the sampling and testing service for 2015 is $5,820, and
the annual cost to maintain the individual SPDES permit is $2,000; and
WHEREAS, McFarland-Johnson, Inc. has recommended the Airport change from the current
individual SPDES permit to a Multi-Sector General Permit (MSGP) for storm water discharge associated
with industrial activity; and
WHEREAS, under the MSGP, Airport staff will be trained to conduct the necessary monitoring
and reporting, eliminating the need to contract for monthly sampling and testing, and the annual fee will
be reduced to $100; and
WHEREAS, after review of permit requirements and costs, the Airport Manager recommends
Clinton County apply for the MSGP; and
WHEREAS, the Airport Manager also recommends Clinton County enter into a six month,
$10,006 not-to-exceed agreement with McFarland-Johnson, Inc. to provide assistance to PBG to comply
with the terms and conditions of the MSGP for PBG to include administration and coordination, training
of PBG personnel, compliance monitoring and reporting for the MSGP; now, therefore,

WHEREAS, Resolution #426 dated June 25, 2014 authorized a lease agreement with Prevost Car
(US), Inc. dba NovaBus to lease approximately 100,000 square feet of the North Apron Lot located at 30
California Street at the Plattsburgh International Airport; and
WHEREAS, Resolution #946 dated December 23, 2014 amended the lease agreement to add a
Common Area Maintenance (CAM) charge for snow removal from the North Apron Lot; and
WHEREAS, Prevost Car (US), Inc. dba NovaBus is requesting permission to rent an additional
100,000 square feet of the South Apron Lot located at 30 California Street; and
WHEREAS, the Airport Manager recommends the lease agreement be amended to add the rental
of the additional square footage of the South Apron Lot, effective March 1, 2015 (all other lease terms
and conditions remain the same); and
WHEREAS, the Airport Manager and NovaBus Manager have negotiated rates for the additional
rent and agree on $2,000 per month; now, therefore,

AUTHORIZING LEASE AGREEMENT WITH FLIGHT LINE EXPRESS –

WHEREAS, Resolution #815 dated October 10, 2007 authorized a lease agreement with Flight
Line Express to provide food service at the Plattsburgh International Airport; and
WHEREAS, Resolution #797 dated October 26, 2011 authorized Flight Line Express to extend
the contract as per the Renewal Option which expired December 31, 2013; and
WHEREAS, Resolution #380 dated May 23, 2012 amended the contract amount which expired
December 31, 2013; and
WHEREAS, Resolution #223 dated March, 26, 2014 authorized a new lease agreement for a oneyear initial term that expired December 31, 2014; and
WHEREAS, Flight Line Express has agreed to a new lease agreement on a month-to-month basis
to commence January 1, 2015 until such time as the Terminal Expansion Project is completed and a
permanent concessionaire has been selected through the Request for Proposals (RFPs) process; and
WHEREAS, Flight Line Express and the County have agreed upon a monthly rental rate of
$333.33 per month for 332 square feet of commercial space on the secured side of the Terminal Building;
and
WHEREAS, the Airport Manager recommends the Clinton County Legislature authorize a new

AUTHORIZING THE IMPLEMENTATION AND FUNDING IN THE FIRST INSTANCE
100 PERCENT OF THE FEDERAL-AID AND STATE "MARCHISELLI" PROGRAM-AID ELIGIBLE
COSTS, OF A TRANSPORTATION FEDERAL-AID PROJECT, AND APPROPRIATING FUNDS
THEREFORE - HIGHWAY DEPARTMENT
BY:
WHEREAS, a project to rehabilitate the Hardscrabble Road Bridge over Saranac River, BIN
3335740, PIN 7753.49 (the “Project”) is eligible for funding under Title 23 U.S. Code, as amended, that
calls for the apportionment of the Construction/Construction Inspection/Construction Support costs to be
borne at the ratio of 100 percent State funds; and
WHEREAS, the County of Clinton desires to advance the Project by making a commitment of
100 percent of the non-Federal share of the total Project costs as shown in Supplemental Agreement #2,
Schedule A.
NOW, THEREFORE, the Clinton County Legislature, duly convened, does hereby
RESOLVE, the Clinton County Legislature hereby approves the above-subject Project; and it is
hereby further
RESOLVED, the Clinton County Legislature hereby authorizes the Chairperson of the Clinton
County Legislature to pay in the first instance 100 percent of the Federal and non-Federal share of the
cost associated in Supplemental Agreement #2, Schedule A; and it is further
RESOLVED, the sum of $2,156,312 is hereby appropriated and made available to cover the cost
of participation in the above phase of the Project; and it is further
RESOLVED, that in the event the full Federal and non-Federal share costs of the Project exceeds
the amount appropriated above, the Clinton County Legislature shall convene as soon as possible to
appropriate said excess amount immediately upon the notification by the New York State Department of
Transportation thereof; and it is further
RESOLVED, the Chairperson of the Clinton County Legislature be and is hereby authorized to
execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or
Marchiselli Aid on behalf of the County of Clinton with the New York State Department of
Transportation in connection with the advancement or approval of the Project and providing for the
administration of the Project and the municipality's first instance funding of Project costs and permanent
funding of the local share of Federal-aid and State-aid eligible Project costs and all Project costs within
appropriations therefore that are not so eligible, and it is further

CONGRATULATING SPENCER PARSONS ON ACHIEVING THE RANK OF EAGLE SCOUT LEGISLATURE

WHEREAS, it is the sense of this Legislative Body to honor those individuals who distinguish
themselves in their service to our community; and
WHEREAS, the Boy Scouts of America and its members are dedicated to the development of
character and leadership in the youth of this Nation; and
WHEREAS, the highest achievement of leadership in Scouting, earned by only four percent of all
Boy Scouts, is the distinguished rank of Eagle Scout; and
WHEREAS, this Legislative Body is justly proud to recognize the accomplishments and
contributions made by Spencer Parsons, who earned the rank of Eagle Scout on August 19, 2014; and
WHEREAS, Spencer Parsons will be honored for this achievement at a special Eagle Scout Court
of Honor ceremony to be held Saturday, April 11, 2015; and
WHEREAS, this outstanding young man has been involved in Scouting for several years, has
lived up to Scouting’s ideals and has demonstrated the five responsibilities of an Eagle Scout: Honor,
Loyalty, Courage, Cheerfulness and Service; and
WHEREAS, Spencer has proven his leadership skills through the construction of two new
woodsheds which add to the campsite and benefit the New Land Trust in Saranac, New York; and
WHEREAS, the New Land Trust is dedicated to developing and sustaining this property for the
health of the environment and the enjoyment of the public and exists for and is supported by the
community; and
WHEREAS, Spencer Parsons should be credited for his hard work and dedication which resulted
in the receipt of this most prestigious honor; now, therefore,
BE IT RESOLVED, this Legislative Body pause in its deliberations to publicly recognize and
commend Spencer Parsons on achieving the rank of Eagle Scout; and
BE IT FURTHER RESOLVED, that a copy of this Resolution, suitably engrossed, be transmitted
