No. 085-3413826; 3425332; Telefax 085-8161214 NARRATIVE REPORT ON THE SEMINAR ON ENVIRONMENTAL LAWS: THINK COMPLIANCE FOR ALL THE MANAGING HEADS HELD AT DOTTIES PLACE HOTEL AND CONVENTION CENTER, J.C. AQUINO, BUTUAN CITY ON NOVEMBER 5-6, 2014 A. RATIONALE The Environmental Management Bureau is the primary government agency under the Department of Environment & Natural resources (DENR) charged to formulate, integrate, coordinate, supervise and implement all policies, programs, projects and activities relative to the prevention and control of pollution as well as the management and enhancement of the environment. There are at least five (5) environmental laws that require nationwide scale of implementation by EMB: a.) PD 1586: “Philippine Environmental Impact Statement (EIS) System” b.) RA 6969: “Toxic Substances & Hazardous & Nuclear Waste Management Act of 1999” c.) RA 8749: “Philippine Clean Air Act of 1999” d.) RA 9003: “Ecological Solid Waste Management Act of 2000” e.) RA 9275: “Philippine Clean Water Act of 2004” To further strengthen the implementation of the abovementioned laws, DENR Administrative Order No. 02 Series of 2014 “Revised Guidelines for Pollution Control Officer (PCO)” was promulgated pursuant to Section 8 which states: Section 8. “That the Managing Head of establishments should have at least eight (8) hours training on environmental management covering the basic environmental laws, rules and regulations and the duties and responsibilities of the PCO as provided in Section 10.0 of this Order”. Hence, EMB-13 had initiated a two-(2)-day Seminar on Environmental Laws for Management Facility Managers/CEO/Head Officers/Directors of the different establishments within Caraga Region. The two-(2)-day environmental seminar is designed to provide the Managing Head of establishments with PRACTICAL steps they can take to stay in compliance with Environmental Regulations. Benefits of attending the seminar, the Managing Head will gain a clear understanding of how these environmental regulations affect their operation and how they can comply with them in a cost-effective manner. Page 1 of 11 B. HIGHLIGHTS: The program proper was started with a welcome remark by the Regional Director of EMBCaraga Region, Engr. Wilson L. Trajico. On his welcome remarks he extended his gratitude to all the participants for responding the invitation of this office to attend the said seminar. He then relates his message on the written statement “Why do nations fail?” Institutionalization relates to the question that has stumped the experts for centuries, as he added. He ended his message with a story when he was in Singapore asking for a change he bought in one of the stores downtown in Singapore where the storeowner responded that the change will come from your heart. RD Wilson Trajico as he gave his welcome remarks to all the managing head of the different establishment within Caraga Region Undersecretary for Administrative and Information System of the DENR, Atty. Ernesto D. Adobo Jr. delivered the keynote address. On his speech he was impressed and lauded the initiative of EMB-13 for being the first region who conducted the said seminar for all the managing heads which is in pursuant to DAO 02-2014. Usec. Adobo emphasized on the role of every managing head of a certain establishment where he/she must possess the quality of a good leader. Being the manager, he/she must be an example of change as what RD Trajico emulates in his message that will also measure that the company is compliant to all environmental laws. Usec Atty. Ernesto D. Adobo Jr. delivers his keynote address and inspirational message before the participants of the two-(2)-day seminar on environmental laws “Think Compliance”. Page 2 of 11 Pre- and post-tests examinations were done by the participants in the seminar which has an objective to measure participants learning received during the two-(2)-day seminar as a result of comparing what the participants knew before the course and then after. This type of test offers a value-added perspective of measuring participant learning in a course. A value-added approach is particularly useful for developmental courses in that standards-based tests or benchmarks may not be appropriate for measuring participants in these courses. Pre-and post-tests allow lecturer to see if participants’ skills significantly improve after course learning and instruction. Participants were taking the test examination before the start of the two-(2)-day seminar. Dr. Sherlito C. Sable, Dean, College of Governance and Business of the University of Southeastern Philippines discussed his term paper with the topic title “Compliance or Conformance: Rescuing the Environment from Politics, an evidence based framework” Page 3 of 11 The second presenter is Dr. Rec Eguia, Associate Professor of the University of Southeastern Philippines who presented the topic on “The Triple Bottom Line of Sustainability and Regional Development”. Certificate of Appreciation and Token gift were given to the two professors, Dr. Sherlito Sable and Dr. Rec Eguia, from USEP. For. Reynaldo S. Digamo, Chief, EIAM Division of EMB-13 discussed the Philippine Pollution Control System and legal framework DENR Administrative Order No. 02 Series of 2014 “Revised Guidelines for Pollution Control Officers”. Page 4 of 11 Mr. Joey V. Valeroso of JVV Farms and Ms. Ma. Alma Bernardo of Loreto Municipal Hospital answered the question “What is PCO?” given by For. Reynaldo S. Digamo. An interval question was thrown to the participant after the topic presentation on DAO 02-2014 where the one who got the correct answer claimed the token prize. The topic on R.A. 9275 “Clean Water Act” and its implementing rules and regulations was discussed by Engr. Renato C. Tacubao, OIC, Chief Ambient Monitoring Section. Page 5 of 11 Meanwhile, Engr. Petronio P. Arciga discussed the salient feature of R.A. 8749 “Philippine Clean Air Act of 1999” and its implementing rules and regulations. For. Joy C. Maagad was the one who discussed the salient features of R.A. 9003 “Ecological Solid Waste Management” and its implementing rules and regulations. Page 6 of 11 While Engr. Albert G. Arcamo, OIC, Chief EME Division, briefly and concisely discussed the DENR Administrative Order No. 27 Series of 2003: “Amending DAO 26, DAO 29 and DAO 2000-81 among others on the preparation and Submission of Self-Monitoring Report (SMR)”.He also emphasized the prompt submission of the said report which was every 15 calendar days after each end of the quarter. Mr. Darnel S. Bughao of Buenavista Water District then asked clarification on the water quality analysis to be attached in Module 3 of the said SMR that if their in-house water quality monitoring result which only had the parameters mostly on bacteriological analysis and their laboratory is not yet accredited as recognized laboratory of the DENR be acknowledged in the SMR. Engr. Arcamo responded that any water quality analysis will also be attached in the said report and in the case of water district, it is being understood that most parameters were in bacteriological analysis for potable water and no discharge of wastewater. The discussion on Greenhouse Gas Emission Inventory and Management for Private/Sectoral Level was given by Mr. Carlo D. Dacera, MPM, EMED Technical Staff. He gave the basic formula on how to compute the carbon footprint and identify GHG emission sources. Page 7 of 11 Ms. Aljuvi C. Virtudazo, Llb, the Interim In-Charge, Legal Section of EMB-13, then discussed the legal framework of the Pollution Adjudication Board (PAB). A question was raised by Mr. Nilo P. Demerey of Wellex Mining Corporation on the legal basis of the PAB. Ms. Virtudazo answered that the legal basis on the creation of PAB was stipulated in Section 19 of Executive Order 192 Series of 1987. The presentation on the Green Financing Program of Development Bank of the Philippines (DBP) was given by Franklin L. Tabo, Bank Executive Officer I. He cited the core environmental projects of DBP as part of the green financing program which supports the implementation of the seven (7) major environmental laws and the Philippine Development Plan 20112016 to improved environmental quality for a healthier and cleaner environ ment as well as improved adaptive capacities of human communities. Page 8 of 11 Engr. Albert G. Arcamo then presented the topic on R.A. 6969 “Toxic Chemicals and Hazardous and Nuclear Wastes Control Act of 1990” and its implementing rules and regulations. The DENR Administrative Order No. 34 Series of 1990 “Revised Water Usage and Classification/ Water Quality Criteria amending Sections Nos. 68 and 69, Chapter III of the 1978 NPCC Rules and Regulations” and DENR Administrative Order No. 35 Series of 1990 “Standards for Effluent Dischargers” was discussed by Engr, Renato C. Tacubao. Page 9 of 11 For, Reynaldo S. Digamo, discussed the updates on Environmental Impact System (i,e. Incorporating DRR/CCA to PEISS, DAO 2014-005: the revised procedural manual and new memorandum circulars). The Gender Sensitivity and Equality was lively discussed by the GAD Focal Person of EMB, Ms. Grace H. Abella where she put emphasis that there should be an equal role between the sexes. At the end of the training course, the participants received the Certificate of Completion of which shall be used for the PCO accreditation/re-accreditation which is provided under Section 8, DENR Administrative Order No. 2014-02 and a complete set of course material written in plain English. Token of prizes were given to the top two and top three highest score participants in the pre- and post-test examinations, respectively, to wit; A. For the Pre-Test Exam 1.) Terence M. Arturo Manto – 28/30 Taganito HPAL Processing Plant [Left to Right Photo] Mr. Terence M. Francisquite of MTDC got the top 1 highest score in the pre-test exam while Mr. Arturo C. Manto and Mr. Lemuel S. Gambin, both from THPAL got also an equal highest score of 28 out of 30 question item for the post-test exam. The program was ended with a closing remark by RD Wilson L. Trajico where he extends his gratitude to the attendees for their active participation during the whole course of the seminar. Page 11 of 11
